g. The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
h. The granting of this change in the development standards for the property has been at
the request of the applicant, with the consent of the landowner. The granting of this
approval allows the property to enjoy uses in excess of those permitted by the zoning
existing on the date of application, subject to conditions. In the event of the failure to
comply with any condition, the property shall revert to the development standards that
existed on the date of application. It is, therefore, stipulated and agreed that either
revocation due to the failure to comply with any conditions, does not reduce any rights that
existed on the date of application to use, divide, sell or possess the property and that there
would be no diminution in value of the property from the value it held on the date of
application due to such revocation of the zone change. The zone change is granted and
reverting to the prior development standards results in the same value of the property as if
the zone change had never been granted. (C-44-17-108-M-00)

k. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
and at the time of expiration of the Special Use Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Special Use Permit, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted. (C-44-17-109-M-00)

Change. The Zone Change enhances the value of the property above its value as of the
date the Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted. (C-44-17-115-M-00)
Darren Gerard, Deputy Director of Planning and Development, reviewed item PZ-5
noting a number of surrounding property owners in opposition, which will require a
supermajority vote on the item. He explained the zoning from R1-35 Residential Unit
Plan of Development (RUPD) & C-3 to C-1 Commercial Unit Plan of Development
(CUPD). It is moving to a less intense zoning so the entitled uses are limited to the
proposed preschool and other types of uses acceptable to Environmental Services.
Chairman Barney asked if any of the Planning Commission recommendations are
unusual or are they all standard conditions. Mr. Gerard responded that the conditions
are standard and noted that CUPD is stipulated to limit uses because of public health
concerns with more intense use of sewers. It is looked at as an improvement to existing
zoning.
Chairman Barney asked for a map to display the current zoning. Mr. Gerard displayed a
map and stated the C-3 zoning is the original 1969 County zoning and the R1-35 has
been brought into the strip over the years.
Supervisor Hickman asked if San Tan Boulevard is a major thoroughfare. Mr. Gerard

Formal Meeting Minutes
Wednesday, June 21, 2017
stated the location is a mid-section alignment and believes it is an arterial road.
Chairman Barney stated he does not consider it a major roadway and asked if Jennifer
Toth, Director of Transportation, could speak regarding the area. Ms. Toth stated she
was unable to get to the road information tool online and is unfamiliar with the location.
Chairman Barney noted the roadway is considered a mid-section collector by virtue of
the location which is a minor transportation scope.
Kenneth Eller, Architect for Archi-CAD Architects PLLC, approached with the applicant
Jacob Gordon. Mr. Eller stated the applicant is not introducing commercial zoning to the
area as it was already established. The rezoning request lowers the intensity of the
commercial zoning. There is a portion of the parcel that is zoned residential and it does
not comply with development standards so the applicant has requested to lower the
intensity for the entire parcel. Mr. Eller noted that the site was analyzed at 100% usage
and the worst case scenario comes out to 88 trips in the morning and 92 trips in the
afternoon which falls below what the County considers a significant impact of 100 trips
per hour. He spoke regarding site access noting there are two driveways into the
property. One driveway was used to the resident location and the second driveway was
a cross access easement along the eastside of the property that provides access to the
residential parcel to the north of the property. An analysis was administered for the
cross access easement and it was determined that the easement would continue to
function with the additional site traffic. So the applicant design of the property does not
adversely affect the cross access easement.
Supervisor Gates asked if the cross access easement goes all the way to San Tan
Boulevard. Mr. Eller responded that the easement connects right at the east corner of
the property and is parallel to the eastern portion of the property.
Mr. Eller stated the vehicular circulation on the site was configured for the safety of the
children. The driveway and parking are arranged against the sidewalk to the building to
assist in that effort. Staff parking was separated from parent and public parking in an
effort to reduce any impact while using both driveways. The cross access easement
entrance will lead to the staff parking lot, will be widened, paved, clearly marked for
inbound/outbound traffic and a sign will be posted indicating that a private drive exists
beyond the staff parking lot to discourage traffic from entering. The intent was to limit
the use of the cross access easement. Mr. Eller stated additional effort has been made
to minimize the use of the cross access easement by placing a directional sign and
markings on the pavement to indicate the correct access point for parents to utilize. He
noted there will be 17 parking spaces versus the 13 required by the zoning ordinance in
an effort to eliminate any unnecessary usage of the cross access easement. He noted
a 6-foot wall will be established between the site and residential area as well as existing
mature trees, adding bushes and ground cover to provide additional buffer. He noted
the location of the retention basin and septic system at the front of the building which
will assist in ease of access for possible future city sewer conversion.
Supervisor Hickman stated the site seems to be near a current commercial location
directly to the east and it shares space with a residential property as well. Mr. Eller
confirmed that the commercial location is a mini shopping center and there is a
residential property located to the east.
Jake Gordon, applicant, responded to a residential complaint received about a possible
delay for medical and fire assistance in an emergency situation. He stated that he has
been a Firefighter Engineer for the Town of Gilbert for 11½ years and there would be a
problem for emergency vehicles to gain access to the property in an emergency
situation with how the cross access easement currently is configured. By widening and

Formal Meeting Minutes
Wednesday, June 21, 2017
paving the access road the applicants are increasing the ability for emergency vehicles
to gain access to the property. He noted there have also been conflicting traffic
complaints from residents.
Susan Patten, resident, stated she lives north of the property with her son and daughter-
in-law and they all use the shared easement. She noted that a fire truck and ambulance
have come to the home without any problem. She has only one way to enter and exit
her property through the shared easement and has used the easement for over 23
years. She noted she has many concerns but her main concern is the inability to obtain
emergency services if there are several parents entering and exiting the property. She
said there are a limited number of parking spots and understands that the spots will be
used by the employees. She stated at the Planning Commission hearing held on May
25, 2017 it was said that the parents would stop to take their children in and it would be
nearly 10 minutes for each parent. With a building capacity of 109 students she
foresees backup of traffic along her easement. The shared easement will be used for
her family to exit for work each morning and she questioned when they would need to
leave their premises to ensure they make it to work on time. She noted possible
damage to her nearly 23-year-old waterline located to the west edge of the easement
where the plans indicate a road will be built over the waterline. Which is an
unnecessary cost and inconvenience to her family. Ms. Patten said the power line runs
along the east edge of the easement so the site really has only 18 feet or less to use for
the proposed driveway. She said that only having 11 feet for each lane does not seem
to be enough room. She questioned how three lanes will be made out of the current two
lane easement and she questioned what a certain line in the map is for on her
easement as it looks to be a fence.
Mr. Gerard responded that the line is not an obstruction. It is a measurement indicating
where the 20 feet easement and existing private drive is located. There is a wall on the
west side of the easement in question.
Ms. Patton stated that on May 16, 2017 a vehicle was parked in a manner that did not
allow her to enter her residence. She noted the problems she has had with the owners
of the property and stated several adverse effects the proposed use will have to the
community.
Kristopher Patten, resident, spoke regarding the petition the neighbors signed due to the
negative impacts the site will bring to their community. He said that in conversations
with neighbors, (most have been living in the area for 20 or more years) many indicated
that they would like to keep the neighborhood exactly as it is today. He stated several
great things about the neighborhood that may be impacted by the proposed site
development. Mr. Patten noted the difficulties his family and the neighbors directly
south of the development encounter in the mornings while trying to exit their properties.
He spoke of the following concerns: possible elevated levels of nitrates within the water;
the 250-feet setback which pushes it closer to his residential property; additional
commercial properties in the area requesting the same setbacks in the future; current
state of undeveloped and vacant commercial property in the area that house vagrants –
this may happen to the proposed development if it is not successful; if the property is
later sold the undesirable commercial possibilities that could develop.
Chairman Barney asked if the item should be continued to a later date to allow for
additional work on the item. He stated he is in support of the application but noted
additional work that needs to be done. He asked if the County has regulatory authority
over the level of nitrates in the water.

Formal Meeting Minutes
Wednesday, June 21, 2017
Steven Good, Director of Environmental Services, stated that the County does have
regulatory authority over the level of nitrates in the water as long as it is not a private
well.
Chairman Barney asked if the property has a commercial well or a commercial water
system. Mr. Gerard responded that Chandler Heights Citrus Irrigation District is the
public provider. Mr. Good responded that the property’s water is regulated by the
County.
Chairman Barney stated it is his understanding that C-3 zoning has been in place since
1969. Mr. Gerard confirmed that the current zoning of the property dates to May 1969
when the ordinance was originally enacted.
Chairman Barney stated that the commercial zoning is not new and questioned the
issue of the 250-foot commercial buffer. Mr. Gerard responded that during the technical
review period staff promoted the idea of zoning the entire parcel the same and
lessening the intensity of the zoning in order to have the open space and retention to be
included in the same project. If the proposed rezone is denied, the applicant will go into
a redesign phase with a less optimal design that could be administratively approved
through the existing C-3 zoning.
Chairman Barney stated that the portion of the property that is already R1-35 being
rezoned as part of the CUPD is a portion that is going to be for the playground and the
applicant could use the property as it stands right now with C-3 zoning. It just creates
restraints on design. Mr. Gerard concurred with Chairman Barney’s statement.
Chairman Barney stated that the easement is for the residential property owner benefit
so the easement cannot be blocked at any time. He said it is a property rights issue and
the property can be used as it is currently zoned. Although he supports the rezoning of
the property to C-1, the residents have a right to the easement. The entrance needs to
be harmonized and the Board should see a striping plan to see what it is going to look
like to control traffic on site. He felt the Board was not given a lot of clarity other than a
sign.
Mr. Gordon stated a striping plan was submitted. Mr. Gerard stated there is a traffic
plan within the presentation. Chairman Barney indicated he would like to see the
striping plan to show what is being done to protect the easement for the benefit of those
that have the beneficial interest in the easement.
Mr. Eller corrected Mr. Gordon’s statement noting that a plan was not resubmitted
showing the striping plan, but they are on record stipulating that as part of the
stipulations for development they will incorporate the striping into the plan. The striping
plan was something he thought would be part of the final design.
Chairman Barney noted his intent to support the application but additional work needs to
be done to refine what the circulation plan is going to be. There needs to be a plan that
will allow those with a beneficial interest in the easement to enter and exit their property
unimpeded. He noted the rezone is a good conversion of property within an existing
property right. He would like a plan devised that Planning and Development Staff
support to manage the interaction of the rights of both.

1. Development and engineering design shall be in conformance with the Maricopa County
Stormwater Quality Management and Discharge Control Regulation. It is required, the
owner/developer to prepare a SWPPP and obtain approval by MCESD prior to construction
permit issuance. (A separate submittal to MCESD would be required.) It is required, upon
completion of construction, the owner to fulfill MCESD requirements and obtain a post-
construction stormwater permit. A Commercial Unit Plan of Development (CUPD) shall be
applied to this site. The CUPD shall vary development standards with regard to parking
standards for the indoor storage facilities. Development of the site shall otherwise adhere
to the development standards of the base zoning district.
2. If applicable, the site plan shall contain a note designating the entity responsible for
operation and maintenance of the on-lot stormwater management facilities consistent with
an approved operation and maintenance plan.
e. Until such time as the site is served by sewer or effective annexation by the City of
Mesa, uses on the site shall only be those acceptable to the Maricopa County
Environmental Services Department (MCESD) that can be accommodated by septic
systems. All other base zoning standards for C-3 zoning district shall remain.
f. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and
ARS § 11-814 for five (5) years for the initial phase and an additional five (5) years for each
subsequent phase, as applicable, within which time the initial construction permit or
construction permit for each phase as applicable must be obtained. The applicant shall
submit a written report every five years from the date of Board of Supervisors approval of

Z2016086 which details the status of this project, including progress on obtaining
construction permits. The status report to be administratively reviewed by Planning and
Development with the ability to administratively accept or to carry the status report to the
Board of Supervisors Board upon recommendation by the Planning and Zoning
Commission for consideration of amendments or revocation of zoning for the parcel.
g. Noncompliance with any Maricopa County Regulation or condition of approval shall be
grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County
Zoning Ordinance. The property owner/s and their successors waive claim for diminution in
value if the County takes action to rescind approval due to noncompliance with conditions.
h. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property owner to enjoy uses in excess of those permitted by the zoning existing on the
date of application, subject to conditions. In the event of the failure to comply with any
condition, a hearing shall be scheduled with the Board of Supervisors for consideration to
revert the zoning that existed on the date of application. It is, therefore, stipulated and
agreed that either revocation due to the failure to comply with any conditions, does not
reduce any rights that existed on the date of application to use, divide, sell or possess the
property and that there would be no diminution in value of the property from the value it
held on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the Zone
Change is granted and reverting to the prior zoning results in the same value of the
property as if the Zone Change had never been granted. (C-44-17-110-M-00)
Darren Gerard, Deputy Director of Planning and Development, reviewed item PZ-6 and
noted a request from the applicant to add the following condition:

The added security measure is supported by the neighbors.

9. REPLACEMENT OF FLEET VEHICLES AND EXEMPTION FROM MARKINGS
Pursuant to A.R.S. § 38-538-03 and §28-2511(A), approve the issuance of non-
governmental license plates and exemptions from county markings for four (4) undercover
vehicles. These vehicles are replacing four (4) vehicles that are used for law enforcement
investigative purposes. Vehicle details and identification numbers will be kept on file with
the Clerk of the Board in accordance with LAPR retention guidelines.
Two (2) vehicles were purchased in accordance with Maricopa County’s vehicle
replacement process. The replacement was acquired using General Government (Agency
470) General fund (100) monies through the Equipment Services department.
Two (2) vehicles were purchased by the County Attorney’s Office using RICO Funds (213)
for a total cost not to exceed $60,000.
These replacements were deemed critical by equipment services due to excessive mileage
and/or the age of the vehicle which made it cost prohibitive to acquire replacement parts
with which to maintain the vehicle. As this action involves the replacement of existing
vehicles in the fleet, expenditures for the operation and maintenance of the vehicles will
continue to be absorbed by the County Attorney's general fund budget with zero net
impact.
As the vehicles being replaced are currently exempt from markings and governmental
license plates, the Maricopa County Attorney's Office requests that the replacement
vehicles purchased also be exempt from County markings and issued regular Arizona
license plates as provided in accordance with A.R.S. § 38-538.03 and A.R.S. § 28-2511(A).
This will ensure that they can be used in furtherance of their law enforcement mission. (C-

Approve an amendment to the network participation agreement between the Maricopa
County Correctional Health Services (CHS) Department and Health
Current authorizing participation in the Statewide HIE Integration Plan’s subsidy program

grant, which provides approximately $9 million annually for services for people living with
HIV in Maricopa and Pinal County. The Board of Supervisors appoints a Planning Council
to set priorities and determine resource allocations for services to be funded with these
grant funds. The Planning Council must establish Bylaws to govern their activities. The
Bylaws were last updated in 2014 with minor revisions. The proposed revisions reflect the
current requirements established by HRSA. The Bylaws were reviewed and revised by the
Planning Council’s Rules Subcommittee, with legal counsel provided by the Maricopa
County Attorney’s Office. The Ryan White Part A Program Manager provided
administrative support to the Rules Committee during this process and staff recommends
approval of the revised Bylaws. Changes to the Bylaws are identified in the attached “Track
Changes” document and are explained in detail in the revised "Change Document."
Approve amendments to the Bylaws of the Phoenix Eligible Metropolitan Area Ryan White
Part A Planning Council (Planning Council). These amendments are made to reflect the
current guidelines and requirements established by the funding agency, the Health
Services Resources and Administration. (C-39-17-021-7-00)

22. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR
STATEWIDE COMPREHENSIVE NEEDS ASSESSMENT
Approve Amendment No. 03 to a(n) Intergovernmental Agreement between Arizona
Department of Health Services and Maricopa County through the Employee Benefits in the
not-to-exceed amount of $177,600. This amendment is funded by a grant from Arizona
Department of Health Services, ADHS14-059037-04. The purpose of this amendment is to
increase funding to complete a needs assessment. This amendment is effective from
November 1, 2016 to October 31, 2018. All other terms and conditions of the
Intergovernmental Agreement remain in full force and effect.
This Agreement does not allow reimbursement for county indirect costs. The Maricopa
County Department of Finance has calculated the Department of Employee Benefits and
Health FY16-17 indirect cost rate at 21.8%. Therefore, the estimated unrecoverable
indirect costs are $38,716.80. Acceptance of the funds without indirect reimbursement is
appropriate because the funds will offset a portion of the direct costs for the Statewide
Needs Assessment, which the County is obligated to conduct by the terms of the existing
Ryan White Part A Grant. Without the funding provided under this Agreement, the full costs
of the Needs Assessment would have to be supported by existing grant funds.
Grant revenues are not local revenues for the purpose of constitutional expenditure
limitation, and therefore, expenditure of the funds in not prohibited by the budget laws. This
budget adjustment does not alter the budget constraining the expenditure of local revenues
duly adopted by the Board pursuant to A.R.S §42-17105. (C-39-14-020-3-03)
Clerk’s Note: In addition, the State ADHS indicates their contract number is being
changed from ADHS 14-059037 to ADHS 18-172575 and designating this as

38. MOU BETWEEN MARICOPA COUNTY BOARD OF SUPERVISORS AND MARICOPA
COUNTY WORKFORCE DEVELOPMENT BOARD AND ITS WORKFORCE
INNOVATION & OPPORTUNITY ACT PARTNERS
Approve a Memorandum of Understanding (MOU) between the Maricopa County Board of
Supervisors (“Board”); the Maricopa County Local Workforce Development Board (Local
WDB), and its Workforce Innovation & Opportunity Act Partners (or “Partners” as defined
herein and as are listed more specifically in Attachment A hereto) (collectively referred to
as the “Parties,” and individually as “Party”).
This MOU is developed to confirm the understanding of the Parties regarding the operation
and management of the One Stop Centers in the Maricopa County Local Workforce
Development Area (Local WDA). The Maricopa County Local WDB provides local oversight
of workforce programming for the Maricopa County Local WDA.
The purpose of this MOU is to define the parameters within which education, workforce,
economic development, and other Partner programs and entities operating in the Maricopa
County Local WDA create a seamless, customer-focused Maricopa County One Stop
Center network that aligns service delivery across the board and enhances access to
program services. By realizing one-stop opportunities together, Partners are able to build
community-benefiting bridges, rather than silos of programmatic isolation. These
partnerships will reduce administrative burden and costs and increase customer access
and performance outcomes.
The term of this MOU is July 1, 2017 through June 30, 2020, unless terminated earlier as
described herein. This MOU will become effective upon execution of the parties. This MOU
will be reviewed once every three-years to ensure appropriate funding and delivery
services.
The Workforce Innovation and Opportunity Act (WIOA) sec. 121(c)(1) requires the Local
Board, with the agreement of the Chief Elected Official (CEO), to develop and enter into a
Memorandum of Understanding (MOU) between the Local Board and the One-Stop
Partners, consistent with WIOA Sec. 121(c)(2), concerning the operation of the one-stop
delivery system in a local area. This requirement is further described in the Workforce
Innovation and Opportunity Act; Joint Rule for Unified and Combined State Plans,

49. PUBLIC HEALTH FY2016-17 GRANT BUDGET APPROPRIATION ADJUSTMENTS
Approve increases in the appropriated budget for Public Health (D860) Public Health Grant
Fund (532) Operating (1000) in the amount of $4,682,554 in revenues and $4,682,554 in
expenditures as identified on the Fiscal Year 2016-2017 Grant Summary Worksheet to be
on file in the Office of the Clerk of the Board and retained in accordance with ASLAPR
approved retention schedule. This appropriation adjustment brings MCDPH’s grant budget
to the amount of $47,567,049. The appropriation adjustment is necessary because the
carry forward amounts of prior year grants and award amounts of new grants differ from
the amount approved in the FY 2016-2017 Budget Appropriation. This action is in accord
with the action plan developed by the Office of Management and Budget and MCDPH to
ensure compliance with the Board approved Budgeting for Results Accountability Policy.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditures of these revenues are not prohibited by the budget
law. The approval of this budget adjustment does not alter the budget constraining the
expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105.
The indirect cost rate is 15.1%, as calculated by the Department of Finance. Most of the
grants for FY 2016-2017 allow for indirect cost recovery, as reflected in the funding
agreements. The status of the indirect costs for each grant is noted on the Grant Summary
Worksheet to be on file in the Office of the Clerk of the Board in accordance with LAPR
retention guidelines. (C-86-17-074-2-00)

51. IGA BETWEEN THE STATE OF ARIZONA AND MARICOPA COUNTY PHX-#5959315
Approve an Intergovernmental Agreement between the Arizona Attorney General, the
Arizona Department of Administration, and the Arizona Superior Court of Arizona in
Maricopa County (“Court”) on the one hand (together the “State”), and Maricopa County on
the other, for the administration of a workers’ compensation program with respect to
employees of the Court.
The purpose of this Intergovernmental Agreement is to provide that, with respect to Court
employees, the County instead of the State shall be responsible for (i) obtaining and
administering workers’ compensation coverage, including, but not limited to, case
management and payment of claims; (ii) representation in all workers’ compensation
actions; and (iii) all legal advice and representation relating to workers’ compensation
issues. This Intergovernmental Agreement is effective upon final signature, with a term of
ten (10) years, beginning July 2, 2016 and ending July 1, 2026, unless terminated sooner,
with option to renew through written consent. This Intergovernmental Agreement continues
Maricopa County’s responsibility for the above referenced responsibilities, which were
previously provided under a February 3, 1992 Intergovernmental Agreement and its
subsequent amendments.
Maricopa County is required by various statutes set forth in Arizona Revised Statutes Title
12, Chapters 1 and 2, to pay certain salaries of Court employees and to provide places for
Court to hold court; and, as such, the Maricopa County Board of Supervisors approves
compensation of Court employees except as otherwise provided by law, establishes the
location of Court facilities and provides and maintains them, approves the annual budget of
the Court, pays Court employees through the County’s payroll system and provides health
and insurance benefits to Court employees on a consistent basis with employees of
Maricopa County. Because of this and the County’s close working relationship with the
Court, the parties wish to have the County continue to be responsible for administering a
workers’ compensation program for the Court. The parties have had an Intergovernmental
Agreement to provide said services in effect since February 3, 1992. This
Intergovernmental Agreement guarantees no lapse in the administration of claims or
provision of services for employees of the Court. The parties agree that this
Intergovernmental Agreement will be a cost effective measure for both parties. (C-75-17-

Under A.R.S. Section 28-6353(E)(2), the Board is required to submit written
recommendations concerning the Major Amendment to the MAG Transportation Policy

Supervisor Hickman stated that the plan is something where a number of committees or
groups work together on an issue. In this case he is on the Transportation Policy
Committee (TPC) and Chairman Barney is on the Maricopa Association of Governments
(MAG). Both groups worked on this Transportation Plan. It is an example of the Board
working together in different capacities to try to improve the county.
Chairman Barney thanked Supervisor Hickman for his comments and for serving on the
TPC.

53. CONSENT TO EXHIBIT E OF AN AGREEMENT WITH AGUA FRIA HIGH SCHOOL #5
FOR CHANGE IN TIMING FOR ROADWAY IMPROVEMENTS
Consent to Exhibit E of an agreement between the Maricopa County Municipal Water
District Number One (MWD) and the Agua Fria Union High School District No. 216 (AFHS)
regarding the timing of certain roadway improvements. As outlined in the Exhibit to the
agreement, the timing for certain roadway construction required of both MWD and AFHS
will be changed. Portions of “dead-end” roadways will not be constructed until such time as
development occurs adjacent to the roadways. (The roadways will be logically terminated
at school driveways.) A critical intersection providing access to the school will be
constructed to its partial ultimate configuration now, rather than wait for when adjacent
development takes place.
Exhibit E to this agreement details a change in timing for when required roadway
construction occurs. The County is not a party to the agreement and is formally consenting
only to the change in timing for construction of certain roadway improvements.
In the event roadways are not installed per the timing in Exhibit E, all roadway construction
obligations will be required as per previous Board of Supervisors approval. (C-64-17-131-

The Clerk announced that the contract is now available and the map which is Exhibit E
has been updated. Maricopa County is only consenting to the change in timing for this
project and the consent form is now available.

A-10. APPROPRIATED BUDGET ADJUSTMENT FOR FY 2017 VOTER REGISTRATION
MAINTENANCE PAYMENT
Pursuant to A.R.S. §42-17106(B), approve the transfer of operating expenditure authority
between Elections Department (D210) General Fund (100) and Non Departmental (D470)

a) Approve a decrease in the expenditure authority in FY 2017 Elections Department
(D210) General Fund (100) Operating (OPER) in the amount of $370,828.
b) Approve an increase in the expenditure authority in FY 2017 Non Departmental (D470)
General Fund (100) Operating (OPER) in the line “Other Programs: Voter Registration”
(4712) in the amount of $370,828.
These adjustments will result in a countywide net impact of zero.
This adjustment will provide funding for payment of the invoice from the Secretary of
State’s Office dated March 24, 2017 for the annual maintenance of the statewide voter
registration system. (C-49-17-052-2-00)
Motion to approve by Supervisor Gates, seconded by Supervisor Hickman
Supervisor Gallardo stated he is not too sure of the resources available in regards to
Help America Vote Act (HAVA) funds. He was on the HAVA Committee when it was
first passed by Congress and the State would receive a lump sum. It is his
understanding that there are funds available. He is hearing conflicting numbers in terms
of what funds are available but as the County moves forward the HAVA funds should be
used first.
Keely Varvel, Chief Deputy of Maricopa County Recorder’s Office, noted the best
number the Recorder’s Office have is from Joint Legislative Budget Committee (JLBC).
They reported there is about $3 million in the fund, but she is not sure what JLBC must
pay out of that fund.
Supervisor Gallardo stated that HAVA funds should be used first for a state-wide voter
database.
Supervisor Hickman stated the HAVA funds is a State fund and said he has a meeting
with the Secretary of State set up where he will ask about HAVA funds.
Chairman Barney noted there has been discussion regarding the issue. The item today
is the County paying for services that have already been rendered. He said a letter was
received from the Secretary of State regarding the new system and he read a portion
that stated, “we will reexamine the cost allocations between the State and the counties.”
Once the State accepts a request for proposals (RFP) and an action plan is in place the
letter states the counties will then enter into an intergovernmental agreement with the
State. This item is from an agreement from 2012. This will be the County’s final
payment under that agreement.
