Change. The Zone Change enhances the value of the property above its value as of the

of the property as if the Zone Change had never been granted.
This item was continued from the June 21, 2017 meeting. (C-44-17-115-M-00)
Kenneth Eller, Architect, stated changes requested by the Board have been made. Mr.
Eller stated the easement is not exclusive and both parties have access to the

in the area and getting washed away.
Chairman Barney questioned staff on the proposed traffic circulation and striping plan.

public will use the south side parking lot.
Chairman Barney asked what actions are in place to monitor the parking lots to ensure
that only staff is using the designated parking lot.
Mr. Gerard stated they have the ability to enforce the zoning but the parking will need to
be monitored according to the business plan. He stated if the parking is noncompliant
than a complaint can be made.
Chairman Barney stated the Board had a chance in June to hear about the item and
made sure his expectations were very clear. He stated the striping plan was a
requirement before approval.
Kristina Gordon, applicant, stated she put in a memo into the parent packets about the
parking regulations for the parents. She stated they have done everything they can to
address the Patton’s concerns.
Chairman Barney thanked Ms. Gordon for addressing the concerns.

Case #: Z2016082
Supervisor District: 1
Applicant/Owner: Welker Development Resources, LLC / Eastbourne Riggs & Recker, LLC
Request: Special Use Permit (SUP) for RV Storage Facility in the R-4 zoning district. Staff
has calculated the support and opposition received, and notes that a Super Majority Vote
has been triggered.
Site Location: Generally located at the southeast corner of Riggs Road and Recker Road in
the Queen Creek/Gilbert area
Commission Recommendation: On 6/8/17, the Commission voted 6-0 to recommend
approval of Z2016082 subject to conditions ‘a’ – ‘i’:
a. Development of the site shall comply with the Site Plan entitled “Riggs Road and Recker
Road,” dated March 6, 2017 and stamped received March 10, 2017 except as modified by
the following conditions.
b. Development of the site shall be in conformance with the Narrative Report entitled
“Riggs & Recker RV Storage”, consisting of 13 pages, dated March 6, 2017, and stamped
received March 10, 2017, except as modified by the following conditions.
c. This Special Use Permit shall expire 30 years from the date of approval by the Board of
Supervisors for a period of 90 or more consecutive days, or upon termination of the use,
whichever occurs first. All of the site improvements shall be removed within 60 days of
such termination or expiration.
d. The following Planning Engineering comments shall apply:
1. When applying for a building permit, the parking lot retention must be limited to a
maximum of 25 percent of the parking lot area per Maricopa County Drainage Policies and
Standards (DPS) Standard 6.10.7. This may require increasing the underground storage
volume.
2. When applying for a building permit, calculations must be provided showing that the
proposed wall openings have sufficient capacity to pass the peak 100-year discharge from
the site (emergency overflow), allowing for 50 percent clogging. This may require an
increase in the number and/or size of wall openings.
e. The following Maricopa County Environmental Services Department (MCESD) condition
shall apply:
1. Stormwater – Development and engineering design shall be in conformance with the
Maricopa County Stormwater Quality Management and Discharge Control Regulation. It is
required, the owner/developer to prepare a Stormwater Pollution Prevention Plan and
obtain approval by MCESD prior to construction permit issuance. (A separate submittal to
MCESD would be required.) It is required, upon completion of construction, the owner to
fulfill MCESD requirements and obtain a post-construction stormwater permit. If applicable,
the site plan shall contain a note designating the entity responsible for operation and
maintenance of the on-lot stormwater management facilities consistent with an approved
operation and maintenance plan.
f. At the time of building permits the applicant shall submit a shared access agreement
between the two property owners.
g. Major changes to the Special Use Permit shall be processed as a revised application,

with approval by the Board of Supervisors upon recommendation of the Planning and
Zoning Commission. Minor changes may be administratively approved by the Planning and
Development Department. Major changes to the Special Use Permit may require a new
Citizen Participation Process as determined by the Planning and Development
Department.
h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
i. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
and at the time of expiration of the Special Use Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Special Use Permit, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted. (C-44-17-116-M-00)
Chairman Barney noted his appreciation to staff for the work done on the item. He noted his
concern of the property becoming a construction storage yard.
Darren Gerard, Planning and Development Deputy Director, noted the zoning ordinance has
a specific category for use of commercial storage. He noted the main concern was the yard
becoming a contractor storage yard, which is an industrial use. Mr. Gerard stated if the yard
is used for contractor’s equipment a zoning violation may be enforced.
Chairman Barney stated that if it does get used for industrial use it would have to be
rezoned.
Motion to concur with Planning Commission recommendations for approval by Supervisor
Barney, seconded by Supervisor Gallardo
Ayes: Barney, Chucri, Gates, Gallardo
Absent: Hickman
Acting Chairman Chucri thanked Chairman Barney, Mr. Gerard and his staff for all their hard
work on the item.

47. IGA WITH THE STATE OF ARIZONA – ARIZONA DEPARTMENT OF
ADMINISTRATION FOR PAYMENT FOR SUPERIOR COURT JUDGES’ BENEFITS
Approve an Intergovernmental Agreement (IGA) between the State of Arizona - Arizona
Department of Administration (ADOA) and Maricopa County through the Department of
Employee Benefits and Health. The purpose of this IGA is to provide that judges of the
Superior Court in Maricopa County may participate in State benefits in lieu of County
benefits, with County reimbursement to the State for the employer cost of the State
benefits, and to delineate the options available to the judges and the obligations of the
ADOA and County with respect to the judges’ benefits. This IGA is effective from July 1,
2015 through June 30, 2025.
A.R.S. §12-128 was amended, effective FY 2011, to provide that in counties with a
population exceeding two million persons, the County shall pay 100% of the judges’ annual
salaries. Previously, the counties and the State each paid 50% of the salaries of judges of
the Superior Court. The purpose of this agreement is to facilitate access to State benefits
by judges of the Superior Court in Maricopa County, allowing them to participate in either
the State’s or the County’s benefit programs, but not both; and to provide for payment by
the County to the State for the employer cost of State benefits with respect to judges that
elect State benefits. Under this IGA, the Maricopa County Department of Employee
Benefits and Health will implement through the County payroll system withholding and
transfer on any amounts required for Judges to participate in State benefits, including any
employer paid premiums. This IGA has been numbered Attorney General Contract No.
KR17-0033. (C-39-18-001-2-00)
Chairman Barney noted Maricopa County is the only County out of fifteen counties that
pays 100% of Superior Court Judges’ salaries and it is a $10 million dollar additional
cost to the County. He stated it was first implemented to be a temporary fix during the
State’s difficult budgetary times. He hopes at some point the issue can be reversed
back to the State’s responsibility.

101. COMPETITION IMPRACTICABLE PROCUREMENT WITH WSP USA FOR
CONSTRUCTION MANAGEMENT FOR INTERSECTION IMPROVEMENTS
Approve an increase in Competition Impracticable Procurement in accordance with
Maricopa County Procurement Code, Section MC1-351, in the amount of $59,554.31 with
WSP USA (formerly Parsons Brinckerhoff) to complete Construction Administration
services for intersection improvements: UNION HILLS DRIVE AND 99TH AVENUE.
Due to extra construction work and extended time to move the subject project toward
completion, WSP's on-call assignment for Construction Management and Inspection was
also subject to extensions and additional costs. WSP recently submitted a fee proposal for
what is required to bring their role in the project to completion. Although this is to be issued
under WSP’s current on-call contract, it is considered a continuation of the original
assignment which is capped at $500,000.00. Previously, in January 2017, the Chief
Procurement Officer approved additional funding for the work assignment, but a wrong
figure was used at the time. The funds required to close out the work assignment now

116. REVISIONS TO ARIZONA’S STATE IMPLEMENTATION PLAN (SIP)
Pursuant to A.R.S. §49-479(b), set a public hearing for September 6, 2017 to solicit
comments and consider the adoption of the submittal to the U.S. Environmental Protection
Agency (EPA) of revisions to the Maricopa County portion of the Arizona SIP. To bring the
SIP up-to-date with current Maricopa County Air Pollution Control Regulations, the
Maricopa County Air Quality Department (MCAQD) is proposing the rescission (removal)
from the Arizona SIP, the following SIP approved rules: 22, 27, 28, 32 Paragraphs A-H and
J-K, 34, 35, 41 Paragraphs A and B, 42, 74, and 81. At the same time, the MCAQD is
proposing for inclusion into the Arizona SIP, the following previously adopted rules: 100,
210, 220, 230, 245, 313, 322, 323, 330, 331, 333, 335, 336 and Appendix A. No revisions
were made to the regulations in this request to the EPA to update the Arizona SIP. The
MCAQD is only proposing rescission (removal) and inclusion of rules to revise the Arizona
SIP. Following the public hearing, the Board is requested to approve the submittal to the
EPA to revise the Arizona SIP. Upon Board approval, this item will become effective
September 6, 2017.
Congress established the basic structure of the Clean Air Act (CAA) in 1970. The CAA
requires the EPA to establish national ambient air quality standards (NAAQS) for common
and widespread pollutants based on the most current science available. For areas that
were determined to be in nonattainment of the NAAQS, the state was required to adopt
federally enforceable SIPs in order to achieve and maintain air quality and meet the
federally established air quality standards. In order to comply with the CAA, the MCAQD
submitted rules under the jurisdiction of the MCAQD to the Arizona Department of
Environmental Quality (ADEQ), the designated EPA contact, for inclusion in the original
SIP submittal made to the EPA on January 28, 1972. Through the years, the MCAQD has
revised the rules submitted in the original SIP and has submitted such revised rules for
inclusion in the SIP. The rules in this request have been previously adopted by the Board
of Supervisors. Permit fees are not changing due to this action. No emission limitations,
work practices and recordkeeping or reporting requirements are changing due to this
action. (C-85-18-001-M-00)

The Mandan Street Drainage Improvements will provide a flood mitigation solution for the
100-year storm event to 17 homes along South Mandan Street between East Sacaton Street
and East Mandan Street, in which many of the homes have been flooded several times. An
application for state and federal grant funding has been made for this project. Such funding
would reduce the use of District and City tax dollars for the project. The District and the City
of Phoenix believe that this project has significant merit to move forward in the District’s
FY18 Capital Improvement Program. This Agenda Item impacts Supervisorial District 1 and
5. (C-69-18-005-6-00)
