Supervisor District: 4
Applicant/Owner: LVA Urban Design Studio / Sun Cities RV Compound, Inc.
Request: Major Amendment to a Special Use Permit (SUP) to expand a 97.2 acre RV
storage compound to 106.5 acres
Site Location: Generally located approximately 2,300’ south of the southeast corner of Bell
Road and 115th Avenue in the Sun City area
Commission Recommendation: On 9/7/17, the Commission voted 6-0 to recommend
approval of Z2017035 subject to conditions ‘a’ – ‘f’:
a. Development of the site shall comply with the exhibit entitled “Compound Expansion Site
Plan”, consisting of 1 full-size sheet, dated May 24, 2017, and stamped received May 31,
2017 except as modified by the following conditions.
b. Development of the site shall be in conformance with the Narrative Report entitled “Sun
Cities R.V. Storage Compound Expansion”, consisting of 13 pages, dated May 31, 2017,
and stamped received May 31, 2017, except as modified by the following conditions.
c. The following conditions from the Engineering division shall apply:
1. The assessor map shows the subject premises as two parcels. At the time of submittal
for a building permit, the plan must match the assessor’s information; if a split/conveyance
has occurred, new APN number(s) and documentation showing the new property
configuration must be provided with the submittal.
2. The plans appear to show work in the Flood Control District of Maricopa County (FCD)
Lands. This requires procurement of a ROW Permit directly from the FCD. This permit
must be procured before Planning and Development (P&D) can issue any building permits
for grading of the site.
3. At the time of submittal for a building permit, the plans must indicate regulatory
floodplain limits. There is a small area of AE floodplain that extends into the channel
southwest of the proposed basin. There appears to be disturbance in this floodplain, which
will require a floodplain use permit (issued by P&D concurrent with the building permit).
d. Noncompliance with any Maricopa County Regulation or condition of approval shall be
grounds for initiating a revocation of this Major Amendment as set forth in the Maricopa
County Zoning Ordinance. The property owner/s and their successors waive claim for
diminution in value if the County takes action to rescind approval due to noncompliance
with conditions.
e. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property owner to enjoy uses in excess of those permitted by the zoning existing on the
date of application, subject to conditions. In the event of the failure to comply with any
condition, a hearing shall be scheduled with the Board of Supervisors for consideration to
revert the zoning that existed on the date of application. It is, therefore, stipulated and
agreed that either revocation due to the failure to comply with any conditions, does not
reduce any rights that existed on the date of application to use, divide, sell or possess the
property and that there would be no diminution in value of the property from the value it
held on the date of application due to such revocation of the Amendment. The Amendment
enhances the value of the property above its value as of the date the Amendment. Change
is granted and reverting to the prior zoning results in the same value of the property as if
the Amendment had never been granted.

e. The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
f. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowners. The granting of this approval allows the
property owners to enjoy uses in excess of those permitted by the zoning existing on the
date of application, subject to conditions. In the event of the failure to comply with any
condition, a hearing shall be scheduled with the Board of Supervisors for consideration to
revert to the zoning that existed on the date of application. It is, therefore, stipulated and
agreed that either revocation due to the failure to comply with any conditions, does not
reduce any rights that existed on the date of application to use, divide, sell or possess the
property and that there would be no diminution in value of the property from the value it
held on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the Zone
Change is granted and reverting to the prior zoning results in the same value of the
property as if the Zone Change had never been granted. (C-44-18-023-M-00)

i. The granting of this change in use of the property has been at the request of the

application, subject to conditions. In the event of the failure to comply with any condition,
and at the time of expiration of the Special Use Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Special Use Permit, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had

Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. A
budget adjustment is not required. (C-85-16-012-G-01)
Dianne Barker, resident, noted the relation between Air Quality and Transportation. She
stated her concern on item 18 as it is a 12 year program that is over half a million dollars
to assist in reducing pollutants and particulates. These are funds from vehicles on
paved or unpaved roads releasing toxins into the air. She requested that the money be
watched and the program sampling be reviewed. She noted the pollution caused by
traffic backup in downtown Phoenix and stated there is a need for a better planned
transportation system.

Approve the issuance of replacement warrants for county warrants related to the Check
Enforcement Program that have been outstanding for more than one year. Necessary

offenders accountable. This service is offered free of charge to individuals and merchants
who have gone unpaid due to insufficient funds. When restitution has been received, the
MCAO Check Enforcement Program issues a warrant to the victim. Unfortunately in some
cases, warrants are returned to MCAO or remain uncashed because of an address
change, an incorrect address on file or changes in merchant ownership. To date, the
MCAO Investigations Division has located current contact information for 55 victims who
were issued warrants prior to June 2015 that have not been negotiated. MCAO requests
the issuance of replacement warrants to these victims in the total amount of $40,813.05.

John Rusinek, resident, submitted handouts with information regarding the dust control
ordinance. He said he has been coming downtown for 5-6 years on dust control
problems but no one has spoken to him. He asked the Board to read the handouts and
reply to him. The property in question is 6,000 feet of barren land. He said there is a
school behind the property where kids are also being effected. Something should be
done with the property to make sure the cars are parked on a dustproof lot.
Dianne Barker, resident, stated she is happy to hear the goals of the County regarding
Domestic Violence and stated the month of October is also Breast Cancer Awareness
which she also supports. She stated that Maricopa Association of Governments has a
chart that links up different community non-profits that aide in the goal to cut down on
domestic violence. She said cancer is found in people who are overweight. She named
several public funds she is watching on issues that concern her such as County
employees improving their health through exercise as she has overcome most of her
health problems because she exercises regularly.

he was denied the right to vote in his own precinct as a public and private person. He

U.S. Representative Congressional District 9. He stated he filed a verbal complaint with
the County Recorder’s Office the next day after the election and submitted a copy of a
letter he received from Michael Schiller, Chief of Staff for Recorder’s Office, responding
