a. Development of the site shall comply with the Site Plan entitled “Rural Metro

County Department of Transportation (MCDOT) for landscaping or other
improvements in the right-of-way.
e. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.
f. Development of the site shall be in compliance with all applicable Maricopa
County Air Quality rules and regulations.
g. The following Drainage Review conditions shall apply:
1. Obtain a drainage waiver to permit no onsite retention, in-lieu of the
regulatory requirement of 100-year 2-hour storm volume.
2. All development and engineering design shall be in conformance with the
Drainage Regulation and current engineering policies, standards and best
practices at the time of application for construction.
3. Drainage review of planning and/or zoning cases is for conceptual design
only and does not represent final design approval nor shall it entitle
applicants to future designs that are not in conformance with the Drainage
Regulations and design policies and standards.
h. This Special Use Permit shall expire on March 7, 2028, or upon the expiration of the
lease to the applicant, or upon termination of the use, whichever occurs first.
i. The applicant/owner shall submit a written report outlining the status of the
development at the end of one (1) year from the date of approval by the Board
of Supervisors. The status report shall be reviewed by staff to determine whether
the Special Use Permit remains in compliance with the approved stipulations.
j. Prior to occupying the existing guest house and garage or any portion thereof for
any use associated with the Special Use Permit, the applicant shall obtain a
Building Permit to retrofit the existing garage to meet current residential building
code requirements as applicable.
k. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
l. Noncompliance with the conditions of approval will be treated as a violation in
accordance with the Maricopa County Zoning Ordinance. Further,
noncompliance of the conditions of approval may be grounds for the Planning
and Zoning Commission to take action in accordance with Chapter 3 (Conditional
Zoning).
m. Non-compliance with the regulations administered by the Maricopa County
Environmental Services Department, Maricopa County Department of
Transportation, Drainage Review Division, Planning and Development
Department, or the Flood Control District of Maricopa County may be grounds for
initiating a revocation of this Special Use Permit as set forth in the Maricopa County
Zoning Ordinance.

n. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval is
temporary and allows the property to enjoy uses in excess of those permitted by
the zoning existing on the date of application, subject to conditions and
stipulations. In the event of the failure to comply with any condition or stipulation,
and at the time of expiration of the Special Use Permit, the property shall revert to
the zoning that existed on the date of application. It is, therefore, stipulated and
agreed that either revocation due to the failure to comply with any conditions or
stipulations, or the expiration of the Special Use Permit, does not reduce any rights
that existed on the date of application to use, divide, sell or possess the property
and that there would be no diminution in value of the property from the value it
held on the date of application due to such revocation or expiration of the Special
Use Permit. The Special Use Permit enhances the value of the property above its
value as of the date the Special Use Permit is granted and reverting to the prior
zoning results in the same value of the property as if the Special Use Permit had
never been granted.

Project Summary:
1. This is a request for a condition modification to extend a Special Use Permit (SUP) Z2012075
for an additional 10 years. The Z2012075 SUP was originally approved on February 20, 2013
by the Board of Supervisors (BOS) for five (5) years. The original SUP is set to expire on February
20, 2018. Listed below is the existing condition language:
h. This Special Use Permit shall expire five (5) years from the date of approval by the
Board of Supervisors, or upon expiration of the lease to the applicant, or upon
termination of the use, whichever occurs first.
2. Rural Metro has operated at the current site for the past five (5) years. The applicant, Mr.
Marchant, lives on the premise in a single family residence. The Rio Verde Foothills
Temporary Fire Station utilizes the guest house for the on-duty crew. South of the guest
house on the same property is a 3,200 sq. ft. metal garage with two bay doors which
houses the emergency response vehicles and associated supplies. There will be no site
improvements.
3. Per the original SUP Rural Metro agreed to adopt limited siren use based on traffic and
time of day to respect the quiet nature of the community and will continue to be judicial
in the use of sirens when responding to calls unless conditions warrant the use. The
narrative states there have been no complaints from neighboring property owners and
there have been no code violations related to the approved SUP.
4. At the time of the original SUP residents in the area were in the process of petitioning for
a fire district, however this was unsuccessful. This request will allow Rural Metro to continue
serving the area until a more permanent solution can be determined.
Existing On-Site and Adjacent Zoning / Land Use:
5. On-site: Rural-43/ Single-family residence
North: Arterial, then Rural-43 / Rio Verde Dr., then vacant land
South: Rural-43/ single-family residence
East: Rural-43 then unimproved road / vacant land then 164th St.
West: Rural-43/ vacant land, then single-family residence

Adopted Plan:
8. Rio Verde Foothills Area Plan: The Plan identifies the subject site for Rural Residential uses.
The plan also allows institutional uses, particularly those providing fire and life safety. The
temporary fire station is providing a use that is in concert with the plan.
Public Participation Summary:
9. The applicant has complied with the Maricopa County Citizen Review Process with the
required posting of the site and notification by first class mail to adjacent property
owners within 300’ of the subject parcel and interested parties. The applicant did not
receive any inquiries from the public. To date, staff has not received any
opposition/support or inquiries from the public. Lastly, the applicant provided staff with
a “Citizen Participation Results Report” which explains that all requirements were met.
Outstanding Concerns from Reviewing Agencies:

Staff Analysis:
11. Staff is in support of the Modification of Condition for a time-extension to SUP Z2012075.
The temporary Rural Metro Fire Station provides continual service to the Rio Verde area.
The closest permanent Fire Station is over 16 miles and would have a response time of
over 20 minutes.
12. The changes to the approved conditions would update the narrative, condition ‘b’ and
the timeframe of condition ‘h’. All other conditions from the approved Z2012075 SUP would
remain in effect as applicable. The changes are shown below in leg-edit format:
b. Development of the site shall be in conformance with the Narrative Report
entitled “Rio Verde Foothills Temporary Fire Station” “Narrative Report”, consisting

Maticopa County Planning & Development - Phoenix, AZ

NARRATIVE REPORT:
This is a request for a Modification of Condition to Special Use Permit Case #
Z2012075 'Rural Metro Temporary Fire Station'. We are requesting a 10-year
extension of expiration date. There will be No Site Improvements Required and
all other terms and conditions to remain the same.
PURPOSE OF REQUEST
The purpose of this request is an extension of the current Special Use Permit
(SUP) to allow Rural Metro Fire Department to continue to operate a fire and
ambulance station located at 16309 E. Rio Verde Drive, Scottsdale Arizona. Rural
Metro Fire Department has operated under a previously granted special use
permit for the past five (5) years at the above address.
The extension of the special use permit will allow Rural Metro Fire Department to
continue to serve the citizens of the Rio Verde Foothills community for fire and
medical responses. As a historical note, prior to the original special use permit
granted in 2013, Rural Metro provided service to the community from a fire
station located in the Town of Cave Creek. The fire station is over 16 miles to the
Rio Verde Foothills and requires a response time of over 20 minutes. Operating at
the present location (13609 E. Rio Verde Dr.) has drastically reduced the response
times to emergencies in the Foothills. Please note response data provided.
As noted in the prior application for the original special use permit, the residents
of the Foothills were in the process of petitioning to for a fire district. Their drive
was unsuccessful and Rural Metro has continued to serve the area for the past
five years. This request for an extension to the special use permit is and has
continued to be in the interest of public safety for the residents and visitors to the
Rio Verde Foothills.

Description of Proposal
As stated in the original SUP, this is an effort to continue to have reduced
response times to emergencies and other fire department related activities in the
Rio Verde Foothills area. Rural Metro Fire Department will continue to provide
staff and equipment which will operate 24 hours per day, 7 days per week. Rural
Metro has responded to 1155 calls for service (as of 1245-2017) since moving
into the facility. A breakdown of the calls by type is attached. Of note, 678 of
those calls were considered life threatening medical calls. By responding from the
current location as opposed to the alternative (Cave Creek), numerous lives have
been saved. Time is of the essence when a citizen is experiencing a heart attack,
stroke, or major trauma. As a note, the response area is predominately properties
with horse facilities These types of occupancies incur medical calls from dealing
with large animals. Rural Metro crews respond to numerous calls for citizens
falling from horses, crushed by horses, stepped on, etc. With a short response
time, outcomes are generally much improved than was the case five years prior.
in addition to medical calls, the fire department has responded to numerous
residential fires. Again like medical calls, time of response is important. Every
minute of delay a fire can double in size once it has become entrenched in a
structure. The fire department was able to contain the majority of these fires
while they were still small due to the improved response times. One other related
area of major concern to the residents in the Rio Foothills are wildland fires. The
fire department has responded to many wildia rid fires over the past five years,
and again clue to the closer proximity have been able to keep the fires small and
contained.
The facility consists of existing buildings on the property located at 16309 E. Rio
Verde Drive. Setbacks on the site are 40' from the south property line, 30' from
the west property line, 90.5' from the north property line, and 101' from the east
property line.
Two (2) existing building will continue to be utilized. The first is a metal garage
with 2 bay doors, This building is 40' X 80' X 16' tall for a total of 3200 square feet.
This building houses the emergency response vehicles and associated supplies

housed by Rural Metro Fire Dept. for responses in the community. The second
building is a 700 square foot Casita that houses the firefighters. The casita
contains a small office, bedroom, kitchen, and bath facilities sufficient for the
crew of three (3) firefighters that are on duty each day.
Shift change occurs in the morning when there are six personnel on site for
approximately 15 minutes. There is ample parking on an all-weather service
provided by the landlord.
There has been no additional lighting added on site during the previous five years
of operation.
Access and egress to the site continues to be over a permanent concrete driveway
as indicated on the original SUP.
As noted in the original SUP, Rural Metro understands the rural nature of the area
and has been and will continue to be very judicial in the use of sirens when
responding out of the location unless conditions warrant the use. As a note, there
have been no complaints from neighboring property owners concerning noise
generated form the emergency vehicles over the past five years. Nor, have there
been any complaints in general concerning the operation of the fire department
out of the subject property. in fact, there have been numerous comments
regarding the satisfaction of having such a faster response and mere presence in
the community.
There are no outside sirens or alarms that activate when a call is received. The
speakers still reset after 5 minutes and cannot be heard outside the buildings.
There is still a sign at the driveway located on Rio Verde Drive indicating a Rural
Metro Fire Department Station.

There is a demonstrated increase in calls for service as each year progresses. Once
the data is complete for 2017, it will show that again, the calls for service have
increased. As the population of the area grows due to new home construction,
the trend is expected to continue.

Relationship to surrounding properties
The site is still flanked on 3 sides by vacant land. To the south is a single family
residence. As all traffic still enters and exits the property from the north, there is
little traffic related impact on the southern residence.
Rural Metro Fire Department has maintained an 'open house' relationship with
the community_ They have held numerous community related events such as
pancake breakfasts, open houses, and other events staged at the fire station. The
idea is to become an integral part of the community in order to stay abreast of
the needs and desires of the community regarding their medical and fire
protection, The owner of the property (Torn Marchant) and Rural Metro Fire
Department have received nothing but positive comments on their presence in
the community and the service delivered.
Rural Metro maintains mutual aid arrangements with the neighboring
communities. On the eastern boundary, Rio Verde Fire District has one fire station
and several pieces of apparatus. Those resources are available when need
through the mutual aid agreement. The City of Scottsdale is on the west boundary
and again, there is a mutual aid agreement that provides resources when needed.
Rural Metro provides fire protection for the Town of Fountain Hills and can call on
the resources located there. To the north is Tonto National Forest and Rural
Metro maintains a relationship with that agency to provide help during wildland
fire along that northern boundary.

Location and Accessibility
The facility is proposed at 16309 E Ea Verde Drive Scottsdale, AZ 85262.
This makes it an ideal location to assure rapid response to emergencies in the Rio
Verde Foothills, All access and egress is ail the north side of the property directly
onto Rio Verde Drive.
Circulation System
No improvements will be needed on site or off site as a result of this project.
Rio Verde Drive is a paved County Road. The parking on site is compacted road
millings. Access to the property is over a concrete entry, approved by MCDOT.
The emergency apparatus will be housed in the Garage/Workshop. This will
allow forward entry onto Rio Verde Drive. At no time should the apparatus have to
back onto the highway.
Community Facilities and Services
This unincorporated community of Maricopa County is home to McDowell
Mountain Park, numerous hiking and horse riding opportunities, and a rural
lifestyle. There are no eating or food establishments, no gas stations, and no other
commercial entities in the area.
Currently emergency response is provided by RM, responding from Cave
Creek and utilizing mutual aid agreements with other agencies. This facility will
provide fire and emergency medical service response to the residents of the Rio
Verde Foothills in a more rapid manner. This area is attempting to form their own
fire district.
This unincorporated area is not included within the boundaries of the Rio
Verde Fire District, and therefore is not in their service area. Rio Verde Fire
District has indicated their written support of this project.

Development Schedule
This project will use existing buildings that will require no structural
changes to accommodate the project. Housing of the on duty staff will be in a
building with bedrooms, bathroom and. kitchen. Apparatus will be housed in an
existing garage/workshop. There is no change of use on either building. No sales or
other business will be conducted from either building.
I anticipate that RM will occupy the site within 30 clays of the SUP approval.
Public utilities and services
Refuse is by private contract
Sewer is an on-site septic tank that holds 3000gallons,
Water is private delivery with on-site storage of 5300 gallons.
Law enforcement is provided by Maricopa County Sheriff s Office.
Fire and EMS response is by Rural/Metro from Cave Creek.
Electric is SRP
School District is Cave Creek #93 with bus service

SUBJECT: Rural Metro temp fire station SUP time extension Z2018002
The Maricopa County Environmental Services Department (MCESD) has reviewed
documents received from the Maricopa County Planning and Development Department
for the above referenced project. This project is a request for a Special Use Permit
time extension to allow for an existing accessory private building located at 16309
East Rio Verde Drive to be used as a temporary fire station. According to the submitted
documentation, an ambulance, fire truck and an emergency medical personnel (2 -5
people on a 24-hour basis) would be stationed at the private residence. The existing
private well and septic systems will support this activity. The relatively few people
are not perceived by MCESD to unduly stress the existing water and septic services.
Based on the above, MCESD raised no concerns to this project to the Planning &
Development Department in Permits Plus on January 12, 2018 and the project may
proceed at this time subject to the following stipulations:
Stipulations: None
It should be noted that this document does not approve the referenced project.
Comments are provided only as advisory to Maricopa County Planning and
Development Department to assist staff to prepare a staff report. Other Maricopa
County agencies may have additional requirements. Final review and approval will be
made through Planning and Development Department procedures. Applicant may
need to submit separate applications to the Maricopa County Environmental Services
Department for approval of proposed facilities regulated by the Department. Review
of any such application will be based on regulations in force at the time of
application.
