TO THE HONORABLE ARIZONA TRANSPORTATION BOARD:
The Highways Division has made a thorough investigation
concerning the abandonment of portions of the right of way
acquired for Old State Route 84 within the above-referenced
projects. These portions of Old State Route 84 were previously
established by resolution of the Arizona State Highway Commission
in the official minutes of February 7, 1928 at page 144.
As a result of the construction of Interstate Route 8, it has
been determined that the portions of Old State Route 84 lying
outside of the existing right of way boundary of Interstate Route
8 are no longer needed for state transportation purposes.
Accordingly, in the interest of public safety, necessity and
convenience, I recommend that these portions of said old right of
way be abandoned.
The portions of old right of way to be abandoned are depicted
in Appendix "A" and are more specifically delineated on maps and
plans on file in the office of the State Engineer, Highways
Division, Phoenix, Arizona.
I further recommend that the portions of old right of way as
depicted in Appendix "A" be abandoned as follows: the portion
depicted as Area "A" be abandoned and the State's interest therein
be vacated to the United States of America, Bureau of Land
Management, pursuant to the terms and conditions of the Grant
dated November 10, 1932 and the portion depicted as Area "B" be
abandoned to the jurisdiction of Maricopa County.
In accordance with Arizona Revised Statutes, Section 28-1903,
upon abandonment, rights of way or easements of existing sewer,
gas, water or similar pipelines and appurtenances and for canals,
laterals, or ditches and appurtenances, and for electric,
telephone and similar lines and appurtenances shall continue as
they existed prior to the abandonment.

RESOLUTION OF ABANDONMENT
CHARLES L. MILLER, Director, Arizona Department of
Transportation, has the 16th day of August, 1985, presented and
filed with this Transportation Hoard his written report under
Arizona Revised Statutes, Section 28-1864, recommending the
abandonment of portions of Old State Route 84 within the above-
referenced project.
The portions of the old right of way to be abandoned are
depicted in Appendix "A", and are more specifically delineated on
maps and plans on file in the office of the State Engineer,
Highways Division, Phoenix, Arizona.
WHEREAS, said portions of Old State Route 84 are no longer
needed for state transportation purposes; and
WHEREAS, this Board finds that public safety, necessity and
convenience will be served by accepting the Director's report;
therefore, be it
RESOLVED that the recommendation of the Director is adopted
and made a part of this resolution; be it further
RESOLVED that the portion of Old State Route 84 right of way
depicted in Appendix "A" as Area "A" is hereby abandoned and the
State's interest therein is hereby vacated to the United States of
America, Bureau of Land Management and the portion depicted as
Area "B" is hereby abandoned to the jurisdiction of Maricopa
County, both as provided for by law; and be it further
RESOLVED that the Director is hereby directed to take such
action as may be necessary to make this resolution effective.
