Wireless Communication Facility.
e. This Special Use Permit shall expire on November 8, 2037, upon inactivity of the use
for a period of 90 or more consecutive days, or upon termination of the use
whichever occurs first. All of the site improvements shall be removed within 60 days
of such termination or expiration.
f. Major changes to this Special Use Permit shall be processed as a revised
application in the same manner as the original application, with final
determination made by the Board of Supervisors following recommendation by
the Planning and Zoning Commission. Minor changes may be administratively
approved by the Planning and Development Department.
g. Non-compliance with the Special Use Permit (the site plan and narrative report) or
the conditions of approval will be treated as a violation in accordance with
provisions of the Maricopa County Zoning Ordinance.
h. Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Special Use Permit as set forth in the Maricopa County
Zoning Ordinance.
i. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, and at the time of expiration of the Special Use Permit, the
property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to
comply with any conditions, or the expiration of the Special Use Permit, does not
reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation
or expiration of the Special Use Permit. The Special Use Permit enhances the value
of the property above its value as of the date the Special Use Permit is granted
and reverting to the prior zoning results in the same value of the property as if the
Special Use Permit had never been granted.

Project Summary:
1. This a request for a Special Use Permit (SUP) for a new Wireless Communication Facility
(WCF) in the R1-6 RUPD zoning district. The applicant is proposing to install an 80’ (h) tower
enclosed within a 672 square feet area (leased area), the related equipment and
cabinets would be concealed by a 6’ (h) CMU wall. This SUP is part of a 157 acre parcel
that is located on northwest corner of Peoria Avenue and Beardsley Canal Road,
approximately 0.5 miles west of Perryville Road. The WCF will be accessible via a 12’ wide
utility easement along the northern portion of the parcel and accessed from Perryville
Road. The proposed WCF is within the Zanjero Trails Development Master Plan (DMP).
2. An SUP is required because the tower does not meet various requirements of the
Maricopa County Zoning Ordinance (MCZO). Specifically, the tower does not meet the
2:1 setback requirements on the north and west property lines. The applicant is requesting
deviations to the setback requirements to 140’-1” on the northern property line and 142’-
4” on the western property line, where a 2’ to 1’ setback is required. The applicant is
requesting a 10’ array diameter where the maximum diameter of antenna arrays are 8’.
All other requirements have been met or are not applicable.

Right-of-Way:
5. The following table includes existing and proposed half-width right-of-way and the future
classification based upon the Maricopa County Department of Transportation (MCDOT)
Major Streets and Routes Plan.
Street Name Half-width Existing R/W Half-width Proposed R/W Future Classification
Peoria Ave. 33’ 34’ Principal Arterial
(Current Classification)
The proposed SUP is not within MCDOT R/W. The northern portion of the subject parcel is
bordered by Peoria Ave and is within the jurisdiction of the City of Surprise.
Adopted Plan:
6. White Tank / Grand Ave Plan: Identifies this area as Small Lot Residential (2-5 d.u./ac). This
area and designation is part of the DMP for Zanjero Trails. Portions of this DMP have been
annexed into the City of Surprise, north of Peoria Ave.
Public Participation Summary:
7. The applicant has complied with the Maricopa County Citizen Review Process with the
required posting of the site and notification by first class mail to adjacent property owners
within 300’ of the subject parcel and interested parties. There was one inquiry regarding
the SUP to the applicant concerning possible radiation where cell tower or other
electronic equipment, and its effect on potentially decreasing property value
nearby. The applicant sent information on data from the Federal Communication
Commission (FCC) regarding exposure to radiation. The citizen thanked the applicant for
the information and had no additional concerns (attached). To date, staff has not
received any concerns from the public.
Outstanding Concerns from Reviewing Agencies:
8. N/A
Staff Analysis:
9. The applicant is requesting a SUP for a WCF to modify MCZO standards with regards to
setbacks and diameter width. These standards are discussed in the table below. The
applicant is requesting deviations to the setback requirements to 140’-1” on the northern
property line and 142’-4” on the western property line, where the MCZO requires a 2’ to
1’ setback. The antenna arrays will observe wider diameters where 8’ is the maximum

permitted. The applicant is requesting a 10’ array diameter.
10. In considering the overall request, staff notes that the nearest WCF is 2 miles to the south.
There are other WCFs located to the northeast and east of the subject site, approximately
6 – 8 miles away. The proposed WCF meets the setback requirements on all but the
northern and western property lines. In the site selection process for the proposed WCF,
and subsequent lease negotiations between the Property Owner and Verizon, it was
determined that the proposed setback of 140’-1” on the northern property line and 142’-
4” on the western property line was the best choice as the Property Owner wants to
maintain much of its land as vacant. The required 8’ antenna array diameter is
appropriate for a monopalm structure, where the intent is to keep the antenna array
smaller and less visually intrusive. The proposed antenna array width of 10’ is what is
needed to provide the necessary coverage in the area and meet Verizon’s new antenna
mount standards. The applicant notes that if approved The WCF would allow other
carriers to co-locate on the monopole which will reduce the need for additional
monopoles in the immediate area in the future.
11. The applicant provided maps within the narrative (attached) showing the existing
coverage currently and with the proposed WCF, showing the need for wireless service in
the area. The applicant notes the closest residential property is approximately 2,188’ to
the east. However staff notes that while currently vacant, north of the subject site single-
family residential infrastructure is shown on the aerial (shown above), and if built would
bring residential within approximately 140’ of the WCF.
12. There are no objections from County reviewing agencies. Staff routed to the City of
Surprise, however did not receive a response. The proposed WCF site is within the vicinity
of Luke AFB who noted the WCF would not negatively impact flying operations at Luke
AFB (attached). The following table is included to illustrate and contrast the standards for
Wireless Communications Facilities in the underlying zoning district with those proposed
changes to the standards.

Purpose of Request
Verizon Wireless ("Verizon") is requesting a Special Use Permit ("SUP") for a new
Wireless Communication Facility ("WCF") to be located on a portion of the property
located at 19011 North Peoria Avenue in the Waddell area of unincorporated Maricopa
County (the "Parent Parcel"). The purpose of the proposed WCF is to increase 4G LTE
capacity for customers in the surrounding residential areas of the intersection of Perryville
Road and Peoria Avenue.
Description of Proposal
Construction and Co-Location
Verizon is proposing to construct an 80' tall monopole and related equipment within a
roughly 672 sq. ft. lease area along the northwestern boundary of the Parent Parcel. The
monopole will be designed to accommodate additional carriers. The related equipment
and cabinets will be concealed by a 6' high CMU screen wall that will be designed and
colored according to the approval by the property owner. There will be ample room left
over within the equipment enclosure to accommodate future carrier equipment.
Ground Space and Equipment Shelter
The Parent Parcel, which is currently vacant desert land, is approximately 157 acres in
size and is owned by the Maricopa County Municipal Water Conservation District #1 (the
"Property Owner"). The Property Owner also owns the parcel to the immediate south
which is approximately 148 acres in size. Verizon will lease a 672-square foot (0.015
acres) area in which they will install the monopole and related equipment. A 6' tall CMU,
painted and textured, will surround the monopole and equipment for screening and
security.
Access and Utility Easement
As part of its lease agreement with the Property Owner, Verizon will lease all access and
utility easements necessary to access and operate the facility. A 12' wide access
easement will be provided on the northern portion of the lease area with direct access
from Perryville Road.
Business Operations
The proposed WCF is an unmanned facility and will operate 24/7 throughout the year. A
technician will visit the site once a month to perform routine maintenance and system
checks. The visits will be approximately a few hours in duration and will be conducted
during business hours unless there is an emergency.

Signs
There will not be any signs or advertising posted at this site other than the site
identification required under FCC Regulations.
Landscaping
There is currently no existing landscaping within or adjacent to the lease area as the
Subject Property is currently vacant desert land.

According to the map of existing WCFs above, there is one existing WCF to the south,
approximately 2 miles way. There are additional WCFs located to the northeast,
approximately 6 miles., and two additional WCFs located to the east, 6 and 8 miles away
respectively. These existing WCFs are too far away to provide the coverage needed for
the subject area. If approved, the WCF will allow other carriers to co-locate on the
monopole which will reduce the need for additional monopoles in the immediate area.

Per the existing coverage map above, the existing VVCFs in the area provide the best
data coverage in the immediate vicinity of each of the surrounding WCFs. As one gets
farther away, the coverage reduces until it becomes marginal to poor. Once the proposed
WCF is approved and permitted, the data coverage in the area around the facility will be
improved dramatically.

Compatibility with the Surrounding Area
Setbacks from Residential Uses
The nearest residential properties are located +/-2,188' to the east.
Setbacks from Uses/Structures on Adjacent Property
The setback from the proposed monopole structure is 140'-1"" from the northern property
line, 2,188'-10" from the eastern property line, and 2,499'-6" from the southern property
line and 142'-4" from the western property line.
Setbacks from Public and Private Streets or Access Easements
The proposed monopole will be set back a distance of 33' from Peoria Avenue.
Future Additional Appurtenances or Expansion Plans
There are no additional appurtenances or expansion plans associated with the proposed
WCF.
Surrounding Non-Residential Uses
All other surrounding uses are residential or undeveloped.
Justification for the Special Use Permit
Pursuant to Article 12013 of the Maricopa County Zoning Ordinance, WCFs are
permitted in rural, single family and multiple family residential zoning districts subject to
certain limitations which are generally described below. Conformance with these
limitations is also provided below.
1) The maximum height of a WCF including the base, platform and attached
antenna shall not exceed 80' above grade or no greater than 15' above the
height of the structure (other than a WCF tower) onto which it will be
attached. Requirement Met: The proposed height of the WCF will be a maximum
of 80'.
2) Up to two WCFs may be mounted on a building and may include not more
than 2 microwave antenna dishes with a diameter of 4.9' each, and each
being 15' or less in height as measured above the roofline so long as the
supporting structure is screened. Requirement not applicable: The proposed
WCF will be not be mounted on a building.
3) Towers and support structures shall have a maximum diameter of 2.5'.
Requirement met: The proposed monopole will not exceed 2.5' in diameter.
SI Page

4) The color of a WCF shall be compatible with the surrounding environment.
Exposed portions of the tower shall be non-reflective. Requirement met: The
proposed WCF will be non-reflective and painted to match the surrounding area.
5) Installation of a WCF shall avoid the removal of mature trees and cacti unless
a plan for their relocation is approved by the County. Requirement not
applicable: There are no existing trees or cacti within the lease area or surrounding
area. The only vegetation observed is low-lying desert shrubs.
6) WCFs shall be setback 2' from all property lines for each 1' in height
(including tower and antenna attachments but not to include architectural
features for stealth design), unless co-locating on a building/structure (other
than a WCF tower). The applicant proposes relief from this requirement through
the Special Use Permit process: The proposed WCF meets the setback
requirements on all but the northern and western property lines. In the site
selection process for the proposed WCF, and subsequent lease negotiations
between the Property Owner and Verizon, it was determined that the proposed
setback of 140'4" on the northern property line and 142'-4" on the western
property line was the best choice as the Property Owner wants to maintain much
of its land as vacant desert. Additionally,
7) The maximum diameter of antenna arrays shall be 8' measured from
circumference line to circumference line through the center of the tower
structure but not including architectural features for stealth design such as
tree limbs, palm fronds and windmill blades. The applicant proposes relief from
this requirement through the Special Use Permit process: The required 8' antenna
array diameter is appropriate for a monopalm structure, where the intent is to keep
the antenna array smaller and less visually intrusive. The proposed antenna array
width of 10' is what is needed to provide the necessary coverage in the area and
meet Verizon's new antenna mount standards.
8) The maximum diameter of any microwave dish shall be 4.9'. Requirement met:
The proposed microwave dish has a diameter of 4.
9) All ground mounted equipment shall be screened visually and to mitigate
noise. Requirement met: The ground mounted equipment will be screened by a
6' CMU wall which will conceal the equipment
10)A WCF tower structure for a new WCF shall be located at least 1,000' (radius)
from any existing WCF. A stealth design must observe reasonable site
aspects to affect the stealth design such as the design of a tree must have
live trees of the respective species imitated and of similar height located in
proximity to the tower. Requirement met: The closest WCFs are located
approximately 2 miles to the south and approximately 6 miles to the northeast. A
stealth design is not proposed with this WCF. With respect to existing trees in the
6 Page

area, there are none on the Subject Property and in the immediate area except for
low-lying desert shrubs. A monopalm or monopine would stand out more in this
area than the proposed monopole.
11)A solid screen wall of a minimum of 6' in height shall be constructed around
the facility's equipment and shall visually screen all equipment and mitigate
noise. Requirement met: A 6' screen wall is proposed to be constructed around
the lease area.
12)Generators will only be permitted for emergency purposes. Requirement not
applicable: There is no emergency generator proposed.
13)All ground equipment shall be setback at least 3' from a lot line and not
located within a required front yard. Requirement met: The proposed ground
mounted equipment will be located well in advance of the minimum 3' requirement
from all property lines.
Location and Accessibility
The WCF is directly accessible via a 12' wide utility easement along the northern portion
of the parcel, accessed from Perryville Road.
Circulation System
The technician access to the proposed WCF is directly off Perryville Road with the parking
space in the northern portion of the lease area.
Development Schedule
The proposed WCF will be completed in one phase after approval of the SUP.
Maricopa County Zoning District
The Subject Property is located within the R1-6 zoning district.
Existing Use of Parent Parcel
The parent parcel currently consists of undeveloped land.
Relationship to Surrounding Area
As indicated on the map (below), the area surrounding the proposed WCF consists of
mostly undeveloped land to the north, west and south; a single-family residence
subdivision (Cortessa Community) located directly to the east. The Shadow Ridge High
School is located to the north-east.
7 1 Page

Community Facilities and Services
There are not a significant amount of community facilities and services in the vicinity of
the proposed WCF. The closest community facility appears to be the Shadow Ridge High
School located at the northeast corner of Perryville Road and Peoria Avenue. It appears
that many residents in the area travel east to the City of Surprise and south to the City of
Litchfield Park for the majority of community services and facilities.
Public Utilities and Services
Electricity is provided by Arizona Public Service with telephone service provided by
Qwest. The Maricopa County Sherriff's office and Rural Metro are the emergency service
providers for the area.

Hi Jane,
Sorry for the delay. I wanted to get some information for you regarding the health and safety of
wireless communication facilities as determined by several national and international
organizations.
The Federal Communication Commission has determined through measurements that ground-
level power densities are well below the exposure limits recommended by the RF/microwave
safety standards used by the FCC. You can confirm this with the FCC on their website or by
calling them.
FCC guidelines are based on federal health and safety agencies including the EPA, the FDA, the
National Institute for Occupational Safety and Health (OSHA) and non-governmental
organizations like the Institute of Eiectrical and Electronics Engineers (IEEE) and the National
Counsel on Radiation Protection and Measurements (NCRP). Each of these organizations have
websites you can review or you can call them.
According to the World Health Organization (WHO), recent surveys indicate that RF exposures
from base stations and wireless devices in publicly accessible area are normally thousands of
times below international standards. The surveys indicate there is no convincing scientific
evidence that the weak RF signals from base stations and wireless networks cause adverse
health effects.

As for a decrease in property values, Verizon has found no evidence that the installation of a
wireless facility has resulted in a decrease in the property values of surrounding areas.
I will share your concerns with the County in our Citizen Participation Report. I have also cc'd
the County Planner we are working with, Jaclyn Sarnowski, on this email.
Please let me know if there is anything else I can to do to alleviate your concerns.

Hi Michelle,
I was concerned about possible radiation where cell tower or other electronic equipment
could be installed/built there. And its effect on the property value nearby (decrease),
Thanks

Hi Jane,
I just received a call from another person in the area who brought to my attention that
the notification letter we sent out incorrectly stated that the size of the project is 672

northwest corner). I am going to send out corrected letters so everyone in the area

If you have additional concerns, let's set up a time to talk.
