Lease No. P-50202 Amendment No. 1 C-85-13-009-3-02 Amendment No. 1 to License Agreement For Use of Real Property Between City of Mesa (Licensor) And Maricopa County (Licensee) RECITALS A. WHEREAS, Licensor and Licensee (collectively the “Parties”) are Parties to that certain Non-Exclusive Revocable License Agreement for Use of Real Property P-50202 dated and approved by the Maricopa County Board of Supervisors January 2, 2014 (the “Agreement”); and B. WHEREAS, the Agreement is for use of Premises at 370 South Brooks Road, Mesa, Arizona, (the “Property”) and C. WHEREAS, the term of the Agreement expires December 31, 2017; and D. WHEREAS, Licensor and Licensee now mutually desire to amend the Agreement to extend the term and update Licensee notice address. AGREEMENT NOW THEREFORE in consideration of the foregoing and other valuable consideration, receipt and sufficiency of which is hereby acknowledged Licensor and Licensee agree to amend the Agreement as follows: 1. The term of the Agreement is hereby extended for five (5) years, to commence January 1, 2018 and expire December 31, 2022. This Agreement is subject to the provisions of A.R.S. § 38-511, the provisions of which are incorporated herein by this reference. Either Licensee or Licensor may terminate the Agreement, without cause, on at least 90 days prior written notice to the other. 2. 18.05 Notices. Written notices to Licensee shall be sent to: Maricopa County Real Estate Department Attn: Director 2801 West Durango Street Phoenix, AZ 85009 3. This Amendment shall not become effective until it is executed by the Chairman of the Maricopa County Board of Supervisors. 4. The foregoing paragraphs contain all the changes made by this amendment. All other terms and conditions of the original Agreement and subsequent amendments remain the same and in full force and effect.
