RELEASE AND TERMINATION OF
DEVELOPMENT AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
That certain real property described as:
See Exhibit "A" attached hereto and incorporated herein by reference;
is hereby released from that certain DEVELOPMENT AGREEMENT (the "Agreement"), entered
into by and between MARICOPA COUNTY, an Arizona political subdivision (the "County"), and
RICHMOND AMERICAN HOMES OF ARIZONA, INC., a Delaware corporation, as successor
to EVEREST BETHANY NORTH, LLC, a Delaware limited liability company, as successor to
EVEREST BETHANY, LLC, a Delaware limited liability company ("Owner"), recorded
December 17,2010 in Instrument No. 2010-109829, Records of Maricopa County, Arizona. This
instrument is intended to terminate the Agreement.
