6. IMPACT STATEMENT HEARING FOR THE PROPOSED SHERWOOD MESA
IRRIGATION WATER DELIVERY DISTRICT
Pursuant to A.R.S. § 48-261 and § 48-263, convene the scheduled public hearing on the
impact statement for the proposed Sherwood Mesa Irrigation Water Delivery District.
The Board of Supervisors will hear those who appear for and against the proposed district
and shall determine whether the creation of the district will promote public health, comfort,
convenience, necessity, or welfare.
If the Board determines that the public health, comfort, convenience, necessity, or welfare
will be promoted, it shall approve the district impact statement, a bond of $250, and
authorize the persons proposing the district to circulate petitions.
The proposed district is located in the Sherwood Mesa Subdivision and Sherwood Mesa
Subdivision Unit 2 combined adjacent subdivisions in Mesa, Arizona. A map of the
proposed boundaries is available in the Office of the Clerk of the Board of Supervisors on
the Clerk’s web site. The district consists of 43.486 acres and 185 lots. (Supervisorial
District 2) (C-06-17-484-M-00)
Maureen Battles, resident, spoke in opposition of this formation because she has been
a resident of this neighborhood for nine years and has never used irrigation water and
does not want to be taxed for something she will never use.
Jeffery Heinrick, resident, spoke in favor of the formation because of the age of the
irrigation system and noted the problems that will occur due to how old the system is.
He said there is a need for the tax money to make the repairs and maintain the aging
system because at present, donations are made on the honor system which he has to
go house to house to collect.
Fran McCarroll noted a letter from John McVey, an attorney representing Jeffrey
Cleveland, who is a property owner in the proposed district. Mr. McVey stated that Mr.
Cleveland is in favor of the formation of the district because the system is so old and

maintenance and repairs need to be made on an ongoing basis.
John Bell, resident and organizer of the Sherwood Mesa Irrigation Water Delivery
District, informed the Board that the irrigation system was installed in 1956 and stated
the positive benefits of maintaining the infrastructure of the system. He said 80% of the
properties within the proposed boundaries use the irrigation water.
Supervisor Chucri explained the purpose of the hearing was to initiate of the process to
form an irrigation water delivery district and to grant the proponents permission to
circulate petitions for the property owners’ signatures.

7. REASONABLY AVAILABLE CONTROL TECHNOLOGY (RACT) STATE
IMPLEMENTATION PLAN (SIP) AND NEGATIVE DECLARATIONS
Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments
and consider the adoption of the submittal of the RACT SIP and negative declarations to
the U.S. Environmental Protection Agency (EPA) as a revision to the (Arizona) SIP.
Following the public hearing, the Board is requested to approve the submittal of the RACT
SIP and negative declarations to the EPA as a revision to the (Arizona) SIP. Upon Board
approval, this item will become effective May 24, 2017.
The RACT SIP is an analysis made by the Maricopa County Air Quality Department
(MCAQD) that concludes that the MCAQD has fulfilled the requirements of RACT, as
applicable to the 2008 eight-hour ozone national ambient air quality standards (NAAQS) for
all Control Techniques Guidelines (CTG) source categories and for all major sources of
volatile organic compounds (VOCs) and nitrogen oxides (NOx). RACT is the lowest
emissions limitation that a particular source is capable of meeting by the application of
control technology that is reasonably available considering technological and economic
feasibility. CTGs, issued by the EPA, are intended to provide States information that should
assist them in determining RACT for source categories. In instances where either there
were no sources in Maricopa County meeting a CTG source category or where the number
of sources or the amount of emissions were de minimis, the MCAQD made a negative
declaration regarding such CTG source category; negative declarations are included in the
RACT SIP. Permit fees are not changing due to this action. (C-85-17-018-M-00)

Environmental Protection Agency (EPA) for implementing the municipal solid waste

landfills emission guidelines (40 CFR Part 60, Subpart Cf (Emission Guidelines And
Compliance Times For Municipal Solid Waste Landfills)). Following the public hearing, the
Board is requested to approve the submittal of the CAA Section 111(d) Plan to the
EPA. Upon Board approval, this item will become effective 05/24/2017.
CAA Section 111 establishes a mechanism for controlling air pollution from 70 stationary
source categories. CAA Section 111(d) establishes procedures, i.e., emission guidelines,
for five (5) source categories, one of which is municipal solid waste (MSW) landfills.
Emission guidelines establish procedures for States to submit a plan identifying sources in
a source category and a program that provides for the implementation and enforcement of
standards of performance for such sources in a source category.
On August 29, 2016, the EPA promulgated emission guidelines for MSW landfills under
CAA Section 111(d). The emission guidelines set forth specific mechanisms and
requirements for controlling emissions of non-methane organic compounds (NMOC). The
emission guidelines are codified at Title 40 of the Code of Federal Regulations, Part 60,
Subpart Cf. The emission guidelines require States to submit to the EPA by May 30, 2017,
a plan to implement the emission guidelines. For the purposes of the CAA Section 111(d)
Plan, the MCAQD is considered a “State”.
The CAA Section 111(d) Plans submitted to EPA must include elements described in EPA
regulations, including 40 CFR Part 60, Subparts B and Cf, and in the EPA guidance
document, “Municipal Solid Waste Landfills, Volume 2”. Such plan elements include: (1)
Identification of enforceable mechanisms for implementing the EPA emission guidelines;
(2) The MCAQD’s legal authority to carry out the CAA Section 111(d) Plan; (3) An
inventory of existing municipal solid waste landfills; (4) An inventory of emissions from
existing MSW landfills; (5) Emission standards for existing MSW landfills that are no less
stringent than those in the emission guidelines; (6) The MCAQD process, for review and
approval of site-specific gas collection and control system design plans; (7) Compliance
schedules; (8) Testing, monitoring, recordkeeping, and reporting requirements; (9) A record
of public hearing(s); and (10) Provision for annual MCAQD progress reports. Details for
these elements can found in 40 CFR Part 60, Subparts B and Cf.
The MCAQD has prepared the CAA Section 111(d) Plan that includes the elements
described in EPA regulations, including 40 CFR Part 60, Subparts B and Cf and in the EPA
guidance document, “Municipal Solid Waste Landfills, Volume 2”. Upon Board approval,
the MCAQD will submit the CAA Section 111(d) Plan to the EPA by the EPA’s deadline of
May 30, 2017.
To implement the CAA Section 111(d) Plan, the MCAQD proposes to revise Maricopa
County Air Pollution Control Regulations Rule 321 (Municipal Solid Waste Landfills). The
rulemaking process to revise Rule 321 will follow the Enhanced Regulatory Outreach
Program Policy and workflow process. Stakeholder Workshops will tentatively begin in
May/June 2017 and a public hearing will tentatively be conducted in December 2017. The
MCAQD is proposing to revise Rule 321 to reflect the requirements in 40 CFR 60, Subparts
Cf and XXX. The proposed revisions will include changing the applicability of the rule to “
existing MSW landfills that commenced construction, modification, or reconstruction on or
before July 17, 2014” and changing the standards of performance for collections and
control system design plan, design capacity report, and non-methane organic compound
emission rate report. The proposed revisions to Rule 321 would not take effect should 40
CFR 60, Subparts Cf and/or XXX be stayed, repealed, or rendered unenforceable or void
as a result of any action by a federal court, Congress, or a new final action by the EPA and
the proposed revision to Rule 321 would not take effect until the EPA approves the CAA
Section 111(d) Plan. Permit fees are not changing due to this action. (C-85-17-019-M-00)

Approve a one-time addition to the County Attorney’s Office fleet listed below:

This vehicle is scheduled for replacement during fiscal year 2017. This vehicle will be used
for special investigative assignments. The County Attorney’s fleet will automatically be
reduced when this vehicle is no longer usable by the County Attorney’s Office.
Approval of this agenda will result in a net impact to the general fund budget of zero.
Pursuant to A.R.S. 38-538-03 and §28-2511(A), this vehicle will continue to bear non-
governmental license plates and be exempt from county markings. Vehicle details and
identification numbers will be kept on file with the Clerk of the Board. (C-19-17-048-M-00)

12. REPLACEMENT OF FLEET VEHICLES AND EXEMPTION FROM MARKINGS
Pursuant to A.R.S. § 38-538-03 and §28-2511(A), approve the issuance of non-
governmental license plates and exemptions from county markings for three (3) undercover
vehicles. These vehicles are replacing three (3) vehicles that are used for law enforcement
investigative purposes. Vehicle details and identification numbers will be kept on file with
the Clerk of the Board.
These vehicles were purchased in accordance with Maricopa County’s vehicle replacement
process. The replacement was acquired using General Government (Agency 470) General
fund (100) monies through the Equipment Services department.
These replacements were deemed critical by equipment services due to excessive mileage
and/or the age of the vehicle which made it cost prohibitive to acquire replacement parts
with which to maintain the vehicle. As this action involves the replacement of existing
vehicles in the fleet, expenditures for the operation and maintenance of the vehicles will
continue to be absorbed by the County Attorney's general fund budget with zero net
impact.
As the vehicles being replaced are currently exempt from markings and governmental
license plates, the Maricopa County Attorney's Office requests that the replacement
vehicles purchased also be exempt from County markings and issued regular Arizona
license plates as provided in accordance with A.R.S. § 38-538.03 and A.R.S. § 28-2511(A).
This will ensure that they can be used in furtherance of their law enforcement mission. (C-

20. IGA WITH THE DEER VALLEY UNIFIED SCHOOL DISTRICT #97 FOR STATE CLEAN
DIESEL PROGRAM SUB AWARD
Approve an Intergovernmental Agreement between Deer Valley Unified School District #97
and Maricopa County through the Air Quality Department, in the not-to-exceed amount of

Intergovernmental Agreement is effective upon final signature until September 30, 2017.
Maricopa County Air Quality Department (MCAQD) has been presented with the
opportunity to provide a sub award of $120,000 to an eligible applicant from its Diesel
Emissions Reduction Act (DERA) State Clean Diesel Program for Federal Fiscal Year
2016. The sub award is necessary because the primary awardee, Maricopa County
Equipment Services Department, will be able to complete requested vehicle retrofits using
less funding than originally anticipated.
Two applicants responded to the March 2017 request for proposals by the County: the City
of El Mirage and Deer Valley Unified School District #97 (DVUSD). The City of El Mirage
proposal would replace one 2001 Fire Pumper truck that averaged 10K miles per year with
a newer model. The DVUSD proposal would replace three older school buses that each
average 14K miles per year, a total of over 40K miles per year. Since miles traveled has a
direct correlation with fuel consumption and associated air pollution, MCAQD recommends
that vehicles utilized more frequently be prioritized in replacement opportunities to bring
newer cleaner technologies to the county. Based on the information provided in both
proposals, MCAQD determined that DVUSD’s proposal would have a more significant
pollution reduction impact in Maricopa County and has selected DVUSD for the Federal
Fiscal Year 2016 DERA sub award. (C-85-17-021-3-00)

27. RENEWAL OF MARICOPA HOME CONSORTIUM IGA
Authorize the automatic renewal of the Maricopa HOME Consortium Intergovernmental
Agreement (IGA) with Maricopa County cities/towns: Avondale, Chandler, Gilbert,
Glendale, Peoria, Scottsdale, Surprise, and Tempe. Maricopa County is the designated
lead agency for the U.S. Department of Housing and Urban Development (HUD) HOME
Investment Partnerships Programs.
The HOME program activities are administered by the Maricopa County Human Services
Department – Housing and Community Development Division. The Division provides
oversight of the HOME activities and the Maricopa HOME Consortium. These cities/towns
entered into the Maricopa HOME Consortium Intergovernmental Agreement with an initial
term of July 1, 2006 to June 30, 2009 or until the HOME program funds from each of the
fiscal years of the qualified period are closed out pursuant to 24 CFR 92.507, whichever
was later. The Agreement provided an automatic renewal clause for succeeding years at
the end of the initial term. As a result, the Agreement will remain in effect until the
participating municipalities elect to amend or not to renew the document.
By authorizing the automatic renewal of the Agreement, the term is extended beginning
July 1, 2018 through June 30, 2020 for Federal Fiscal Years 2018, 2019, and 2020 will
ensure that HUD funds are allocated to Maricopa County as the Maricopa HOME
Consortium IGA will remain in place.

The Cranston Gonzales Affordable Housing Act allows for local governments that are
geographically contiguous to form a consortium for the purposes of receiving an allocation
of and participating in the HOME Investment Partnerships Program. The purpose of the
HOME program, administered by HUD, is to strengthen public-private partnerships to
increase the supply of affordable housing.
Maricopa County currently receives approximately $3.3 million HOME funds annually that
are administered by the Housing and Community Development Division of the Human
Services Department. These funds will be used to serve housing needs of residents within
the Consortium service area boundaries. If Maricopa County elects to opt out of the
Consortium, it would result in the dissolution of the Consortium, and may result in a partial
or complete loss of HOME funds for the remaining Consortium member cities/towns
effective July 1, 2018.
The Agreement will be effective for Fiscal Years 2018-2019, 2019-2020, and 2020-2021.
Consortium members had the opportunity to opt out of the Consortium prior to the
automatic renewal date, however all members chose to remain a part of the Consortium.

57. IGA WITH CITY OF GOODYEAR FOR THE EXCHANGE OF SERVICES (ENTENTE)
Approve the Intergovernmental Agreement between Maricopa County and the City of
Goodyear for the exchange of services or reimbursement of services (Entente). The
Agreement will expire June 30, 2022 unless extended by appropriate actions by the County
and the City. Either party may terminate this Agreement at any time prior to the expiration
date of this Agreement by furnishing the other party with a thirty (30) day written notice.
The purpose of this Intergovernmental Agreement is to identify and define both Parties’
respective roles in the execution of the responsibilities of specific maintenance tasks in
areas that cross jurisdictional boundaries.
The Agreement provides the opportunity to focus on routine maintenance tasks or
emergency highway projects and the availability of the most economical resources by
extending beyond jurisdictional or geographical boundaries. The application of the
Agreement will benefit areas in the County and the City where certain types of routine
maintenance or emergency highway project activities could be completed by the other
party based on scheduled work within the area. Individual tasks performed by either party
will be executed upon completion of a Letter of Agreement (LOA) approved and signed by
the County Department of Transportation Director and the City Manager, or their
designees.
If the value of goods or services exchanged by the Parties is not of equal value, the total
aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year.
If no services are exchanged, there is no financial impact. An accounting mechanism will
be utilized to track each LOA, as applicable, to identify specific tasks and services and to
ensure the exchange of these services is of similar value. (Supervisory District No. 4 and 5)
