Maricopa County Procurement CodelVIC1-351 states; "Single source" means an acquisition where, competition is impractical because
of standardization, warranty, or other factors as approved by the Board of Supervisors.
NOTE: The following are unlikely to be sufficient single source justifications:

• Agency perception that the vendor is the best qualified (this should be determined through a competitive process)
• Lack of agency planning resulting in limited time to conduct a competitive procurement
• Special incentive or deal offered (can be assessed in open and competitive solicitation)
• Agency convenience

Describe the search from above in detail:
Based on a Feasibility Study of the County's abandoned Madison Street Jail building located at 225 West
Madison Street determined the highest and best use for the former jail is to be re-purposed to contain
offices. A two-step solicitation for Construction Manager-At-Risk process to prepare the building to contain
offices and associated spaces resulted in Layton Construction Company being selected to perform Pre-
Construction constructibility and other professional consulting services. This Contract includes conditional
award of the Selective Demolition. Layton prepared a due-diligence study of the building and preformed
exploratory, moderately intrusive and non-intrusive, observations. This investigation yielded procedures
recommended to be the optimum, cost-beneficial, and safe way to perform the scope of selective demolition
prepared by the Architect selected by the County. This knowledge gives Layton qualifications in ways that
competition is impracticable.

The unique nature of a project of this nature (re-purposing a six-story jail that had no value as a jail
but with a solid structure) provides challenges and through the normal scope of preparing the
selective demolition, Layton Construction proved themselves highly qualified to perform this build-
back gaining knowledge of the building's structural advantages as well as disadvantages.

ATTACHMENT A
Reasons to Perform the Build-Back of 225W. Madison
Under a CMR Delivery Contract Method with Layton
Construction
Layton Construction Company was competitively selected as the Construction Manager at Risk
(CMR) to perform Pre-Construction service and Demolition of 225 West Madison and as a result
has acquired unique knowledge of the requirements to complete the renovation of the building.
Having Layton complete the build-back of the building under a CMR delivery contract benefits
Maricopa County by reducing costs of the build-back and allows for a shorter construction
schedule. Using the CIVIR contract would allow: Layton to perform Pre-Construction Services
(constructability reviews, value engineering, scheduling, estimating and qualification of sub-
contractors), thereby reducing costs, shortening the construction schedule.
• Layton to prepare required submittals sooner.
• Layton to begin procurement of long-lead equipment, shortening construction time
• Layton to apply their unique knowledge of the facility acquired from their performing pre-
construction services and demolition, thereby reducing risk to Maricopa County
• Shortens the construction schedule and reduces cost.
• The County to potentially reduce or eliminate lease hold over costs due to the ability to move
offices to 225 W. Madison sooner.
