A RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY, PHOENIX, ARIZONA (THE
"COUNTY") AUTHORIZING EXECUTION ON BEHALF OF THE COUNTY OF A DEVELOPMENT AGREEMENT
BETWEEN THE COUNTY AND MARBELLA RANCH LIMITED PARTNERSHIP ("OWNER") COVERING THE
PROPERTY DESCRIBED HEREIN, REGARDING IMPLEMENTATION OF THE MULTI-PHASED DEVELOPMENT
KNOWN AS MARBELLA RANCH.
WHEREAS, the Board of Supervisors recognizes that it must exercise its authority to
accommodate growth in an efficient manner that protects County residents and taxpayers from undue
fiscal burdens; and
WHEREAS, Arizona Revised Statute §11-1101 provides an opportunity for counties to enter into
development agreements with to help mitigate the fiscal impacts of such development; and
WHEREAS, Owner owns certain real property comprising a total of approximately three-
hundred, twenty-seven (327) acres (the "Property"), which does not include any property owned by
the Arizona State Land Department, is within the boundaries of the County and is not currently within
the boundaries of any incorporated town or city; and
WHEREAS, Owner represents and warrants that it is the fee title owner of the Property and has
good and marketable title to the Property or otherwise has an interest in the Property as described in
Arizona Revised Statute §11-1101 B; and
WHEREAS, County wishes to enter into the Development Agreement with Owner for the multi-
phased development known as Marbella Ranch in accordance with ARS §11-251, 11-251.05 and 11-
1101 to help ensure timely and efficient development of infrastructure and services for current and
future residents of Maricopa County, and to help minimize fiscal impacts to County residents and
taxpayers;
NOW, THEREFORE, BE IT RESOLVED, the Board of Supervisors of Maricopa County authorizes execution
of the Marbella Ranch Development Agreement on behalf of the County.
