A RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY, PHOENIX, ARIZONA (THE
"COUNTY") AUTHORIZING EXECUTION ON BEHALF OF THE COUNTY OF A SUBDIVISION ASSURANCE
GAURANTY AGREEMENT BETWEEN THE COUNTY AND MARBELLA RANCH LIMITED PARTNERSHIP
("OWNER") COVERING THE PROPERTY DESCRIBED HEREIN, REGARDING ASSURANCE OF THE REQUIRED
INFRASTRUCTURE FOR DEVELOPMENT OF THE SUBDIVISION KNOWN AS MARBELLA RANCH PARCEL 2,
PHASE 1.
WHEREAS, the Board of Supervisors recognizes that it must exercise its authority to obtain
assurance of performance for provision of required infrastructure for subdivision development in an
efficient manner that protects County residents and taxpayers from undue fiscal burdens; and
WHEREAS, Arizona Revised Statute §11-822(A) allows the assurance in form acceptable to the
Board of Supervisors; and
WHEREAS, Owner owns certain real property comprising a total of approximately twenty-three
(23) acres (the "Property"), which does not include any property owned by the Arizona State Land
Department, is within the boundaries of the County and is not currently within the boundaries of any
incorporated town or city; and
WHEREAS, Owner represents and warrants that it is the fee title owner of the Property and has
good and marketable title to the Property or otherwise has an interest in the Property as described in
Arizona Revised Statute §11-1101 B; and
WHEREAS, County wishes to enter into the Subdivision Assurance Guaranty Agreement with
Owner for the subdivision known as Marbella Ranch Parcel 2, Phase 1 in accordance with ARS §11-251,
11-251.05, 11-822(A) and 11-1101 to help ensure timely and efficient development of infrastructure
and services for current and future residents of Maricopa County, and to help minimize fiscal impacts
to County residents and taxpayers;
NOW, THEREFORE, BE IT RESOLVED, the Board of Supervisors of Maricopa County authorizes execution
of the Marbella Ranch Parcel 2, Phase 1 Agreement for Guaranty of Performance on behalf of the
County.
