Dear Sir or Madam:
In our June 7, 2017 letter to you, we informed you that the Maricopa County (County)
Department of Public Health Women, Infants, and Children (WIC) Program had been informed
that their WIC clinic located on HTA-Thunderbird Medical, LLC’s (HTA) property at 5422 W.
Thunderbird Road in Glendale would not be funded in the coming 2018 Federal fiscal year. Our
letter also explained that the County was exercising its right to early termination of the lease due
to non-appropriation of funds.
The County has recently been informed that the State of Arizona Department of Health Services
(ADHS) has committed to provide the County WIC Program with funding that will allow this
location to stay open through the 2018 Federal fiscal year. Therefore, the County is revising its
notice of termination of the Lease Agreement by and between HTA as Lessor and Maricopa
County as Lessee; executed on January 21, 2005, and amended on December 15, 2010 and
September 21, 2016 respectively (Lease Agreement).
Pursuant to Section 21 of the Lease Agreement, this letter serves as written notification that
earlier today, the Maricopa County Board of Supervisors approved Agenda Item C-86-05-566-4-
06 authorizing the County Real Estate Department to issue a revised notice of early termination
of the subject Lease Agreement. The termination shall be effective September 30, 2018 due to
non-appropriation of funds. The County will contact you prior to September 30, 2018 to schedule
a walk-through and return of the leased premises.
