STATUTORY HEARINGS - AUDIENCIAS LEGALES
Air Quality
5. MARICOPA COUNTY HAZARDOUS AIR POLLUTANTS (HAPS) PROGRAM (AQ-2016-
005-RULE 372)
Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments
and consider the adoption of proposed rescission of Maricopa County Air Pollution Control
Regulations Rule 372 (Maricopa County Hazardous Air Pollutants (HAPS) Program) and
associated Appendix H (Procedures for Determining Ambient Air Concentrations for
Hazardous Air Pollutants). Following the public hearing, the Board is requested to approve
the proposed rescission of Rule 372 and associated Appendix H. Maricopa County Air
Quality Department requests that the convene public hearing date be changed to February
1, 2017. Upon Board approval, this item will become effective February 1, 2017.
The Maricopa County Air Quality Department (MCAQD) is proposing to rescind Rule 372
(Maricopa County Hazardous Air Pollutants (HAPs) Program) and associated Appendix H
(Procedures For Determining Ambient Air Concentrations For Hazardous Air Pollutants).
Rule 372 and associated Appendix H were adopted on June 6, 2007 as required by
Arizona Revised Statutes (A.R.S.) §49-480.04 (County Program For Control Of Hazardous
Air Pollutants). The rules apply to new sources of HAPs or modified sources of HAPs,

when such existing sources increase the emissions of a HAP by more than a de minimis
amount. These rules regulate HAPs that are on the federal list of HAPs - Section 112(b) of
the Clean Air Act and list de minimis levels for Maricopa County HAPs and 24 minor source
categories subject to the program. The rules are similar to and no more stringent than the
Arizona Department of Environmental Quality’s (ADEQ’s) Arizona program for the
regulation of HAPs. ADEQ’s Arizona program for the regulation of HAPs was intended to
replace the Arizona Ambient Air Quality Guidelines (AAAQG), which are health-based
guidelines/acceptable concentration levels for hazardous air pollutants that are regulated
by the State Of Arizona. The AAAQGs are not standards but residential screening values
that help agencies make sound environmental risk management decisions to protect
human health. ADEQ’s Arizona program for the regulation of HAPs (rules R18-2-1701
through R18-2-1709) expired on August 26, 2016 and is no longer in effect.
On March 20, 2008 as a result of the final judgment of the Maricopa County Superior Court
in Oak Canyon Manufacturing et al. v. Arizona State Department of Environmental Quality,
CV 2006-018439, ADEQ’s Arizona program for the regulation of HAPs is unenforceable.
The superior court held that ADEQ does not have authority to regulate de minimis amounts
of federal HAPs. Since Maricopa County’s HAPs program (Rule 372 and associated
Appendix H) is similar to and no more stringent than ADEQ’s Arizona program for the
regulation of HAPs and the superior court held that ADEQ does not have authority to
regulate de minimis amounts of federal HAPs, the MCAQD is proposing to rescind Rule
372 and associated Appendix H.
The federal HAPs standards at 40 Code of Federal Regulations Part 61 and Part 63, which
are incorporated by reference in Maricopa County Air Pollution Control Regulations Rule
370 (Federal Hazardous Air Pollutant Program), are separate and independent from
Maricopa County’s HAPs program (Rule 372 and associated Appendix H) and remain fully
enforceable. Sources of federal HAPs in Maricopa County remain obligated to comply with
any applicable requirements of the federal program. Permit fees are not changing due to
this action. (C-85-17-016-M-00)

7. MOBILE FOOD (EROP CASE ES-2016-001)
Pursuant to A.R.S. §11-251.08 and A.R.S. § 36-184(B)(5), convene the scheduled public
hearing, to solicit comments and consider the adoption of Fee related proposed revisions
to Maricopa County Environmental Health Code (MCEHC) Chapters I and VIII. Upon Board
approval, this item will become effective February 1, 2017.
The Maricopa County Board of Health (BOH) reviewed and approved revisions to MCEHC
Chapters I and VIII (EROP Case ES-2016-001/Mobile Food) as an Enhanced Regulatory
Outreach Program (EROP) expedited case at a public meeting held on Monday, October
24, 2016, at the Board of Supervisors Conference Room, 301 West Jefferson Avenue, 10th
Floor, Phoenix, Arizona 85003. The report to the BOH outlines proposed revisions to the
MCEHC and is accessible at ES-2016-001/Mobile Food Staff Report.
This proposed revision to MCEHC Chapters I and VIII increases opportunities for business
owners while ensuring public health and safety are maintained. Furthermore, clarification of
existing definitions, requirements and terminology would occur to help streamline the
permitting process. Revisions include updating permit definitions (e.g. those for Food
Establishment, Retail Food Establishment and Mobile Food Establishment),
organizing/revising Mobile Food Establishment code for readability, and revising permit
titles, e.g. Food Peddler to Mobile Food Type I, Pushcart to Mobile Food Type II, and
Mobile Food Unit to Mobile Food Type III. Additional proposed permit title updates include:
Itinerant (Temporary) to Temporary Food Establishment, Seasonal Food Establishment to
Seasonal Food Establishment/Annual Event Food Establishment, Food Service Manager
to Certified Food Protection Manager, card to certificate or Limited Use Certificate, and
Food Service Worker to Food Employee or Limited Use Food Employee.
Proposed updates do not increase permit fees. Fee Schedule text changes for the above
permit titles (including permit durations) are proposed. Plus, Fee Schedule deletions for
Food Service Worker Card exam and class, each with a $10.00 fee will be eliminated. In
addition, the Food Peddler 6 month permit, proposed as the Mobile Food Type I - 6 month
fee ($60.00), is included in the Fee Schedule to agree with MCEHC Chapter VIII language
that states the 6 month Food Peddler fee is half the cost of the 1 year permit. (C-88-17-

8. COUNTY ASSESSOR REQUEST FOR REVIEW OVER BASELINE
Approve an exception to FY18 Budgeting Guidelines and Priorities allowing the Office of
Management & Budget to review the following request over baseline:
An increase of $191,000 to help fund the Legal Class Verification Program (Operating
Expense, Fund 100)
An increase of $850,000 to fund the Appraiser Market Study/Adjustments (Operating
Expense, Fund 100)
We are requesting funding of $191,000 to help fund the Legal Class Verification Program
(LCV). LCV program is an Unfunded Mandate requiring the Assessors to look property
owners that have rental properties, second homes or multiple properties that are classified
as Legal Class 3. Class 3 properties are eligible for Property Tax State Aid Credit of up to
$600 each property. We are estimating that we have saved the State $38 million since
FY12 and we are estimating additional revenue of $2 million to the County General Fund
through the Civil Penalty phase. We are looking to change our internal focus from
processing to quality assurance. We plan on outsourcing document preparation, printing
and processing while internally focusing on ownership research, address verification and
data integrity.
The County Human Resources completed the Appraiser Market Study and it was
determined that all Appraiser Market Ranges are below market by 8-10%. $850,000 is the
estimated cost of implementation of the study findings. We will work with County HR and
OMB on the placement in range process. We are committed on funding a portion of these
market adjustments through the elimination of vacant positions. (C-12-17-003-M-00)
Supervisor Hickman noted the importance of the budget and the elimination of vacant
positions. He is looking forward to the Assessor’s strategy for this issue.
Supervisor Chucri concurred with Supervisor Hickman’s comments and added there is a
constant strain and need to provide more with less dollars without raising taxes.

The Parties desire to develop and implement a cooperative process that will allow the
Parties to provide joint coordination efforts (exchange of services) through the County
Adopt-a-Highway Volunteer Program (“AAH Program”) where shared roadway right-of-way
exists due to annexations by the City. The AAH Program is designed for individuals or
organizations who desire to provide volunteer clean-up activities within their community.

Agreement (the “LOA” or “LOAs”). The Parties desire to authorize the County
Transportation Director (or their designee) and the City’s designee to enter into separate

63. REGIONAL TRANSPORTATION PLAN PERFORMANCE AUDIT (PROP. 400)
RECOMMENDATIONS
Approve the Board’s concurrence with the Auditor General’s Performance Audit of the
Maricopa County Regional Transportation Plan (Prop. 400) and forward a letter confirming
the Board’s action to the Maricopa Association of Governments (MAG) Transportation
Policy Committee.
The enabling statutes for Proposition 400 require that beginning in 2010 and every five
years thereafter, that the Arizona Auditor General hire an independent auditor with
expertise in multimodal transportation systems and regional transportation planning to
conduct a performance audit of the regional transportation system.
The first audit was conducted in 2011. The second audit has now been concluded and is
available for review at www.azauditor.gov. The Auditors concluded that based on the audit
work performed, there are no significant changes warranted for the transportation system.
Per A.R.S. §28-6313 the Board of Supervisors is required to submit written
recommendations to the MAG Transportation Policy Committee that the findings are
agreed to or disagreed with and the recommendations should be implemented,
implemented with modification or not be implemented.
None of the findings or recommendations are directed at Maricopa County or have a
negative impact on the county. A proposed letter of concurrence is attached should the
Board approve this request. All Supervisory Districts. (C-64-17-076-M-00)
