County Department of Transportation. Said Development Agreement shall be consistent
with the provisions as outlined in Stipulation “ee.4” of DMP2002005. This agreement shall

improvements referenced in stipulation “c.6” below. The Preliminary Plat in process under
S2005020 shall not be approved until the Development Agreement is executed.
c. The following Maricopa County Department of Transportation (MCDOT) stipulations shall
apply:
1. A revised Traffic Impact Statement (TIS) was received May 5, 2006. The TIS shall
comply with MCDOT requirements and shall address development phasing and the offsite

the applicant shall pay the contribution amount at the time individual building permits are
issued, or per an alternate agreement as approved by MCDOT.
7. If required per item #6, a development agreement shall be executed prior to any zoning

process.
16. The applicant shall design landscaping to comply with all MCDOT requirements and to
conform to Chapter 9 of the MCDOT Roadway Design Manual. The developer (or as
assigned to the Home Owner’s Association) shall be responsible for maintenance of
landscaping within public rights-of-way.
17. The applicant shall provide a construction traffic circulation plan. The construction
traffic circulation plan must be approved by MCDOT prior to commencing construction.

19. Prior to issuance of any permits for development of the site, the applicant shall obtain
the necessary encroachment permits from the Maricopa County Department of

Historic Preservation Office prior to issuance of a Grading Permit. The applicant must
contact the State office prior to initiating disturbance of the site. The applicant shall provide
the Planning and Development Department with written proof of compliance with this
stipulation.
f. Prior to the approval of the first Final Plat, the developer shall obtain from the Maricopa
County Environmental Services Department Approvals to Construct for all required onsite
and offsite water and sewer lines.
g. Prior to the development or issuance of any building permits for property located within a
regulated Floodplain, the developer shall obtain a Floodplain Use Permit from the
Regulatory Division of the Maricopa County Flood Control District.
h. Prior to the approval of any Final Plat, the developer shall obtain a Certificate of 100-
Year Assured Water Supply from the Arizona Department of Water Resources.

department. Prior to Final Plat approval, the developer shall seek review and comment
from the applicable fire protection agency, and shall provide written confirmation that the
site will be developed in accordance with their requirements.
l. Prior to Final Plat, developer(s) and/or builder(s) shall establish emergency fire protection
services, covering all real property contained within the project area during course of
construction and shall obtain a ‘will serve’ letter substantiating coverage from the
appropriate Fire Department servicing the site.
m. The master developer shall notify future homeowners that they are located within the
state-defined “territory in the vicinity of a military airport” with the following language:
“You are buying a home or property in the ‘vicinity of a military airport’ as described by
State of Arizona statute A.R.S. §28-8481. Your house should include sound attenuation
measures as directed by State law. You will be subject to direct over flights and noise by
Luke Air Force Base jet aircraft in the vicinity.
Luke Air Force Base executes over 200,000 flight operations per year, at an average of
approximately 170 overflights per day. Although Luke's primary flight paths are located
within 20 miles from the base, jet noise will be apparent throughout the area as aircraft
transient to and from the Barry M. Goldwater Gunnery Range and other flight training
areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky
conditions due to noise reflections off the clouds.
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these hours
and during most weekends.
Luke Air Force Base Auxiliary Field 1, located approximately 15 miles to the northwest of
Luke Air Force Base is a site of intense instrument procedure landing approaches, with
approximately 12,000 flight operations per year. Aircraft will descend down to 200 feet
above the ground over the Auxiliary Airfield and will create severe noise in that area.
For further information, please check the Luke Air Force Base website at
www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and
Development Department.”
Such notification shall be recorded on all Final Plats, be permanently posted on not less
than a 3 foot by 5 foot sign in front of all home sales offices, be permanently posted on the
front door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be
included in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report
and conveyance documents.
n. All habitable buildings constructed within this subdivision shall be constructed to attain a
noise reduction level as per ARS § 28-8482(B).
o. Major changes to the zoning exhibit and narrative report shall be processed as a revised
application, with approval by the Board of Supervisors upon recommendation of the
Planning and Zoning Commission. Minor changes may be administratively approved by the
Planning and Development Department. Major changes to the project may require a new
Citizen Participation Process as determined by the Planning and Development
Department.
p. Noncompliance with the conditions of approval will be treated as a violation in

Elections - Elecciones
11. ELECTIONS REQUEST FOR REVIEW OVER BASELINE
Approve an exception to FY18 Budgeting Guidelines and Priorities allowing the Office of
Management & Budget to review the following request over baseline:
An increase of $137,615 to fund eight additional positions in Elections in FY 2018 (Full year
impact is $420,412 in FY 2019).
We are requesting funding of $137,615 to help fund eight additional positions in the
Elections Department beginning March 2018. All of the positions requested are in answer
to allowing the department to maintain a level of individuals on staff that are “subject matter
experts” and that is critical to the integrity of an election.
At present and with the limited permanent staff, we cannot manage certain processes
beyond a singular shift and have, in the past, had to rely on extended hours (upwards of
13-15 hour shifts) for our current permanent staff during any countywide elections. To
move away from this practice, the additional positions requested would allow the
department to move into a “shift” format when called for during major countywide elections
- all while still providing for supervision and oversight by permanent “subject matter”
leadership. Without these positions, the “shift” format cannot occur and the already lean
election staffing in place does not allow for us to manage the process effectively and
efficiently as it can be achieved. (C-21-17-009-2-00)
Adrian Fontes, Recorder, stated items 11 and 12 are requests to meet with the Office of
Management and Budget Department.
Chairman Barney thanked Mr. Fontes for attending the meeting. He stated he
understands the need but noted the challenge of requests for $38 million over baseline
when all departments have not turned in their budgets.
Supervisor Hickman stated the Board will continue to look into all budget requests.

Approve an exception to FY18 Budgeting Guidelines and Priorities allowing the Office of
Management & Budget to review the following request over baseline:
An increase of $88,511 to fund an additional position in the Office of the Recorder.
We are requesting funding of $88,511 for an additional position in the Office of the
Recorder. The position requested is in answer to the restructuring of the Administrative
Services Division. The position will be responsible for reviewing and auditing departmental

THE 2013 INVESTING IN INNOVATION FUND
Approve grant award notification No. 6 from the U.S. Department of Education increasing
the Investing in Innovation Fund (I3) award by $4,518.00 from $2,995,482 to $3,000,000.

$395,519 for Prison Re-entry Supervision
The increasing population under Adult Probation supervision continues to increase the
caseloads for Probation Officers beyond the previously agreed upon workload levels for
safe operations. This increase in staffing and the supporting equipment will help the
department address the additional workload that has been created by the current pre and
post decree adjudication requirements (i.e. Pre-trial / Pre-sentence Reports and the Post-
conviction Probation Tails that are required. (C-11-17-007-M-00)
Supervisor Churci stated it is troubling when you continue to receive the requests to go
over the baseline. It indicates that we have a strain on the County and we must
remember it is “needs” over “wants”.
Chairman Barney stated the reality is that this is not an easy decision. Every office looks
at their own budget in isolation, but the Board must look at the entire budget as a whole.
Supervisor Gates stated everyone should be proud of the condition of the County. It is
through hard work that the County is in a great financial position.

Department of Homeland Security, FFY17 SHSGP, in the not-to-exceed amount of
$8,000.00 for Satellite Connectivity. The grant period for this grant is October 1, 2017
through September 30, 2018. The Maricopa County Department of Finance has calculated

Emergency Management is responsible for implementing the County’s Emergency
Operations Plan (EOP) for responding to disasters within Maricopa County.
Telecommunications are an integral part in that response as MCDEM hosts a Crises
Information Management System to our response partners. The fixed site satellite
connection will provide a backup to our main telecommunication connection at the
Emergency Operations Center. Using a satellite connection will decrease the likelihood the
Emergency Operations Center (EOC) would be down due to a commercial
telecommunications outage whether through natural or man-made causes. The mobile
satellite connection will provide telecommunications for Reception Center or Shelter sites
that will be coordinated by the department and can be leveraged for Continuity of
Operations Plans (COOPs) by the department due to un-inhabitable conditions of the EOC
whether during a response or steady state. (C-15-17-001-G-00)

58. PRIMITIVE CAMPGROUNDS PROPOSED REVISIONS TO CHAPTER XII OF THE
MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE (ES-2016-002)
Pursuant to A.R.S. §11-251.05 and A.R.S. §36-184(B)(5), set a public hearing for March 8,
2017 to solicit comments and consider the adoption of proposed revisions to Maricopa
County Environmental Health Code (MCEHC) Chapter XII (EROP Case ES-2016-
002/Primitive Campgrounds). This item will become effective upon Board of Supervisors
approval.
The Maricopa County Board of Health (BOH) reviewed and approved revisions to MCEHC
Chapter XII (EROP Case ES-2016-002/Primitive Campgrounds) as an EROP expedited
case at a public meeting held on Monday, January 23, 2017, at the Board of Supervisors
Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The
report to the BOH outlines proposed revisions to the MCEHC and is accessible at ES-
2016-002/Primitive Campgrounds Staff Report.
This revision will align MCEHC Chapter XII with the recently enacted Primitive
Campgrounds statutory update, Arizona Revised Statute (A.R.S.) §36-183.02. A.R.S. §36-
183.02 includes an exemption for Primitive Campgrounds, which by definition are remote in
nature. To mesh with the A.R.S. update, new MCEHC Chapter XII language is proposed
that will exempt Primitive Campgrounds from water, electricity and sewer public
infrastructure requirements.
This MCEHC revision proposal is following the EROP policy and workflow process, without
added fees. (C-88-17-008-L-00)

59. FARMERS MARKET PROPOSED REVISIONS TO CHAPTER VIII OF THE MARICOPA
COUNTY ENVIRONMENTAL HEALTH CODE (ES-2016-003)
Pursuant to A.R.S. § 11-251.05 and A.R.S. §36-184(B)(5), set a public hearing for March 8,
2017 to solicit comments and consider the adoption of proposed revisions to Maricopa
County Environmental Health Code (MCEHC) Chapter VIII (EROP Case ES-2016-
003/Farmers Market). This item will become effective upon Board of Supervisors approval.
The Maricopa County Board of Health (BOH) reviewed and approved revisions to MCEHC
Chapter VIII (EROP Case ES-2016-003/Farmers Market) as an EROP expedited case at a
public meeting held on Monday, January 23, 2017, at the Board of Supervisors Conference
Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The report to the
BOH outlines proposed revisions to the MCEHC and is accessible at ES-2016-
003/Farmers Market Staff Report.
This proposal adds a farmer’s market coordinator and increases business owner market
opportunities. The coordinator will submit documentation to the Department, be present
during farmer’s market operating hours, and ensure certain sanitary measures are applied.
Coordinator oversight of sanitary measures (e.g. hand sink design and application), will
provide food venders the opportunity to utilize temporary hand wash stations in lieu of
having installed units. By allowing greater flexibility under coordinator direction; this
proposal increases opportunities for business owners while ensuring public health and
safety are maintained.

60. CERTIFIED FOOD MANAGER (CHAPTERS I AND VII CFM) PROPOSED REVISIONS
TO CHAPTER VIII OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE
(ES-2016-004)
Pursuant to A.R.S. §11-251.05 and A.R.S. §36-184(B)(5), set a public hearing for March 8,
2017 to solicit comments and consider the adoption of Enhanced Regulatory Outreach
Program (EROP) Case ES-2016-004/Chapters I and VII Certified Food Manager (CFM).
Upon Board approval, this item will become effective March 8, 2017.
The Maricopa County Board of Health (BOH) reviewed and approved revisions to Maricopa
County Environmental Health Code (MCEHC) Chapters I and VII (EROP Case ES-2016-
004/Chapters I and VII CFM) as an EROP expedited case at a public meeting held on
Monday, January 23, 2017, at the Board of Supervisors Conference Room, 301 West
Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The report to the BOH outlines
proposed revisions to the MCEHC and is accessible at ES-2016-004/Chapters I and VII
CFM Staff Report.
The MCEHC Chapters I and VII CFM proposal eliminates Department issued Certified
Food Manager cards. Also, this proposal clarifies when food establishments are exempt
from the Certified Food Protection Manager requirement. Currently, a card is issued by the
Department after each manager travels to a regional office and shares his/her certificate for
passing an approved Food Protection Manager training. Upon this proposal’s BOS
approval, the Certified Food Manager card and $5 fee will be discontinued; thereby, saving
food managers $5 and a commute while ensuring public health and safety are maintained.
Additional proposal updates include eliminating the Certified Food Protection Manager
duplicate card with the $3 fee, and adding certificate text for training clarification.
This MCEHC revision proposal is following Maricopa County’s Enhanced Regulatory
Outreach Program (EROP) policy without added fees; it will eliminate a fee. (C-88-17-009-

62. PROPOSED REVISIONS OF THE MARICOPA COUNTY PARKS AND RECREATION
DEPARTMENT USER FEE SCHEDULE
Pursuant to A.R.S. §11-251.08 and 11-251.13, set a public hearing for April 26, 2017 to
solicit comments and consider the adoption of proposed changes to the Maricopa County
Parks and Recreation Department User Fee Schedule. Upon Board approval, this item will
become effective May 1, 2017.
By this action, the Department wishes to:
1. adopt a $5/person general admission fee for users of the Hassayampa River Preserve
Conservation area for users over 12 years old;
2. remove the room restriction on the meeting room fee, thereby allow meeting room fees
charged to be consistent across the park system.
Upon Board approval, these fee changes will become effective May 1, 2017, except as to
members of the Friends of Hassayampa and The Nature Conservancy who will pay the
new fees on January 1, 2018 as more fully detailed below.
The adoption of a Hassayampa River Preserve entrance fee is in anticipation of the
transfer of the Hassayampa River Preserve property from The Nature Conservancy (TNC)
to the County by the end of April. Upon closing, the County will begin full operations and
maintenance of the Preserve. TNC currently charges $5.00 per person admission for the
general public; $3.00 per adult for TNC members with children 12 and under admitted free;
and free entry for each member of the Friends of Hassayampa and holders of a TNC,
Arizona Chapter Pass (limit 2 adults/pass). Maricopa County proposes one fee for all
parties; $5.00 per person with children under 12 admitted for free. However, pursuant to
the County’s Operations Plan with TNC, current members of Friends of Hassayampa,
holders of TNC, Arizona Chapter Passes and TNC Members, will pay fees currently
charged by TNC through December 31, 2017. After that time, general admission fee will be
$5.00/person for all entrants, except children 12 and under are free. This entry fee and the
remaining fee changes will enable the Department to apply any changes in fees to off-set
park operations and maintenance.
The Parks and Recreation Commission held a public meeting regarding the proposed fee
revisions on September 20, 2016. No comments were received from the public. The
meeting was advertised on the Parks’ website and in the parks. Changes to the Parks’ fees
schedule must be scheduled for public hearing pursuant to A.R.S. §§11-251.08 and 11-
251.13. (C-30-17-020-M-00)

individual who was alleged to have been injured in a motor vehicle accident. A third-party
recovery was obtained from the alleged tortfeasor by the injured party; however, recovery
was substantially less than the claims paid. Compromise of the County’s lien must be

A-2. JAMES MICHAEL HUMPHREY AND CHASE QUINN V. STATE OF ARIZONA (CV2011-
091958)
Authorize the Maricopa County Attorney’s Office (MCAO) to file an Amicus Curiae (“friend
of the court”) brief in support of the State of Arizona’s Appeal on the issues:
(1) Statute of Limitations and Accrual of a Cause of Action. Accrual is not delayed until the
claimant has secured evidence supporting negligence;
rather, a claim accrues once the claimant knows he or she has been injured and knows or
should know the cause, source, act, event, instrumentality, or condition that caused or
contributed to the injury (that’s it); and
(2) Absolute Immunity Statute. The immunity statute applies to governmental decisions not
to act (e.g., not installing a median barrier or traffic signal at a specific location) when that
“decision by default” automatically flows from a broader legislative or administrative act that
set specific criteria for determining when to act in the future.

F-2. AGREEMENT WITH U.S. DEPARTMENT OF AGRICULTURE, NATURAL RESOURCES
CONSERVATION SERVICE FOR VINEYARD ROAD FLOOD RETARDING STRUCTURE
REHABILITATION PROJECT
Approve the Operation and Maintenance (O&M) Agreement (Agreement) between the U.S.
Department of Agriculture Natural Resources Conservation Service (NRCS) and the Flood
Control District of Maricopa County (District) for the Vineyard Road Flood Retarding
Structure (Vineyard FRS) Rehabilitation Project (Project). The NRCS and District agree to
carry out the terms of the O&M Agreement, which defines the responsibilities for operating,
inspecting, and maintaining rehabilitation work completed for the Vineyard FRS and existing
structure features. This Agreement is to be followed by a detailed O&M Plan to be
developed and approved at a later date prior to final construction of the Project. The
Agreement shall become effective when signed by both parties.
A number of dam safety issues which require correction have been identified at Vineyard
FRS and overall rehabilitation of the dam best meets District goals and objectives related to
dam safety and public safety. This Agreement is required by the NRCS funding authorization
process and for reimbursements of construction costs, prior to the construction of dam
rehabilitation projects. This item impacts Supervisorial District 1. (C-69-17-021-3-00)

F-3. CHANGE ORDER TO CONTRACT WITH STANTEC CONSULTING INC. FOR

Formal Meeting Minutes

POWERLINE, VINEYARD ROAD, AND RITTENHOUSE FLOOD RETARDING
STRUCTURES ON-CALL DESIGN PROJECT
Approve Change Order No. 3 for Contract FCD 2013C004 – Powerline, Vineyard Road, and
Rittenhouse Flood Retarding Structures (FRS) On-Call Design Project (Project) to Stantec
Consulting, Inc. Change Order No. 3 adds funds in the amount of $1,100,000 to the existing
contract. Timing and funding for these projects has caused the design and construction for
the Vineyard and Powerline structures to be split into multiple phases. This has caused a
need for additional funding to complete the designs of Vineyard Road FRS Phases 2B and 3
as well as for two additional phases of the Powerline Channel. Post design engineering
services for construction of Phases 2A, Powerline Channel, and Powerline Channel
Segment 5 are also included in Change Order No. 3. These additional funds will bring the
total design contract value to $6,600,000 which is 7.2% of the total construction cost for
these projects and includes;
• Projects design cost
• Cost of geotechnical investigations for design
• Post Design Services for; Vineyard Phase 1, Vineyard Phase 2A, Powerline Channel
Phase 1 and Powerline Channel Segment 5
The Powerline, Vineyard Road, and Rittenhouse Flood Retarding Structures (PVR FRS) are
three flood control dams that were all designed and built by the Soil Conservation Service
(now the Natural Resources Conservation Service – NRCS). The PVR FRS are located in
northwest Pinal County, south of Apache Junction. They lie on the east side of the Central
Arizona Project canal (CAP), and extend south from approximately Baseline Road to the
Ocotillo Road alignment, which is approximately 12 miles in length.
These structures provide flood protection to Maricopa County for residential, commercial
and agricultural areas as well as critical public facilities and infrastructure such as: Williams
Gateway Airport, San Tan Freeway (202), other public roadways, railroads and the CAP
Canal. The ability of the PVR FRS to maintain the current level of protection in the long-term
for the benefit of the public in an increasingly urbanized environment is in question due to
significant concerns regarding aging infrastructure, land subsidence, earth fissuring,
urbanization encroachment and current dam safety standards. These dam safety issues
have led the Flood Control District of Maricopa County (District) to determine that an overall
rehabilitation of the dams is required. This Project protects area located in Supervisorial
District 1. (C-69-14-028-5-02)
