AMENDMENT TO PROGRAMMATIC AGREEMENT WITH CITY OF GLENDALE AND STATE HISTORIC PRESERVATION OFFICE FOR HUD-FUNDED PROGRAM ACTIVITIES Approve as a concurring party, a non-financial Amendment No. 1 to the Programmatic Agreement between the City of Glendale (City) and the State Historic Preservation Office (SHPO) governing the environmental clearance of U.S. Department of Housing and Urban Development (HUD) funded program activities. Concurrence by the Board of Supervisors is required by SHPO because the City of Formal Meeting Minutes Wednesday, April 12, 2017 Page 28 of 57 Glendale receives HUD HOME Investment Partnerships Program (HOME) grant funds through the Maricopa HOME Consortium. Maricopa County is the lead agency of the Maricopa HOME Consortium and, as such, serves as the certifying agency on all environmental clearances under the HOME program. Approving and signing the Amendment as a concurring party does not subject the Board to any additional responsibility or liability under the HUD regulations. The City and SHPO agree to amend as follows: a. Preamble to include a Discovery clause in statement five (5) to become an integral part of this Amendment; b. Applicability of Agreement: Addition of Exhibit L in the agreement for Infill and Replacement Housing utilizing HOME funds; c. Ratification of Agreement: City and State hereby agree that, except as expressly provided herein, the provisions of the Agreement will be and remain in full force and effect, and that if any provision of this Amendment conflicts with the Agreement, then the provisions of this Amendment will prevail. The Amendment requires the Board’s signature as a concurring party. HUD regulations require an environmental clearance on any activities undertaken with HOME funds. For all properties that are 50 years old or older, or that are listed on a historical register, SHPO must be consulted in order to determine whether the property is of historical significance and whether the property will be adversely affected by the investment of the HOME funds. SHPO allows any local government that has its own Historic Preservation Office or Commission to enter into a programmatic agreement that will allow the local Historic Preservation Office or Commission to determine the historical significance of local properties without a specific concurrence from SHPO. The City and the County cooperate in performing environmental reviews within the geographic boundaries of the City for HOME-funded HUD projects in accordance with the National Environmental Policy Act (NEPA), 24 CFR Part 58 and the related laws and authorities, listed at sections 58.5 and 58.6, including responsibilities under Section 106 of the NEPA. The County shall delegate and the City agrees to assume all Section 106 responsibility as required by 24 CFR Part 58.1 for all undertakings of HOME-funded HUD projects. The County remains the lead agency and will have ultimate responsibility, in concurrence with SHPO, for determining whether projects have or do not have a potential effect on historic properties in the environmental review process for projects funded by HOME funds. This Amendment to the Programmatic Agreement is subject to and incorporates by reference the statutory language of A.R.S. §38-511. REVISIONS TO REASONABLY AVAILABLE CONTROL TECHNOLOGY STATE IMPLEMENTATION PLAN AND NEGATIVE DECLARATIONS Pursuant to A.R.S. §49-479(b), set a public hearing for May 24, 2017, to solicit comments and consider the adoption of the submittal of the Reasonably Available Control Technology (RACT) State Implementation Plan (SIP) and negative declarations to the U.S. Environmental Protection Agency (EPA) as a revision to the (Arizona) SIP. Following the public hearing, the Board is requested to approve the submittal of the RACT SIP and negative declarations to the EPA as a revision to the (Arizona) SIP. Upon Board approval, this item will become effective May 24, 2017. Formal Meeting Minutes Wednesday, April 12, 2017 Page 42 of 57 The RACT SIP is an analysis made by the Maricopa County Air Quality Department (MCAQD) that concludes that the MCAQD has fulfilled the requirements of RACT, as applicable to the 2008 eight-hour ozone national ambient air quality standards (NAAQS) for all Control Techniques Guidelines (CTG) source categories and for all major sources of volatile organic compounds (VOCs) and nitrogen oxides (NOx). RACT is the lowest emissions limitation that a particular source is capable of meeting by the application of control technology that is reasonably available considering technological and economic feasibility. CTGs, issued by the EPA, are intended to provide States information that should assist them in determining RACT for source categories. In instances where either there were no sources in Maricopa County in a particular CTG source category or where there were no sources exceeding the CTG applicability threshold, the MCAQD made a negative declaration regarding such CTG source category; negative declarations are included in the RACT SIP. Permit fees are not changing due to this action. (C-85-17-018-M-00) Motion to approve by Supervisor Chucri, seconded by Supervisor Hickman Ayes: Barney, Chucri, Gates, Hickman, Gallardo 77. SUBMITTAL OF EMISSION GUIDELINES PLAN Pursuant to A.R.S. §49-479(b), set a public hearing for May 24, 2017 to solicit comments and consider the adoption of the submittal of a CAA Section 111(d) Plan to the U.S. Environmental Protection Agency (EPA) for implementing the municipal solid waste landfills emission guidelines (40 CFR Part 60, Subpart Cf (Emission Guidelines And Compliance Times For Municipal Solid Waste Landfills)). Following the public hearing, the Board is requested to approve the submittal of the CAA Section 111(d) Plan to the EPA. Upon Board approval, this item will become effective May 24, 2017. CAA Section 111 establishes a mechanism for controlling air pollution from 70 stationary source categories. CAA Section 111(d) establishes procedures, i.e., emission guidelines, for five (5) source categories, one of which is municipal solid waste (MSW) landfills. Emission guidelines establish procedures for States to submit a plan identifying sources in a source category and a program that provides for the implementation and enforcement of standards of performance for such sources in a source category. On August 29, 2016, the EPA promulgated emission guidelines for MSW landfills under CAA Section 111(d). The emission guidelines set forth specific mechanisms and requirements for controlling emissions of non-methane organic compounds (NMOC). The emission guidelines are codified at Title 40 of the Code of Federal Regulations, Part 60, Subpart Cf. The emission guidelines require States to submit to the EPA by May 30, 2017, a plan to implement the emission guidelines. For the purposes of the CAA Section 111(d) Plan, the MCAQD is considered a “State”. The CAA Section 111(d) Plans submitted to EPA must include elements described in EPA regulations, including 40 CFR Part 60, Subparts B and Cf, and in the EPA guidance document, “Municipal Solid Waste Landfills, Volume 2”. Such plan elements include: (1) Identification of enforceable mechanisms for implementing the EPA emission guidelines; (2) The MCAQD’s legal authority to carry out the CAA Section 111(d) Plan; (3) An inventory of existing municipal solid waste landfills; (4) An inventory of emissions from existing MSW landfills; (5) Emission standards for existing MSW landfills that are no less stringent than those in the emission guidelines; (6) The MCAQD process, for review and approval of site-specific gas collection and control system design plans; (7) Compliance schedules; (8) Testing, monitoring, recordkeeping, and reporting requirements; (9) A record of public hearing(s); and (10) Provision for annual MCAQD progress reports. Details for Formal Meeting Minutes Wednesday, April 12, 2017 Page 43 of 57 these elements can found in 40 CFR Part 60, Subparts B and Cf. The MCAQD has prepared the CAA Section 111(d) Plan that includes the elements described in EPA regulations, including 40 CFR Part 60, Subparts B and Cf and in the EPA guidance document, “Municipal Solid Waste Landfills, Volume 2”. Upon Board approval, the MCAQD will submit the CAA Section 111(d) Plan to the EPA by the EPA’s deadline of May 30, 2017. To implement the CAA Section 111(d) Plan, the MCAQD proposes to revise Maricopa County Air Pollution Control Regulations Rule 321 (Municipal Solid Waste Landfills). The rulemaking process to revise Rule 321 will follow the Enhanced Regulatory Outreach Program Policy and workflow process. Stakeholder Workshops will tentatively begin in May/June 2017 and a public hearing will tentatively be conducted in December 2017. The MCAQD is proposing to revise Rule 321 to reflect the requirements in 40 CFR 60, Subparts Cf and XXX. The proposed revisions will include changing the applicability of the rule to “…existing MSW landfills that commenced construction, modification, or reconstruction on or before July 17, 2014” and changing the standards of performance for collections and control system design plan, design capacity report, and non-methane organic compound emission rate report. The proposed revisions to Rule 321 would not take effect should 40 CFR 60, Subparts Cf and/or XXX be stayed, repealed, or rendered unenforceable or void as a result of any action by a federal court, Congress, or a new final action by the EPA and the proposed revision to Rule 321 would not take effect until the EPA approves the CAA Section 111(d) Plan. Permit fees are not changing due to this action. The purpose of this amendment is to modify the federal cost share to this agreement. A total of $6,500,000 is to be de-obligated from the current federal funding allocation. In January 2008 the District Board of Directors adopted Resolution FCD2008R019 authorizing the Project and for the District to negotiate project IGAs with NRCS. In August 2013 the District Board of Directors approved the Supplemental Watershed Agreement (FCD 2013A005) with NRCS for the Supplemental Watershed Plan / Environmental Assessment (EA) for the Powerline FRS. This Supplemental Watershed Plan EA allows for the alternative that has been selected (the Project) to move forward to final design and construction. In August 2014 the District Board of Directors approved IGA FCD 2014A008 which established FCD and NRCS responsibilities and cost shares for the Project design, right-of- way acquisition, construction, construction management, and operations and maintenance. The IGA also obligated federal funding to the project. This item impacts Supervisorial Districts 1 & 2. (C-69-15-002-3-01) No action was taken on this item. Item was withdrawn by department. F-2. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF TRANSPORTATION TO REDEFINE WARNING RESPONSIBILITY FOR RED MOUNTAIN FREEWAY FROM UNIVERSITY DRIVE TO POWER ROAD Approve Intergovernmental Agreement (IGA) FCD 2004A009 Amendment No. 3 to transfer initial warning responsibility of a hazardous flood condition affecting the Red Mountain Freeway – University Dr. to Power Rd., from the Arizona Department of Transportation (ADOT) to the Flood Control District of Maricopa County (FCDMC). The Red Mountain Freeway/Spook Hill FRS IGA (2004A009) between the State (ADOT) and FCDMC was recorded in 2005. Section IV of the Agreement, 1. o), 2nd bullet states “ The State will be responsible for implementation of all Freeway Emergency Action Plan measures during PROJECT and REHABILITATION WORK construction and for as long as State operates the Power Road to University Drive section of the Red Mountain Freeway except as may otherwise be negotiated by formal agreement between the State and the Formal Meeting Minutes Wednesday, April 12, 2017 Page 54 of 57 FCDMC.” One of the “measures” involves the recognition and notification of a hazardous flood condition that could impact and result in the temporary closure of the Red Mountain Freeway from University Dr. to Power Rd. To this point in time ADOT has been responsible for recognition and notification of flood threat. FCDMC requests that the responsibility for recognition and notification of a flood threat be transferred from ADOT for the following reasons: 1. FCDMC monitors Spook Hill FRS in the course of its normal operations anyway, so we’re already watching the freeway levee as well (see Figure 1). 2. FCDMC has provided courtesy calls to ADOT when warning criteria are met during past significant rain events. In some cases they were not aware of a problem. 3. Through experience, available technology and training FCDMC flood warning staff are better equipped to recognize and react to significant rain events than ADOT staff. 4. FCDMC recently completed a communications upgrade to their flood warning gauges. It would represent a significant expense for ADOT to upgrade radio reception and computer software in order to receive the necessary data. This Agenda Item impacts Supervisorial District 2.
