Report to the Board of Supervisors Prepared by the Maricopa County Planning and Development Department Board Hearing Date: June 21, 2017 Case #/Title: Z2016086 – Apache Super Storage Supervisor District: 2 Applicant & Owner: Nate Wadsworth Request: Zone change from R-5 and C-3 to C-3 Commercial Unit Plan of Development (CUPD) overlay Site Location: Generally located north of Main Street, approximately 420 feet west of the Loop 202 freeway in the east Mesa area Site Size: Approximately 2.11 acres County Island Status: No Additional Comments: All concerns from reviewing County agencies are addressed with recommended conditions. Commission Recommendation: On 5/25/17, the Commission voted 6-0 to recommend approval of Z2016086 subject to conditions ‘a’ – ‘h’: a. Development of the site shall comply with the exhibit entitled “Apache Super Storage Site Plan”, consisting of 1 full-size sheet, dated March 29, 2017 and stamped received May 2, 2017 except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “Zone Change with Overlay – Narrative Report”, consisting of 7 pages, dated March 23, 2017, and stamped received April 3, 2017 except as modified by the following conditions. c. The applicant/property owner shall submit a ‘will serve’ letter from Rural Metro for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. d. The following conditions from Maricopa County Environmental Services Department (MCESD) shall apply: 1. Development and engineering design shall be in conformance with the Maricopa County Stormwater Quality Management and Discharge Control Regulation. It is required, the owner/developer to prepare a SWPPP and June 21, 2017 Z2016086 Page 1 of 3 obtain approval by MCESD prior to construction permit issuance. (A separate submittal to MCESD would be required.) It is required, upon completion of construction, the owner to fulfill MCESD requirements and obtain a post-construction stormwater permit. A Commercial Unit Plan of Development (CUPD) shall be applied to this site. The CUPD shall vary development standards with regard to parking standards for the indoor storage facilities. Development of the site shall otherwise adhere to the development standards of the base zoning district. 2. If applicable, the site plan shall contain a note designating the entity responsible for operation and maintenance of the on-lot stormwater management facilities consistent with an approved operation and maintenance plan. e. Until such time as the site is served by sewer or effective annexation by the City of Mesa, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. All other base zoning standards for C-3 zoning district shall remain. f. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and ARS § 11-814 for five (5) years for the initial phase and an additional five (5) years for each subsequent phase, as applicable, within which time the initial construction permit or construction permit for each phase as applicable must be obtained. The applicant shall submit a written report every five years from the date of Board of Supervisors approval of Z2016086 which details the status of this project, including progress on obtaining construction permits. The status report to be administratively reviewed by Planning and Development with the ability to administratively accept or to carry the status report to the Board of Supervisors Board upon recommendation by the Planning and Zoning Commission for consideration of amendments or revocation of zoning for the parcel. g. Noncompliance with any Maricopa County Regulation or condition of approval shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, a hearing shall be scheduled with the Board of Supervisors for consideration to revert the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. The applicant, Nate Wadsworth, is requesting approval of a zone change with a precise plan for a 2.11-acre parcel located in the east Mesa area to allow a self-storage facility. The 2.11-acre subject property contains two zoning districts; the 0.85-acre portion is zoned C-3 and is located along the Main Street frontage while northern 1.26-acre portion is zoned R-5. The applicant requests to rezone the entire 2.11-acre parcel to C-3 CUPD to allow 18 self-storage containers, as well as storage space for RVs, boats, trailers and vehicles. The facility will also provide a fenced area for storage of small construction equipment, materials, and small contractor storage. The storage containers will be anchored to the ground per building code requirements. 2. An 8-foot block wall will enclose the property to provide separation from residential uses and provide security for the facility. The wall at south end of the parcel, with frontage on Main Street, will have two courses of split face block for aesthetics. The facility will operate without an on-site manager and will be fully self-serve. Tenants will access the facility through a rolling gate accessible via an electronic keypad. New tenants will view the property by appointment between the hours of 7:00 am and 4:00 pm. 3. Six parking stalls will be provided at the east hammerhead turnaround area for customers to park their vehicles while they access their stored items, plus an additional 10 spaces for boat and RV storage. A portable toilet is also provided at the turnaround area for convenience. 4. Since the facility will not be providing potable water and sewer, staff is recommending a CUPD overlay to limit the use of the property to the requested storage facility. Therefore, in the event that the storage facility ceases operations any other commercial facility would require another zone change or an amendment to the conditions of the CUPD overlay. All other development standards required for the C-3 zoning district shall remain. Existing On-Site and Adjacent Zoning / Land Use: 5. The applicant has complied with the Maricopa County Citizen Review Process with the required posting of the property and notification by first class mail to adjacent property owners within 300’ of the subject parcel and interested parties. Neither the applicant nor Staff has received any calls or letters of opposition as of the writing of this staff report. Outstanding Concerns from Reviewing Agencies: 7. N/A. Staff Analysis: 8. Split zoning between C-3 and R-5 is characteristic of many parcels along the far eastern stretch of Main Street between the corporate limits of Mesa and Apache Junction. This zone change results in a modest expansion of commercial use into a portion of the parcel that is unlikely to be developed for residential. 9. The property’s location along Main Street and its close proximity to a full interchange with the Loop 202 freeway provides ease of access to and from the site. The proposed 8-foot block wall provides security for the facility and adequate separation of uses between the commercial and adjacent residential area. 10. Until such time there is adequate sewer and water available for this site, staff finds the CUPD overlay both reasonable and necessary to ensure that the proposed storage facility is not converted to another commercial use without proper entitlements. Recommendation: 11. Staff recommends the Commission motion for approval with conditions ‘a’ – ‘h’ of Z2016086: a. Development of the site shall comply with the exhibit entitled “Apache Super Storage Site Plan”, consisting of 1 full-size sheet, dated March 29, 2017 and stamped received May 2, 2017 except as modified by the following conditions. The property owner/s and their successors Agenda Item: 5 – Z2016086 Page 5 of 6 waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. There are new apartment complexes, housing developments, an ever-increasing number of rental properties (as home ownership rates decline), and an increasing winter visitor population all throughout East Mesa. This proposal will help fill some of that demand, and provide a valuable service and convenience to local residents, neighbors, and businesses. The facility will operate without an on-site manager, and will be fully 'self-serve'. Tenants will access the facility through an electronic keypad gate. New tenants will view the property by appointment between the hours of 7am - 4pm, Monday through Saturday. The property will store RVs, boats, trailers, containers, vehicles, and will have some amount of fenced yard space for items such as small equipment, materials, and small contractor storage. An 8 ft. block wall will enclose the facility. This will increase security for tenants, discourage trespassing, and eliminate any possibility of disturbing the residential neighbors. The wall on the south end of the parcel, with frontage on E Main St, will have two courses of split face block, creating an appealing aesthetic. There will be a rolling gate at entrance of facility that will be accessed by an electronic keypad. Customers will be provided use of a Chemical Toilet, located at the end of the hammerhead turnaround area. This is to provide convenience and value to tenants as well as keep the property clean. Landscaping will consist of Desert Museum Palo Verde trees, and an assortment of desert cactus and shrubs creating an attractive and low impact statement from Main St. Signage will be affixed to the block wall near the entrance gate. The block wall will be tan in color, which complements the natural colors of the desert. Customers will be provided parking in the east hammerhead turn around area There will be 7 spaces available for customers to park their cars while they access their stored items. 3 Relationship to indin g_p_ Pro erties •-• Figure 1 shows the location of new residential and multifamily developments in the east valley. These new dwellings increase demand for storage. Newer homes are often built on smaller lots, making it difficult for people to store their boats, RV's, and trailers at home. It also makes it difficult for individuals operating a small business who may have an extra work truck or piece of equipment. For example, a small landscape contractor might have a dump trailer or small skidsteer. A small plumbing ongs Supettgition center contractor may have an assortment of ABS pipe, appliances, and a back-up work truck that all need a place to stay. This facility will create a flexible storage solution that will solve a problem and benefit everyone in East Mesa. The tenants will be served by having secure storage, and the general public will be served by creating an out of sight location for items that may currently be parked or stored in violation of HOAs, zoning ordinances, and CC&Rs. Figure I.- Location of under construction and proposed There is heavy foot traffic through the area, residential developments in East Valley. which promotes trespassing on the neighboring properties. Also, the current grading of the property is flooding the east neighbor's business during heavy monsoon rain. Allowing this development will improve property value and quality of life for all surrounding property owners and residents. The neighbors are supportive of the storage proposal since this is a quiet and low impact use for the property. There is very little traffic, and virtually no noise associated with a storage facility. Location and Accessibility The property site is merely a few hundred feet from the on and off ramp to the Loop 202 freeway. This is an optimal site for a storage facility since the freeway creates such quick access. Tenants will be able to quickly retrieve their stored items and then easily hop back onto the freeway. 4 Circulation System The facility will be accessed via Main Street. A rolling, or folding steel gate will be opened via keypad to provide access for customers. Customers will exit back through the same gate onto Main St. Development Schedule The development will take less than 3 months once building permit is obtained. 1. Grading and Drainage - 1 Month 2. CMU Wall Sz Landscaping- 1 Month 3. Electric Service, Chain Link Fencing, and Storage Containers - 1 Month The exact layout and design of storage space and yards will be determined after further market analysis and feedback Community Services Police - Maricopa County Sherriff Fire - Rural Metro School District - Mesa Unified School District 004 Elementary School - Salk Elementary School Jr. High School - Fremont Junior High School High School - Red Mountain High School East Main Street, between Sossaman and 202 Freeway, is home to a wide assortment of businesses. and Quality Used Furniture. atIsTraleigaleg eft APashem Service Center 400- - CASTLE* megastore FactorySetedHomes AUTO BOSS 110 LEY WHITE 5 The 11- Weather Shack Watie AiN Krasemann Eye Center The area is heavily commercial and services a wide variety of customers and needs. The commercial and residential storage needs of the area are growing rapidly. There are retail, manufacturing, and service businesses here. A storage facility (which provides valuable service) will suit the area well, while adding zero negative impact to the surrounding residential properties. There is currently a proposal with the City of Mesa regarding the 11 acres directly across Main St. from the subject property; a developer is requesting annexation to develop a large apartment complex, consisting of several hundred units. This will only increase the need for storage in the area. Without additional storage developments, residents and businesses will resort to storing items in unpermitted areas regardless of zoning ordinance, security, or safety. Public Utilities and Services The City of Mesa is unwilling to provide access to City Water for this property. I believe this is the primary reason why the property has sat undeveloped for so long. The storage facility I propose will not need a water or sewer connection since there will be no onsite manager, employee, or residence (See Figure 2) The property will strictly be used for storage. Public utilities and services serving the property include: Water - None Sewer - None Electric - SRP Trash - RAD Disposal Grading and e The property will be properly graded, and all drainage requirements addressed. A Grading and Drainage plan will be submitted. Off Site flows will be transported through the property via an underground pipe. Onsite storm water will be retained in a basin at southeast corner of property. The property currently has serious drainage issues, which are having large a impact on neighboring properties. The property receives significant off site water flows 6 from the subdivision to the north. Currently this water flows across the subject property and over into the west neighbors building during rain, causing serious damaging his inventory, building, and business. It is a serious issue in desperate need of attention. This proposal will solve it once and for all. City of Mesa General Plan The frontage on Main St. and proximity to the freeway make a complete C3 zoning appropriate. As mentioned earlier in this narrative, there are dozens of C3 zones properties all along Main Street serving the needs of the community. This proposal conforms to the City of Mesa General Plan, and the City of Mesa Planning department has given their support in favor of a single commercial zoning at the location. See Figure 2, and Attachment B for support. On Jun 15, 2016, at 8:01 AM, Tom Ellsworth <Torn.Ellsworth@mesaaz.gov > wrote: Nate, Given the frontage on Main Street and proximity to the freeway the City of Mesa would be supportive of commercial zoning at this location. Thank you, Tom Eli sworth Senior Planner City of Mesa, Planning Division (480) 644-2182 Figure 2 (See Attachment B for complete email) 7 Maricopa County Vision 2030 The proposed storage facility fulfills many of the plan "Elements" detailed in Maricopa County Vision 2030. Maricopa County Zoning Ordinance A storage facility of this type is an approved use for a C3 zoning under Maricopa County Zoning Ordinance Section 804.2.43 & 44 and Section 805.2.23 & 27. Conclusion The proposed storage facility fulfills many of the plan "Elements" detailed in Maricopa County Vision 2030. The existing, dual zoning on this land makes the property extremely difficult to develop. As vacant land, it is negatively impacting the area and neighbors. Allowing a single C3 zoning will allow the property owner to fully enjoy and utilize his property rights. A storage facility will improve the safety and aesthetic of the area, and improve quality of life for the neighbors. The facility will serve the public interest by creating storage space for the general public and local small business owners. An increase in the supply of storage space will reduce overall price of storage in the East Valley, and promote a more productive and efficient economy and community.
