DATE: June 21, 2017 TO: Board of Supervisors FROM: Darren Gerard, AICP, Deputy Director SUBJECT: Z2016086 – Apache Super Storage AGENDA ITEM: PZ-6 The applicant has requested to remove this item from the Consent Agenda and add it to the Regular Agenda in order to discuss a revision to the site plan originally provided with this zone change request to allow an outdoor storage facility. The revision includes the addition of 1-foot (h) of three-strand barbed wire on top of the 8’ block fence originally proposed for the perimeter wall. The barbed wire strands will provide additional security to the north, east, and west of the property and discourage climbing of the wall. The south wall faces Apache Trail and will not include the barbed wire. Article 1111.5 of the MCZO limits the height of perimeter walls in commercial zoning districts to a total of 8 feet (h). However, with inclusion of the a Commercial Unit Plan of Development overlay, Staff supports a height increase to 9-feet, including the additional 1 foot (h) barbed wire. Below is the addition of condition ‘i’ in legislative edit format: i. One foot (1’) of three-strand barbed wire may be added above the 8’ wall along the east, north and west perimeters of the site. For the reasons discussed above, staff recommends the Board motion for approval with conditions ‘a’ – ‘i’ of case Z2016086 with the addition of condition “i”, shown below in final format: a. Development of the site shall comply with the exhibit entitled “Apache Super Storage Site Plan”, consisting of 1 full-size sheet, dated March 29, 2017 and stamped received May 2, 2017 except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “Zone Change with Overlay – Narrative Report”, consisting of 7 pages, dated 502 N. 44th Street, Suite 200 Phoenix, AZ 85008 (602) 506-2364 (602) 506-3711 fax Internet: www.maricopa.gov/planning March 23, 2017, and stamped received April 3, 2017 except as modified by the following conditions. c. The applicant/property owner shall submit a ‘will serve’ letter from Rural Metro for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. d. The following conditions from Maricopa County Environmental Services Department (MCESD) shall apply: 1. Development and engineering design shall be in conformance with the Maricopa County Stormwater Quality Management and Discharge Control Regulation. It is required, the owner/developer to prepare a SWPPP and obtain approval by MCESD prior to construction permit issuance. (A separate submittal to MCESD would be required.) It is required, upon completion of construction, the owner to fulfill MCESD requirements and obtain a post-construction stormwater permit. A Commercial Unit Plan of Development (CUPD) shall be applied to this site. The CUPD shall vary development standards with regard to parking standards for the indoor storage facilities. Development of the site shall otherwise adhere to the development standards of the base zoning district. 2. If applicable, the site plan shall contain a note designating the entity responsible for operation and maintenance of the on-lot stormwater management facilities consistent with an approved operation and maintenance plan. e. Until such time as the site is served by sewer or effective annexation by the City of Mesa, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. All other base zoning standards for C-3 zoning district shall remain. f. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and ARS § 11-814 for five (5) years for the initial phase and an additional five (5) years for each subsequent phase, as applicable, within which time the initial construction permit or construction permit for each phase as applicable must be obtained. The applicant shall submit a written report every five years from the date of Board of Supervisors approval of Z2016086 which details the status of this project, including progress on obtaining construction permits. The status report to be administratively reviewed by Planning and Development with the ability to administratively accept or to carry the status report to the Board of Supervisors Board upon recommendation by the Planning and Zoning Commission for consideration of amendments or revocation of zoning for the parcel. g. Noncompliance with any Maricopa County Regulation or condition of approval shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. The property owner/s and their successors 502 N. 44th Street, Suite 200 Phoenix, AZ 85008 (602) 506-2364 (602) 506-3711 fax Internet: www.maricopa.gov/planning waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, a hearing shall be scheduled with the Board of Supervisors for consideration to revert the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. i. Here are the details. What I would like to do is attach stranded barbed wire to the top of the block wall. • The wall sits entirely on my property, and this is being done at the request of a neighbors who value the additional security this would add to both properties. • Adding this will discourage climbing of the wall which will increase security for tenants of the storage facility, AND neighboring properties. • This will only be added to East, North, and West walls. The South wall (facing Main St.) will not have barbed wire so keep the appearance of the facility up. • The barbed wire will be in accordance with all applicable MAO detail. • See attached detail showing the proposed barbed wire. I really apologize for the last minute nature of this, and fact that engineer is out of town. He will be back this weekend, so I should have an updated site plan with this change included before the meeting on Wednesday. Let me know if there is anything else I can do - thanks! It sounds like it's a change that won't be considered substantial conformance and thus we would need to include it as a condition/stipulation of approval for BOS consideration. 2 Darren V. My project is Apache Super Storage (Case Z2016086). Would it be possible to pull this from the consent agenda to a regular motion? I have had a last minute and very minor change to the fence detail. Ralph Shepard (after speaking with someone, not sure who) advised this would be the best procedure to make the change at this point... Please let me know what you would like to me do, Thank You!
