-Abridged Version for the Purpose of Setting the BOS Hearing- Report to the Board of Supervisors Prepared by the Maricopa County Environmental Services Department Board of Health (BOH) Meeting Date: January 23, 2017 Board of Supervisors Hearing Date: March 8, 2017 Case #/Title: ES-2016-004/Chapters I and VII CFM Supervisor Districts: All Districts Applicant: Maricopa County Environmental Services Department (Department) Request: Approve proposed revision to Maricopa County Environmental Health Code (MCEHC) – Chapters I and VII. Support/Opposition: This proposal originated from restaurant and mobile food industry operator/manager requests for the Department to discontinue Certified Food Manager cards. A November 7, 2016 public meeting was held for this and two other cases; however, no stakeholders for this case attended. Additionally, no opposition for this proposal has been received. Department Recommendation: Staff recommends the Board of Supervisors (BOS) approve the proposed MCEHC. BOH Recommendation: Approve per Department recommended language and proceed on the EROP expedited process. Executive Summary: The MCEHC Chapters I and VII CFM proposal eliminates Department issued Certified Food Manager cards. Also, this proposal clarifies when food establishments are exempt from the Certified Food Protection Manager requirement. Currently, a card is issued by the Department after each manager travels to a regional office and shares his/her certificate for passing an approved Food Protection Manager training. Upon this proposal’s BOS approval, the Certified Food Manager card and $5 fee will be discontinued. Thereby, saving food managers $5 and a commute while ensuring public health and safety are still maintained. Additional proposal updates include eliminating Page 1 of 2 the Certified Food Protection Manager duplicate card with the $3 fee, and adding certificate text for training clarification. The proposal does not increase fees; instead, it eliminates two fees. In addition, this MCEHC proposal is following the EROP policy and workflow process. In accordance with the Maricopa County Resolution, “Moratorium on Increased Regulatory Burdens,” the County Manager authorized the Department to proceed with this case in September 2016. Also, in October 2016, the County Manager briefed the Board of Supervisors. The Department conducted a stakeholder workshop on November 7, 2016. Then on January 23, 2017 the Department presented a Staff Report for this case to the Board of Health (BOH) at which time the BOH approved this case to proceed on the EROP expedited process for the BOS to adopt this proposed Department revision.
