Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: February 15, 2017
Case #/Title: Z2016072 – Zanjero Trails Major Amendment
Supervisor District: 4
Applicant/Owner: Gammage and Burnham P.L.C. / First American Title Insurance
Company (Trust No. 8708)
Request: Revisions to RUPD development standards
Site Location: Generally located west of Perryville Rd. alignment, north of
Camelback Rd., south of Peoria Ave., and east of the
Beardsley Canal in the Buckeye and West Glendale areas.
Site Size: 1,834 acres
County Island Status: N/A
Additional
Comments: With this amendment, Sunbelt Holdings (SBH) would like to
match the lot coverage standards of Zanjero Trails to current
County standards. In some cases, the new standards match
the approved RUPD standards for Zanjero Trails. In the R1-18
and R1-6 table, the newer County standards now exceed the
Zanjero Trails lot coverage standards. The first proposed
modification is to modify table 4 of the approved RUPD to
increase the allowed R1-6 lot coverage from 45% to 50% (the
current County standard) and to modify table 4 of the
approved RUPD to increase allowed R1-18 lot coverage from
30% to 35% (also the current County standard). The second
proposed modification is intended to expand the availability
of side entry garage and forward living space options. The
current Zanjero Trails R-2 RUPD development standards allow
a 10 foot front yard setback for side entry garages or forward
living spaces, only requiring a 20 foot setback for front facing
garages. Sunbelt Holdings would like a similar option
available in R1-6, R1-7, and R1-8 areas of Zanjero Trails,
requiring modification to Tables 4, 5, and 6. It is thus proposed
that rather than having a default 10 foot setback, a 20 foot
setback would become the default in these districts, with the
right to reduce to 10 feet for side entry garages or forward
living spaces.

Report to the Planning and Zoning Commission
Prepared by the Maricopa County Planning and Development Department
Case: Z2016072 – Zanjero Trails Major Amendment
Meeting Date: January 19, 2017

Applicant: Gammage and Burnham P.L.C.
Owner: First American Title Insurance Company (Trust No. 8708)
Request: Revisions to RUPD development standards
Site Location: Generally located west of Perryville Rd. alignment, north of
Camelback Rd., south of Peoria Ave., and east of the Beardsley
Canal in the Buckeye and West Glendale areas.

Project Summary:
1. On February 21, 2007 the Maricopa Board of Supervisors (BOS) approved the zoning
change for the Zanjero Trails DMP. The zone change was from Rural-43 to various single-
family, multi-family, and commercial zoning districts, together with various UPD overlays
and a PAD overlay, such to implement the Zanjero Trails Development Master Plan that
was approved by the Board of Supervisors on October 6, 2004. The DMP was approved
for 7,664 dwellings and will provide approx. 24 acres of active open space in addition to
the mini-parks, landscape areas, and retention areas.
2. Zanjero Trails is essentially a 9 mile long strip of land along Perryville Rd., varying in width
from ¼-mile to 1-mile, extending from Bell Rd. on the north to Camelback Rd. on the
south. In 2008 the City of Surprise annexed 831 acres of the Zanjero Trails UPD north of
Peoria Avenue. The property owner, Maricopa County Water Conservation District No.1
and development partner, Sunbelt Holdings are preparing to start developing the 1,824
acres remaining in unincorporated County. As part of this, the applicant is requesting to
revise some of the RUPD development standards. Stipulation ‘a’ from Z2005031 requires
compliance with the original UPD Narrative, thus a Major Amendment to the UPD is
required per Chapter 1002.8 of the MCZO.
3. With this amendment, Sunbelt Holdings (SBH) would like to match the lot coverage
standards of Zanjero Trails to current County standards. In some cases, the new standards
match the approved RUPD standards for Zanjero Trails. In the R1-18 and R1-6 table, the
newer County standards now exceed the Zanjero Trails lot coverage standards. The first
proposed modification is to modify table 4 of the approved RUPD to increase the allowed
R1-6 lot coverage from 45% to 50% (the current County standard) and to modify table 4
of the approved RUPD to increase allowed R1-18 lot coverage from 30% to 35% (also the
current County standard). The second proposed modification is intended to expand the
availability of side entry garage and forward living space options. The current Zanjero
Trails R-2 RUPD development standards allow a 10 foot front yard setback for side entry
garages or forward living spaces, only requiring a 20 foot setback for front facing
garages. Sunbelt Holdings would like a similar option available in R1-6, R1-7, and R1-8
areas of Zanjero Trails, requiring modification to Tables 4, 5, and 6. It is thus proposed that
rather than having a default 10 foot setback, a 20 foot setback would become the
default in these districts, with the right to reduce to 10 feet for side entry garages or
forward living spaces.
Public Participation Summary:
4. Staff mailed out Commission and Board hearing notification postcards to property owners
within 300’. To date, staff received numerous inquiries as to the nature of the request and
one e-mail of opposition from the public regarding the request to modify the RUPD table.
The applicant also posted 20 signs around the perimeter of the subject site and sent letters
to property owners within 300’. The letter of opposition is not clear as to the reason for
opposition as it relates to the request.
Background:
5. October 6, 2004: The BOS approved the Zanjero Trails Development Master Plan
DMP2002005 subject to conditions (not shown here for brevity).

lieu of payment of this contribution. Such off-site street improvements must
be all weather facilities, must meet County standards in effect at the time
they are improved, and must be pre-approved by MCDOT. MCDOT may
require a development agreement to detail the specifics of construction,
including phasing and timing. If the applicant chooses not to construct off-
site regional roadway improvements, the applicant shall pay the
contribution amount at the time individual building permits are issued, or
per an alternate agreement as approved by MCDOT.
7) If required per item #6, a development agreement shall be executed prior
to any zoning or preliminary plat approval. The development agreement

Staff Analysis:
21. The applicant is requesting an increase in the R1-6 RUPD lot coverage from 45% to 50%
(Table 4) and R1-18 RUPD lot coverage from 30% to 35%, (Table 7) to match the current
County standard for each zoning district. The applicant is also requesting a 10 foot front
yard setback for side entry garages or forward living spaces, only requiring a 20 foot

setback for front facing garages. Sunbelt Holdings would like a similar option available
in R1-6, R1-7, and R1-8 areas of Zanjero Trails, requiring modification to Tables 4, 5, and 6.
22. Staff supports the modified RUPD to allow the increase in lot coverage and reduced front
yard setback for side entry garages or forward living spaces.
Recommendation:
23. Staff recommends Approval of Z2016072 subject to condition ‘a’ for the following reasons:
There is no opposition to the proposal from the neighboring community.
The proposal is consistent with current zoning regulations for the district.
Reviewing County agencies have no concerns.
Provided the following conditions are met:
a. Development of the site shall comply with the zoning narrative entitled “Zanjero Trails
Unit Plan of Development Zone Change Request with PAD Overlay” consisting of a
bound document containing sixty-three (63) pages, including all figures and
diagrams, dated August 2006 and stamped received October 18, 2006, except as
modified by the following stipulations. However, within 30 days of Board of Supervisors
approval the applicant shall submit a revised narrative that accurately identifies the
RUPD zoning standards as approved by the Board of Supervisors. Accuracy of the
narrative report shall be verified by Planning and Development Department staff.
b. Prior to the submittal of any Preliminary Plat for any portion of the Zanjero Trails
project, with the exception of the Phase 1 Preliminary Plat currently being processed
under S2005020, the developer shall enter into a Development Agreement with the
Maricopa County Department of Transportation. Said Development Agreement
shall be consistent with the provisions as outlined in Stipulation “ee.4” of DMP2002005.
This agreement shall detail transportation issues, including the timing for construction
of the offsite roadway improvements referenced in stipulation “c.6” below. The
Preliminary Plat in process under S2005020 shall not be approved until the
Development Agreement is executed.
c. The following Maricopa County Department of Transportation (MCDOT) stipulations
shall apply:
1) A revised Traffic Impact Statement (TIS) was received May 5, 2006. The TIS shall
comply with MCDOT requirements and shall address development phasing and the
offsite improvements necessary to accommodate the anticipated traffic demands.
The TIS must be approved before subsequent approval of any roadway
improvement plans. The TIS shall be updated prior to the first final plat approval and
with each development phase to reflect current conditions and any changes to the
Development Plan. Additional lane capacity on offsite alignments will be reviewed
with each resubmittal of the TIS. The project must comply with all recommendations
in the MCDOT approved TIS.
Agenda Item: 3 - Z2016072
2) The applicant shall provide the ultimate full-width of right-of-way for all interior public
roadways, consistent with the Maricopa County Major Streets and Routes Plan, or as
otherwise approved by MCDOT.
3) The applicant shall provide the ultimate half-width of right-of-way for all perimeter
public roadways, consistent with the Maricopa County Major Streets and Routes
Plan, or as otherwise approved by MCDOT.
4) The applicant shall construct the ultimate full-width interior public roadways.
5) The applicant shall construct the ultimate half-width perimeter public roadways.
6) The applicant shall make a contribution to regional transportation infrastructure. The
contribution shall be $3,281.00 per residential dwelling unit. The applicant may
choose to construct off-site street improvements in lieu of payment of this
contribution. Such off-site street improvements must be all weather facilities, must
meet County standards in effect at the time they are improved, and must be pre-
approved by MCDOT. MCDOT may require a development agreement to detail
the specifics of construction, including phasing and timing. If the applicant chooses
not to construct off-site regional roadway improvements, the applicant shall pay the
contribution amount at the time individual building permits are issued, or per an
alternate agreement as approved by MCDOT.
7) If required per item #6, a development agreement shall be executed prior to any
zoning or preliminary plat approval. The development agreement shall be an
enforceable contract, regardless of annexation.
8) The applicant shall design all roadways and public infrastructure to meet county
standards in effect at the time improvements are constructed.
9) The applicant shall provide all-weather access to all parcels and lots, and on all
arterial roadways.
10) The applicant shall provide and make available a minimum of two access points to
each development phase and/or subdivision unit.

language:
“You are buying a home or property in the ‘vicinity of a military airport’ as described
by State of Arizona statute A.R.S. §28-8481. Your house should include sound
attenuation measures as directed by State law. You will be subject to direct over
flights and noise by Luke Air Force Base jet aircraft in the vicinity.
Luke Air Force Base executes over 200,000 flight operations per year, at an average
of approximately 170 overflights per day. Although Luke's primary flight paths are
located within 20 miles from the base, jet noise will be apparent throughout the area
as aircraft transient to and from the Barry M. Goldwater Gunnery Range and other
flight training areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast. Noise will be more noticeable during
overcast sky conditions due to noise reflections off the clouds.
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these
hours and during most weekends.
Luke Air Force Base Auxiliary Field 1, located approximately 15 miles to the northwest
of Luke Air Force Base is a site of intense instrument procedure landing approaches,
with approximately 12,000 flight operations per year. Aircraft will descend down to
200 feet above the ground over the Auxiliary Airfield and will create severe noise in
that area.
Agenda Item: 3 - Z2016072

For further information, please check the Luke Air Force Base website at
www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and
Development Department.”
Such notification shall be recorded on all Final Plats, be permanently posted on not
less than a 3 foot by 5 foot sign in front of all home sales offices, be permanently
posted on the front door of all home sales offices on not less than an 8½ inch by 11
inch sign, and be included in all covenants, conditions, and restrictions (CC&Rs) as
well as the Public Report and conveyance documents.
n. All habitable buildings constructed within this subdivision shall be constructed to
attain a noise reduction level as per ARS § 28-8482(B).
o. Major changes to the zoning exhibit and narrative report shall be processed as a
revised application, with approval by the Board of Supervisors upon
recommendation of the Planning and Zoning Commission. Minor changes may be
administratively approved by the Planning and Development Department. Major
changes to the project may require a new Citizen Participation Process as
determined by the Planning and Development Department.
p. Noncompliance with the conditions of approval will be treated as a violation in
accordance with the Maricopa County Zoning Ordinance. Further, noncompliance
of the conditions of approval may be grounds for the Planning and Zoning
Commission to take action in accordance with Chapter 3 (Conditional Zoning).
q. Property owner and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with stipulations.

Purpose of Request
On February 21, 2007, the Maricopa County Board of Supervisors approved
County Zoning Case No. Z2005031 for the Zanjero Trails UPD. The rezoning
approved a Unit Plan of Development with both Residential and Commercial
components, along with a Planned Area Development Overlay, on 2,665 acres of
land generally adjacent to the Beardsley Canal from Bell Road on the north to
Camelback Road on the south. In 2008, the City of Surprise annexed 831 acres of
the Zanjero Trails UPD, everything north of Peoria Avenue.
The property owner, Maricopa Water Conservation District No. 1 ("MWD"),
and its development partner, Sunbelt Holdings ("SBH"), are now preparing to start
development on the 1,824 acres remaining in Maricopa County. As part of that
effort, SBH wishes to revise some of the RUPD development standards for Zanjero
Trails. Stipulation (a) of Case No. Z2005031 requires compliance with the original
UPD Narrative. In order to make its proposed revisions, SBH will need to modify
the Narrative and therefore Stipulation (a). Because SBH is proposing to alter
development standards, this will be a Major Amendment to the UPD, per Section
1002.8 of the County Zoning Ordinance.
Regulatory Framework and Governance Documents
The Zanjero Trails Unit Plan of Development was originally approved on
February 21, 2007 in Z2005031 and subsequently amended in this amended Unit
Plan of Development dated November 28, 2016. The development standards found
in this amended Unit Plan of Development are both superior and supplemental to
the development standards found in the originally approved document.
Development of property within the Zanjero Trails Unit Plan of Development
is governed by the Maricopa County Zoning Ordinance except where modified by
this Zanjero Trails Unit Plan of Development and its subsequent amendments. In
the event of a conflict between a specific provision of the Zanjero Trails Unit Plan of
Development approved on February 21, 2007, the Maricopa County Zoning
Ordinance, and this amended Unit Plan of Development dated November 28, 2016,
this amended Unit Plan of Development prevails. The Maricopa County Zoning
4192.3.1033521.4 2 11/28/2016
Ordinance governs with regard to development standards and design guidelines
not specifically addressed within the Zanjero Trail Unit Plan of Development or this
amended Unit Plan of Development.
Description of Proposal
First, SBH would like to match the lot coverage standards of Zanjero Trails to
current County standards. In 2014, the County modified its lot coverage standards
for single family residential categories. In some cases, the new standards match
the approved lot coverage RUPD standards for Zanjero Trails, but in the R1-18 and
R1-6 categories, the new County standards now actually exceed the Zanjero Trails
lot coverage standards. SBH proposes to modify Table 4 of the approved RUPD to
increase allowed R1-6 lot coverage from 45% to 50%, the current County standard,
and to modify Table 7 of the approved RUPD to increase allowed R1-18 lot
coverage from 30% to 35%, the current County standard.
Second, SBH would like to expand the availability of side entry and forward
living space options to its future home buyers. As approved by the County Board of
Supervisors in 2007, the Zanjero Trails R-2 RUPD development standards allow a 10
foot front yard setback for side entry garages or forward living spaces, only
requiring a 20 foot setback for front facing garages. SBH would like to make a
similar feature available in the R1-6, R1-7 and R1-8 areas of Zanjero Trails, requiring
modification to Tables 4, 5 and 6. However, rather than having a default 10 foot
setback, SBH is proposing a 20 foot default setback in these districts, with the right
to reduce to 10 feet for side entry garages or forward living spaces. An illustration
depicting the layout of a typical side entry garage or forward living space lot is
attached as Exhibit A.
Relationship to Surrounding Properties
Zanjero Trails is a self-contained community, surrounded on all sides by
Section lines and major streets. These proposed changes will have no impact on
any properties outside Zanjero Trails. These proposals only impact future
4192.3.1033521.4 3 11/28/2016
development within individual, yet to be developed, subdivisions within the
Zanjero Trails project.
As part of the original approval in 2007, MWD carefully negotiated a very
detailed set of buffering and transitional conditions to protect Clearwater Farms, its
oldest immediate neighbor to the east. A major feature of these conditions is the
realignment of Perryville Road off of the Section line alignment and into the
Zanjero Trails project. These proposed UPD changes will not impact the buffering
conditions to Clearwater Farms in any way, and will not impact the existing
commitment to realign Perryville Road as Zanjero Trails develops.
Explanation of Benefit and Relevance to Recent Changes
SBH is proposing both the lot coverage and front yard setback changes to
allow for a greater diversity of housing options, in particular more single story
homes. As a result, both of these changes will increase the architectural interest of
the streetscapes within Zanjero Trails. In addition, both proposed changes reflect
concepts already allowed by the County. The lot coverage changes are consistent
with the 2014 Countywide Text Amendment changes. The front yard setback
reduction was already approved by the County for other parts of Zanjero Trails in
2007.
Other UPD Narrative Requirements
The County checklist for UPD Amendments includes Location and
Accessibility, Circulation System, Development Schedule, Community Facilities and
Services, and Public Utilities and Services. These subjects are all related to project
infrastructure. The changes proposed here will have no impact on project
infrastructure or the number of lots within the project or its individual subdivisions.
Therefore, there is no need to address any of these subject areas for purposes of
this proposal.

SUBJECT: Zanjero Trails UPD Major amendment; Z2016072
The Maricopa County Environmental Services Department (MCESD) has reviewed
documents received from the Maricopa County Planning and Zoning Department for
the above referenced project. This project is an amendment to the previously
approved Development Master Plan (DMP) DMP2002005 for Zanjero Trails. Zanjero
Trails is an approximately 2,665-acre parcel of land located in western Maricopa
County, approximately 2 miles west of Loop 303. In 2008 the City of Surprise
annexed 831 acres, everything north of Peoria Avenue. The project stretches south
from Bell Road to Camelback Road, and varies in width, and parallels the Beardsley
Canal. According to the project narrative and site plan, Arizona-American Water
Company will provide potable water to the project. LPSCO will provide sanitary
sewer services to the project via proposed new sewer lines that will connect Zanjero
Trails, Savannah, Jackrabbit Estates and Russell Ranch Unit 6 to the existing LPSCO
wastewater treatment plant. Currently, MCESD is awaiting the submittal and
approval of the onsite/offsite water/sewer infrastructures.
Based on the above, MCESD has no objections to and recommends approval
of this project to the Planning & Development Department in Accela Automation on
October 3, 2016, with the following stipulations:
Stipulations:
1. Prior to approval of the first Final Plat, Approvals to Construct for all required
onsite and offsite water and sewer lines must be issued by MCESD.
