Dear Sir,
Please put a stipulation on this request that it remain a nursery. It has been a nursery for many years. Please do not
allow the other uses of C-2.
Thank you,

I am a property owner and registered voter living in the Saguaro
West Area of Cave Creek. My residence is located approximately
300 yards from Desert Foothills Nursery.
On 12/7/23, Maricopa County P&Z approved a lot-split of
Desert Foothills Nursery, and rezoning application submitted by
"Toy Barn" to C-2 with carefully negotiated conditions. I am
personally familiar with these conditions because I was one of the
individuals responsible for the drafting and acceptance of these
conditions. THE CONSISTENCY OF THIS RURAL AREA REQUIRES
THAT THESE SAME CONDITIONS BE APPLIED TO THE DESERT
FOOTHILLS NURSERY APPLICATION.
Comes now, the owner of Desert Foothills Nursery is making an
application to rezone the balance of the lot from RU to C-2. This
application DOES NOT include any of the carefully negotiated
conditions recorded with the Toy Barn application. This rezoning
inconsistency will be a travesty for the residents living in this rural
area.
I am opposed to any potential multi-family dwelling units, the sales
of compressed gas/propane, billboards, lighting, traffic access into
1

the Saguaro West community off of 52nd Street, and we absolutely
do not want a cell phone tower in our residential neighborhood.
The Desert Foothills Nursery has been operating under a Special
Use Permit within our residential zone. This rezoning application is
not necessary for the Nursery to continue operating in the same
fashion while retaining the RU zoning.
If the Board of Supervisors does grant a change in zoning to C-2, it
must include the same restrictions and conditions as the adjoining
Toy Barn parcel.
Thank you for your attention to this matter.

I reside in the notification section for this application.
This is a residential community. The Desert Foothills Nursery has operated under a special use permit within
our residential zone for many years.
I feel there is no need to change the zoning to C-2. There is no need for feed stores of any kind in this
neighborhood.
There are several feed stores within a few miles and some in walking distance from the nursery. There is no
need for cell towers as there are many already in this neighborhood. There clearly is no need for a billboard
and especially within 39 feet of a residential property. There are at least 2 places to obtain propane within
walking distance of the nursery.
I am vehemently opposed to any multi-family housing units, the sale of any feed sources, expansive lighting
and traffic access into our neighborhood from 52nd street. I am vehemently opposed to any billboards, the sale
of propane gas and certainly no cell towers.
The application for the Toy Barn Z2023090 was approved with negotiated conditions. These same conditions
must also be applied to the Desert Foothills nursery application Z2023052 in order to maintain continuity in our
residential community.
I am asking you to please maintain the integrity of our neighborhood. The Desert Foothills Nursery has
operated with a special use permit since its beginning. The neighborhood is opposed to this request for
commercial zoning. We ask for it to stay with its current use. If any change is made it needs to be continuation
with the Z2023090 conditions.
Thank you for your attention to this process.

I have been made aware of the zoning change request to a C-2 intermediate commercial for parcel 211-46-
032B.
I understand this zoning could allow for lighted billboards. This property is within the Cave Creek dark sky
initiative. It would be sad to have a lighted billboard add light pollution to this still beautiful desert area.
Please do not allow lighted billboards in this area.

Laurel King

Good Morning,
I am for the rezoning for case number Z2023052. I have found previously that the neighbors that have
complained about other projects in the area have lied to others to get them to oppose it also. The also handed in
petitions with people signing that live as far as Connecticut and have signed twice. Many petitions not even
explaining what they were signing. I hope you vote yest to the zoning. If you get a lot of opposition, it is
probably because they don’t know the facts and are following the loudest voices when they have no idea what is
going on.

DATE: January 11, 2024
TO: Planning & Zoning Commission
From: Nick Schlimm, Planner
SUBJECT: Z2023052 – Desert Foothills Gardens Nursery
Agenda Item: #4
Since the publication of the staff report for the referenced case, staff received comments from
the Town of Cave Creek (herein referred to as “the Town” or “Cave Creek”). In their letter, Cave
Creek thanked the County for allowing the opportunity to review the case and acknowledged their
familiarity with the subject site. The Town noted that an attempt to annex the subject site was
made as recently as 2014. This was unsuccessful, as Cave Creek was unable to secure the
necessary land ownership consent to do so.
In their letter, Cave Creek acknowledges the 105’ landscape setback established (within Maricopa
County jurisdiction) from the centerline of Cave Creek Road, as required in the MCZO. The letter
refers to this as a “Scenic Corridor setback” and further notes that the MCZO prohibits billboards
within a Maricopa County Scenic Corridor and within 660’ of a Scenic Corridor Overlay Zoning
District. County staff notes that Cave Creek Road is not a designated Scenic Corridor, nor is the
subject site located within 660’ of a Scenic Corridor Overlay Zoning District.
The Town provided the following recommendations to County staff:
• “…that Maricopa County consider a condition that prohibits the installation of both static
and digital billboards.”
• “…that Maricopa County consider conditions to restrict the height, total square footage
and illumination of any future signage to limit adverse visual impact on the area.”
• “…that a Condition of Approval be considered where any future consideration of [Wireless
Communication Facilities] be subject to a Special Use… to inform surrounding property
owners.”
The letter concluded with a request that both the applicant and Maricopa County consider the
associated regulations of neighboring properties, particularly regarding maximum height
restrictions for structures and outdoor lighting.
County staff notes that the conditions of approval permit a single static billboard but that
illuminated billboards (including digital) and billboard embellishments are prohibited. No
restrictions have been established on the square footage of signage (beyond the base regulations

established by the MCZO), but the maximum height of all buildings, structures, and billboards
would be restricted to 28’. Likewise, the maximum height of outdoor lighting would be restricted
to 10’ and further restricted to six feet within the west side building setback along 52nd Street.
These height restrictions are the same restrictions that will be established for the adjacent site
to the north if the Board of Supervisors approves case Z2023090 (also a request for a zone
change from Rural-43 to C-2 CUPD).
Since the publication of the staff report, staff has also received an additional 17 letters of
opposition from members of the public. Most of these additional letters are from residents in the
Cave Creek area, although none are from properties within 300’ feet of the subject site. These
letters, received between January 3rd and January 9th, have been attached to this handout.

Re: Z2023052 – A request to Rezone to C-2 CUPD to allow retail and
wholesale plant nursery with additional retail
Dear Mr. Schlimm:
The Development Services Department on behalf of the Town of Cave Creek
would like to thank you for the opportunity to review the associated case
scheduled to come before the Maricopa County Planning and Zoning
Commission in January. The Town is familiar with the property and has even, as
recently as 2014, taken steps to annex the property as a result of an
Intergovernmental Agreement with Maricopa County. That process was not
successful as the Town was unable to secure the necessary land ownership
consent to move forward.
Staff has reviewed the application material received by your office in October of
this year and, although staff has not received an updated or revised application
based on Maricopa County staff’s comments, will make the following comments
based upon that submittal:
• The applicant’s narrative states that, “No changes to the existing buildings
or signage are currently proposed, and they will remain unchanged unless
modified with the subsequent POD.” However, the proposed C-2 CUPD
Development Standards indicate “Billboards per MCZO,” which prohibits
billboards within 660 feet of a Scenic Corridor Overlay Zoning District AND
prohibits billboards located on any property located within a Maricopa
County Scenic Corridor (1403.3.1.D & E). It is the understanding of the
Town, that Cave Creek Rd. beginning at Jomax Rd. and continuing north
to Carefree Highway has an adopted Scenic Corridor setback of one-
hundred and five feet (105’) measured from the centerline of Cave Creek
Rd.
T:\Planning\LETTERS\MC Z2023052.doc

• The applicant proposes Billboards per MCZO. The Town would request
confirmation that, based upon Maricopa County’s review and detailed Staff
Report, the current adopted Maricopa County Zoning Ordinance would
preclude and otherwise prohibit the installation or erection of both static
and digital billboards. Further, should staff deem that billboards are
acceptable on the subject property, the Town would recommend that
Maricopa County consider a condition that prohibits the installation of both
static and digital billboards.
• Due to the nature of Cave Creek Rd., specifically north of Lone Mountain
Rd., the Town would recommend that Maricopa County consider
conditions that restrict height, total square footage and illumination of any
future signage to limit adverse visual impact on the area. The neighboring
Commercial Zone, within the Town of Cave Creek, has a maximum sign
height of twelve feet (12’), a maximum sign area of forty-eight (48) square
feet and prohibits internally illuminated signs.
• The applicant proposes Wireless Communication Facilities per MCZO
(1202); the Town of Cave Creek allows Wireless Communication Facilities
in all zones subject to approval of a Special Use Permit by the legislative
body (Town Council). The Town recommends that a Condition of
Approval be considered where any future consideration of such use be
subject to a Special Use as well to inform surrounding property owners.
In addition to the items identified above, the Town of Cave Creek would also ask
that both the applicant and Maricopa County consider the associated regulations
of neighboring properties, both residential and commercial, as future
development may occur on the subject property including the maximum height of
structures and outdoor lighting. The Town of Cave Creek limits the maximum
height of structures, in all zones, to two (2) stories and twenty-five (25) feet
measured from natural grade to the top of the roofline or peak of roof. Cave
Creek also restricts building mounted outdoor lighting installed to a maximum of
ten (10) feet in height and further requires that all outdoor lighting be shielded
and cast downward so that the light source (bulb) is not clearly visible from any
adjacent property or street.
At this time, the Town of Cave Creek has no further comments related to
Maricopa County application case number Z2023052. Should you have any
questions or wish to discuss this letter in more detail, please do not hesitate to
contact me directly.
Respectfully,

Hi Nicholas,
This is concerning the Rezoning Case Z2023052, specifically to request the County to restrict the CUPD
overlay, to eliminate the following three usages:
1. No billboards: lit and or digital billboards are light polluters, dark sky killers, and driver distractors
whether the sign lobby agrees or not. This is essentially the wrong kind of advertising devise for our area.
2. No cellphone or wireless communication towers or facilities: These towers near to or next to housing
or anywhere where people work are a dangerous electronic emission field that everyone knows is bad for
health and should not be placed so close to humans and pets.
3. No retail sale of gas (including propane, butane or otherwise): Again, this is a health issue due to
noxious and toxic fumes as well as a danger from explosion. In addition, it attracts and promotes the
kind of traffic and activity that is disruptive to a community like this.
Because this proposed rezoning property is close to and abuts this long-standing residential community
to the west and the south, this rezoning proposal should be highly restrictive for any current or future
usage to only a cactus or plant nursery business. In that case there would be no need for 40ft tall
structures or buildings.
Thank you for your consideration.
Sincerely,
Bruce Arlen

Dear Nicholas,
I am a resident of Cave Creek and would like to let you know I oppose the rezoning of Cactus
Nursery. I live in the neighborhood that would be directly impacted from this proposal. It is a
wonderful neighborhood that would be changed forever if you allow billboards, cell towers and retail
sales of Propane and Butane.
I vehemently oppose Z2023052 and request you keep that parcel zoned rural. The only opposition is
from a realtor who would not be directly impacted as she does not live in the neighborhood.
Thank you for your attention to this matter.

Dear Nicholas,
My husband, Tyler Hurlock, and I are in opposition for the rezoning of the Desert Foothills Nursery.
We moved to N 48th street in Cave Creek from Connecticut. We visited for the first time in January of 2019
and moved here five months later. We immediately fell in love with the area and overall lifestyle that Cave
Creek presented us with.
We love the quiet, uncluttered, historic, and overall feel of Cave Creek. Recently, it feels like this perfectly
undisturbed town has become congested with unnecessary big businesses such as McDonald’s and Harbor
Freight. Adding billboards, cell towers and apartment buildings will only add to the mess.
Cave Creek is simple and an escape from the city. We do not want the hustle and bustle to creep into our quiet
slice of heaven.
Thank you for your time,
Hailey

My name is Tim Troutman.
I oppose the above rezoning request for the following reasons. i live in the neighborhood directly behind the
proposed rezoning site im located in the city of cave creek. we moved here because cave creek and carefree
have set back and sign ordinances prohibiting large tall signage and commercial business road frontages
without a buffer zone similar to the walmart directly across the street. the strip of maricopa county land where
the proposed zoning change is requested for will not blend with the rest of the commercial land use along cave
creek road and will be unsightly with tall billboards and cell towers giving our community heavy
commercial/industrial look directly adjacent to a residential area that residents moved to specifically to enjoy
the low density zoning (1 acre lots) and for their view of black mountian which will be affected by the zoning
change.
all of us in the area affected area moved here to get away from the exact type zoning/land use thats proposed.
we moved here to get away from the cluttered over built big city such as phoenix etc. the neighborhood directly
behind the proposed zoning change will be adversely impacted by this change soley for the profit of a few to
the detriment of the many who have lived here for years and expect to live here for many more in quiet
enjoyment of their low density properties and unrestricted view of black mountian with very little commercial
noise, traffic, signage and possible interference/danger from propane or cell tower emissions.
in short please dont turn our
quiet neighborhood into a downtown phoenix, glendale, mesa cluttered big city.
theres plenty of other uses for the property and we feel that our lifestyle and neighborhood should be taken into
consideration when
adjacent land use zoning is requested. any use of the land should prohibit large signage, tall structures, and
require setbacks and unobtrusive buildings like the wallmart across the street.
there is plenty of land not directly adjacent to a low density neighborhood to install cell towers, billboards and
tall structures etc and putting them on the disputed
zoning change land is driven by a desire of a few for profit
to the detriment of the many land owners who moved here trusting that there lifestyle was protected by the
original
zoning decisions made the county and cities.
please dont fold and give in to the requests for zoning changes that will do to us what it has done to everyone
in the country next to a big city
and ruin their quiet enjoyment with profit driven big city commercial barrio creep syndrome.
