Report to the Board of Supervisors Prepared by the Maricopa County Planning and Development Department Board Hearing Date: February 7, 2024 Case #/Title: Z2023106 - PHO Marisol Supervisor District: 4 Applicant/Owners: Declan Murphy / Jacqueline and Angel Delahaut Request: Special Use Permit (SUP) for a wireless communication facility (WCF), 80' lattice-tower stealth designed as a windmill, in the Rural– 43 zoning district Site Location: Generally located 2,100’ west of the NWC of Montgomery Rd. and 163rd Ave. in the Surprise area Site Size: Approx. 2,500 sq. ft. of a 33-acre parcel County Island Status: N/A Additional Comments: The proposed SUP will allow a WCF on the subject property with a reduced setback to the southern lot line and increased support structure and antenna array diameters. The diameter increases are needed to accommodate the proposed WCF design to mimic an old style water pump windmill. The proposed WCF design will be an aesthetic improvement over other WCF design options and will blend in with the surrounding rural environs. Staff received no public comment on the request. There are no outstanding concerns from reviewing agencies. Commission Recommendation: On 1/11/24, the Commission voted 7-0 to adopt a motion recommending the Board of Supervisors approve Z2023106 subject to conditions ‘a’ – ‘g’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “PHO Marisol“, consisting of 6 full-size sheets, dated October 27, 2023, and stamped received November 8, 2023, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled ““PHO Marisol“, consisting of 4 pages, dated November 8, 2023, and stamped received November 8, 2023, except as modified by the following conditions. February 7, 2024 Z2024106 Page 1 of 3 c. The wireless communication tower shall retain the stealth properties as originally designed. Any damaged or missing windmill components shall be replaced within 60 days of such damage occurring. d. The following Rural-43 SUP standards shall apply: 1. Minimum Setback to Southern lot line: 68’ 2. Maximum WCF Structure Diameter: 14’ 6” 3. Maximum Antenna Array Diameter: 18’ e. The following Planning Engineering conditions shall apply: 1. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain regulation for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Engineering review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the MCDOT Roadway Manual. 3. The WCF compound walls will require a turned block, every other block along the base course to maintain historic drainage patterns. 4. The site contains areas of regulated floodplains. The project, as submitted, does not appear to disturb any floodplain. Any disturbance would require issuance of a floodplain use permit concurrent with building permits. 5. Any work in the Montgomery Road will require a permit from MCDOT. 6. The applicant must execute a wireless agreement with MCDOT for all equipment, conduit, F/O and other work that will be within the MCDT ROW. 7. Approval of the US Bureau of Reclamation (BOR) is required to permit utility extensions across federally owned property under their control. f. This special use permit is valid for a period of thirty years and shall expire on January 11, 2054 or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the special use permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either February 7, 2024 Z2024106 Page 2 of 3 revocation due to the failure to comply with any conditions, or the expiration of the special use permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the special use permit. The special use permit enhances the value of the property above its value as of the date the special use permit is granted and reverting to the prior zoning results in the same value of the property as if the special use permit had never been granted. The applicant is proposing an 80’ tall WCF on the subject property that will include a 2,500 sq ft area with associated ground equipment surrounded by an 8’ masonry screen wall. The WCF will be designed to mimic an old-style water pump windmill so that it blends in with the rural western character of the surrounding area. The proposal includes a requested increase in allowed structure diameter to 14’ 6” and increased antenna area diameter to 17’ 10”. The requested diameter increases are to facilitate the chosen style of tower, as it will utilize a lattice style structure in order to achieve the old-style windmill appearance. The applicant is also requesting a setback reduction to the southern lot line from 160’ (2’ setback per 1’ height) to 68’ 5”, as measured from the plane of the southernmost protrusion of the proposed antenna array to the southern lot line. The WCF will be setback at least 2:1 from all other lot lines. 2. The subject property has no recent history prior to the pursuit of the current SUP request. The initial pre-application meeting for the proposed WCF was held on July 25, 2023. It was determined a SUP would be necessary due to the proposed WCF not meeting zoning code setback requirements to the southern lot line as well as to facilitate increased diameters for the antenna array and support structure. The formal submittal for the request was on September 7, 2023 and the technical advisory committee meeting was held on October 3, 2023. Public Participation Summary: 8. The applicant met all minimum public participation requirements by sending notice of the request to all property owners within 300’ of the site via USPS and installing two compliant posting signs on site. The applicant reported no public comment as a result of their outreach efforts. Likewise, staff has not received any public comment on the case. Outstanding Concerns from Reviewing Agencies: 9. N/A Staff Analysis: 10. Staff notes that WCFs of up to 80’ in height are an allowed use within the Rural-43 zoning district. The proposed WCF does not meet the required 2:1 minimum setback distance to the southern lot line nor maximum diameter for both the support structure and antenna array. The latter is chiefly because of the design choice to mimic an old western style water pump windmill. This design choice includes a lattice style tower, much like many antiquated windmills employed, that is much wider than a monopole WCF design commonly employed. Since the surrounding area is dominated by rural land uses, ‘western’ character, and densities this is an appropriate design Z2023106 Page 4 of 8 choice aesthetically superior to a standard WCF design. As such, staff has no concerns over the requested increase in diameter of both the support structure and antenna array. Staff notes the property adjacent to the requested reduced setback is owned by the United State Bureau of Reclamation (USBOR) and appears to act as a buffer for the canal to the south. As such there is no foreseeable adverse impact with the 68’ 5” southern setback (assuming no future lot-splits). Verizon in cooperation with ANTHEMNET (Applicant) is proposing a new Wireless Communication Facility (WCF) to be located at 30651 N 167th Ave, Surprise AZ 85387. The proposed WCF will provide residents, visitors and businesses with improved high quality reliable wireless service for both personal & business, in addition to enhancing emergency services in the area. Details of Request Applicant is proposing a new WCF to mimic an “Old-Style Water Pump” with an associated equipment compound enclosed by a masonry wall as detailed on the attached site plan/elevation. The proposed 2,500 sq/ft equipment compound will be enclosed by an 8’ Masonry wall, that will conceal the ground equipment from view. SUP Request Applicant is requesting a Special Use Permit to allow a new 80’ WCF, with an antenna diameter of 17’- 10” (due to the style of tower). The Old-Style Water Pump type of site was chosen due to the rural nature of this location, and this particular type of site has been very well received in other rural neighborhoods throughout the State. SUP Request Details/Standards that need to be varied The specific type of WCF being proposed (based on the previously detailed rationale) will require variations from the typical WCF standards outlined in MCZO 1202. WIRELESS COMMUNICATION FACILITIES. Applicant is requesting the following: Applicant is requesting to vary the maximum antenna array diameter from the required 8’ to 17’-10” (MCZO Art. 1202.3.1.h), due to the type WCF been proposed. The required 8’ diameter is outdated relative to the type of antenna/radios in use nowadays from that period when this section of code was introduced. Applicant is requesting to vary the setback of the new portion of the 80’ tall WCF from the required 160’ to 68’-5” (MCZO Art. 1202.3.1.g) as this proposed location is the only location the property owner will allow the WCF to be placed, but is the furthest away location from the nearest neighboring residential. Proposed WCF Setbacks From North Property Line: 904’-4” From South Property Line: 68’-5” From East Property Line: 774’-8” From West Property Line: 528’-6” Proposed Equipment Compound Setbacks From North Property Line: 887’ From South Property Line: 51’-9” From East Property Line: 758’-1” From West Property Line: 512’-7” Relationship to Surrounding Properties The proposed WCF will not alter or impact conditions of the surrounding properties, or impact traffic in the immediate area. Property to North: County RU-43 Property to South: County RU-43 Property to East: County RU-43 Property to West: County RU-43 The proposed site maybe visited once a month for routine maintenance, or the event of a breakdown, so the proposed use will not impact traffic or conditions in the area and will comply with all local, state and federal laws & regulations. The Department appreciates the opportunity to provide an evaluation of impacts to wildlife or wildlife habitats associated with this project. Based on the information provided, the Department offers the following general recommendations: Minimize the potential introduction or spread of exotic invasive species, including aquatic and terrestrial plants, animals, insects and pathogens. Precautions should be taken to wash and/or decontaminate all equipment utilized in the project activities before entering and leaving the site. The Department encourages the applicant to review the Arizona Department of Agriculture’s website for a list of prohibited and restricted noxious weeds and the Arizona Native Plant Society for recommendations on control methods. To view a list of documented invasive species or to report invasive species in or near your project area visit iMapInvasives - a national cloud-based application for tracking and managing invasive species. If vegetation removal/trimming is required, the Department recommends that a qualified biologist survey for nesting birds within the project area if work will be conducted during the breeding season. The trees and/or vegetation within the project area may provide nesting opportunities for avian species that are regulated under the Migratory Bird Treaty Act (MBTA) and protected under state law. Breeding season for birds in the project vicinity is generally January through late June. If it is anticipated the project will not be in compliance with MBTA, the Department also recommends contacting the U.S. Fish and Wildlife Service (USFWS) for technical assistance and options to comply with the MBTA. If trenching or digging of holes will occur, trenching/digging and backfilling crews should be close together to minimize the amount of open trenches/holes at any given time. Avoid leaving trenches/holes open overnight. Where trenches/holes cannot be back-filled immediately, escape ramps should be constructed, which can be short lateral trenches or wooden planks sloping to the surface. The slope should be less than 45 degrees (1:1). Trenches/holes that have been left open should be inspected and animals removed prior to backfilling. This email serves as our official response.
