0065) between the Arizona Department of Environmental Quality (ADEQ) and Maricopa
County through the Air Quality Department in the not-to-exceed amount of $815,200. The

An amount of up to $260,000.00 will be passed through to the Regional Public
Transportation Authority (RPTA) as an external service provider upon separate agenda

23. PILOT FIREPLACE RETROFIT PROGRAM
The authorization to develop, administer and fund in the amount of $300,000 a Pilot
Fireplace Retrofit Program. This program will, at no charge to the residents, retrofit with
catalytic conversion technology or convert from wood burning to natural gas wood burning
fireplaces to mitigate fine particulate matter (PM 2.5) emissions that can have a harmful
impact on residents. The boundaries of the pilot program area are Baseline Road, Northern
Avenue, 59th Avenue, and 16th Street. Subsequent phases will be introduced to provide
further emission reduction opportunities and may include differing elements to improve
program effectiveness.
According to the EPA and studies targeting Maricopa County, PM 2.5 emissions from
burning wood in fireplaces are a significant contributor to breathing related health issues
including hospitalizations from acute asthma symptoms. Currently, Maricopa County is in
attainment with the EPA health based standard for PM 2.5; however, three local monitors
show significant PM 2.5 concentrations during the fireplace burning season (November
through February). Exceedances of the annual standard and being designated as non-
attainment for PM 2.5 would require more stringent regulations that would limit economic
growth. This proposal to fund and implement a Fireplace Retrofit Program is a preventative
approach aimed at reducing PM 2.5 emissions to improve community well-being and to

eliminate the threat of PM 2.5 violations that would result in increased regulatory burden.
The Pilot program will focus on developing partners, outlining the process, preparing the
outreach material, and contracting with a vendor to conduct the installations. Initially, the
program will focus on houses without access to natural gas and offer the installation, by an
Arizona provider, of catalytic conversion technology in the chimney to reduce the wood
burning emission of PM 2.5 by up to 75%. The next priority will be to offer conversion from
wood burning to natural gas burning logs in houses that have access to natural gas.
The costs of retrofits may vary from $900 to $1,500, depending on the specific product and
the situation at the residence. The initial $300,000 authorization to initiate the pilot program
will include outreach efforts, administration costs, contracting, and product installation (we
anticipate that approximately 200 homes will be retrofitted during the Pilot Fireplace Retrofit
Program). Permit fees will not change due to this action. (C-85-17-001-2-00)

Ginette Weiner, resident, commented on churches being used as polling sites. She said
since an election is a secular activity polling sites should not be allowed to be in a
church and asked that churches not be considered for polling sites.
Melanee Moore, resident, commented on the Maricopa County Animal Care and Control
(MCACC) animal shelters and the manner in which animals are killed. She provided a
history of how San Antonio, Texas animal shelters improved their kill ratio. She
expressed her belief that if the shelters are opened to the media that adoptions and
donations will increase and the County should consider outside investigators to look into
the problems at MCACC shelters.
Adreinne Ayala, resident, stated she is asking for positive change within MCACC and
said current policies and procedures are not transparent to the public. She commented
on pets being killed within two hours after intake and the inconsistencies between the
east and west shelters. She expressed her desire to see guidelines implemented for
both shelters and that these guidelines be made transparent to the public.
Ed Bufford, resident, commented on his experience of the day he spent with the Director
of MCACC. Mr. Bufford spoke about statistics concerning state law which had a
mandatory connection between dog licenses and the lack of proof for rabies
vaccinations. He asked that the County meet with the State Veterinarian Board to revisit
and consider changing legislation concerning licensing and rabies vaccinations. Acting
Chairman Barney asked that the County Manager follow up on this idea.
John Rusinek, resident, provided air quality control definitions concerning air quality
codes. He reiterated his complaints about a dust issue where he lives.
Pat Vint, resident, commented on the dust problem Mr. Rusinek experiences and asked
that something be done to alleviate his problem.
Christy Skeen, resident, commented specifically about the assessments being done on
animals during intake to the facilities. She thanked Melissa Gable for raising awareness
concerning pet adoption. Ms. Skeen provided her opinion on the failure to assess pets
in the proper environment and the changes that need to be made in assessing animals
during intake.
Kim Kulpa, resident, explained that she witnessed a gentleman with Maricopa County
who beat two dogs and she rescued them. She provided pictures and documentation of
the injuries the dogs experienced. She stated the dogs are being assessed after
experiencing aggressive behavior from shelter employees and this affects their chances
of being adopted. She asked the Board to investigate these allegations and rectify the
problem.
Diane Barker, resident, stated she believes in communication and interaction with the
government. She expressed her opinion that the State Open Meeting Law allows for a
wider window for comment and that the Board is allowed to respond to public comment.
Joe Downs, resident, explained that he is a candidate for County Treasurer and
provided his qualifications for the position. He commented that accountability has not

Joy Rich, County Manager, stated she will be attending an Arizona County Managers
Association meeting to receive an award on behalf of Tom Manos, former County
Manager. He is receiving the Gabe Zimmerman Public Service Award.
Chairman Hickman thanked Supervisor Barney for acting as Chairman while he is away
on business.
Acting Chairman Barney recognized Constable Kevin Jones for serving as the Presiding
Constable. This was brought about by the County efforts through legislation to provide
consistency in budgeting and accountability for this elected office. Chairman Barney
noted that he and Supervisor Chucri along with several city mayors and other elected
officials were in the Town of Gilbert to recognize Mayor Lewis who resigned as mayor to
accept the position of Executive Director of the East Valley Partnership.

F-1. AMENDMENT TO AGREEMENT WITH EPCOR WATER ARIZONA INC. FOR 115TH
AVENUE AND UNION HILLS DRIVE DRAINAGE IMPROVEMENTS PROJECT
Approve Amendment Number 2 to the Agreement FCD 2015G005 (FCD 2015G005B) for
construction, construction management, and operation and maintenance of the 115th
Avenue and Union Hills Drive Drainage Improvements Project (Project [#450]) Water Line
Relocations between EPCOR Water Arizona Inc. (EPCOR) and the Flood Control District
of Maricopa County (District). This Amendment includes EPCOR’s waterline relocation
plans for 115th Avenue and Union Hills Drive Drainage Improvements Phase 2. The
revised estimated cost of the water line relocations and sewer force main sleeve
installation associated with this Agreement is $350,000. EPCOR will pay one hundred
percent (100 %) of the actual costs of the water line relocations for Phase 2 of the Project.
The District, in cooperation with Peoria and Surprise, completed the Glendale/Peoria Area
Drainage Master Plan Update (ADMPU) 107th Avenue and Union Hills Drive Design
Concept Report (DCR). The DCR recommended the Project to mitigate flooding in the
115th Avenue, Union Hills Drive, and 107th Avenue area. The Project was also
recommended in the FY 12/13 CIP Prioritization Procedure. The design for all phases has
been completed to the thirty percent level and the first and second phase designs have
been completed. This Agenda Item impacts Supervisorial District 4. (C-69-16-002-3-02)

F-2. IGA WITH CITY OF BUCKEYE FOR DESIGN CONCEPT REPORT FOR THE EL RIO
BUCKEYE LEVEES
Approve Intergovernmental Agreement (IGA) FCD 2016A013 for the Design Concept
Report for the El Rio Buckeye Levees (Project [#126]) between the City of Buckeye and the
Flood Control District of Maricopa County (District). This IGA establishes a cost share for
the Project and establishes responsibilities with respect to project design and data
collection. The estimated total Project cost is $750,000; the cost share will be 50% District
($375,000) and 50% City of Buckeye ($375,000). The IGA shall become effective when
signed by both parties and shall expire 5 years from the effective date or upon Project
completion, whichever comes first.
The District completed the El Rio Watercourse Master Plan in 2006, which identified
flooding hazards along the Gila River between the SR85 Bridge and the confluence with
the Agua Fria River, and recommended solutions, including the Project, to mitigate those
hazards. Conceptual plans for the Project include levee segments and vegetation
management, subject to revision during the engineering process. Under the terms of this

F-3. IGA WITH STATE OF ARIZONA FOR JOINT ACCESS MAINTENANCE
RESPONSIBILITIES OF THE SUN CITY WEST DRAIN
Approve Intergovernmental Agreement FCD 2016A014 (ADOT No. IGA/JPA 15-0005475-I)
for joint access of operations and maintenance roads of the State of Arizona’s (State) SR
303L project and Flood Control District of Maricopa County’s (District) Sun City West Drain
project. This IGA/JPA describes the areas to be jointly utilized, maintenance
responsibilities and permitting requirements.
The State’s SR 303L project eliminated District’s access to its Sun City West Drain
between the Litchfield and Dysart Road alignments and the State partially restored access
via a right of way grant across its SR 303L project basin west of El Mirage Rd. This
IGA/JPA addressed the remaining access needs for both parties. This Agenda Item
impacts Supervisorial District 4. (C-69-16-049-3-00)

Absent: Kunasek
F-4. IGA WITH TOWN OF QUEEN CREEK FOR THE PURCHASE, INSTALLATION AND
MAINTENANCE OF AUTOMATED FLOOD WARNING STATIONS
Approve Intergovernmental Agreement (IGA) FCD 2016A011 to purchase, install and
maintain three (3) additional automated flood warning stations for joint use between the
Flood Control District of Maricopa County (District) and Town of Queen Creek (Town). The
IGA is funded by the District through secondary property tax monies and by the Town
through its General Fund monies. The District’s contribution to this program is the design,
installation and perpetual maintenance of the flood warning stations and associated
electronics. The purchase price of the equipment, estimated to be $24,850.00, will be
reimbursed by the Town. Installation of flood warning assemblies at additional locations in
the future would require budgeting of additional funds toward the IGA by the Town.
The District and several cities (Scottsdale, Fountain Hills, and Phoenix) have in the past
shared in the funding of flood warning stations considered outside our backbone system
using similar IGAs. As in this proposed IGA, each City paid for the initial equipment, with
the District providing installation, long-term maintenance and data access. This Agenda
Item impacts Supervisorial District 1. (C-69-16-047-3-00)

F-5. COMPETITION IMPRACTICABLE PROCUREMENT WITH NINYO & MOORE FOR ON-

Formal Meeting Minutes

CALL QUALITY ASSURANCE MANAGEMENT AND MATERIALS TESTING SERVICES
Approve a Competition Impracticable Procurement, Maricopa County Procurement Code,
MCI-351, in the amount of $500,000.00, with Ninyo & Moore to provide Quality Assurance
Management and Materials Testing Services for the construction of the White Tanks FRS
No. 4 Phase 2 Rehabilitation Project. The Contract FCD 2016C015 will be effective for
1,095 calendar days from the date of execution or the expenditure of $500,000.00,
whichever comes first. As an option, the Contract may be extended by change order for an
additional period of 730 calendar days, or expenditure of the remaining funds.
Ninyo & Moore provides Quality Assurance Management and Materials Testing Services
under the current On-Call Contract FCD2015C002 for the White Tanks FRS No. 4 Phase 2
Rehabilitation Project which is presently under construction. The original contract was
$500,000.00 and these monies will be fully expended by October of 2016. Due to the
complex nature of pre-construction testing activities required by the regulating authority
(Arizona Department of Water Resources) and observed by the Federal funding partner
(Natural Resources Conservation Service) Ninyo & Moore was engaged to provide their
services almost seven months prior to the actual construction start date. As a result of both
the unforeseen pre-construction expenditures and the actual construction expenditures to
date, only 55% of the funds are remaining. Since a further twelve months are required to
complete the construction project, the allocated funds remaining under the present
Contract will not be sufficient to complete the Project. Therefore, it is estimated that an
additional $500,000.00 will be required on the contract for Ninyo and Moore to finish the
remaining Quality Assurance Management and Materials Testing Services.
The proposed funds will provide continuity of Quality Assurance Management and
Materials Testing Services by the same firm that is currently engaged with the work. As
Ninyo & Moore is the Quality Assurance and Materials Testing Firm of Record for the
Project, it is the only firm with sufficient project expertise to provide these services and
produce the quality assurance sections of the final construction completion report as
specified in AAC R12-15-1213. The project needs to retain the Firm of Record until project
completion. This Agenda Item impacts Supervisorial District 4. (C-69-16-050-5-00)
