This Agreement is entered into by the MARICOPA COUNTY, a political subdivision of
the State of Arizona, and Marianne Fike, Trustee of the Marianne Fike Trust dated
November 15, 2005 and shall become effective upon acceptance by the Maricopa
County Board of Supervisors.
Maricopa County is acquiring a portion of property owned by Marianne Fike, Trustee
of the Marianne Fike Trust dated November 15, 2005 for the above referenced
project. In order to accomplish the proposed roadway improvements, Maricopa County
agrees, at County expense, to have removed and replaced the existing electronic entrance
gate currently located within the portion of property being purchased for the project.
Per the appraisal that Maricopa County has received from John M. McCook, Appraiser
and per the estimate provided by Parker & Son's, Inc a cost-to-cure estimate for this
work totaling Thirty-Six Thousand Seven Hundred Forty-One and no/100 Dollars
($36,741.00) and broken down as follows:
40 linear feet of arched iron frame, pinch rollers,
track, nylon wheels, and powder coat finish (appraisal) $ 8,000.00
Keypad entry with motor drive (appraisal) $12,000.00
Install new electrical conduit underground to transformer
location, install new feeder wires and pedestal panel, new
bonding and grounding for new panel, all permit fees,
boring 36 inch deep 175 LF to transformer, digging pits
for boring machine, new electrical conduit, includes SRP
fees, wire in new gate system, cement in new pedestal
panel, pedestal panel (estimate from Parker & Sons, Inc.) $16,741.00 (rounded)

THEREFORE, in consideration of the mutual covenants and agreements contained
herein, the parties hereby agree:
MARICOPA COUNTY AGREES:
A. To issue a warrant in the amount of Thirty-Six Thousand Seven Hundred Forty-
One and no/I00 Dollars and ($36,741.00) payable to Marianne Fike, Trustee of
the Marianne Fike Trust dated November 15, 2005 for cost-to-cure payment.

AGREE:
1. To accept the sum of Thirty-Six Thousand Seven Hundred Forty-One and no/100
Dollars ($36,741.00) for cost to cure payment.
2. That should they have additional claims against Maricopa County, it will make
specific claims in compliance with the procedures and conditions set forth in ARS
12-821.01.
3. To complete all necessary work by March 15, 2017.
4. That they are solely responsible for the adequacy of the work plan, the selection
of the contractors, and for the sufficiency of the work performed by said
contractors as set forth in the work plan,
5. To release Maricopa County, a political subdivision of the State of Arizona,
GRANTEE, from any further obligations concerning the compensation for the
items described above on the aforementioned property located in Maricopa
County, Arizona.
