Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: October 5, 2016
Case #/Title: 1. CPA2016001 – Dillon Aero
2. Z2016004
Supervisor District: 5
Applicant/Owner: Lewis Roca Rothgerber Christie/Flying Bucket LLC.
Requests: 1. Comprehensive Plan Amendment (CPA) to change the land
use designation from Rural Development Area to Heavy
Industrial. CPA approval is by resolution.
2. Zone Change from Rural-190 to IND-3 Industrial Unit Plan of
Development (IUPD) to allow for a weapons testing facility.
Site Location: Generally located west of 99th Ave. approximately 2 miles
south of Schumacher Ln.
Site Size: 610 acres (240 acres – operations area only)
County Island Status: No
Additional
Comments: There are no outstanding concerns from reviewing agencies.
Staff presented the Commission with a memo (attached)
regarding changes to recommended conditions of
approval (‘c’ and ‘e’) for Z2016004. These changes would
allow for flexibility with obtaining fire protection services as
service contracts are still being discussed. Also, there would
be more specifics included with regulative entities and
restrictions to commercial recreational and/or sporting use
of the facility. The Commission agreed to these
recommended changes.
The applicant presented at the Commission hearing
changing the berms on the testing site from 8’ (h) to 20’ (h)
per BLM request. This would require revisions to the site plan
and narrative report for both cases. The Commission was in
favor of this and recommended to exclude the “expansion
area for buffer” from the IND-3 IUPD requests and to keep
the area as Rural-43 zoned property. The Commission
recommendation changing the IND-3 IUPD rezoning
acreage from 610 acres to only include 240 acres (APN #s
300-32-001A & 300-32-001D) for the test range operations

area only. The recommendation alters conditions ‘a’ and ‘b’
for both CPA2016001 & Z2016004.
Shown below in legislative edit format are all the
modifications as recommended by the Commission:
CPA2016001
a. Development of the site shall be in conformance with the Narrative Report entitled
“Dillon Test Range General Comprehensive Plan Amendment”, consisting of 23 pages
including the land use exhibit, dated stamped received July 1, 2016, except as
modified by the following conditions. The Comprehensive Plan Amendment shall only
apply to parcels 300-32-001A and 300-32-001D. Within 30 days of Board of Supervisors
approval, the applicant shall submit a revised Comprehensive Plan Amendment
narrative report that references the two parcels utilized for the test range operations.
b. If the Board reverts the zoning back to Rural-190, this land use plan shall be considered
for amendment to change the land use designation back to Rural Development
Area. The Comprehensive Plan Amendment shall only apply to parcels 300-32-001A
and 300-32-001D for the test range operations.
Z2016004
a. Development of the site shall be in conformance with the Site Plan entitled, “Dillon Aero
Flying Bucket Property”, consisting of 10 full-size sheets, stamped received July 1, 2016
except as modified by the following conditions. Within 30 days of Board of Supervisors
approval, the applicant shall submit a revised site plan showing the IND-3 IUPD zoning
district only applies to the testing operations on parcels 300-32-001A and 300-32-001D
and identify the location of the proposed 20’ (h) berms.
b. Development of the site shall be in conformance with the Narrative Report entitled
“Dillon Aero Test Range Rezoning Request”, consisting of 13 pages stamped received
August 16, 2016, except as modified by the following conditions. Within 30 days of Board
of Supervisors approval, the applicant shall submit a revised narrative report indicating
the IND-3 IUPD zoning district only applies to the testing operations on parcels 300-32-
001A and 300-32-001D and address the location and height of the proposed 20’ (h)
berms.
c. The applicant/property owner shall submit a ‘will serve’ letter from The Goodyear Fire
Department or other fire department approved by Maricopa County staff for fire
protection services for the project site. Alternatively, Maricopa County staff may accept
alternative means of fire protection deemed acceptable to staff. A copy of the ‘will
serve’ letter or other materials deemed acceptable by Maricopa County staff shall be
required as part of the initial construction permit submittal.
e. Approval of this Zone Change is contingent upon a valid contract with the U.S.
Government for the stated operations. The site shall not be used for recreational,
personal, or other uses. Upon termination or expiration of the contract with the U.S.
Government, compliance at all times with all conditions and requirements imposed on
the property or applicant by Alcohol, Tobacco, Firearms and Explosives (ATF);

Homeland Security (HS); and all U.S. Customs and Border Protection (CBP) requirements
for the property, applicant or operations and the associated Foreign Trade Zone. If at
any time the property, applicant or operations are not in full compliance with all ATF, HS
or CBP requirements or if the applicant uses the property for commercial recreational
and sporting purposes (such as charging a fee to allow members of the public to target
practice or otherwise use the property), the zoning shall may be scheduled for public
hearing by the Maricopa County Board of Supervisors (Board), upon recommendation
by the Maricopa County Planning and Zoning Commission (Commission), to consider
revocation of zoning.
A super-majority vote (4 affirmative) of the Board of Supervisors for IND-3 IUPD zone
change has been triggered with opposition of 78.14% of 300’ parcels by acre and
81.82% of 300’ parcels by number (see attached maps). Legal counsel opines that the
super-majority vote would not be required if the Board were to vote to approve the
Commission recommendation to only include the 240 acres for the Zone Change
request.
Commission
Recommendations: On 9/8/16, the Commission voted 6-0 to recommend
Approval of CPA2016001 subject to conditions ‘a’ – ‘c’ with
revised language for conditions ‘a’ and ‘b’.
Provided the following conditions are met:
Within 30 days of Board of Supervisors
approval, the applicant shall submit a revised Comprehensive Plan Amendment
narrative report that references the two parcels utilized for the test range operations.
b. If the Board reverts the zoning back to Rural-190, this land use plan shall be considered
for amendment to change the land use designation back to Rural Development Area.
The Comprehensive Plan Amendment shall only apply to parcels 300-32-001A and 300-
32-001D for the test range operations.
c. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property owner to enjoy uses in excess of those permitted by the land use existing on
the date of application, subject to conditions. In the event of the failure to comply with
any condition of approval, the property shall change to the land use designation that
existed on the date of application. It is, therefore, stipulated and agreed that such
change due to the failure to comply with any conditions does not reduce any rights
that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the
date of application due to such change.
On 9/8/16, the Commission voted 6-0 to recommend
Approval of Z2016004 subject to conditions ‘a’ – ‘k’ with
revised language for conditions ‘a’, ‘b’, ‘c’ and ‘e’.

Provided the following conditions are met:
Within 30 days of
Board of Supervisors approval, the applicant shall submit a revised narrative report
indicating the IND-3 IUPD zoning district only applies to the testing operations on parcels
300-32-001A and 300-32-001D and address the location and height of the proposed 20’
(h) berms.
c. The applicant/property owner shall submit a ‘will serve’ letter from The Goodyear Fire
Department or other fire department approved by Maricopa County staff for fire
protection services for the project site. Alternatively, Maricopa County staff may
accept alternative means of fire protection deemed acceptable to staff. A copy of the
‘will serve’ letter or other materials deemed acceptable by Maricopa County staff shall
be required as part of the initial construction permit submittal.
d. The owner shall apply for building permits for all existing structures. The owner shall
receive final inspections on all existing structures from Planning and Development within
one year from Board of Supervisors approval of Z2016004.
e. Approval of this Zone Change is contingent upon compliance at all times with all
conditions and requirements imposed on the property or applicant by Alcohol,
Tobacco, Firearms and Explosives (ATF); Homeland Security (HS); and all U.S. Customs
and Border Protection (CBP) requirements for the property, applicant or operations and
the associated Foreign Trade Zone. If at any time the property, applicant or operations
are not in full compliance with all ATF, HS or CBP requirements or if the applicant uses
the property for commercial recreational and sporting purposes (such as charging a
fee to allow members of the public to target practice or otherwise use the property),
the zoning may be scheduled for public hearing by the Maricopa County Board of
Supervisors (Board), upon recommendation by the Maricopa County Planning and
Zoning Commission (Commission), to consider revocation of zoning.
f. The applicant/owner shall submit a written report outlining the status of the
development every 2 years from the date of approval by the Board of Supervisors. The
status report shall be reviewed by staff to determine whether the entitlement remains in
compliance with the approved conditions.
g. The following IND-3 IUPD standards shall apply:
1. Building Height – Maximum 50’
2. Parking – 0 spaces provided
3. Screening – 4’ (h) cattle fencing with warning signs

h. The following Engineering condition shall apply:
1. All development shall include its associated infrastructure, including but not
limited to roads, drainage channels and swales, and retention. Each area
developed for the purpose of this use shall provide or exceed its required 100-
year, 2-hour retention volume. All retained water, up to 100-year, 2-hour storms
volume, shall drain within 36 hours of the storm event that provided the retained
storm water. All drainage infrastructure shall be connected to its downstream
elements so as to create a connected system according to the layout and
designs submitted. No drainage infrastructure shall be reduced in capacity or
effectiveness going downstream.
i. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
j. The property owner/s and their successor waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
k. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any
condition, the property shall revert to the zoning that existed on the date of
application. It is, therefore, stipulated and agreed that either revocation due to the
failure to comply with any conditions, does not reduce any rights that existed on the
date of application to use, divide, sell or possess the property and that there would be
no diminution in value of the property from the value it held on the date of application
due to such revocation of the Zone Change. The Zone Change enhances the value of
the property above its value as of the date the Zone Change is granted and reverting
to the prior zoning results in the same value of the property as if the Zone Change had
never been granted.

Project Summary:
1. The applicant is requesting a CPA to change the Vision 2030 Comprehensive Plan land
use designation of an approximate 610 acres from Rural Development Area to Heavy
Industrial. In addition, the applicant is requesting a Zone Change from Rural-190 to IND-
3 with an Industrial Unit Plan of Development (IUPD) overlay. The requests are to entitle
a weapons testing facility known as Dillon Aero. This operation includes an existing
weapon testing facility and “expansion area” for buffering. The operation would also
allow for import and export of defense articles. The subject property is located west of
the 99th Ave. alignment and is approximately 9 miles north of Interstate 8.
Figure1: Labeled aerial of subject site and surrounding parcels
2. Dillon Aero has been utilizing the subject property for weapons testing products and
training government officials and law enforcement customers without entitlement. They
would need to obtain approval for these operations as a Foreign Trade Zone (FTZ) is
pending to allow for taxable trade with the United States Military and its allies. As shown
on the aerial above, the “Existing Test Range Operations” is highlighted which is 240
acres of the site. The applicant is requesting to expand to the east to essentially create
a buffer zone between the testing operation site and the private properties in the area.
The subject property is surrounded by Bureau of Land Management lands to the west,
east, south, and most of the north. There is private property to the northeast of the site
Agenda Items: 6 & 7 – CPA2016001 & Z2016004
Page 2 of 10

and 9 vacant private properties that are within the operation area. It should be noted
that the proposed buffer areas of the operation are adjacent to these private
properties. There would be approximately ¼ mile between the testing operations
parcels and the closest private property line. There would be no more than 10
employees on-site at any given time where hours of operation are not specified.
3. The CPA narrative report asserts that the proposed development meets the
Comprehensive Plan Amendment criteria in the following manner:
Whether the amendment constitutes an overall improvement to the Comprehensive
Plan and is not solely for the good or benefit of a particular landowner or owners at a
particular point in time.
This application offers an opportunity to add economic value including taxable trade,
job opportunities, and exposure to the national and international community to a
portion of the County that would otherwise not likely see economic activity. In addition
to bringing this economic value, the proposed land use also does not require public
expenditures or infrastructure.
The property has no water or sewer utility services. This request would allow for the use
of land that would otherwise not be developed or used because the property is
located in a remote area, with poor access and no utility services. Additionally, the
property is adjacent to, and almost surrounded by BLM holdings that will likely not be
developed in the foreseeable future. The proposed use also would not result in the
need for roads, sewer, or water systems and would not generate significant traffic.
Finally, the livability of the surrounding properties would not be affected because the
property would not include noticeable physical improvements and the properties in
this area are largely vacant, don’t have access to utilities (and such access is unlikely
to be economically provided) and, thus the surrounding properties are also unlikely to
develop.
Whether the amendment will adversely impact all or a portion of the planning area by:
A. Altering acceptable land use patterns to the detriment of the plan.
The proposed amendment addresses a significant area of land, but does not
include many physical improvements (an abandoned dirt landing strip, an aerial
gunnery range, several small arms ranges, a remote fueling station, as well as
basic life support facilities which include a classroom, generator power, a test
range complex and a tower for safety observation). The property would largely
remain vacant and includes a significant buffer area. All improvements are
existing and in keeping with surrounding vacant land and ranch property land
uses. The few vertical improvements are also easily removed.
B. Requiring public expenditures for larger and more expensive infrastructure.
The proposed use would not result in the need for public expenditures. The
proposed land use does not require infrastructure, including roads, sewer or
water systems that are needed to support the planned land uses.
Agenda Items: 6 & 7 – CPA2016001 & Z2016004
Page 3 of 10

C. Requiring public improvements to roads, sewer, or water systems that are
needed to support the planned land uses.
As mentioned previously, the application offers an opportunity to add economic
value. In addition to bringing this significance, the proposed land use would not
require any public improvements.
D. Adversely impacting planned uses because of increased traffic.
The proposed amendment would not have a noticeable impact on traffic. Most
trips to the property are made during off-peak hours and the property would not
generate significant traffic volume. Unlike other land uses, trips to the property
are scheduled, coordinated and limited to authorized personnel.
E. Affecting the livability of the area or health or safety of present and future
residents.
The operations on the property are isolated from populated areas and it is
unlikely the operations area is visible (unaided) from most borders of private land
holdings. The operating area is surrounded by BLM holdings of vacant land and
the area shown as the “Expansion Area” is intended to be used as a buffer area
from other properties. The operations include a sizeable buffer that mitigates, if
not eradicates, off-property effects. Additionally, Dillon values its ability to remain
in full compliance with federal and state law, continually strives for safety,
carefully trains all employees and performs periodic internal reviews to check for
any accidental error or omissions. Additionally, visitors to the site are typically
highly trained Dillon employees or military personnel quite familiar with weapons
and weapons safety.
F. Adversely impacting the natural environment or scenic quality of the area in
contradiction to the plan.
As previously noted, the property includes very few physical improvements.
Additionally, the buffer area for operations on the property is significantly larger
than the actual operations area and the buffer area would remain undisturbed
land.
Whether the amendment is consistent with the overall intent of the Comprehensive Plan
The Comprehensive Plan provides a vision that ensures a balance of land uses to
ensure high quality of life, business opportunity, environmentally protected areas and
proper placement of land uses. In accordance with the Comprehensive Plan, the
proposed Heavy Industrial land use designation for the property would provide a
unique and highly desired economic opportunity without the need for infrastructure,
with few physical features and with minimal impact on surrounding land uses which
would be separated a significant distance from operations on the property by buffer
areas.
The Economic Development Element of the Comprehensive Plan looks to create a
vital, diverse, and sustainable economy that enhances Maricopa County’s resources
Agenda Items: 6 & 7 – CPA2016001 & Z2016004
Page 4 of 10

which include human, natural, and economic resources. The proposed amendment
would support this goal by providing the opportunity for a variety of jobs, including
technical job opportunities requiring highly skilled labor and by also providing a land
use that includes significant buffer areas and very few improvements needed for the
property that would otherwise alter the natural area.
4. Vehicle access to the site would be from 99th Ave. The applicant typically accesses the
site via military grade vehicles, utility vehicles, or helicopter. The site plan shows a
layout which includes such structures as storage containers/sheds, office, garage,
bunk house, classroom, observation tower, latrine, water tanks, and engineering test
facility. The applicant is required to obtain permits for these structures. The airstrip is
non-operational as labeled on the detailed portion of the plan which is attached.

5. The applicant proposes changes to the required zoning district and other Ordinance
standards as requested through the IUPD overlay request. Below is a chart outlining
these variations from the requirements set forth in the MCZO. Justification by the
applicant for these deviations is provided following the IUPD chart.

The site has an existing observation tower for safety purposes that is 50’ (h). The applicant
provides justification for varying the requirement for a minimum solid 6’ (h) wall mentioning
that the site is nearly a square mile and would be uneconomical and inefficient to meet
this requirement. The 4’ (h) cattle fencing would fit more with the surrounding area and
would provide warning signs. The limited access to the site (exclusive to Dillon Aero
employees and military personnel) helps Dillon Aero efficiently control who enters and exits
the site. There is a request to waive the parking standards as the site does not have
traditional parking spaces. Although there would be preferred parking areas, the actual
parking area of any vehicles would be dictated by safety protocol based on the specific
operation planned for each visit.

Public Participation Summary:
9. The applicant complied with the Maricopa County Citizen Review Process with the
required posting of the site and notification by first class mail to adjacent property owners
within at least 300’ of the subject parcel and interested parties. The applicant provided
staff with a “Citizen Participation Results Report” which explains that all requirements were
met and provided a log of correspondence. Staff received 6 emails of opposition as of
the writing of this staff report which are attached. There have been stated issues with
safety, noise, property values, impact on environment and habitat, as well as concerns
with contaminants and pollutants on-site.
Outstanding Concerns from Reviewing Agencies:
10. N/A
Staff Analysis:
11. Staff believes that the proposal provides justification for the requested CPA and Zone
Change for the subject site. The operation, although existing, is without any reported
violations and the requests would entitle the property for the existing use. The applicant
has provided significant expansion areas to create buffers between the testing
operations and private properties. Staff believes this is important as included with the
site plan and narrative report to insure that there is no possibility of rural/residential
developments adjacent to the testing facility area. The rest of the facility would be
adjacent to vacant BLM land where development is unlikely. Staff will include a
recommended condition that requires the operation be limited to government related
business/training, and that recreational activity on the site would be prohibited and
could be cause for revocation of the entitlements. As the applicant states in the
narrative reports, they have to be in full compliance with Federal and State laws.
12. The requested IUPD variations offer relief from required standards for the specific land
use (weapons testing facility) which needs these changes to make the development
work for the site and would limit the land use to that requested. Staff understands that
security for the site is extremely important where access is limited and there is need for
Dillon Aero to monitor the entering and exiting of vehicles from the operation. The
existing observation tower is 50’ (h) where 40’ (h) is allowed in the IND-3 zoning district.
The observation tower is needed to view the sites operations and security purposes.
Agenda Items: 6 & 7 – CPA2016001 & Z2016004
Page 7 of 10

The request for a waiver of parking standards would be justified as the specific
operations planned for each visit change and are only limited to employees and
military personnel. Thus not needing the traditional parking standards. Lastly, the
request to vary the screening would be justified as the site is large at 610 acres and a
solid screen wall would not be efficient. For security purposes, the proposed 4’ (h)
cattle fencing with warning signs provides for better visibility of the site and meets more
of the rural character of the area while keeping the site discrete. The applicant will be
required by recommended condition to obtain permits for existing structures.
13. Water would be hauled to the site and stored for potable purposes. The septic system
would be required to obtain proper permits along with any structures that need
permitting. Per Maricopa County Department of Emergency Management (MCDEM)
comments, the applicant is provided information regarding the Emergency Planning
and Community Right-to-Know Act (EPCRA) regarding hazardous chemicals and fire
protection services concerns. Fire protection services would be provided on site, it is
also mentioned that the Goodyear Fire Department would provide services to the site
where a ‘will serve’ letter would be required once construction plans are submitted for
review. Lastly, staff received an email from the Maricopa County Sheriff’s Office stating
no objections to the requests.
14. This is a remote location far removed from any residential neighborhood. The Mobile
community is near frontier condition at less than 3 persons per square mile for this isolated
region of the county. This use would not be compatible with residential development.
Recommendations: (two motions - CPA2016001 & Z2016004)
15. For reasons outlined in this report, staff recommends the Commission motion for Approval
with conditions ‘a’ –‘c’ of CPA2016001.
Provided the following conditions are met:
a. Development of the site shall be in conformance with the Narrative Report
entitled “Dillon Test Range General Comprehensive Plan Amendment”,
consisting of 23 pages including the land use exhibit, dated stamped received
July 1, 2016, except as modified by the following conditions.
b. If the Board reverts the zoning back to Rural-190, this land use plan shall be
considered for amendment to change the land use designation back to Rural
Development Area.
c. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval
allows the property owner to enjoy uses in excess of those permitted by the land
use existing on the date of application, subject to conditions. In the event of the
failure to comply with any condition of approval, the property shall change to
the land use designation that existed on the date of application. It is, therefore,
stipulated and agreed that such change due to the failure to comply with any
conditions does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in

value of the property from the value it held on the date of application due to
such change.
16. For reasons outlined in this report, staff recommends the Commission motion for Approval
with conditions ‘a’ – ‘k’ of Z2016004.
Provided the following conditions are met:
a. Development of the site shall be in conformance with the Site Plan entitled,
“Dillon Aero Flying Bucket Property”, consisting of 10 full-size sheets, stamped
received July 1, 2016 except as modified by the following conditions.
b. Development of the site shall be in conformance with the Narrative Report
entitled “Dillon Aero Test Range Rezoning Request”, consisting of 13 pages
stamped received August 16, 2016, except as modified by the following
conditions.
c. The applicant/property owner shall submit a ‘will serve’ letter from The Goodyear
Fire Department for fire protection services for the project site. A copy of the ‘will
serve’ letter shall be required as part of the initial construction permit submittal.
d. The owner shall apply for building permits for all existing structures. The owner
shall receive final inspections on all existing structures from Planning and
Development within one year from Board of Supervisors approval of Z2016004.
e. Approval of this Zone Change is contingent upon a valid contract with the U.S.
Government for the stated operations. The site shall not be used for recreational,
personal, or other uses. Upon termination or expiration of the contract with the
U.S. Government, the zoning shall be scheduled for public hearing by the
Maricopa County Board of Supervisors (Board), upon recommendation by the
Maricopa County Planning and Zoning Commission (Commission), to consider
revocation of zoning.
f. The applicant/owner shall submit a written report outlining the status of the
development every 2 years from the date of approval by the Board of
Supervisors. The status report shall be reviewed by staff to determine whether the
entitlement remains in compliance with the approved conditions.
g. The following IND-3 IUPD standards shall apply:
1. Building Height – Maximum 50’
2. Parking – 0 spaces provided
3. Screening – 4’ (h) cattle fencing with warning signs
h. The following Engineering condition shall apply:
1. All development shall include its associated infrastructure, including but
not limited to roads, drainage channels and swales, and retention. Each
area developed for the purpose of this use shall provide or exceed its
required 100-year, 2-hour retention volume. All retained water, up to 100-
Agenda Items: 6 & 7 – CPA2016001 & Z2016004

year, 2-hour storms volume, shall drain within 36 hours of the storm event
that provided the retained storm water. All drainage infrastructure shall be
connected to its downstream elements so as to create a connected
system according to the layout and designs submitted. No drainage
infrastructure shall be reduced in capacity or effectiveness going
downstream.
i. Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Zone Change as set forth in the Maricopa County
Zoning Ordinance.
j. The property owner/s and their successor waive claim for diminution in value if
the County takes action to rescind approval due to noncompliance with
conditions.
k. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval
allows the property to enjoy uses in excess of those permitted by the zoning
existing on the date of application, subject to conditions. In the event of the
failure to comply with any condition, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, does not
reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such
revocation of the Zone Change. The Zone Change enhances the value of the
property above its value as of the date the Zone Change is granted and
reverting to the prior zoning results in the same value of the property as if the
Zone Change had never been granted.

Executive Summary
Dillon flight Test, Inc. Dillon Aero, Inc. and Dillon Precision Products, Inc. (collectively,
"Dillon") proposes to operate a test range for ammunitions and munitions within
approximately 610 acres of land located south of Maricopa Road and Schumacher
Road and west of 99th Avenue as shown on the below regional map (the "Property" or
the "Site"). The proposed test range requires a general amendment to the Maricopa
County Comprehensive Plan (the "Comp Plan") to change the current land use
designation for the Property from Rural Development Area to Heavy Industrial. This
Comp Plan amendment request is submitted in conjunction with a request to rezone the
Property from Rural 190 to Industrial 3 with an Industrial Unit Plan of Development
overlay and is required to activate a foreign trade zone within the Property (the "FTZ").

Comp Plan Amendment I Executive Summary I Dillon Aero Test Range
Dillon is a Scottsdale, Arizona based company that specializes in developing and
manufacturing military products for contracts with the U.S. government and allied
nations. Dillon redesigned the GAU-2 Minigun creating the Dillon MI34D, which was
accepted in to service with the U.S. Army in 2003 as a replacement for the GAU-2.
Dillon has a complete line of support products for the new Minigun, including helicopter,
naval, and vehicle mounts, and related safety equipment. Creation of the new Minigun
led Dillon to acquire the Property for testing their products and training government and
law enforcement customers on the gun system.
The use of the Site that is the subject of this request is associated with Dillon's facilities
located in Scottsdale. The Scottsdale facilities are located within an industrial park area
directly adjacent to the Scottsdale Airport for import/export logistics. The Scottsdale
6200729_4

Comp Plan Amendment 1 Executive Summary ! Dillon Aero Test Range
property includes a secure building that operates as the headquarters of the Dillon
companies. It is the primary location for design, development, recordkeeping and
general business activities. The Site that is the subject of this request is Dillon's primary
testing facility. The subject Site consists of an abandoned dirt landing strip, an aerial
gunnery range, several small arms ranges, a remote fueling station, as well as basic life
support facilities to include a classroom, generator power, a test range complex, and a
tower for safety observation.
The applicant has taken great care to design and locate the Dillon Test Range to
address the needs of our country and community, as discussed below:
Site Selection The test range is located in western Maricopa County adjacent to,
and almost surrounded by, Bureau of Land Management (BLM)
holdings. The proximity of the site to BLM holdings ensures the
facility is not located near, and does not affect, developed areas.
Additionally, it is not easily accessed and is relatively easy to
secure. The Property is surrounded by vacant, undeveloped
parcels. It is remote property that is not easily accessed by a
series of dirt roads and is in an area that does not have utility
service and, thus, is unlikely to develop in the near future.
Access The Property is accessed via West Maricopa Road, west of John
Wayne Parkway and a series of dirt roads in various states of
accessibility. The applicant typically accesses the Property via
vehicles. The relative difficulty reaching the Property is beneficial
to maintaining the remoteness of the Property, securing the
Property and maintaining very high safety standards.
Operations Almost all operations for Dillon are conducted at their existing
Scottsdale, Arizona facility. The Property that is the subject of this
request includes only a few improvements generally consist of: an
abandoned dirt landing strip, ia remote fueling station, basic life
support facilities, generator power, a test range complex and a
tower for safety observation. The Property is used sporadically to
allow for testing of non-sporting ammunition and munitions for
evaluation purposes.
FTZ This request is submitted in conjunction with a request to establish
a FTZ subzone comprised of two parcels: the Property and the
Dillon headquarters at Scottsdale. The Scottsdale location will be
used for the delivery, storage and shipping of items excluding
warhead munitions. The Property will be used for importation and
exportation as well as limited expending of non-sporting
ammunition and munitions for testing and evaluation purposes.
Dillon will not seek tax benefits available to an FTZ operator, so the
taxing jurisdictions will not lose any tax revenue as a result of the
FTZ locations in Scottsdale and Maricopa County. Under U.S. law
6200729_4

Comp Plan Amendment Executive Summary I Dillon Aero Test Range
provisions of the Gun Control Act and the National Firearms Act are
deferred, allowing these items to be stored and tested inside the
FTZ. Storage allows immediate access for delivery to the U.S.
military and its allies upon approval by ATE and U.S. Customs and
Boarders Protection. The location of the test range on private
property allows for expedited testing and allows Dillon to securely
maintain an inventory of items that are hard to obtain, especially on
short notice.
Economic Impact Creation of the FTZ and expansion of the range will allow Dillon to
increase its revenue and gross sales. With the additional work
and additional revenue, Dillon will likely have need for additional
professional, vocational and support staff. Dillon has already hired
one additional staff member since the FTZ was commenced and
expects it will need to hire more in the foreseeable future. As noted
above, Dillon will not seek tax benefits available to an FTZ
operator, so the taxing jurisdiction will not lose any revenue as a
result of the FTZ. Additionally, increased training activities will have
beneficial effects for local service industries as customers coming
in for testing or training at the testing range will need
accommodations and food during their stay.
Safety Dillon values its ability to remain in full compliance with federal and
state law, continually strives for safety, carefully trains all
employees and performs periodic internal reviews to check for any
accidental error or omissions. Additionally, visitors to the site are
typically highly trained Dillon employees or military personnel quite
familiar with weapons and weapons safety.
Security The Property is not easily accessed and, thus, is more readily
secured. Security for the Property is also reviewed by federal
agencies, including ATF and Homeland Security.

Comp Plan Amendment I Introduction I Dillon Aero Test Range
Introduction
The purpose of this request is to seek approval of an amendment to the Comp Plan
from Rural Development Area to Heavy Industrial to allow for the development and
operation of a test range for ammunition and munitions, including importing and
exporting of defense articles. The test range will be operated by the Dillon family of
companies. Dillon has significant experience with the manufacture and use of military
weapons and the testing of those weapons.
Dillon Precision, the original Dillon company, is primarily focused on the private
sportsman's market, manufacturing items such as reloading equipment and
accessories. As operations evolved over the years, a new company, Dillon Aero, was
formed to focus on military products for contracts with the U.S. government and allied
nations. From early work on replacement parts for the U.S. military's problem-prone
GAU-2 Minigun, Dillon eventually redesigned the entire gun system, creating the Dillon
M134D, which was accepted into service with the U.S. Army in 2003 as a replacement
for the GAU-2. Dillon has a complete line of support products for the new Miningun,
including helicopter, naval and vehicle mounts related safety equipment. Creation of the
new Minigun lead Dillon to acquire the subject Property commonly known as Flying
Bucket Ranch for testing their products and training government and law enforcement
customers on the gun system.
The use of the Site that is the subject of this request is associated with Dillon's facilities
located in Scottsdale. The Scottsdale facilities are located within an industrial park area
directly adjacent to the Scottsdale Airport for import/export logistics. The Scottsdale
property includes a secure building that operates as the headquarters of the Dillon
companies. It is the primary location for design, development, recordkeeping and
general business activities.
The subject Property consists of approximately 610 acres and consists of an
abandoned dirt landing strip, an aerial gunnery range, several small arms ranges, a
remote fueling station, as well as basic life support facilities which include a classroom,
generator power, a test range complex and a tower for safety observation. The
Property contains a bureau of Alcohol, Tobacco, Firearms and Explosives ("ATF")
approved Type 2 explosives magazine for the storage of explosives (due primarily to
powder content for training and practice with non-sporting ammunition) in furtherance of
the pending issuance of the just issued Importer Federal Explosives License held by
Dillon Flight Test, Inc. Additionally, some defense articles are controlled by the National
Firearms Act ("NFA") of 1934. Dillon holds all applicable licenses necessary to lawfully
possess, store and retransfer the same to government end-users, and U.S. government
approved foreign end-users as well as specifically licensed U.S. Companies that hold
certain Department of Justice and Department of State licenses, registrations and
permits.
Dillon values its longtime successful safety and security record. The company works
closely with federal agencies and constantly evaluates its safety and security programs
to ensure success. The details of the security and safety measures for the Property are
reviewed by ATF, Homeland Security and other federal agencies. Additionally, the

Comp Plan Amendment Introduction I Dillon Aero Test Range
Property is not easily accessed and, thus, is more readily secured. The remote nature of
the Property coupled with 24 hour, frequent and random use makes it difficult to attempt
to breach the security of the site. Finally, with regard to safety, visitors to the site are
typically highly trained Dillon employees or military personnel quite familiar with
weapons and weapons safety.
The Proposed Amendment Constitutes an Overall Improvement to the Comp Plan
and is Not Solely for the Good or Benefit of a Particular Landowner at a Particular
Point in Time
This application offers an opportunity to add economic value including taxable trade, job
opportunities and exposure to the national and international community to a portion of
the County that would otherwise not likely see economic activity. In addition to bringing
this economic value, the proposed land use also does not require public expenditures or
infrastructure.
The Property has no water or sewer utility services. This request will allow for the use of
land that would otherwise not be developed or used because the Property is located in
a remote area, with poor access and no utility services. Additionally, the Property is
adjacent to, and almost surrounded by, BLM holdings that will likely not be developed.
The proposed use also will not result in the need for roads, sewer or water systems and
will not generate significant traffic. Finally, the livability of the surrounding properties will
not be affected because the Property will not include noticeable physical improvements
and the properties in this area are largely vacant, don't have access to utilities (and
such access is unlikely to be economically provided) and, thus, the surrounding
properties are also unlikely to develop.
Below, we address each element of the Comp Plan and discuss the consistency of the
test range with the stated goals, objectives and policies of the Comp Plan. A successful
amendment to the comp Plan will establish the framework necessary to the permitting
activities required to initiate the FTZ. This Comp Plan amendment request is submitted
in conjunction with a request to rezone the Property from Rural 190 to Industrial 3 with
an Industrial Unit Plan of Development overlay to allow for operation of the test range.
The Proposed Amendment will Not Adversely Impact all or a Portion of the
Planning Area.
As detailed below, the proposed amendment will not adversely impact all or a portion of
the planning area.
1. The proposed amendment will not alter acceptable land use patterns to
the detriment of the Comp Plan.
The proposed amendment addresses a significant area of land, but does not include
many physical improvements (an abandoned dirt landing strip, an aerial gunnery range,
several small arms ranges, a remote fueling station, as well as basic life support

facilities which include a classroom, generator power, a test range complex and a tower
for safety observation). The Property will largely remain vacant and includes a
significant buffer area. All improvements are existing and in keeping with surrounding
vacant land and ranch property land uses. The few vertical improvements are also
easily removed.
The proposed amendment will not require public expenditures for larger
and more expensive infrastructure.
The proposed use will not result in the need for public expenditures. The proposed land
use does not require infrastructure, including roads, sewer or water systems and will not
generate significant traffic.
3. The proposed amendment will not require public improvements to roads,
sewer or water systems that are needed to support the planned land uses.
This application offers an opportunity to add economic value including taxable trade, job
opportunities and exposure to the national and international community to a portion of
the County that would otherwise not likely see economic activity. In addition to bringing
economic value, the proposed land use also does not require any public improvements.
The proposed use will not result in the need for public improvements. The proposed
land use does not require infrastructure, including roads, sewer or water systems and
will not generate significant traffic.
4. The proposed amendment will not adversely impact planned uses
because of increased traffic.
The proposed amendment will not have a noticeable impact on traffic. Most trips to the
Property are made during off-peak hours and the Property does not generate significant
traffic volume. Finally, unlike other land uses, trips to the Property are scheduled,
coordinated and limited to authorized personnel.
5. The proposed amendment will not affect the livability of the area or health
or safety or present and future residents.
The operations on the Property are isolated from populated areas and it is unlikely the
operations area is visible (unaided) from most borders of private land holdings. The
operating area is surrounded by BLM holdings of vacant land and the area shown as
the "Expansion Area" on the map included on page 2 is intended to be used as a buffer
area from other properties. The operations include a sizeable buffer that mitigates, if not
eradicates, off-Property effects. Additionally, Dillon values its ability to remain in full
compliance with federal and state law, continually strives for safety, carefully trains all
employees and performs periodic internal reviews to check for any accidental error or
omissions. Additionally, visitors to the site are typically highly trained Dillon employees
or military personnel quite familiar with weapons and weapons safety.

Comp Plan Amendment I Introduction I Dillon Aero Test Range
6. The proposed amendment will not adversely impact the natural
environment or scenic quality of the area in contraction to the Comp Plan.
As previously noted, the Property includes very few physical improvements.
Additionally, the buffer area for operations on the Property is significantly larger than the
actual operations area and the buffer area will remain undisturbed land.
The Proposed Amendment is Consistent with the Overall Intent of the
Comprehensive Plan.
The Comp Plan provides a vision that ensures a balance of land uses to ensure a high
quality of life, business opportunity, environmentally protected areas and proper
placement of land uses. In accordance with the Comp Plan, the proposed Heavy
Industrial Land Use designation for the Property would provide a unique and highly
desired economic opportunity without the need for infrastructure, with few physical
features and with minimal impact on surrounding land uses which uses are separated a
significant distance from operations on the Property by a buffer area.
The Economic Development Element of the Comp Plan looks to create a vital, diverse
and sustainable economy that enhances Ilflaricopa County's resources which include
human, natural and economic resources. The proposed amendment will support this
goal by providing the opportunity for a variety of jobs, including, technical job
opportunities requiring highly skilled labor and by also providing a land use that includes
significant buffer areas and very few improvements needed to the Property that would
otherwise alter the natural area.
Phasing
The Property is currently improved. No additional improvements are contemplated, thus,
the proposed land use will be implemented in one phase.
The Proposed Land Use is Suitable with Surrounding Properties
The Property has been used as proposed for a significant number of years without
adversely affecting surrounding properties. Similar to surrounding properties, the
Property does (and will) include only a few physical features akin to improvements that
would be found on ranch land. Thus, the land use is in keeping with surrounding ranch
and vacant land uses. The physical features on the Property are also easily removed,
thus, the Property can relatively easily be returned to vacant land. Finally, significant
portions of the Property will be used as a buffer area and, thus, not altered.

Comp Plan Amendment Land Use Element IDillon Aero Test Range
Land Use Element
The stated goal of the Land Use Element of the Comp Plan is to:
Promote efficient land development that is compatible with adjacent land
uses, is well integrated with the transportation system, and is sensitive to
the natural environment.
The test range is consistent with the goal of this element the improved structures on the
Property occupy only a small percentage of the approximately 610 acre site, thus using
the land efficiently; the Site has been designed to provide an ample buffer around the
test range so as to be compatible with adjacent properties (vacant land held by BLM
and private parties); and the land uses proposed for the Property are among the few
that will thrive under the existing (and likely future) lack of infrastructure, including
roadways. The Site is accessed by military vehicles and helicopters that do not require
reliable roadway networks.
The Site is also consistent, and will be compatible, with the Land Use Element
descriptions of Rural Development Area (RDA) land use areas in which it is noted that
"[w]hile the primary land uses of the RDA are residential and agricultural, other
compatible public and private nonresidential uses may be located within these areas."
The goals of the Land Use Element are further achieved by meeting the specific stated
objectives of the Land Use Element as discussed below:
Objective L2: Provide employment opportunities proximate to housing
Dillon will have to add professional, vocational and supporting staff as a result of the
creation of the FTZ and an expansion and approval of the test range. The employment
opportunities created by the Site will emanate from Dillon's Scottsdale headquarters
which location is within a developed area near ample housing opportunities. Jobs
created by this request will include various higher paying, skilled jobs and positions that
lend to hiring military veterans. These job opportunities will be created from an area of
the County that otherwise has a low probability of being developed or creating job
opportunities. The Property is not conducive to development because it has no
infrastructure, cannot efficiently obtain infrastructure, and is surrounded by BLM
property that is unlikely to develop and leaves the Property isolated from development
opportunities.
Objective L4: Provide for the coexistence of urban and rural land uses
The range provides a unique opportunity for significant economic development,
including the use and development of innovative technology within Maricopa County
without affecting the rural character of land proximate to the Property. The range
requires few buildings, it does not require infrastructure and it allows for the majority of
the Property to remain vacant. The buildings located on the Site are in keeping with
improvements that would be found on a rural, isolated ranch.

Comp Plan Amendment I Land Use Element I Dillon Aero Test Range 1
The Property is largely surrounded by vacant BLM land holdings. The few private
parcels within the vicinity of the Property are largely vacant (with the exception of a few
ranches north and east of the Property) and unlikely to be developed. The use of the
Property as a test range will be in keeping with these vacant, rural land characteristics.
Additionally, to ensure the rural character and uses in the area of the Site are not
compromised, the Property includes a significant buffer from adjacent properties to be
maintained as undeveloped land.
Objective L7: Ensure the provision of adequate public facilities
The test range presents one of the few land uses that do not require public facilities and
is a use that benefits from a lack of public facilities and access. This Property is located
in a portion of Maricopa County that is unlikely to develop because the Property is
isolated, surrounded by BLM holdings, is surrounded by rough terrain and is far from
any existing utilities. The Property is also difficult to access. It must be accessed via
dirt roads.
The lack of access to the Property assists with maintaining high security standards on
the Property. Activity is easily detected in this remote area of the County. The high
costs associated with developing infrastructure, including utilities in this area of the
County helps ensure the Property will remain remote and surrounded by vacant land.
Finally, the County will reap the benefits of the relatively high tax dollars generated from
the use of this Property without implications to the County budget. No infrastructure or
other needs will be requested of the County.

Comp Plan Amendment I Transportation Element I Dillon Aero Test Range
Transportation Element
The stated goal of the Transportation Element is to:
Provide an efficient, cost-effective, integrated, accessible, environmentally
sensitive, and safe county-wide multi-modal system that addresses
existing and future roadway networks, as well as promotes transit,
bikeways and pedestrian travel.
The test range is consistent with this goal: the range will utilize existing roadways with
adequate capacity to serve the Site. The test range is one of the few land uses that can
effectively utilize the existing transportation network serving the Property. The test
range will not result in the need for additional access routes or modifications to the
existing transportation routes. No investments in transportation systems will be required
or requested of the County.
Objective TI: Reduce the proportion of trips made in a single occupancy vehicle
Almost all trips to the range require two or more passengers. Additionally, many trips to
the Property are made during off-peak hours. The Property does not generate
significant traffic volume and trips to the site are scheduled, coordinated and limited to
authorized personnel.
Objective T4: Identify and accommodate transportation corridors
Existing access routes will be utilized to access the Site. Almost all trips to the Site
originate from the Scottsdale facility and it is accessed by vehicle or flight from
Scottsdale as identified in the below maps (flight patterns vary per standard flight
protocol). The range will not impact the local or regional transportation systems. Trips
made to and from the site are easily accommodated by the existing roadway system.

Objective TE1: Minimize and mitigate impacts of construction and operation
The test range will not result in construction activity because the infrastructure and
improvements required for the range are minimal and in place. Additionally, with
respect to ongoing operations, Dillon will work closely with Maricopa County and Luke
Air Force Base to ensure the least amount of impact on the regional and local systems.

Comp Plan Amendment I Environmental Element IDillon Aero Test Range
Environmental Element
The stated goals of the Environmental Element are set forth below:
1. Promote development that considers adverse environmental impacts
on the natural and cultural environment, preserves highly valued open
space and remediates areas contaminated with hazardous materials.
2. Improve air quality and reduce noise impacts.
The test range and its operations are consistent with the goals of the Environmental
Element: the range has been carefully sited and designed to minimize impacts on the
natural and cultural environments within the County and it is located in an area that will
not disturb sensitive areas. These goals have been met by achieving compliance with
objectives of the Environmental Element as discussed below:
Objective E2: Promote development that is compatible with the visual character and
quality of the site.
Improved structures on the Property occupy only a small percentage of lot coverage of
the approximately 610 acre site, thus maintaining the vacant characteristics of the Site
and surrounding properties. Additionally, the Site has been designed to provide an
ample buffer around the test range to be compatible with adjacent vacant properties;
and the land uses and improvements to be located on the Property are consistent with
large parcels of vacant land and rural ranch land uses.
Objective 2E2: Minimize vehicle traffic noise on sensitive land uses
The Site is located in an isolated area that is surrounded by BLM land holdings and
some smaller private land holdings. Land proximate to the Site is vacant. There are
sporadic, rural ranches located north and east of the Property. Accordingly, it is unlikely
activities on the Property will generate noise that will affect surrounding properties or
any sensitive land uses.
Environmental Effects Element
The goals of the Environmental Effects Element are set forth below:
1. Encourage development that considers environmental impacts on air
quality, water quality, and sensitive plant and wildlife species, as well as
the impacts that noise exposure has on health and quality to life.
2. Encourage development that protects preserves, enhances the use of
(where appropriate) and raises the public's appreciation of prehistoric,
historic and archaeological sites, buildings, structures and objects.
3. Encourage development that minimizes environmental hazards.

Comp Plan Amendment J Environmental Element J Dillon Aero Test Range
The test range and its operations are consistent with the goals of the Environmental
Effects Element: The range has been located to minimize impacts on the natural and
cultural environments with in the County and it is located in an area that will not disturb
sensitive areas or housing developments. These goals have been met by achieving
compliance with objectives of the Environmental Effects Element as discussed below:
Objective EE5: Encourage Noise abatement in new development located near noise
generating activities, according to federal, state and local regulations and guidelines.
As noted above, the Site is located in an isolated area that is surrounded by 13LM land
holdings and some smaller private land holdings. Land proximate to the Site is vacant.
There are sporadic, rural ranches located north and east of the Property. Accordingly,
noise abatement will not be needed in this area because noise generated from the use
of the Property will not affect adjacent land parcels. Additionally, the Property includes a
significant buffer of vacant land to further separate operations on the test range from
adjacent parcels.

Comp Plan Amendment I Economic Development Element I Dillon Aero Test Range !_
Economic Development Element
The goal of the Economic Development Element is to:
Promote a growing, balanced, efficient and diversified economy, consistent with
available resources, that enhances quality employment opportunities, improves
quality of life, and is sensitive to the natural and cultural environment.
The range is consistent with the goals of the Economic Development Element: the
range continues a long tradition of supporting our military and provides additional
industrial job opportunities requiring engineering and other professional skills. The
range will be a catalyst to provide quality employment opportunities for the County and it
has been located to be sensitive to the natural and cultural environment. Most notably,
the uses on the Property will further the following objectives and polices of the
Economic Development Element:
Objective EDI: Expand quality employment opportunities and capital investment.
The range is used to test state-of-the art ammunitions and munitions used throughout
the world. Creation of the FTZ and expansion of the range will allow Dillon to increase
its revenue and gross sales. With the additional work and additional revenue, Dillon will
likely have need for additional professional, vocational and support staff. Dillon has
already hired one additional staff member since the FTZ located on the Property and
the Scottsdale facility was commenced and expects it will need to hire more in the
foreseeable future. Additionally, increased training activities will have beneficial effects
for local service industries as customers coming in for testing or training at the testing
range will need accommodations and food during their stay.
Objective ED2: Encourage employment opportunities proximate to housing.
Dillon will have to add professional, vocational and support staff as a result of the
creation of the FTZ and an expansion and approval of the test range. These job
opportunities will be created from an area of the County that otherwise has a low
probability of being developed or creating job opportunities. The employment
opportunities created by the Site will emanate from Dillon's Scottsdale headquarters
which location is within a developed area near ample housing opportunities. Jobs
created by this request will include various higher paying, skilled jobs and positions that
lend to hiring military veterans. The Property is not conducive to development and future
economic opportunity because it has no infrastructure, cannot efficiently obtain
infrastructure, and is surrounded by BLM property that is unlikely to develop and leaves
the Property isolated from development opportunities.
Objective ED4: Enhance opportunities for education and labor training in the region
The range supports the design and development functions of Dillon's Scottsdale
facilities. The expansion of the range will allow for opportunities for additional research,
development and design jobs that lend to the hiring of military veterans. The positions
created by the range expansion will require extensive training and education.

Comp Plan Amendment 1 Comp Plan Elements I Dillon Aero Test Range
Growth Areas Element
The goal of the Growth Areas Element is to:
Promote orderly, timely and fiscally responsible growth in Maricopa
County.
The range supports an important industry to Maricopa County and our military. The
primary operations supported by the range are located in the developed airport park
located within Scottsdale. The range does not add improvements that will require any
improvements or monetary contributions from Maricopa County. Instead, the range will
help generate tax dollars that can be used to provide improvements to other parts of the
County.
Open Space Element
The goal of the Open Space Element is to:
Maintain and, where necessary, encourage expanding the open space
system for Maricopa County to address public access connectivity,
education, preservation, buffering, quantity, quality and diversity for
regionally significant open spaces.
The range supports this goal by having relatively little property within the range that will
include vertical improvements. The physical improvements located on the range will
have little to no effect on surrounding vacant land. Thus, it will be easy to maintain and
locate future open space programs near the range.
Water Resources Element
The goal of the Water Resources Element is to:
1. Promote development that makes conservative use of renewable water supplies
such as effluent, surface water, and Central Arizona Project Water when feasible,
and that uses groundwater as the primary water source only in the absence of
renewable sources.
2. Reduce the impact of development on water quality, land subsidence and
fissuring and riparian habitat.
The Range will likely have no impact on water resources in the County. Range activities
will not require water resources to be permanently located on the Site. Additionally, the
range, at 610 acres, includes substantially more land than required for the cumulative
total lot coverage including vertical improvements. Accordingly, it is easy to avoid
disturbances on the Property that would result in land subsidence or fissuring or that
would affect riparian habitats.

Comp Plan Amendment I Comp Plan Elements I Dillon Aero Test Range
Cost of Development Element
The goal of the Cost of Development Element is to:
Ensure that new development pays its fair and proportional share of the
costs of additional public facility and service needs generated by new
development.
The range is consistent with the goals of the Cost of Development Element: the range
will not require any public facilities or services that require physical improvements.
However, tax dollars generated from activities supported by and conducted on the
range can be used to help provide public facilities and service needs in other areas of
the County.

Comp Plan Amendment I Supplement IDillon Aero Test Range
Supplement for Comprehensive Plan Amendment
Location of Property: South of Maricopa Road and Schumacher Road and
west of 99th Avenue
Land Use Plan to Be Amended: Comprehensive Plan
Current Land Use Designation: Rural Development Area
Proposed Use of Property by Applicant: Test Range
Summary of features in the project request that do not conform with the Land Use Plan:
The Property will not be used for agricultural purposes. It includes some buildings
typically associated with agricultural and rural development, but it also includes some
improvements specific to the test range, although similar in feature to ranch
improvements, such as berms, fencing and some buildings that house tools and
technical equipment.
Why should this plan be amended as requested?
It is unlikely the Property has value as a potential development parcel. The proposed
land use offers significant economic value and tax revenue for the County with no
infrastructure requirements or other demands on the County. The test range is
important to diversify our county, state and regional economy and it supports U.S.
military efforts.

Rezoning Application Introduction Dillon Aero Test Range
Introduction
Dillon Flight Test, Inc. Dillon Aero, Inc. and Dillon Precision Products, Inc. (collectively,
"Dillon") proposes to operate a test range for ammunitions and munitions within
approximately 610 acres of land located south of Maricopa Road and Schumacher
Road and west of 99 th Avenue (the "Property" or the "Site"). The proposed test range
requires the Property be rezoned from the current zoning designation for the Property
(Rural-190) to Industrial-3 with an Industrial Unit Plan of Development overlay. This
rezoning request is submitted together with a request to amend the Maricopa County
Comprehensive Plan (the "Comp Plan") land use designation for the Property from
Rural Development Area to Heavy Industrial and together with a pending Foreign Trade
Zone (the "FTZ") approval to allow for taxable trade with the United States military and
its allies.
Dillon
Dillon Precision, the original Dillon company, is primarily focused on the private
sportsman's market, manufacturing items such as reloading equipment and
accessories. As operations evolved over the years, a new company, Dillon Aero, was
formed to focus on military products for contracts with the U.S. government and allied
nations. From early work on replacement parts for the U.S. military's problem-prone
GAU-2 Minigun, Dillon Aero eventually redesigned the entire gun system, creating the
Dillon M134D, which was accepted into service with the U.S. Army in 2003 as a
replacement for the GAU-2. Dillon has a complete line of support products for the new
Miningun, including helicopter, naval and vehicle mounts and related safety equipment.
Creation of the new Minigun lead Dillon to acquire the subject Property commonly
known as Flying Bucket Ranch for testing their products and training government and
law enforcement customers on the gun system.
The use of the Site that is the subject of this request is associated with Dillon's facilities
located in Scottsdale. The Scottsdale facilities are located within an industrial park area
directly adjacent to the Scottsdale Airport for import/export logistics. The Scottsdale
property includes a secure building that operates as the headquarters of the Dillon
companies. it is the primary location for design, development, recordkeeping and
general business activities.
Economic impact
Approval of the rezoning request, creation of the FTZ and expansion of the range will
allow Dillon to expand its existing operations. With the additional work and additional
revenue, Dillon will likely have need for additional professional, vocational and support
staff. Dillon offers unique employment opportunities for Maricopa County that require
engineering skills, machining skills, flying expertise, military experience and a variety of
other skill positions. Dillon has already hired one additional staff member since the FTZ
was commenced and expects it will need to hire more in the foreseeable future.
Additionally, increased training activities will have beneficial effects for local service
industries as customers coming in for testing or training at the testing range will need
accommodations and food during their stay. Finally, Dillon will not seek tax benefits

available to an FTZ operator, so the taxing jurisdictions will not lose any tax revenue as
a result of the FTZ locations in Scottsdale and Maricopa County.
Property
The subject Property consists of approximately 610 acres and includes an abandoned
dirt landing strip, an aerial gunnery range, several small arms ranges, a remote fueling
station, as well as basic life support facilities which include a classroom, generator
power, a test range complex and a tower for safety observation. The Property contains
a bureau of Alcohol, Tobacco, Firearms and Explosives ("ATF") approved Type 2
explosives magazine for the storage of explosives (due primarily to powder content for
training and practice with non-sporting ammunition). Additionally, some defense articles
are controlled by the National Firearms Act ("NFA") of 1934. Dillon holds all applicable
licenses necessary to lawfully possess, store and retransfer the same to government
end-users, and U.S. government approved foreign end-users as well as specifically
licensed U.S. Companies that hold certain Department of Justice and Department of
State licenses, registrations and permits.
Safety and Security
Dillon values its longtime successful safety and security record. The company works
closely with federal agencies and constantly evaluates and updates its safety and
security programs to ensure success. The details of the security and safety measures
for the Property are reviewed by ATF, Homeland Security and other federal agencies
and are not for public review. Additionally, the Property is not easily accessed and, thus,
is more readily secured. The remote nature of the Property coupled with 24 hour,
frequent (and random) use makes it difficult to attempt to breach the security of the site.
Finally, with regard to safety, visitors to the site are typically highly trained Dillon
employees or military personnel quite familiar with weapons and safety.
Although much of the safety and security measures and processes are not for public
review, it is important to note that no one may enter the Site without being accompanied
by a Dillon employee who is trained in life safety and weapons safety procedures.
Dillon has precise pre-testing safety checklists and procedures that are enforced at all
times. These processes are then reviewed with follow-up reviews and checks. On
average there are no more than 2 to 10 Dillon employees on the Site at any one time.
Accompanied visitors are allowed in numbers appropriate for the type of testing and the
qualifications of the visitors.
Dillon also maintains specialized safety equipment, including specialized first aid
equipment and fire suppression equipment near the areas requiring that specialized
equipment. Dillon employees are trained to use the safety and first aid equipment and a
Dillon employee always accompanies a visitor to the Site. As an aside, visitors to the
Site are also typically trained to use the specialized safety and first aid equipment.
Finally, the Goodyear Fire Department will provide service to the Site and Dillon
regularly keeps the nearest station apprised of current life safety and materials
information relevant to that service.

Rezoning Application I Introduction I Dillon Aero Test Range
Utilities and Services
The Property has no water or sewer utility services. This request will allow for the use of
land that would otherwise not be developed or used because the Property is located in
a remote area, with poor access and no utility services. Additionally, the Property is
adjacent to, and almost surrounded by, vacant Bureau of Land Management (BLM)
holdings that will likely not be developed. Finally, the Property is not deemed good
grazing land. This application offers an opportunity to add economic value including
taxable trade, job opportunities and exposure to the national and international
community to a portion of the County that would otherwise not likely see economic
activity.
In addition to bringing economic value and activity to an area of the County that would
likely not otherwise have such an opportunity, the proposed land use also does not
require any public expenditure for infrastructure. The proposed use will not result in the
need for roads, sewer or water systems and will not generate traffic. The livability of the
surrounding properties will not be affected because of significant buffer areas and
because the adjacent properties are vacant and most are held by federal agencies and
unlikely to develop.
6470438 5

Rezoning Application I Purpose of Request 1 Dillon Aero Test Range
Purpose of Request
The purpose of this request is to obtain approval of 1-3 zoning for the approximately 610
acre Site with an Industrial Unit Plan of Development overlay over the entirety of the
Site to allow for the development and operation of a test range for ammunition and
munitions, including importing and exporting of defense articles. Approval of this request
will support existing operations located in Scottsdale as well as a pending FTZ to be
located on the Property and to be associated with another subzone at the Scottsdale
property. The FTZ supported by this rezoning will allow for expedited testing and
maintenance of an inventory of items that are hard to obtain, especially on short notice.
Specifically, under U.S. law provisions of the Gun Control Act and the National Firearms
Act are deferred allowing these items to be stored and tested inside the FTZ. Storage
allows immediate access for delivery to the U.S. military and its allies upon approval by
ATF and U.S. Customs and Boarders Protection. This access ensures timely delivery to
the U.S. Military and its allies.
IUPD
The 1UPD is requested to address building height, fencing and parking requirements
and other development requirements and restrictions. The Site requires the use of an
observation tower that is approximately 50 feet in height, whereas the Industrial-3
district allows a building height of only 40 feet. Accordingly, Dillon has requested a
maximum allowed height of 50 feet. The Industrial 3 district also requires a 6 foot high
minimum height solid masonry wall. The Site is nearly a square mile in size and it
would be uneconomical and inefficient to use a 6 foot high solid masonry wall around
the perimeter of the Site or around the active areas of the Site in which some flexibility
in entry points is required. The Site currently includes a 4 foot high cattle fence with
warning signs. The fencing currently used on the Site, and the fencing proposed with
this application, is more in keeping with the fencing used in the surrounding area (which
area consists largely of vacant and ranch land).
It should also be noted the Site is in an isolated area that does not have utility service
and the remoteness of the Site renders it unlikely to be able to secure utility service.
Accordingly, the Site uses potable water that is transported onto the Site by Dillon
employees. A septic system is used for waste removal. The Site also does not have
access traditionally associated with a property with Industrial 3 zoning. Unlike most
developed properties, limited access is preferred for this Site. Limited access helps
Dillon efficiently control who enters and exits the Site. The Site is not accessed by the
general public; it is accessed almost exclusively by Dillon employees and military
personnel often by using utility vehicles that do not require traditionally accessible
roads. Finally, the Site does not include traditional parking spaces. Access to the Site
is strictly controlled such that only a few vehicles are allowed on the Site at any one
time. Finally, although there are preferred parking areas, the actual parking area of any
vehicles is dictated by safety protocol based on the specific operations planned for that
visit. Any vehicles allowed on the site are parked in safe locations based on planned
operations.

Rezoning Application I Description of Proposal I Dillon Aero Test Range
Description of Proposal
Dillon proposes to use portions of the Property to import and export defense articles and
to engage in limited expending of non-sporting ammunition and munitions for testing
and evaluation purposes. Approximately 240 acres of the 610 acres that comprise the
property are currently used for test range purposes and approximately 26.3 acres of the
referenced 240 acres are the subject of a concurrent application for approval of a
Foreign Trade Zone (FTZ). The remaining 370 acres of the 610 acre Property will be
used as a buffer around private property holdings in close proximity to the Property.
The approximate locations of these land uses are shown on the below maps.
As shown in detail on the site plan associated with this application, the improvements
located on the property can be divided into roughly four areas: the North Landing Strip
Area the South Landing Strip Area, the Testing Facilities and the Testing Range.
These improvements are discussed in detail, below:
North Landino Strip Area
This portion of the Property (a portion of Parcel 7) shares its northern and western
boundaries with undeveloped BLM holdings, its eastern boundary with vacant Dillon
holdings (Parcel 1) and runs roughly to the southern portions of the original ranch

The Testing Range portion of the Site includes gravel roads; six steel storage
containers (16.0' x 19.8', 2 smaller containers, 6.6' x 7.9', 6.0' x 7.7' and an oddly
shaped container roughly 30' to 39' x 18.9 to 7.3') used to store supplies and materials;
four covered concrete areas of approximately 60.4' to 75.3' x 13.7' to 14.1' used to
shade operators during testing; and the immediately aforementioned four covered
concrete areas each face bermed horseshoe shaped testing areas formed by 8' high
berms roughly 100' wide and varying in depth (approximately 300' deep, 150' deep and
two at approximately 100' deep).
Almost all operations for Dillon are conducted at their existing Scottsdale, Arizona
facility. The Scottsdale location is used for research and development, production and
the delivery, storage and shipping of items (excluding explosive warhead munitions).
Dillon's employees are housed at the Scottsdale facility. The Property that is the
subject of this request will be used for importation and exportation as well as limited
expending of non-sporting ammunition and munitions for testing and evaluation
purposes. The range located at the Property is used sporadically for both day and night
testing conditions.

Rezoning Application I Surrounding Properties I Dillon Aero Test Range
Relationship to Surrounding Properties and Buffer Areas Related to Surrounding
Properties
The test range is located in western Maricopa County adjacent to, and almost
surrounded by, Bureau of Land Management (BLM) holdings that are vacant. The
proximity of the Site to the vacant BLM holdings ensures the facility is not located near,
and does not affect, developed areas. As shown in the above map, there are also
approximately 30 acres of privately held vacant property that is excluded from the
section of land that otherwise constitutes the Property. Properties in this area are within
the Rural-190 zoning district and will be isolated from operations on the Site by a buffer
area that surrounds these properties (this buffer area is shown as land outside of the
yellow highlighted areas and marked as "Expansion Area"). There are also some private
land holdings to the northeast of the Site. This property to the northeast of the Site is
also within the Rural-190 District and will be adjacent to the above-referenced buffer
area. There is a 4' cattle fence with warning signs posted around the perimeter of the
Site. Additionally, there are berms installed for protection within the range for screening
from surrounding, largely vacant, properties.
The use of the Property as a testing range is in keeping with these vacant, rural land
characteristics. The improved structures on the Property occupy only a small
percentage of lot coverage of the approximately 610 acre site. The land uses proposed
for the Property are among the few that will thrive under the existing (and likely future)
lack of infrastructure, including roadways. The Site is accessed by military-grade
vehicles, utility vehicles and helicopters that do not require reliable roadway networks
and the test range does not require utility services.
Location and Accessibility
The Property is accessed via West Maricopa Road, west of John Wayne Parkway off of
State Route 238 and a series of dirt roads, including 99th Avenue that are in various
states of accessibility. The applicant typically accesses the Property via military grade
vehicles, utility vehicles or helicopter. Precise details concerning access to the Site are
not for public review and access to the Site is ultimately determined by the safety
protocol associated with the specific testing to be done on the Site. The relative
difficulty reaching the Property is beneficial to maintaining the remoteness of the
Property, securing the Property and maintaining very high safety standards.
Circulation System
The test range would not measurably affect local transportation systems. Access to the
Property is tightly controlled and only a few vehicles or aircraft access the site per day.
Due to the nature of the land uses on the test range, there are only a few vehicles
present on the Property at a time. Vehicles access the Property and park on the
Property in accordance with safety protocol associated with the training activities for that
visit.
6470438 5

Rezoning Application I Surrounding Properties I Dillon Aero Test Range
No traffic circulation improvements or dedications are anticipated. As noted earlier, the
relative difficulty reaching the Property is beneficial to maintaining the remoteness of the
Property, securing the Property and maintaining very high safety standards.
Development Schedule
The Property is currently improved and, thus, will be developed and operated in one
phase. The Property is currently improved with facilities including: a remote fueling
station; basic life support facilities; generator power; a test range complex (comprised of
concrete and berms); an older ranch home; a classroom; restroom facilities; a septic
system; secure munitions storage (re-enforced steel container) with security fences; a
tower for observation (constructed of metal beams); and ancillary supporting
improvements primarily used for storage of equipment. The applicant is working with
County officials to secure permits for these improvements, as required.
Community Facilities and Services
There are no community facilities located near the Property and none are necessary.
Public Utilities and Services
This request will allow for the use of land that would otherwise not be developed or used
because the Property is located in a remote area, with poor access and no utility
services. The proposed use will not result in the need for roads, sewer or water
systems and will not generate traffic.
Potable bottled water is transported to the Property by Dillon employees, as needed
based on use of the Property. Bulk water for septic use is transported to the Property,
as needed, by Dillon employees. The Property includes an on-site septic tank system
and accompanying restroom facilities. The applicant will work with County officials to
secure proper permits for the system and any buildings.
Refuse is removed from the Property after each visit.
Fire protection is provided on-site, as noted under the Safety discussion in the above
Introduction, and as also noted above; the Goodyear Fire Department will provide
service to the Site. Police protection is provided the Maricopa County Sheriffs
Department (which department conducts training at the Site), BLM law enforcement and
security services and on-site security measures.

RE: Dillon Aero CPA2001001 & Z2016004
The Maricopa County Department of Emergency Management has reviewed
the materials for the request for a Comprehensive Plan Amendment and
zoning case to allow a testing facility for defense articles, NFA weapons and
non-sporting ammunition.
MGDEM has two items of note related to the proposed land use.
First, Section 311 of the Emergency Planning and Community Right-to-Know
Act (EPCRA) of 1986 requires that any facility required under the
Occupational Safety and Health Act to prepare or have available a Safety
Data Sheet (SDS) for a hazardous chemical must submit an SDS (for each
hazardous chemical which meets or exceeds a specified threshold quantity at
the facility) to the state emergency response commission (www.azsersc.org ),
the Local Emergency Planning Committee (www,maricopa.gov) and the local
fire department with jurisdiction over the facility.
• As the applicant notes the existence of a remote fueling station as well as
storage, the applicant is responsible for determining whether these
regulations apply and, if so, meeting their reporting requirements. The
reporting thresholds are codified in 40 CFR 370.10
(http://www.opo.davfidsvsisearchinome.action ):
Secondly, the narrative indicates that fire protection is provided on-site;
however, details regarding the method are not noted. The use of munitions
even in a sparsely vegetated area does cause considerable concern, as
would any accidental exposure to stored munitions. The narrative should
detail the type of fire protection provided. MCDEM would also point out that
the property owner may be held liable for any fire starting on the subject
property due to use and spreading to other properties.
If you have any questions regarding our comments, please contact Julie
Syrmopoulos at (602) 273-1411.

Hello,
We are Daniel and Kati Ong. We own parcel 300-29-020D which is within 300 ft of the subject area.
We want to state that we are opposed to the proposed zoning change of approximately 610 acres from Rural -
190 to Ind-3 IUPD allowing weapons testing.
Our opposition is based on the loud noise and safety concerns involved in weapons testing. These factors will
harm the potential use of the property and also its property value.
Please give our opposition and reasons serious consideration.

Ms Baker,
I am writing you to protest and ask for reconsideration of the potential action that the County is considering to
make changes to the current use allowed for the property represented in this above referenced cases. I and my
family own the following parcels: Parcel 300-32-F,
Parcel 300-32-V,
Parcel 300-32-P
As you are aware, the petitioner, Dillion., currently has been using the land in violation of it's current zoned
usage to develop ammunitions and to fire and test high powered Gatling guns for military use. The You Tube
video that they have posted give a striking example of the intensity of their usage of this property. I am not
against developing guns or testing ammunitions, but this usage, in this location, is inappropriate. Their testing at
this site destroys the ability for those of us that bought property in the Vekol Valley, to use our property without
fear of injury or death. I can not enter my property without the fear of death from their firing of live
ammunition/bullets flying through the air. This proposed usage destroys the intended usage of the properties as
they were originally intended. Not only will our lives be at risk when we are on the property, but any livestock,
horses or other living things will be exposed to these same hazardous activities If this Plan Amendment and
zoning change request is approved this, my property will become useless and of no value to me, my family and
the other families that have purchased this land and have paid property taxes to Maricopa county for so many
years. I am asking the Board of Supervisors to deny both requested changes.
My other concern is for the habitat represented within the surrounding area impacted by this request to amend
the permitted usage. As you may be aware, environments can be more fragile than what would commonly be
considered. One impact to an environment or ecosystem is the amount of rainfall the specific ecosystem
receives. The lower the rainfall in a particular area, the more fragile the environment and its ability to repair
itself from damage is. This pristine desert has one of the lower rainfall rates in our state. The adjacent land was
designated a protected area due to the uniqueness of the landscape. We believe that as long as we own this land,
we should be afforded the same protection from damage. Should the supervisors approve the requested changes
represented by this use request, the increased usage will continue to damage this unique and fragile site. As an
interested land owner, I have not been provided or seen an environmental impact study related to the site,
however it is highly probable that the area's aggressive use will further damage and destroy the value of this
unique habitat. As it is now, the damage caused by driving vehicles has created significant broken surface area
which is stirred up into minor dust stoups with every minor wind event. I am asking the Board of Supervisors
to deny both requested changes.
I intend to be present at the hearing on September 8th, 2016 and will be very willing to express my
concerns. Should you wish to personally discuss this with me, feel free to call me on my cell phone (602-318-

represented by these two cases (Case 2016001, and Case 2016004)

Subject: Oppose/Against Approval for Case Numbers CPA2016001 and Z2016004 (Dillon Aero
Dear Ray Banker,
This email serves as a notice as the property owner of Parcel 300-32-002Q
that we are strongly against the approval of Dillon Aero's request on cases CRA2016001
and Z2016004. The Planning and Zoning Commission and the Board of Supervisors must
reject/deny the request for =2016001, a Comprehensive Plan Amendment to change the land
use designation of the Maricopa County Vision 2030 Comprehensive Plan from "Rural
Development Area" to "Heavy Industrial" and case number Z2016004 for a Zone Change from
Rural-190 to IND-3 with an TUPD overlay.
My parcel is surrounded by Dillon Aero property and we strongly disapprove of
Dillon's current use as a test site and their request for rezoning. As a Mobile property
owner since 2002 in the Mobile area, we have serious concerns relating to physical
safety, devaluation of surrounding property, changes to the desert landscaping, and the
negative environmental impact caused by Dillon Aero munitions testing.
The Planning & Zoning Commission and Board of Supervisors must first consider the
negative impact from munitions testing, fuel spills, and maintenance of equipment in the
environment. You must determine if Dillon Aero has ethically complied with the same
military testing standards that are mandated by the United States Environmental
Protection Agency (EPA).
These are some of the chemical components found at testing sites to include, but
not limited to the following:
1) Contaminants detected included volatile organic compounds, polychlorinated biphenyls,
polynuclear aromatic hydrocarbons, semi-volatile organic compounds, and waste oils and
metals. These contaminants polluted not only the ground but the water table, and private
wells.
2) Noise pollution is also a concern from the munitions explosions as well as from the
aircraft delivering those munitions. They typically use live explosives, propellants,
flares and lead bullets.
An additional concern would be the landing of unexploded ordnance in the surrounding
area(s),
Due to the above concerns and issues, we strongly recommend Lhe Planning and Zoning
Commission and Board of Supervisors reject/deny Dillon Aero's request for case
numbers CPA2016001 and Z2016004.
Sincerely,
Rudy and Irene Ruiz

Planner
Maricopa County
Planning and Development Department
Dear Ray,
Thank you for explaining the process I need to follow to oppose Dillon Aero's request to rezone 610 acres surrounding
the 4.75 acres (parcel #300-32-002T) I own within a 30 acre parcel of unincorporated land in Maricopa County near
Mobile, AZ. I bought this land because it abuts a low mountain range to the rear of the parcel and has numerous large
Saguaro cacti growing on the slope of the property, unlike the flat lands of much of the surrounding area. I was willing to
pay additional money for its beauty and the fact that it was surrounded by agricultural land and BLM property (Sonoran
National Monument). This reassured me that the quiet beauty and solitude of the landscape would likely remain intact.
Over the years I have thought about building there and, in fact, had hoped to build a camp and a small retreat there for
weekend classes as I am an educator and counselor. Dillon Aero, previously unbeknownst to me, has been firing high
powered munitions (Gatling machine guns) from both Huey helicopters and jeep mounts within a few thousand feet of
my property, which is in an agricultural zone. This violates the intended use of the land.
A. I oppose the future plans as well as the current actions of Dillon Aero, which have not only altered the
surrounding landscape, but have also affected my right to quiet enjoyment. Knowing that heavy weaponry is
being shot from Huey helicopters and machine gun mounted jeeps, within a few thousand yards of my property,
causes me to feel unsafe in what now feels like a hostile environment.
B. Heidi Short (Louis and Rocha) told me I didn't need to worry even though part of my land abuts Dillon Aero's
property as the parcels they are testing on (Parcel 300-32-001 D and 300-32-001A) is 3300 feet from my
property. Dillon Aero's own specs (from their website) indicate that the Gatling machine gun is capable of
"delivering 3000 shots per minute at a range of 1093.61 yards" (or 3,280.83 feet), which is within range of my
property and even closer to another land owner's property. That's if they are firing from a stationary position,
which they are not doing, as shown in the following video, thus increasing the
risk. https://www.youtube.com/watch?v=v4gTOoE18Is (Video from Youtube.com entitled: "Death By
Helicopter (Mike Dillon/Dillon Aero in Arizona)"
C. One of my friends, a fellow land owner, and companion, were driving down 99 th Avenue when asked by two
armed men in a grounded helicopter to leave the area. If there is no danger to us, why were they asked to leave
a public through way?
D. Heidi Short also told me that the rezoning would not change anything as Dillon Aero has been flying their
helicopters and firing their guns for years. She also stated that Dillon Aero is filing for a Foreign Trade Zone (FTZ)
for this property to move munitions through customs more quickly. This can only escalate what is occurring if

they are approved. In the information I read in Dillon Aero's filing, they speak of munitions, bunkers, berms and
high security for the area (far from residential areas) to secure the arms that are stored and tested on site.
(Google Earth shows this as well as the targets they are firing at and the damage they have done to the
landscape.)
E. Dillon Aero's website indicates they currently offer a three day training on how to use the machine guns which
includes target practice. httbs://www.dillonaero.com/training.html
F. While I cannot verify just who shot at them, I noticed that the Saguaros that were healthy on my previous visits
no longer are. There were bullet casings strewn about and cactus arms which have fallen to the ground.
As a land owner, I am entitled to quiet enjoyment of the property I purchased in an agricultural zone. Under the current
circumstances, it is unlikely that I can build on my property for the purpose I had intended. Furthermore, my property
would be of no value to anyone other than Dillon Aero. No one would want to live surrounded by an active military
zone. Dillon Aero's actions and future plans have negatively impacted my land use and peace of mind as well as the
potential value of my property. For this reason, I strongly oppose their request to rezone their property.
Thank you for considering my opposition to Dillon Aero's request to rezone the 610 acres surrounding my property.

Hello Mr. Banker,
am contacting you in regards to land I own in Maricopa County, parcels #30032002N, R, and U. I want to file
a formal objection/complaint against the re-zoning of land directly west of my land.
I visited my land last weekend and saw a sign posted regarding the re-zoning of land very near my properties
from Rural-190 to Industrial-3. This concerns me very much as I had planned to build a home out there.
After looking at plat maps, I have discovered that much of the land around my parcels has been bought by
Dillon Aero aka Flying Bucket Ranch and I am pretty much surrounded. I know only a portion of these holding
are slated to be re-zoned, but having researched Dillon Aero, I also know they are a very large operation, work
on mostly military contracts, and may petition for the same re-zoning for their other parcels.
While driving I also spotted some kind of tower, huge earthen berms, and the tops of many buildings, none of
which were there the last time I visited my property. I'd like to know what is going on out there! I had planned
on building a home. If they are doing what this video shows, then my home would be in a war zone.

Hello Mr. Baker, '
I believe I have some additional information that may be pertinent to these cases and may affect the decision
made by the Planning Commission.
While I can't recall the exact time, this occurred more than 5 years ago.
My boyfriend, who is an aviation mechanic, and I had gone out to look at the roperty, and decided to explore
what was south on 99th Ave. As we were coming back, traveling north on 99 Ave., we saw 2 helicopters
overhead. It is due to my boyfriend's knowledge of aircraft that we are able to attest to the make of these
helicopters. A Huey flew in front of us about 500' in the air, circled around behind and landed to the east of us
about 100 yards away. Another helicopter, registration number N530DA, was higher up and circled overhead
the whole time. A man dressed in military garb got out of the Huey, ran over to the driver's side of our truck
and told us we needed to leave the area immediately. He was quite officious. We could see that both
helicopters had Galling guns externally mounted. Scared me, I can tell you! We were about 1/4 mile south of
my parcel of land at that point and still on 99 th Ave.
Thank you.
