Lease No. L-7357 Amendment No. 2 C-86-05-566-4-04 AMENDMENT No. 2 to LEASE AGREEMENT Between HTA-THUNDERBIRD MEDICAL, LLC, LESSOR And MARICOPA COUNTY, LESSEE RECITALS A. Lessor and Lessee are parties to that certain Lease Agreement No. L-7357 dated and approved by the Maricopa County Board of Supervisors January 4, 2005 and subsequently amended December 15, 2015. The Lease Agreement is for approximately 4,292 rentable square feet of office and clinic space at 5422 W. Thunderbird Road, Glendale, AZ 85306. B. The current term of the Lease Agreement expired July 31, 2016 and County is in holdover status. C. Lessor and Lessee now mutually desire to amend the Lease Agreement to extend the lease term, adjust the lease rate, and update Lessee Notice address. AGREEMENT NOW THEREFORE, in consideration of the foregoing recitals and other good and valuable consideration, receipt and sufficiency of which is hereby acknowledged, Lessor and Lessee agree as follows: 1. The term of the Lease Agreement is hereby extended by fifty-two (52) months, commencing October 1, 2016, and expiring January 31, 2021. This Lease Agreement is subject to termination pursuant to the provisions of A.R.S. § 38-511, the provisions of which are incorporated herein by this reference. 2. Section 20 of the Lease Agreement is updated as follows: Notices to Lessee shall be sent to: Maricopa County Facilities Management Attn: Chief Real Estate Officer 2801 West Durango Street Phoenix, AZ 85009 All rent requests shall be sent to Lessee at: Maricopa County Public Health – WIC Attn: WIC Accountant 4041 N. Central Avenue, 7th Floor Phoenix, AZ 85012 4. The parties agree that the option to extend the term of the Lease set forth in Section 4 of Amendment No. 1 to the Lease is no longer of any force or effect. 5. The effective date of this amendment is the date of execution by the Maricopa County Board of Supervisors. 6. The foregoing paragraphs contain all the changes made by this amendment. All other terms and conditions of the original agreement and as modified by subsequent lease amendments remain the same and in full force and effect. 7. This Second Amendment may be executed in multiple counterparts, each of which is an original, but all of which, taken together, constitute a single document.
