Report to the Board of Supervisors Prepared by the Maricopa County Planning and Development Department Board Hearing Date: September 7, 2016 Case #/Title: Z2015099 – Kinderland Supervisor District: 5 Applicant/Owner: Withey Morris PLC/Sandra Guerroro Request: Zone Change from Rural-43 to C-2 CUPD with a precise Plan of Development for a proposed preschool and day care center Site Location: Generally located approximately 970 ft. east of the intersection of 35th Avenue and Baseline Road in the Laveen area Site Size: 1.28 acres County Island Status: Yes (Phoenix) Additional Comments: A representative from the Laveen Planning Committee appeared at the Commission meeting to express opposition to the zone change request, citing concerns that it will attract strip commercial development to the area. Staff received an Appeal of the Planning and Zoning Commission Determination, which results in the case being placed on the Board of Supervisors Regular agenda for presentation and discussion. Commission Recommendation: On 8/4/16, the Commission voted 6-0 to recommend approval of Z2015099 subject to conditions ‘a’ – ‘j’. Provided the following conditions are met: a. Development of the site shall comply with the Site Plan entitled “Site Plan”, consisting of 1 full-size sheet, dated April 12, 2016, and stamped received July 15, 2016 except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “The Garden at Kinderland”, consisting of 36 pages, dated July 15, 2016, and stamped received July 15, 2016 except as modified by the following conditions. September 7, 2016 Z2015099 Page 1 of 3 c. The applicant/property owner shall submit a ‘will serve’ letter by Rural Metro for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. d. The following Planning conditions shall apply: 1) All retention basins must drain within 36 hours. 2) All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. 3) Detailed Grading and Drainage Plans shall be submitted with the application for building permits. 4) Access to and improvements along Baseline Road are subject to review and approval by the City of Phoenix. e. The CUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system shall be required prior to establishment of any non-residential use that requires potable water. f. The applicant/property owner shall provide a recorded copy of the 25’ access easement along the eastern parcel boundary as part of the initial construction permit submittal. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. h. The property owners and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. September 7, 2016 Z2015099 Page 2 of 3 j. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and ARS § 11-814 for five (5) years, within which time the construction permit must be obtained. The applicant shall submit a written report every five years from the date of Board of Supervisors approval of Z2015099 which details the status of this project, including progress on obtaining construction permits. The status report is to be administratively reviewed by Planning and Development with the ability to administratively accept or to carry the status report to the Board of Supervisors (Board), upon recommendation by the Planning and Zoning Commission (Commission) for consideration of amendments or revocation of zoning for the undeveloped parcel. Status reports will be required until completion of construction for the parcel. Municipal Comments: City of Phoenix letter regarding services Support/Opposition: None known Recommendation: Approve with conditions Agenda Item: 7 - Z2015099 Page 1 of 7 Project Summary: 1. On December 31, 2015, Kinderland submitted a zone change with a precise plan for a new preschool and daycare facility in the Laveen area. The request is to rezone from Rural-43 to C-2 with a Commercial Unit Plan of Development (CUPD) for a 1.28 acre parcel generally located 970 feet east of the intersection of 35th Avenue and Baseline Road. 2. The proposed Kinderland Learning Center consists of a single-story, 7,689 square foot building, behind which will be a fully fenced play yard. The site plan shows a 115-foot building setback with the first 50 feet dedicated for landscaped retention. This and other landscaped areas will constitute approximately half of the 1.28-acre site. 3. The facility will consist of six classrooms, two common area rooms, a kitchen, breakroom, laundry room, and restroom facilities to accommodate students and staff. The front of the building will consist of a covered walkway to provide shade and cover to the students and faculty entering the building. The roof will extend on the south side of the building to provide shade to students in the main playground. Site Plan Detail Agenda Item: 7 - Z2015099 Page 2 of 7 Front Elevation 4. The school will employ 16 full-time and 3 part-time staff, and enroll up to 160 students. Business hours will begin at 6:00 am and close at 6:30 pm, Monday through Friday. Kinderland will offer transportation to and from the facility, as well as before and after school care. The applicant states that these services will decrease the project’s traffic impact. 5. The site will be accessible via two driveways from Baseline Road. The west driveway includes a 25-foot wide easement for access to the residence to the south, which also belongs to the owner of the subject property. A total of 22 parking spaces are provided on the north and south sides of the building, including 2 ADA stalls. 6. The subject parcel, along with the parcel to the south, was originally part of a single parcel measuring approximately 165’ x 1280’. This extremely long parcel configuration is characteristic of other parcels in this county island. The parcel has since been split and recorded to create the subject parcel measuring approximately 341 feet in length. 7. Although not called out on the site plan, the applicant intends to install a freestanding sign along Baseline Road that will comply with the base C-2 sign regulations. Laveen Area Plan: The 1992 plan designates the property for Light Industrial Center. 11. Phoenix General Plan: Designated for Large Lot Residential (1 to 2 d.u./ac.) Public Participation Summary 12. The applicant complied with the Maricopa County Citizen Review Process with the required posting of the site and notification by first class mail to adjacent property owners within 300’ of the subject parcel and to interested parties. As of the date of this report, neither the applicant nor staff has been notified of any objections or concerns. Outstanding Concerns from Reviewing Agencies: 13. Maricopa County Environmental Services Department has concerns that the proposed 160 student preschool and day care center will be served by an offsite domestic well and an onsite septic system. The county’s comprehensive plan calls for urban development to have an urban level of services. Staff Analysis: 14. The subject site is within the future municipal planning area of Phoenix, which designates the subject property for Large Lot Residential (1 to 2 d.u./ac.). Staff received a letter from the City stating that it will not provide sewer and water services to the property as it is outside the city limits. However, staff cannot ascertain if the City is in support of or in opposition to the zone change. 15. Although a preschool/daycare is allowed in a C-1 (Neighborhood Commercial) zoning district, the applicant is requesting zone change to C-2 (Intermediate Commercial). This is consistent with the existing commercial pattern that already exists at the intersection of Baseline Road and 35th Avenue to the west. 16. Staff requires that a CUPD zoning overlay be applied to all commercial zone changes for parcels without access to a public sewer service. This is done to limit the commercial use to that which is specifically proposed by the applicant and to uses that can be accommodated via septic; until such time that the property is served by public sewer. No variations to the C-2 base zoning standards are proposed for fencing, building setbacks, or signage. 17. There is further concern with the fact that water is proposed to be provided from a domestic well on the property to the south. Septic systems must meet different setbacks from buildings, lot lines, and walls when not served by a public water system. This may severely encumber the lot. The City of Phoenix is a municipal water provider for this region and must approve creation of any new public water system for monitoring of the proposed well. 18. The properties to the east and west are primarily residential lots of at least one acre. Staff is of the opinion that the preschool/daycare facility will be of minimal impact to the area, and that the 50-foot landscape retention area between the front building Agenda Item: 7 - Z2015099 Page 5 of 7 setback helps maintain the rural character of the adjoining neighborhoods. Furthermore, the applicant’s citizen participation efforts demonstrated no neighborhood opposition to the request. Recommendation: 19. For the reasons outlined in this staff report, staff recommends the Commission motion for approval with conditions ‘a’ – ‘j’ of Z2015099: Provided the following conditions are met: a. Development of the site shall comply with the Site Plan entitled “Site Plan”, consisting of 1 full-size sheet, dated April 12, 2016, and stamped received July 15, 2016 except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “The Garden at Kinderland”, consisting of 36 pages, dated July 15, 2016, and stamped received July 15, 2016 except as modified by the following conditions. c. 4) Access to and improvements along Baseline Road are subject to review and approval by the City of Phoenix. e. A public water system shall be required prior to establishment of any non-residential use that requires potable water. f. The applicant/property owner shall provide a recorded copy of the 25’ access easement along the eastern parcel boundary as part of the initial construction permit submittal. Agenda Item: 7 - Z2015099 Page 6 of 7 g. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. j. Purpose of Requesi This request seeks companion rezoning and site plan approvals far the 41- 1.28 acre site (the "Property") which is currently the northern portion of a 4.83 acre parent parcel (APN 300-14-084) that is located east of 35th Avenue and Baseline Road (3247 W. Baseline Road) within Maricopa County Supervisor District No. 5. The northern portion of the Property is currently vacant but there is a single-family residence that exists on the southern portion of the site (which is not part of this application) that will serve as the home of one of Kinderland's owners, thereby ensuring that the Property is well-maintained at all times. The purpose of this request is to rezone the Property from RU-43 (Residential) to C-2 (Intermediate Commercial) CUPD overlay zoning with a Precise Plan of Development for a new Kinderiand Early Learning Center daycare. The CURD overlay will serve to restrict the permitted uses to only a daycare/preschool facility. Please note, the CUPD will also prohibit billboard uses. In addition, a separate request is being filed with the Maricopa County Recorder's office in order to split the Property so that a new separate parcel is created for the proposed daycare use. See Aerial Map and Lot Split Map attached at Tab 1. Kinderland is a locally-owned pre-school and daycare, which has been operating in the valley since 2005. This Kinderland Early Learning Center will be the Applicant's fourth location in the valley. With three successful locations — in Mesa, Tempe, and Central Phoenix — the owners plan to expand Kinderland to a fourth location within this Maricopa County island. Each location is purposefully designed to support the surrounding community. B. Description of Proposal The Kinderland Learning Center development consists of a single-story (26-foot tail), 7,689 square-foot ranch-style building that is orientated towards Baseline Road. Within the proposed +/- 115-feet building setback from northern property line along Baseline Road, a 50-foot landscaped retention area Is proposed which will soften the curb appeal and buffer the proposed parking area. Nearly half of an acre has been dedicated from this small site in order to provide both the significant landscaped areas along Baseline Road and other perimeter landscape setbacks that will be enhanced with a variety of drought-tolerant 1-inch and 2-inch caliper trees at planting with colorful groundcover vegetation. Clearly, this proposal will preserve the area's rural character while sustaining significant buffers between adiacent uses. See Tab 2, Site Plan, Landscape Plan and Preliminary Grading & Drainage Plan. There will be a fully-fenced play yard built behind the Learning Center. The Learning Center building will consist of six classrooms, two common area rooms, a kitchen, breakroom, laundry room, and sufficient restroom facilities to accommodate students and staff. The proposed building is comprised of a pre-fabricated metal structure enveloped by exterior stucco walls and metal roofing. Colors will reflect the character and demeanor of Kinderland, a playful and youthful style designed to stimulate creativity in its students. The design will also blend in with the Residential Character of the Area. See Tab 3, Building Elevations. The front of the building will consist of a covered walkway to provide shade and cover to the students and faculty entering the building. Rain water received by the roof will be directed to rain gutters and downspouts hidden from view and discharged onto landscaped areas around the building. The roof will extend on the south side of the building to provide ample shade to students in the main playground as to protect them from excessive sun exposure. Kinderland's mission is to "continually provide our families with the best daycare by treating children, parents, and employees with fairness and respect, and by providing children with a comfortable, nurturing, and safe environment." The Learning Center takes a uniquely complete approach to childcare by encouraging development on linguistic, social, and emotional skills in addition to the traditional aspects of developmental care. Poge 2 Kinderland Early Learning Center The Learning Center will provide transportation to and from the facility, thereby decreasing the project's traffic impact. Kinderland also offers before and after school care, which will decrease the traffic flow during peak hours. Business hours will begin at 6:00am and close at 630pm. In order to ensure it is providing the highest level of care to its students and families, Kinderland has partnered with outside organizations such as the T.E.A.C.H. ® initiative, which is a national organization aimed at increasing the professional qualifications of primary school educators. Kinderland has also partnered with Empower Plus, Arizona's Quality First Program, and the Association for Supportive Child Care. Kinderland's commitment to providing its students and their families with a first-rate, quality experience is apparent and the Applicant is eager to bring its services to this key area within Maricopa County. A large part of that quality includes providing a peaceful, clean, and safe environment in which children can learn and develop. The owners' relationship to the Property and the nature of the proposed use cause the Applicant to be uniquely committed to ensuring the development is one that improves the surrounding area and continues to benefit its neighbors for years to come. C. Justification for Request The subject land use proposal implements Maricopa County's Comprehensive Plan objectives of providing employment proximate to housing (Goal 1.5) and encouraging innovative and varied approaches to development (Goal 1.3) by bringing a low-intensity commercial use on an underutilized property which fronts Baseline Road. Due to the site's immediate access to a major arterial roadway, this project as proposed will not have a negative impact on the existing/future land uses or existing conditions of the adjacent residential properties. This request involves a small undeveloped parcel that is within approximately 600-feet of nearby C-2 Commercial zoned properties which are located at the intersection of 35 6 Avenue and Baseline Road. This proposal is consistent with the commercial zoning pattern that already exists along Baseline Road and is appropriate given that nearly every motor arterial intersection accommodates a variety of non-residential uses which support the local residential communities. See Tab 4, Zoning Map. Further, most traditional commercial users are incompatible with this property. The irregular shape of the parcel diminishes the visibility along Baseline Road and small size of this site limits the available area needed for parking and circulation that most commercial users require for their operations. Furthermore, traditional commercial users do not use a septic system to support the businesses, which is the only sewer option for this site. The proposed C-2 zoning with a Precise Plan of Development for this small daycare use provides the flexibility needed without unnecessarily creating a significant opportunity for the Property to be redeveloped in the future with a much more intense commercial use. D. Relaitenship to Surrounding PfGperfies The Property is surrounded by rural (R-43) and commercial (C-2) zoning districts. The area is a mixture of rural, commercial, and residential uses with a number of small businesses growing alone Baseline Road and 35* Avenue. Just to the west of the Property are a QuikTrip gas station and a self-storage facility, to the east: a limousine rental location, and to the northwest: a Circle K and Mexican Food restaurant. Each of these uses is more intense than the proposed Learning Center, but also exhibits a need for a few basic, commercial uses within a close proximity to the existing residences. This area is particularly unclerserved in terms of childcare and Kinderland will be the only learning center within a four mile radius. The Project also lies within the Laveen Village Southwest Growth Study (the "Growth Study"). See Southwest Growth Study Boundary Map attached at Tab 5. One of the chief objectives of the Growth Study is, "[to] establish an appropriate land use and balanced housing mix; encourage development which protects existing residential lifestyles and natural resources. A mixture of land uses will be needed in Laveen at build out to have a balanced community that provides options for housing, work, and commerce. Development that complements existing uses and rural character can help maintain Laveen as a special and unique area." The proposed Learning Center will achieve Page 3 a mixture of kind uses in a way that will not disrupt the rural feel of the area. It will also provide a conveniently- located childcare facility to residents who work and live nearby in furtherance of a unique, rural live and work community. Location and Accessibility The Property is located east of the southeast corner of Baseline Road and 35th Avenue (the "Property") in unincorporated Maricopa County surrounded by the City of Phoenix. The Property's frontage along Baseline Road will provide ideal access to its patrons, who will live and work in the surrounding community. The direct access off of Baseline further warrants the requested C-2 zoning. Kinderland will also provide transportation for its students and offers a variation of drop off and pick up times, which will significantly cut down on the Learning Center's impact on traffic. The proposed, looped driveway will be marked with exit and entrance signs to prevent any traffic from backing up onto Baseline Road. The internal circulation is specifically designed to keep drop-off and pick-up procedures moving effectively without interfering with local traffic. Parking is provided on the north and south sides of the building for ease of use by staff and families attending Kinderland. Accessible routes are provided for people with disabilities connecting the sidewalk to the building. The road on the west side of the property will be 26' wide to provide circulation in both directions. There will be a 12' drive on the northeast side of the Property, which will provide easier drop-off and pick-up circulation with and reduce on-site vehicle lines. The exit lane will only permit right turns, further reducing on-site vehicle wait lines. There will also be a permanent easement for ingress and egress along the western side of the Property, which will preserve access through the Learning Center to the residence to the south. F. Circulation System Legal and permanent access to the Project is provided via Baseline Road - a major arterial street along the entire north boundary of the Property. An internal road will be paved along the western side of the site, connecting the Learning Center to the residence on to the south. There is sufficient room for on-site circulation and there is more than adequate spacing for turn movements. As previously stated, this area is significantly underserved in terms of primary care uses and the proposed facility will serve as a significant amenity to the community. G. Development Schedule (phasinql It is anticipated the project will be constructed in a single phase, but Kinderland will reserve the ability to develop the Project in multiple phases if needed. gm I.Oty Services and Facilities Due to the nature of the type of use, additional services such as parks, school districts, or park amenities are not needed. Conclusion The proposed Learning Center constitutes an overall improvement to the area. The request allows for compatible development with the existing area developments and area character. The request is also consistent with the goals outlined in the Comprehensive Plan and it supports the vision and intent of the Comprehensive Plan by promoting orderly and responsible development. More importantly, the request follows the development trends represented in this area and is compatible with existing residential and C-2 commercial uses and zoning districts. City of Phoenix PLANNING AND DEVELOPMENT DEPARTMENT February 26, 2016 Farhad Tavassoli, AICP, CFMA Maricopa County Planning and Development Department 501 North 44th Street, Suite 200 Phoenix, Arizona 85008 RE: Z2015099 — Kinderland (35th Avenue and Baseline Road) Rezoning Dear Mr. Tavassoli: Thank you for the opportunity to comment on case Z2015099. Per the information you provided, the applicant is seeking to rezone a 4,73 acre property located east of the southeast corner of 35th Avenue and Baseline Road from RURAL-43 (Rural Zoning District — One Acre Per Dwelling Unit) to C-2 (Intermediate Commercial Zoning District). Staff has reviewed the application material and has the following comments: • Zoning adjacent to the subject property is R1-10 (Single-Family Residence District). Zoning on both the northwest and southeast corners of the 35th Avenue and Baseline Road intersection are C-2 (Intermediate Commercial). • The property is currently designated Residential 1 to 2 dwelling units per acre on the city of Phoenix General Plan Land Use Map. • The city of Phoenix does not provide water or sewer services outside the city limits. • The property falls within the boundaries of the Laveen West impact fee area. If the rezoning request is approved and the property is subsequently annexed into the city of Phoenix to obtain services, impact fees will be assessed. Mailing Address2: laveen, az 85339 Telephone Number: 602-435-0243 E-mail: donnysanchez@hotmail.com Reason for the Appeal of the subject case: Infrastructure - Baseline has no utilities from 31st ave to 35th ave. Existing residential properties will not make the expense to extend utilities. New developments (especially commercial) should not be allowed to build without contributing to the public infrastructure. We currently have no water, sewer, internet, phone etc. The property north of this area could be developed by pulling utilities from 35th ave and leaving baseline undeveloped. Obvious additional concerns - additional traffic on an already accident filled location, home value diminution, nuisances of proximity to any commercial property. 1
