This Intergovernmental Agreement ("IGA") is made and entered into by and between the
Arizona Department of Transportation Motor Vehicle Division (“ADOT MVD”), a government
agency of the State of Arizona, and Maricopa County, a political subdivision of the State of
Arizona ("County"). ADOT MVD and County will collectively be referred to in this IGA as the
"Parties."
RECITALS
A. ADOT MVD is ready, willing and able to provide services of the kind and character
that County wishes to provide for its citizens at various Regional Court Centers (the
“Facilities” or individually, the “Facility”), as specified in Exhibit “A” which is attached
hereto and made a part hereof, and County wishes ADOT MVD to provide such
services.
B. County owns certain real property within its county limits, including the “Facilities” as
shown in Exhibit “A”.
NOW, THEREFORE, in consideration of the covenants and promises contained in
this IGA and for other good and valuable consideration, the sufficiency of which is
hereby acknowledged, the Parties agree as follows:
TERMS
1.0 Recitals. The recitals which appear above are incorporated into this IGA by this
reference.
2.0 Applicability. The terms and conditions of this IGA shall apply to ADOT MVD’s
use of the Facilities listed in Exhibit “A,” attached hereto and incorporated herein
by this reference:
3.0 Service Area.
3.1 The County agrees to provide ADOT MVD with space in the Facilities, subject to
the terms and conditions contained in this IGA, to enable ADOT MVD to render
those services and conduct the programs and activities, as applicable, which it
customarily provides, as more specifically provided in Subsection 4.1. The
applicable space designated for the use of ADOT MVD to provide services in each
of the individual County-controlled properties to which this IGA relates shall be
referred to in this IGA as the "Service Area."

3.2 Both Parties understand and acknowledge that the services provided at each
Facility are subject to continuous review to determine the needs of the persons
using the Facilities and how to best respond to them. The nature of the service to
be provided or activity to be conducted, the frequency of need, scheduling and
need to coordinate other services and providers are all considered in determining
a suitable and appropriate Service Area.
3.3 County, after conferring with ADOT MVD, shall have the final authority and sole
discretion to determine the size and location of each Service Area at the Facilities,
and the times at which each Service Area will be made available to ADOT MVD.
ADOT MVD acknowledges by the execution of this IGA that ADOT MVD has
examined each Service Area at the Facilities, which each Service Area shall consist
of a portion of the lobby area at the Facilities sufficient in size to contain the
ServiceArizona Kiosk discussed in Subsection 4.1 of this IGA, and ADOT MVD
agrees that it is appropriate and suitable for providing the services as described
herein. Unless otherwise provided in this IGA, ADOT MVD accepts each Service
Area at the Facilities in “as is” condition. In the event that a change to the size or
location of a Service Area at one or more of the Facilities is necessary, the
requesting entity will prepare a diagram showing the proposed new Service Area. A
change shall be deemed approved when the diagram is signed by a County and
ADOT MVD Contract Administrator (defined below).
3.4 At the sole discretion of County, ADOT MVD may furnish signage at the Facility
to direct members of the public to any Service Area at the Facilities. ADOT MVD
will confer with County concerning signage, but County shall have sole discretion
to determine the signage content and amount, based upon the need for existing
signage at each of the Facilities, the need for consistency and uniformity in
signage, and other considerations. County shall not use the name of ADOT
MVD, its seal, signs or logos in any advertising, promotional materials, or for any
other purpose without the express, written prior approval of the ServiceArizona
Program Administrator. Upon full execution of this Agreement, County hereby
approves and authorizes the “ServiceArizona ADOT MVD Authorized Location”
insignia depicted on Exhibit “B,” attached hereto and incorporated herein by this
reference, to be placed on the main entrance door(s) of each of the Facilities
listed in Exhibit “A”.
