License No. P-50275 C-86-16-018-M-01 AMENDMENT No. 1 to FACILITIES USE/REVOCABLE LICENSE AGREEMENT Between PHOENIX DAY (“Contractor”) And MARICOPA COUNTY (“County”) RECITALS A. County and Contractor (the “Parties”) are Parties to that certain Facilities Use/Revocable License Agreement (the “Agreement”) approved by the Maricopa County Board of Supervisors on October 15, 2015. The Agreement is for use of County leased premises at 19401 N. Cave Creek Rd., #8, Phoenix, AZ 85024 and 5422 W. Thunderbird Rd., #6, Glendale, AZ 85306. B. The term of the Agreement expires September 30, 2017. C. County and Contractor now mutually desire to amend the Agreement to extend the term, amend Article 4.3 and add an additional site. AGREEMENT NOW THEREFORE, in consideration of the foregoing and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties hereto agree as follows: 1. The term of the Agreement is hereby extended one (1) year, to commence October 1 2017 and expire September 30, 2018. 2. Article 4.3 is of the Agreement is deleted in its entirety and replaced by the following: The Public Health Director of Maricopa County, or their designee, is hereby given the authority to execute an Exhibit “B” to change or add specific dates, times and locations when Use and Parking are required, provided there is no cost to the County as a result of the change. Such change shall be at the sole discretion of the Public Health Director which may be unreasonably withheld. 3. Exhibit “A” of the Agreement is deleted in its entirety and replaced by Exhibit “A,” amended to add one site and attached hereto and made a part hereof. 4. The effective date of this amendment is the date of execution by the Maricopa County Board of Supervisors 5. The foregoing paragraphs contain all the changes made by this amendment. All other terms and conditions of the original Agreement remain the and in full force and effect.
