MARICOPA COUNTY RESOLUTION
FOR
BUCKEYE YARD LEASE AGREEMENT RATIFICATION
WHEREAS, Maricopa County Department of Transportation (MCDOT) has
received funding for its facilities and operations through the Arizona Highway
User Revenue Fund (HURF), which is subject to Article 9, Section 14 of the
Arizona Constitution. This regulation limits the purposes for which HURF monies
may be expended for highway and street-related purposes.
WHEREAS, the Flood Control District of Maricopa County (DISTRICT) requires a
designated area for use by its Operations and Maintenance Division in a West
Valley location. Assessor Parcel Number 401-87-001G is owned by Maricopa
County (known as the “Buckeye Yard”), operated and maintained by MCDOT,
and has facilities compatible with the needs of the DISTRICT. It is in the best
interests of the DISTRICT and MCDOT (Parties) to collaborate on space
allocation within MCDOT’s Buckeye Yard and facilities contained therein.
WHEREAS, a Lease Agreement (LEASE) was entered into by the Parties on
April 1, 2015 and commencing on May 1, 2015, for five (5) years. This LEASE is
for the DISTRICT’s use of the specific areas of the Buckeye Yard’s office and
yard space in exchange for rental fees paid by the DISTRICT to MCDOT.
WHEREAS, MCDOT did not have express authority to sign the LEASE, and the
Parties now wish to ratify and confirm the existing LEASE document.
NOW THEREFORE BE IT RESOLVED that the “LEASE”, attached hereto and
made a part hereof, as though recited in its entirety, is hereby ratified by the
Maricopa County Board of Supervisors on behalf of MCDOT.
BE IT FURTHER RESOLVED that this LEASE shall be effective immediately
upon ratification by the Board of Supervisors and retroactively to May 1, 2015.

ADOPTED by the Maricopa County Board of Supervisors in public session this
22nd day of June, 2016.
