(C-19-16-033-M-00) Motion to approve by Supervisor Kunasek, seconded by Supervisor Gallardo Ayes: Hickman, Kunasek, Chucri, Barney, Gallardo Elections - Elecciones 11. AMENDMENT TO CONTRACT WITH RUNBECK ELECTION SERVICES INC. FOR NOVUS BALLOT DUPLICATION SYSTEM Amend the Runbeck Election Services Inc. contract to include the use of the Novus Ballot Duplication System. Ballots that need duplication for bleed through, mismarks, or damage can be scanned into the Novus system for duplication. The system will spray a control number on the ballot scanned and will pull up on the screens the scanned ballots and a corrected ballot (with the same control number) with offices marked as the system interprets. The two operators can accept the new ballot or make any needed corrections. Duplicated ballots may be printed out or saved and printed out at the Runbeck printing facility. (C-21-11-008-3-02) Diane Barker, resident, stated the County needs to make sure that Runbeck has worked out any bugs before the general election. She commented that she was pleased with the voter turnout, but was disappointed the long lines were because voters were not being handled properly. Helen Purcell, County Recorder, asked that Karen Osborne, Elections Director, address the agenda item before commenting on the Presidential Preference Election (PPE). Ms. Osborne explained that the Nova System is funded from department savings. She explained how the Nova System works and the benefits derived from having the system. Ms. Purcell stated the Election Department had not been prepared for the large voter turnout. She explained how historical data and other factors were used in determining that only 60 polling places were needed. She said one of the factors were that one-third of registered voters were not eligible to vote in this election because they were either Independents or without party preference. Most of the eligible voters requested early ballots and the cost of the election was considered. Ms. Purcell reported that it is not yet definite that the state is going to reimburse the counties for the PPE. Ms. Osborne reported even though there were people in line for long hours, all ballots were tabulated, with 23,000 provisional ballots submitted. Of the provisional ballots submitted, 20,000 were invalid. Supervisor Barney commented that he is interested in what made this election different from past PPEs. He advised that data from this election be used and compared to prior data in an effort to determine and understand the differences. Ms. Purcell responded that an effort is already being made to increase polling places for the May 17, 2016 election. She explained there will be 724 polling places for the August and November elections because voting needs to be in the precincts for these elections. She explained the issues with early and provisional ballots and why this could have attributed to the Formal Meeting Minutes Wednesday, March 23, 2016 Page 8 of 40 long lines. Supervisor Gallardo said he appreciated Ms. Purcell taking ownership for the problems encountered with the PPE. He reviewed problems that he stated disenfranchised many voters because they could not stand in line so long or had to go to work, etc. He commented on Independent voters and the issues they encountered and expressed his concerns that there may be the same problems encountered in the May 17, 2016 election. Supervisor Kunasek noted that this discussion did not concern this agenda item and further discussion should be saved for a posted agenda item. Supervisor Chucri noted the Elections Department needs to address the issues and explain what happened. Ms. Purcell responded that she agreed and suggested an agenda item be added to the special session when the election is canvassed. Annual operating expenses are anticipated to be $1,500 and will be paid from the General Fund. This vehicle will be retired at the end of its useful life with no funding from the General fund for its replacement. This vehicle will have County vehicle markings and government plates. This serves the interest of judicial economy and promotes sound case flow management. The attached list of Court Commissioners would serve as Superior Court Judges Pro Tempore without any additional compensation other than that to which they are entitled as Court Commissioners. WITHDRAW MARICOPA COUNTY AIR POLLUTION REGULATION FOR EXCESS EMISSIONS FROM THE STATE IMPLEMENTATION PLAN Approve Maricopa County Air Quality Department (MCAQD) to withdraw Rule 140 (Excess Emissions) of the Maricopa County Air Pollution Control Regulations from the (Arizona) State Implementation Plan (SIP). Maricopa County Air Pollution Control Regulation Rule 140 grants sources an affirmative defense if there are emissions in excess of an applicable emissions limitation due to malfunction, startup and shutdown. Rule 140 is currently in the (Arizona) SIP, and locally and federally enforceable. In May 2015, the Environmental Protection Agency (EPA) determined that affirmative defenses should not be allowed in the SIP. MCAQD has until November 2016 to withdraw Rule140 from the SIP. To comply with the EPA’s deadline, the MCAQD is requesting the Board of Supervisors approve the withdrawal of Rule 140 from the SIP. Rule 140 would remain locally enforceable and not be federally enforceable. Upon the Board’s approval, the MCAQD will request the Arizona Department of Environmental Quality (ADEQ) to submit to the EPA a request to withdraw Rule 140 from the SIP. ADEQ has a similar excess emissions/affirmative defense rule; currently locally and federally enforceable. ADEQ will be requesting the EPA to remove their rule from the (Arizona) SIP. (C-56-16- 004-M-00) Motion to approve by Supervisor Gallardo, seconded by Supervisor Chucri Ayes: Hickman, Kunasek, Chucri, Barney, Gallardo Public Fiduciary - Fiduciario Público Formal Meeting Minutes Wednesday, March 23, 2016 Page 24 of 40 39. PUBLIC FIDUCIARY REQUEST FOR REVIEW OVER BASELINE Approve an exception to FY2017 Budgeting Guidelines and Priorities allowing the Office of Management & Budget to review the following request over baseline: • $352,431 expenditure increase to personnel services for four new Fiduciaries assigned primarily to front-end case administration and stabilization, along with the addition of one support position • $200,871 revenue increase for additional fees anticipated as a result of the increased positions • The net increased impact is $151,560. Currently, the Public Fiduciary caseloads are too high to be maintained. The Office of the Public Fiduciary is mandated to limit the fiduciary caseload to a size that allows each fiduciary acting as a guardian to accurately and adequately support and protect the person under his/her care. This includes a minimum of one visit per month with each person and regular contact with all service providers. The current staff-to-client case ratio is 1:77 and includes both guardianship and conservatorship appointments. The standards governing the fiduciary industry recommend caseloads not exceed 1:40. Client visitation, assessment, and monitoring services are only performed once within a quarter as a result of the high client-to-staff ratios. The additional staffing requested will allow for better service to the clients, more timely responses, and will reduce the potential for liability. The Public Fiduciary is able to collect revenue only when a client’s accounts are sufficient to fund it after the client’s needs have been met. By better staffing front-end case management to obtain client entitlements, the Public Fiduciary will be able to collect more revenue to partially offset additional costs for the requested positions. Triage and revenue collection will be the majority of the work performed by the new positions, and the most active cases will be handled by this unit. This will help to alleviate some of the significant workload strain currently an issue for the regular line Fiduciary caseloads. COMPETITION IMPRACTICABLE PROCUREMENT WITH ACQUISITION SCIENCES II, LLLP FOR NORTHERN PARKWAY PROJECT Approve an increase in the Competition Impracticable Procurement, with Acquisition Sciences II, LLLP, in the amount of $20,000, from $220,000 to $240,000 to provide Relocation Services for Maricopa County Department of Transportation’s MAG ALCP Projects subproject T347 Northern Parkway Dysart Road to 111th Avenue. The City of Glendale initially assumed lead agency responsibilities for acquisition of Northern Parkway right-of-way and relocation of affected property owners. The City contracted with Acquisition Sciences to perform this work. In 2010, Maricopa County assumed the lead role. Approximately half of the relocation work on the project is ongoing, and federal processes mandate an 18-month follow-up on completed work. Seeking a new vendor is impractical, as ensuring a continuity of service is critical to avoiding delays to the Northern Parkway project and to avoiding jeopardizing federal funding for the project.
