AGREEMENT FOR COST-TO-CURE COMPENSATION Project TT525 — Peak View Road (58th St to 60th St) Item No. D23210 Assessor's Parcel No.: 211-44-051 This Agreement is entered into by the MARICOPA COUNTY, a political subdivision of the State of Arizona, and Harriette Atchison, an unmarried woman, and shall become effective upon acceptance by the Maricopa County Board of Supervisors. Maricopa County is acquiring a portion of property owned by Harriette Atchison for the above referenced project. In order to accomplish the proposed roadway improvements, Harriette Atchison agrees, at County expense, to have removed and replaced the existing fence currently located within the portion of property being purchased for the project. The value of this cost-to-cure was calculated in an appraisal prepared by an Independent State Certified Appraiser and adjusted to include a professional estimate for the costs associated with the relocation of an electronic slide gate and its components. The cost-to- cure for this work totals Eleven Thousand Nine Hundred Dollars and 00/100 ($11,900.00) and broken down as follows: Relocate L9OLF, (19 - 10’ sections), of metal pipe and woven wire mesh fencing @ $8.00/LF: $1,500.00 Electronic Gate installation and components. $9,465.00 Remove and haul existing concrete V-track. $935.00 Total: $11,900.00 THEREFORE, in consideration of the mutual covenants and agreements contained herein, the parties hereby agree: MARICOPA COUNTY AGREES: A. To issue a warrant in the amount of Eleven Thousand Nine Hundred Dollars and 00/100 ($11,900.00) payable to Harriette Atchison for cost-to-cure payment. HARRIETTE ATCHISON AGREES: 1. To accept the sum of Eleven Thousand Nine Hundred Dollars and 00/100 ($11,900.00) for cost to cure payment. 2. That should they have additional claims against Maricopa County, it will make specific claims in compliance with the procedures and conditions set forth in ARS 12-821.01. 3. To complete all necessary work by April 29, 2016. 4. That they are solely responsible for the adequacy of the work plan, the selection of the contractors, and for the sufficiency of the work performed by said contractors as set forth in the work plan.
