RESOLUTION ROAD FILE 5905-R C-64-15-108-M-02 RESOLUTION ROAD DECLARED (ROAD FILE NO. RF 5905-R) C-64-15-108-M-02 WHEREAS, on the 20th day of April, 2015, the County Engineer and others filed with the Board of Supervisors of Maricopa County, Arizona, a petition praying the Board to open and declare streets within Dreaming Summit Unit 3B as a county highways; and WHEREAS, on the 24th day of June, 2015, the Board adopted a Resolution designated Road File No. 5905 (C-64-15-108-M-01), declaring said streets into the County Highway System; and WHEREAS, on the 29th day of June, 2015, the Clerk of the Board recorded the minutes of the Board action to adopt said Road File No. 5905 (C-64-15-108-M-02) in Maricopa County Recorder Number 2015-0463165; and WHEREAS, the Department of Transportation has determined that it is in the best interest of the County to alter the roadway as adopted on the 24th day of June, 2015, in Road File No. RF 5905 (C-64-15- 108-M-02) to exclude certain streets that were dedicated as private streets in Dreaming Summit Unit 3B as recorded in Book 570 of Maps, Page 50, Maricopa County Recorder; and WHEREAS, that, pursuant to A.R.S. §28-6701, said petition and Resolution is being revised to amend the legal description approved on the 24th day of June, 2015. NOW, THEREFORE, BE IT RESOLVED, that the legal description be amended to read as follows: All streets consistent with the rights-of-way, as depicted in Dreaming Summit Unit 3B, a subdivision as shown in Book 570 of Maps, Page 50, M.C.R., EXCEPTING those streets lying east of 135th Avenue and north of Missouri Avenue identified as “Tract H”; Containing 11.96 acres. General Vicinity: Missouri Avenue and 135th Avenue in Supervisor District 4 and in an unincorporated area. WHEREAS, A.R.S. § 28-6701 authorizes the Board to establish County highways; WHEREAS, A.R.S. § 28-6705(A) authorizes the Board to spend public monies for the maintenance of public roads and streets other than legally designated state and county highways located without the limits of an incorporated city or town; WHEREAS, in accordance with A.R.S. § 28-6705(A), the following public roads and streets have been laid out, opened, constructed and completed at no cost to the County in accordance with the County’s standard engineering road specifications and have been found acceptable to the county, said roads legally described as follows: Legal description identified as Exhibit "A", is attached. WHEREAS, A.R.S. § 11-822(C) authorizes and directs the Board to accept such streets and roads into the County maintenance system; WHEREAS, the Board believes that accepting into the County maintenance system the public streets and roads more fully set forth hereinabove is in the County’s best interests; RESOLUTION ROAD FILE 5905-R C-64-15-108-M-02 NOW, THEREFORE, BE IT RESOLVED that the public streets and roads more fully set forth hereinabove are hereby established, opened and declared a county highway, and the County Engineer is hereby directed to make a plat of the survey of said highway and cause the same to be recorded in the Office of the County Recorder of Maricopa County as provided by law. BE IT FURTHER RESOLVED that the Board accept any right-of-way or property donated to the State or County for said highway. The Board hereby accepts all U. S. Patent easement reservations, right- of-way or properties along this alignment into the Department of Transportation’s Highway system.
