ORDINANCE 2015-17
AN ORDINANCE OF THE CITY OF SURPRISE, ARIZONA,
EXTENDING AND INCREASING THE CORPORATE LIMITS OF
THE CITY OF SURPRISE, ARIZONA MARICOPA COUNTY,
STATE OF ARIZONA PURSUANT TO THE PROVISIONS OF
ARIZONA REVISED STATUTES § 9-471 AND AMENDMENTS
THERETO, BY ANNEXING CERTAIN ROADWAY CONTIGUOUS
TO THE EXISTING CITY LIMITS OF THE CITY OF SURPRISE.
WHEREAS, Arizona law establishes a simplified procedure for annexing
roadway in A.R.S. § 9-471 (N);
WHEREAS, the real property described in Exhibit A, attached hereto and
incorporated herein by reference, and as illustrated on the map attached hereto as
Exhibit B, which is likewise incorporated herein, is right-of-way (hereafter “right-of-way”)
dedicated to the public and located in Maricopa County; and
WHEREAS, the City of Surprise, Arizona is desirous of extending and increasing
the corporate limits of the City of Surprise, Arizona to include the right-of-way; and
WHEREAS, the right-of-way is adjacent to the existing corporate limits of the City
of Surprise, Arizona for the entire length of the proposed annexation; and
WHEREAS, through this Ordinance, the Mayor and Council is requesting the
governing body of Maricopa County, Arizona to give its mutual consent to the
annexation of this right-of-way located within Maricopa County, Arizona; and
WHEREAS, by adoption of this ordinance, it is the intent and desire of the Mayor
and Council of the City of Surprise, Arizona, to annex the right-of-way to the City of
Surprise, Arizona, and to give their mutual consent thereto;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of
Surprise, Arizona, as follows:
SECTION 1. That, subject to the concurrence of the Board of Supervisors of
Maricopa County, Arizona, the territory in the Maricopa County right-of-way as
described in Exhibits A and B attached hereto is hereby annexed to the City of Surprise,
Arizona, and that the present corporate limits of the City of Surprise, Arizona are hereby
extended and increased to include the Maricopa County right-of-way described in
Exhibits A and B attached hereto, all of which such right-of-way is contiguous for the
entire length thereof to the present corporate limits of the City of Surprise, Arizona.

SECTION 2. That a copy of this Ordinance, together with an accurate map of the
territory hereby annexed, be forthwith filed and recorded in the office of the County
Recorder of Maricopa County, Arizona.
SECTION 3. The annexation herein provided for shall become effective upon the
last of the following to occur:
1. The effective date of this Ordinance, in the manner prescribed by law, or
2. The date that the consent of the governing body of Maricopa County, Arizona
consenting the annexation herein enacted shall become effective in the
manner provided by law.

DESCRIPTION
ANNEXATION: CACTUS ROAD
ANNEXATION PARCEL #1
A portion of the Southeast quarter of Section 14, Township 3 North, Range 2 West of the
Gita and Salt River Base and Meridian, Maricopa County, Arizona described as follows:
COMMENCING at the southeast corner of said Section 14 from which the south quarter
corner of said Section 14 lies South 89°49'03" West 2645.36 feet;
Thence along the south line of said southeast quarter South 89°49’03" West 16.50 feet
to the southwest corner of that real property as described in the City of Surprise
Annexation Ordinance # 08-21 as recorded in Book 2008-0498462, Records of said
Maricopa County being also on the northerly line of that real property as described in the
City of Surprise Annexation Ordinance # 06-42 as recorded in Book 2006-1354327,
Records of said Maricopa County, being the POINT OF BEGINNING;
Thence continuing along said south line and said northerly line of Annexation Ordinance
# 06-42 South 89°49’03” West 316.50 feet to the most southerly southeast corner of that
real property as described in the City of Surprise Annexation Ordinance # 10-12 as
recorded in Book 2010-0568578, Records of said Maricopa County, said corner also
being designated as POINT “A” for the purposes of this description;
Thence along an east line of said Annexation Ordinance # 10-12 North 00°10°50” East
33.00 feet;
Thence North 89°49'03” East 316.50 feet to the westerly line of said Annexation
Ordinance # 08-21;
Thence along said westerly line South 00°10'54" West 33.00 feet to the POINT OF
BEGINNING.
Containing 10,444 square feet, more or less.

Ordinance # 10-12 and the POINT OF BEGINNING;
Thence continuing along said south line and said northerly tine of Annexation Ordinance
# 06-42 South 89°49'03” West 1089.29 feet to said south quarter corner and the
southeast corner of that real property as described in the City of Surprise Annexation
Ordinance # 03-15 as recorded in Book 2003-0920269, Records of said Maricopa
County;
Thence along the east line of said Annexation Ordinance #03-15 North 00°12'41” East
33.00 feet;
Thence North 89°49'03” East 1089.06 feet to the west line of said Annexation Ordinance
#10-12;
Thence along said west line South 00°10’57” East 33.00 feet to the POINT OF
BEGINNING.
