C-50-15-032-M-02 P50243 P-50243 C-50-15-032-M-02 Amendment No. 2 to Non-Exclusive Revocable License Agreement for Use of Real Property RECITALS A. Western Maricopa Education Center, an Arizona Title 15 public school district (“West- MEC”) and Maricopa County, an Arizona Title 11 political subdivision of the State of Arizona (“Maricopa”) (collectively, the “Parties”) are Parties to that certain Non-Exclusive Revocable Facility Use Agreement for Use of Real Property, No. P50243, dated and approved by the Maricopa County Board of Supervisors on October 22, 2014 and subsequently amended by Amendment No. 1 to Non-Exclusive Revocable License Agreement for Use of Real Property, dated and approved by the Maricopa County Board of Supervisors on August 5, 2015 (collectively, the “Agreement”). The Agreement is for the use of West-MEC Central Campus property located at 6997 North Glen Harbor Boulevard, Glendale, Arizona (the “Property”). B. The term of the Agreement expires on September 30, 2016. C. The Parties now mutually desire to amend the Agreement to extend the term and append Exhibit “A” with an additional location to be included as Property. AGREEMENT NOW, THEREFORE, in consideration of the foregoing, mutual promises contained herein and other good and valuable consideration, the sufficiency and adequacy of which the Parties hereby acknowledge, West-MEC and Maricopa agree to amend Agreement No. P50243 as follows: 1. The accuracy of the foregoing Recitals is hereby acknowledged and by this reference such Recitals are hereby incoprporated into the Agreement. 2. The Agreement term is hereby extended and will expire June 30, 2018. This Agreement is subject to termination pursuant to the provisions of A.R.S. §38-511. 3. West-Mec property located at 1617 West Williams Drive, Phoenix, Arizona (“Property B”) will be depicted and added to Exhibit “A”, consisting of 35,000 square feet of classroom and laboratory space for Maricopa use as describe at #2 of the Agreement. 4. The effective date of this amendment is the date of execution by both Parties. 1 C-50-15-032-M-02 P50243 5. The foregoing paragraphs contain all the changes made by this amendment.
