AMENDMENT NO. 1 TO LICENSE AGREEMENT FOR
USE OF REAL PROPERTY
RECITALS
A. Maricopa County, a political subdivision of the State of Arizona, (“Licensor”) and the
Arizona Game and Fish Commission (“Licensee”) collectively (the “Parties”) are Parties
to that certain License Agreement for Use of Real Property, dated and approved by the
Maricopa County Board of Supervisors on February 21, 2007 (the “Agreement”). The
Agreement is for use of Licensor Property to further the goals of Licensee’s Urban
Wildlife Program.
B. The Agreement may be revoked upon 90-days’ prior written notice.
C. Licensor and Licensee now mutually desire to amend the Agreement per this Amendment
No. 1 to create a new term, update notice addresses of both Licensor and Licensee, add
personal safety equipment use and install additional equipment at the Property.
AGREEMENT
NOW, THEREFORE, in consideration of the following mutual covenants, the
sufficiency and adequacy of which are hereby acknowledged, the Parties agree to amend
the Agreement as follows:
1. The term of the Agreement is hereby agreed to by the Parties to be confined to the period
commencing upon execution by the Maricopa County Board of Supervisors and expiring
December 31, 2017. The term of the Agreement will renew automatically for four (4)
terms of two (2) years each unless prior written notice is given by either party of intent
not to renew within sixty (60) days of the expiration of the term or unless the term is
terminated earlier as provided for in the Agreement. This Agreement is subject to
termination pursuant to the provisions of A.R.S. § 38-511.

3. Licensee, its agents, employees and contractors shall use personal protective safety
equipment and gear appropriate to their work when in proximity to the nest box.
4. Licensee, at Licensee’s sole cost and expense, shall replace certain equipment with the
following:
a. High-speed internet cable
b. Two (2) streaming web cameras.
5. The effective date of this Amendment No. 1 is the date of execution by the Maricopa
County Board of Supervisors.
6. The foregoing paragraphs contain all the changes made by this Amendment No. 1. All
other terms and conditions of the original agreement remain the same and in full force
and effect.
