REGULAR AGENDA - AGENDA REGULAR
PZ-3. LINDSAY PALM PROPERTY
Case #: Z2015019
Supervisor District: 1
Applicant/Owner: David Ullrich/Phalavann Ea
Request: Special Use Permit (SUP) for a Wireless Communication Facility (WCF) – 70’
monopole stealth designed as a palm tree, in the Rural-43 zoning district
Site Location: Generally located 400’ south and west of the intersection of Appleby Rd. and
Lindsay Rd.
Site Size: Approximately 500 sq. ft. of 1.06 ac. parcel
Additional Comments: Staff has calculated the opposition received, and notes that a Super
Majority Vote has been triggered. The trigger is when 20% or more of property owners
within a 300’ radius of the subject site, by both number and area register opposition to the
case. The opposition received accounts for 8 property owners with an area of 603,119 sq.
ft.
66.85% opposed parcel acreage within 300’ buffer
61.54% opposed parcel numbers within the 300’ buffer
Commission Recommendation: On 8/6/15, the Commission voted 5-1 (Commissioner
Muller dissenting) to recommend approval of Z2015019 subject to conditions ‘a’ – ‘h’:
a. Development of the site shall comply with the Site Plan entitled “PH30547F, Lindsay
Palm)”, consisting of five (5) full-size sheets, dated May 12, 2015, and stamped received
July 16, 2015, except as modified by the following conditions.

b. Development of the site shall be in conformance with the Narrative Report entitled “T-
Mobile Site – PH30547F – Lindsay Palm Property”, consisting of four (4) pages, dated
Revised May 14, 2015, and stamped received July 16, 2015.
c. The height of the wireless communication facility shall be limited to 70’ including all
antennas and attachments.
d. A Minor Amendment shall be required to co-locate future carriers on the Wireless
Communication Facility.
e. The wireless communication tower shall retain the stealth properties as originally
designed. Any damaged or missing fronds or branches shall be replaced within 60 days of
such damage occurring.
f. This Special Use Permit shall expire 30 years from the date of approval by the Board of
Supervisors, or upon termination of the use for a period of 90 days or more. All of the site
improvements shall be removed within 60 days of such termination or expiration.
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
h. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
and at the time of expiration of the Special Use Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Special Use Permit, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted. (C-44-16-011-M-00)
Darren Gerard, Deputy Director of Planning and Development, reviewed the item. He
stated that a Super Majority Vote is required due to the number of property owners in
opposition.
Melissa Parker, T-Mobile representative, addressed several resident concerns stating
FCC regulations are being followed, the monopalm will be in an enclosed area, and the
aesthetics of the monopalm does not seem to draw children’s attention because it
blends in with the developing area. She noted the area is still developing and T-Mobile
would like to accommodate customer needs within the area.
Chairman Chucri stated the following individuals would like to register in opposition but
did not wish to speak:
Laura Robinson
Lisa Canchola
Randy Robinson

Formal Meeting Minutes

Philip Canchola, resident, stated he is in opposition of the proposed monopalm. He
noted an agreement was not achieved with Darrin Ullrich of Reliant Land Services in
reducing the cellular tower from 80 feet to 70 feet because he did not want the cellular
tower to exist. There are 24 homeowners surrounding the proposed site that are in
opposition. He is speaking on behalf of the petitioning homeowners stating that the
remaining owners could not be present due to work restraints. Within the 300 foot
radius of the proposed cellular tower there are 10 parcels with eight of the parcels in
opposition. He raised concerns about the undeclared health risks, children in the area,
property values and noise that will come from the cellular tower. He stated there is an
existing cellular tower just east of the proposed site and he does not want to live near an
additional cellular tower and suggested a co-location. He handed the Clerk of the Board
a picture that was taken of the existing cellular tower from the property line.
Mr. Canchola stated he spoke to the current land owner of the existing cellular tower
who agreed to allow for co-location, and stated the County has already approved for co-
location. Mr. Canchola stated that adding another tower would be redundant when one
already exists in the area. He stated the existing tower is 95 to 100 feet, three spaces
available co-location and ample power to keep it running. He said that measures have
been instituted by the County to protect the owners and promote co-location of cellular
towers. He stated that at previous meetings held regarding the proposed monopalm Mr.
Ullrich admitted that he did not look into co-location. Mr. Canchola stated that Mr.
Ullrich has not provided any information other than an opinion on the efficiency of the
monopalm. Mr. Canchola stated that a T-Mobile engineer has not attended any of the
meetings to provide information pertaining to the location reasons and why they do not
plan to co-locate. He was told that the proposed monopalm was more complex. He
stated that the proposal should be to co-locate at the existing cellular tower.
Supervisor Kunasek asked where the existing tower is located.
Mr. Canchola stated it is 1,750 feet east of the proposed site.
Supervisor Barney stated he met with Mr. Ullrich and asked where he was.
Ms. Parker stated Mr. Ullrich is no longer with Reliant Land Services.
Supervisor Barney asked Ms. Parker for a map showing where the existing cellular
tower is located. Mr. Gerard showed a map on the monitor and pointed out the
approximate location of the existing cellular tower.
Ms. Parker stated the current cellular tower is located behind trees and foliage that does
not reach portions of the development for coverage. She noted that with the newer
development area there is a need for more southwest coverage.
Supervisor Barney stated he met with Mr. Ullrich and asked about the co-location
opportunities. The challenge of utilizing the existing tower is the lack of service within
the development area. It was his understanding that T-Mobile was trying to attain a
location south of the existing tower but was unable to do so.
Ms. Parker agreed with Supervisor Barney stating that the location was changed
because a site could not be attained in that specific location.
Supervisor Barney stated these items are always difficult because no one wants a
cellular tower within a residential area unless they are the one leasing the property and
the demand for cellular coverage is significant. He explained the County passed the
text amendment to invite companies to co-locate at existing towers to reduce the

Formal Meeting Minutes

number of cellular towers. Unfortunately the cellular towers do not all carry the same
technology or capacity. The text amendment was not to force co-location but to state it
as the Board’s preference. He noted that staff has looked into the co-location issue as
well as the Planning & Zoning Commission in regards to coverage area to fill the non-
covered areas. He addressed the concerns stating that the area is fenced, located in
the middle of private property, and the monopalm has been shortened but will still
maintain the effectiveness of the coverage. He noted that the applicant could put a 38
foot tower on the location without the Board approval. He asked Mr. Canchola what his
preference would be for the aesthetics of the cellular tower.
Mr. Canchola responded that a palm tree would stick out like a sore thumb because
there are no palm trees in the area. He suggested a pine tree would work better
because there are pine trees within that particular area. He reiterated his concern that
no one has approached the owner of the current cellular tower owner or contacted
Crown Castle on any of the issues stating why co-locating will not work when AT&T is
the only service there now. He questioned why the current location does not work for
coverage when it is taller than and only 1,750 feet from the proposed new location when
the owner has not been contacted for co-location.
Supervisor Barney stated Mr. Ullrich had informed him that there was discussion with
technicians about the technology components of the cellular tower, and it was
determined that it would not be sufficient for the needed coverage. Supervisor Barney
noted the location, necessary technology and tower height of 70 feet would satisfy the
demands for service. He noted that at a cost standpoint the company would prefer to
co-locate but are not able to in this case.
Mr. Canchola questioned the proposed tower location because the original plan to install
a tower in the area of Ocotillo and Lindsey is further south.
Supervisor Barney responded that the location is at the heart of the service range based
on the necessary technology and engineering perimeters for service demands. He
realizes that residents may or may not want a tower near them but with the advances in
technology the demand for cellular and bandwidth coverage will increase. He thanked
Mr. Canchola and the residents for attending.
Mr. Gerard noted the following revised language to conditions ‘a’, ‘b’ & ‘e’:
a. Development of the site shall comply with the Site Plan entitled “PH30547F, Lindsay
Palm)”, consisting of five (5) full-size sheets, dated May 12, 2015, and stamped
received July 16, 2015, except as modified by the following conditions. A revised site
plan shall be provided within 30 days of Board approval illustrating design as a pine
tree.
b. Development of the site shall be in conformance with the Narrative Report entitled “T-
Mobile Site – PH30547F – Lindsay Palm Property”, consisting of four (4) pages,
dated Revised May 14, 2015, and stamped received July 16, 2015. A revised
narrative shall be provided within 30 days of Board approval indicating design as a
pine tree.
e. The wireless communication tower shall retain the stealth properties as originally
designed. Any damaged or missing fronds or branches shall be replaced within 60
days of such damage occurring.

51. AGREEMENT WITH NEWCASTLE DEVELOPMENT LLC, AND KEIGHLEY PLACE
COMMUNITY ASSOCIATION, INC. FOR DRAINAGE EASEMENT
Approve and execute Four Original Agreements that identify the roles and responsibilities
between Maricopa County and Newcastle Development LLC, an Arizona Domestic Limited
Liability Company, and Keighley Place Community Association, Inc., an Arizona Not For
Profit Corporation pertaining to acquisition and payment for a Drainage Easement needed
for the maintenance of a culvert crossing of Meridian Road. Said proposed Drainage
Easement is located on land managed by the Arizona State Land Department for the State
Trust.
Keighley Place is a residential subdivision located north of Ray Road and west of Meridian
Road. The subdivision is located within the City of Mesa and was approved in accordance
with the City of Mesa standards and requirements. As part of those requirements the
development was required to construct Meridian Road, a portion of said roadway is located
in Unincorporated Maricopa County, and as part of Meridian Road it is necessary to pass
flows of a wash under the roadway through a culvert.
Construction of Meridian Road is a half-street improvement and said half-street
improvement is being constructed to monument line which coincides with the boundary
between Maricopa County and Pinal County. In order to maintain the culvert crossing it is
necessary to have a drainage easement upstream of the culvert, this drainage easement is
located in Pinal County on Arizona State Trust Land. The drainage easement is 50 feet in
width and 160 feet in length and located approximately 1194 feet north of the intersection
of Meridian Road and Ray Road. Since Maricopa County is unable to spend monies on
roadways outside of the boundaries of the County it was necessary to enter into an
agreement to fund the purchase of the drainage easement from the State Land Trust.
State Land is willing to issue a 10-year drainage easement, per this agreement; the
developer Newcastle Development LLC will fund that initial 10 year easement and the
future renewals of the drainage easement will be funded by the Keighley Place Community
Association. In return, Maricopa County will be the applicant to the State Land Department
and will maintain said culvert crossing until such time as is no longer needed. (C-64-16-

Improvements Project (Project [#450]) Water Line Relocations between EPCOR Water
Arizona, Inc. (EPCOR) and the Flood Control District of Maricopa County (District). This
Agreement defines responsibilities for construction, construction management, operation
and maintenance of the Project, and for payment of the Project. The estimated cost of the
water line relocations associated with this Agreement is $48,600. EPCOR will pay one
hundred percent (100 %) of the actual costs of the water line relocations.
The District, in cooperation with Peoria and Surprise, completed the Glendale/Peoria Area
Drainage Master Plan Update (ADMPU) 107th Avenue and Union Hills Drive Design
Concept Report (DCR). The DCR recommended the Project to mitigate flooding in the 115th
Avenue, Union Hills Drive, and 107th Avenue area. The Project was also recommended in
the FY 12/13 CIP Prioritization Procedure. The design for all phases has been completed to
the thirty percent level and the first phase has been completed. This Agenda Item impacts
Supervisorial District 4. (C-69-16-002-3-00)
Motion to approve by Director Barney, seconded by Director Hickman
Ayes: Chucri, Hickman, Barney, Kunasek, Gallardo
F-2. RESOLUTION FOR AUTHORITY TO CONVEY REAL PROPERTY INTERESTS
Adopt Resolution FCD 2015R007, Authority to Convey Real Property Interests.
The Board adopted Resolution FCD 86-21 Lease and Disposal of Excess Flood Control
District Real Property in 1987 which authorized a process and procedure to sell or lease real
property no longer necessary to continuing District purposes. This new resolution clarifies
that an inventory of property that is either necessary or is excess to District purposes may
occur after the two year time period from the completion of a project that was specified by
Resolution FCD 86-21. Further, this new resolution expands the policy to allow the District to
sell or release any and all interests in a real property upon District staff determining that less
than a fee title interest is all that is necessary to continuing District purposes.
This new policy will allow the District more flexibility to partner with both public and private
development for compatibility of our facilities with development activities, while protecting
our interests. This Agenda Item impacts all supervisorial districts. (C-69-16-003-6-00)
Motion to approve by Director Barney, seconded by Director Hickman
