Jefferson, 10th Floor, Phoenix, AZ 85003, with the following members present: Steve Chucri, Chairman, District 2; Clint Hickman, Vice Chairman, District 4 (entered late); Denny Barney, District 1 (entered late); Andy Kunasek, District 3; Steve Gallardo, District 5. Also present: Fran McCarroll, Clerk of the Board; Tom Manos, County Manager; and Michelle Wood, Legal Counsel. Minutes compiled by Lori Medaris, Minutes Coordinator. 1. EXECUTIVE SESSION Vote to convene in Executive Session to consider the items on the Special Executive Agenda dated November 04, 2015, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. Motion to approve by Supervisor Kunasek, seconded by Supervisor Gallardo Ayes: Chucri, Kunasek, Gallardo Absent: Barney, Hickman THE BOARD CONVENED IN EXECUTIVE SESSION ~ Supervisors Barney and Hickman entered the meeting ~ ~ Supervisor Barney left the meeting following Special Executive Session Item No. 2 ~ SPECIAL MEETING RECONVENED BOARD OF SUPERVISORS Special Meeting Summary Wednesday, November 04, 2015 Page 2 of 3 OPEN SESSION 2. AMENDMENT TO WARSHAW AND ASSOCIATES AGREEMENT Consideration and possible action to approve an amendment to the Agreement between Maricopa County and Warshaw & Associates, Incorporated to increase the contract amount for the Current Contract Year by $1,275,000 from $1,725,000 to $3,000,000. The agreement is necessary to effectuate the terms and conditions of the Judgment Order (Dkt#606) and subsequent related orders issued by the United States District Court for the District of Arizona in the matter of Manuel de Jesus Ortega Melendres, et. al. vs. Joseph M. Arpaio, in his individual and official capacity as Sheriff of Maricopa County, et. al., No. CV-07-02513-PHX-GMS. Warshaw & Associates, Inc. acts as the court-appointed monitor and assists the court in the implementation of the Judgment Order and subsequent related orders and assess compliance with the Judgment Order and subsequent related orders. (C-50-14-053-M-03) Supervisor Hickman made a motion to approve the amended agreement as stated in the agenda. He also wished to clarify that this amendment is partially necessary because of the expanded role of Maricopa County. This new contract amount still falls within the budgeted amount for the monitor contract. Motion was seconded by Supervisor Kunasek. Ayes: Chucri, Hickman, Kunasek, Gallardo Absent: Barney 3. GUARDIANSHIP/CONSERVATORSHIP FOR SALVATORE CORVO, PB2015-003194 In the matter of the Guardianship/Conservatorship for Salvatore Corvo, PB2015-003194, authorize counsel to take action consistent with the direction received in executive session on November 4, 2015. (C-06-16-222-M-00) Motion made by Supervisor Hickman to authorize the Public Fiduciary to file an appeal in the Matter of the Guardianship for Salvatore Corvo, seconded by Supervisor Kunasek Ayes: Chucri, Hickman, Kunasek, Gallardo Absent: Barney 4. CONSIDERATION OF A CONFLICT WAIVER FOR KUTAK ROCK Consider and take action on Kutak Rock’s request for conflict waiver to represent defendant in Maricopa County v. German Dobson CVS, L.L.C. et al., CV2015-011439, a condemnation proceeding consistent with the direction received in executive session on November 4, 2015. (C-06-16-221-M-00) Motion made by Supervisor Kunasek, seconded by Supervisor Hickman to approve the request for a conflict waiver for Kutak Rock in the matter of Maricopa County v.
