Supervisor Barney expressed his reservations about the item and the challenges the
Board has encountered with regard to ascertaining performance at the Constable level.
He stated that the Board has a fiduciary responsibility to approve budgets, but it does
not have the same oversight with the Constables as it does with other elected offices
and County departments and would like to continue the conversation regarding this
matter.
Chairman Chucri stated that the Board should focus on what the Arizona Legislature is
doing and try to compliment that work.
Motion to approve by Supervisor Gallardo, seconded by Supervisor Hickman
Supervisor Gallardo stated that this has been a constant debate that occurs at the State
Legislature. He noted that the Deputy Constables provide support and assistance and
are important in certain precincts where Justices of the Peace have high productivity
credits. He added that the debate at the State Legislature is a political debate and the
Board should watch closely as the issue develops.

56. AGREEMENT RESOLUTIONS FOR VELDA ROSE HOMEOWNER'S ASSOCIATION
LANDSCAPED MEDIANS
Approve and execute Three Original Board of Supervisor Agreement Resolutions that
identifies the roles and responsibilities between Maricopa County and the Velda Rose
subdivisions relative to certain roadways and landscaped medians within the Velda Rose
developments.
The Velda Rose Homeowners Association currently maintains landscaped medians that
are within right-of-way plated in three locations. A segment along the north side of
University Drive between 58th Street and 56th Street, a segment along the south side of
University between 62nd Street and 65th Street, and a segment along the east side of 65th
Street between Butte Street to Albany Street. Execution of this Resolution would allow in a
later action, Maricopa County to transfer by Quit Claim Deed our interests in the
landscaped medians to the Velda Rose Homeowner’s Association that are along the south
side of University between 62nd Street and 65th Street and along the east side of 65th
Street between Butte Street and Albany Street.
Furthermore, said Resolution would give direction to resolve the ownership question of the
landscaped median on the north side of University between 56th Street and 58th Street by
a later action in which roadways within the Velda Rose Estates and Velda Rose Estate Unit
Three would be Open and Declared as County Roadways excluding the area of the
landscaped median.
These actions relieve Maricopa County of any responsibility for maintenance of said
landscaped medians and recognize the expenses previously incurred by the Velda Rose
Homeowner’s Association to maintain those landscaped medians. Supervisory District No.

F-1. AMENDMENT CONSTRUCTION MANAGER AT RISK CONTRACTS FOR BUCKEYE
FLOOD RETARDING STRUCTURE #1 - PHASE 2
Amend the authorization under agenda Item number C-69-12-052-5-00 for the Flood Control
District of Maricopa County (District), which authorized the award of a Pre-Construction
contract and a Construction Service contract. This amendment is to allow the District to
award two Construction Services contracts, Phase 2A and Phase 2B to Coffman Specialties,
Inc. Additionally, amend the authorization for the cost of the Construction Services contracts
to $24,750,000 for Phase 2A and $11,000,000 for Phase 2B for a total not- to-exceed
$35,750,000.
Coffman Specialties, Inc. was selected under a qualification-based selection in accordance
with Maricopa County Procurement Code, Article 5, Paragraph 504(F) and Article IV of the
Maricopa County Procedures Manual.
Buckeye Flood Retarding Structure (FRS) No.1 is the westernmost of a series of three flood
control dams designed and built by the Soil Conservation Service (now the Natural
Resources Conservation Service, or NRCS) between 1973 and 1975. The dam is located
along the southern slopes of the White Tank Mountains and parallels the north side of
Interstate 10 for 7.1 miles west to the Hassayampa River. The dam is operated and
maintained by the District and is regulated by the Arizona Department of Water Resources
(ADWR).
Several non-emergency dam safety deficiencies have been identified at Buckeye FRS No.1.
During the planning phase, which was completed in July 2009, the District identified overall
rehabilitation as the selected alternative. NRCS has authorized federal assistance for this
project. Phase 2A and Phase 2B construction of the project involves placing a central filter
within a portion of the dam east of Johnson Road and the east terminus of the dam,
improving the spillway works, improving the principal outlet, removing an irrigation outlet and
raising the embankment height near the east terminus of the FRS as may be needed. This
Agenda Item impacts Supervisorial District 4. (C-69-12-052-5-01)
Motion to approve by Director Hickman, seconded by Director Barney
