Jefferson, 10th Floor, Phoenix, AZ 85003, with the following members present: Steve Chucri, Chairman, District 2; Clint Hickman, Vice Chairman, District 4; Denny Barney, District 1; Andrew Kunasek, District 3; Steve Gallardo, District 5 (entered late). Also present: Fran McCarroll, Clerk of the Board; Constance Copeland, Deputy Clerk of the Board; Tom Manos, County Manager; and Michelle Wood, Legal Counsel. EXECUTIVE SESSION Vote to convene in Executive Session to consider the items on the Special Executive Agenda dated September 09, 2015, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. Motion to approve by Supervisor Kunasek, seconded by Supervisor Hickman Ayes: Chucri, Hickman, Barney, Kunasek Absent: Gallardo THE BOARD CONVENED IN EXECUTIVE SESSION ~ Supervisor Barney left the meeting ~ SPECIAL MEETING RECONVENED 2. MARICOPA COUNTY V. JOHN H. O'DELL, III Take action consistent with discussions in Executive Session on September 9, 2015, regarding Maricopa County v. John H. O’Dell, III, Trustee of the John H. O’Dell, III, Separate Property Trust dated February 5, 2008, et al, CV2014-008663. (C-64-16-014-S- 00) Special Meeting Minutes Wednesday, July 15, 2015 Page 2 of 2 Motion made by Supervisor Hickman to authorize a settlement in the amount of $45,000, inclusive of interest, as just compensation to be paid to defendant, John O’Dell, III, in the case of Maricopa County v. John H. O’Dell, III, et al, CV2014-008663, said sum to be paid by the City of Chandler, consistent with the terms of the Intergovernmental Agreement between Maricopa County and the City of Chandler concerning improvements to McQueen Road. Motion was seconded by Supervisor Gallardo. Ayes: Chucri, Hickman, Kunasek, Gallardo Absent: Barney 3. CONFLICT WAIVER FOR SIMS AND MURRAY Consider approval of a conflict waiver for the firm of Sims and Murray regarding Chandler Unified School District to review a contract between the school district and the Maricopa County WIC program. This conflict waiver does not extend to litigation. This item was heard in Executive Session on September 9, 2015.
