Shaw Butte Road Use and Gate Key Agreement
Recital
In so far as Pinnacle West Capital Corporation (A.K.A. Arizona Public Service Company) has
secured and holds an easement granted by the City of Phoenix which provides right-of-way to
the communication sites atop Shaw Butte, Pinnacle West desires to restrict vehicular access to
the roadway, which occupies the easement, to those parties who have legitimate need. Parties
considered to have legitimate need for access are:
• Government agencies in support of safety and welfare of the public (Fire, Police and
Parks Department)
• Owners of property on Shaw Butte
• Owners or managers of communications facilities and their tenants on Shaw Butte who
are members
• Contractors employed on a short-term basis to perform services for parties previously
listed.
Schedule of Costs for Each Key
• Property Owners………......................$ 15.00
• Members of S.B.U.A…………………………..$ 15.00
• Contractors (short term) …………………..$100.00 (Refundable)
Agreement
I, the undersigned, upon payment of the scheduled cost per key and upon acceptance of said
key(s), and affixing my signature to this document, agree to use this road in accordance with
the Shaw Butte Users Association Constitution and Bylaws.
Failure to comply with the Shaw Butte Users Association Constitution and Bylaws will result in
the revocation of this agreement and access to the road. All keys must be surrendered and the
use of the road terminated.
Should you not surrender your key(s), you will be liable for all costs incurred as a result of
having to change the lock on the gate.
Keys no longer needed shall be returned to Pinnacle West Capital Corporation – IT Utility
Communications, Attn: Utility Communications Mgr., 2043 W Cheryl Drive MS3388, Phoenix,
AZ 85021 (Telephone number is 602-371-5777).
This agreement and key(s) are non-transferable.
