This Agreement is entered into by MARICOPA COUNTY, a political
subdivision of the State of Arizona, and Anna Churan and Andrew Churan, husband
and wife, who acquired title as, Anna Willison, an unmarried woman and Andrew
Churan, an unmarried man as joint tenants with right of survivorship and shall
become effective upon acceptance by the Maricopa County Board of Supervisors.
Maricopa County is acquiring a portion of a property owned by Anna Churan
and Andrew Churan, husband and wife, who acquired title as, Anna Willison, an
unmarried woman and Andrew Churan, an unmarried man as joint tenants with
right of survivorship, for the above referenced project. In order to accomplish the
proposed roadway improvements and corresponding utility relocations, Maricopa County
agrees, at County expense, to pay for re-establishing irrigation berm and re-establishing
the resident grade of the remaining irrigated area disturbed by the partial acquisition.
Maricopa County has received a cost-to-cure estimate for this work totaling
$2,425.20 and broken down as follows:
Re-establishing Irrigation Berm $ 425.20
Re-establishing Resident Grade $2,000.00
Total $2,425.20

THEREFORE, in consideration of the mutual covenants and agreements contained
herein, the parties hereby agree:
MARICOPA COUNTY AGREES:
A. To issue a warrant in the amount of Two Thousand Four Hundred Twenty-Five
Dollars and 20/100 ($2,425.20) payable to Anna Churan and Andrew Churan as
final payment for the cost-to-cure.
B. To reserve the right to review copies of all estimates prior to payment.
ANNA AND ANDREW CHURAN AGREE:
1. To accept the sum of Two Thousand Four Hundred Twenty-Five Dollars and
20/100 ($2,425.20) as final payment for the cost-to-cure.
2. To provide to the County copies of all estimates prior to payment.
3. To complete the Berm and Resident Grade re-establishment as a result of the
effects of project TT429.
4. That should Anna and Andrew Churan have additional claims against Maricopa
County, it will make specific claims in compliance with the procedures and
conditions set forth in ARS 12-821.01.
5. That Anna and Andrew Churan is solely responsible for the adequacy of their
work plan, the selection of their contractors, and for the sufficiency of the work
performed by said contractors as set forth in their work plan.
