notice to the other party. However, the confidentiality requirements related to this data, as
ordered in the Administrative Order, shall continue beyond the term of this agreement.
4. Records Accessed. Pursuant to the directives of the Court, C2C may provide limited data
related to individuals who have received or are receiving services from C2C to JSPI personnel
assigned to work on the evaluation.
5. Use of Information. Any data provided to JSPI under this Agreement may only be used for the

b. Recipient shall ensure the security and confidentiality of any records or data provided

in correcting any inaccurate or incomplete records within the Recipient's control
provided by the custodian.
g. In response to a public records request, the parties will comply with all legal
requirements pertaining to confidentiality and release of records provided under this
Agreement.
h. Prior to merging any records or data obtained from the custodian with other records or
data concerning an individual or organization, recipient will ensure there is sufficient
identifying information to reasonably conclude that the record or data concerns the
same individual or organization.
i. Recipient will notify the custodian of any record or data inaccuracies discovered by the
recipient.
j. The parties shall cooperate with one another to verify compliance with this Agreement,
including but not limited to provisions governing the use of and access to records or

k. The parties shall agree on how the records or data will be exchanged, and if done so
electronically, the format, timing, and frequency of exchanges.
1. The parties shall agree on a change management process and allocation of
responsibilities for ensuring any unilateral software modifications do not disrupt the
on-going exchange of electronic case record information.
m. All applicable rules and laws pertaining to the release of the records and data have been
disclosed by the parties.
7. State Mandated Standard Terms.
a. None of the provisions of the Agreement may be waived, changed or altered except in

the State of Arizona at reasonable times. Upon request, the parties shall produce the
original of any or all such records.
c. The requirements of A.R.S. § 38-511 apply to this Agreement. Any party may, within
