KNOW ALL MEN BY THESE PRESENTS:
THAT WHEREAS, Jeffrey Wade Whitting and Vikki Lu Whitting, husband and wife,
hereinafter called the GRANTOR(S), for and in consideration of the sum of FOUR HUNDRED
AND 00/100 DOLLARS ($400.00), receipt of which is hereby acknowledged, do hereby grant
and convey to MARICOPA COUNTY, a political subdivision of the State of Arizona,
hereinafter called the GRANTEE, and to its agents, successors and assigns, a drainage easement
for the purpose of constructing and maintaining a channel and appurtenances on, over, under and
across the ground embraced within a parcel of land situated in the County of Maricopa, State of
Arizona, and being described as follows:
SEE ATTACHED EXHIBIT "A" FOR LEGAL DESCRIPTION
The GRANTEE or its agents, successors and assigns shall at all times have the right of full and
free ingress and egress to said easement for the purpose heretofore specified.
The covenants and agreements herein set forth shall extend and inure in favor and to the benefit
of and shall be binding on the heirs, successors in ownership and estate, assigns and lessees of
the respective parties hereto.

NOW THEREFORE, in consideration of the same and further consideration hereinafter
set forth, it is agreed, that this instrument contains the entire agreement between the parties
hereto and there being no further consideration paid than herein specified.
THE COUNTY OF MARICOPA AGREES:
A. To use the property described herein for the general welfare and benefit of the public.
THE GRANTORS AGREE:
1. To grant an easement for the property described herein to the County of Maricopa and/or
its agents for the general welfare and benefit of the public.
2. GRANTEE agrees to relinquish all rights granted herein to the above described property
in the event that the Grantors OR GRANTOR'S SUCCESSOR IN INTEREST shall at
any time in the future develop the parcel containing the easement, PROVIDED THAT
THE DEVELOPMENT INCLUDES approved drainage facilities to the satisfaction of the
GRANTEE and or the municipality having jurisdiction at this location.

COMMENCING at North quarter corner of said Section 19;
THENCE, along the Mid Section line of said Section 19, South 00°18,'44" West, a distance of 25.00
feet;
THENCE South 89°3530" East, a distance of 587.14 feet to the POINT OF BEGINNING.
