REGULAR AGENDA - AGENDA REGULAR
PZ-3. SUPERSTITION MANOR
Case # Z2014012
Supervisor District: 2
Applicant/Owner: John Burns
Request: Major Amendment to Special Use Permit (Z2012086) for Superstition Manor
Site Location: Located at the northwest corner of Brown Rd. and Signal Butte Rd in the
east Mesa area
Site Size: Approx. 6.2 acres
County Island Status: N/A
Additional Comments: Attached is handout material provided to the Commission including
changes to the recommended conditions and opposition/support documents since the
writing of the report. The applicant also gave a handout to the Commission, attached.
Since the Commission hearing staff has received an appeal of the P&Z recommendation to
the Board. This appeal, attached, requires this case to be on the regular agenda. Staff has
received a memo from the New River/Desert Hills Community Association (NRDHCA) on
6/16/15. The memo is included as supplemental to this report.
On 6/12/15 staff received an email from Mr. Donald Dahler (included with this report), the
supplier of petitions and emails regarding opposition for this case. He removed several of
the names from the opposition list within 300’ of the subject site indicating they have
“changed their minds”. The memo states that there are four (4) parcels within 300’ that are
still opposed. Staff confirms three (3) of these parcels in opposition. Parcel #220-04-014P
is now under new ownership (updated by the Maricopa County Assessor’s Office) where
the new owners support the Amendment. Within the 300’ radius, staff counted ten (10)
residents in support of the Amendment. The opposition parcels do not trigger a Super
Majority vote by the Board. The trigger for a supermajority vote is when 20% or more of
property owners within 300’ radius of the subject site, by number and area register
opposition to the case. The map for opposition/support calculation is included as an
attachment to this report with the following opposition percentages:
31.49% opposed parcel acreage within 300’ buffer
17.65% opposed parcel numbers within 300’ buffer
Since this case was originally opened in 2014, staff has received a total of 246 opposition
and 592 support documents in the form of emails and petitions. This is not excluding
duplicates. Staff did not include the opposition/support items from before this case was first
withdrawn on June 9, 2014. However, staff includes these documents with this report to
have all documents available for analysis by the Board. Lastly, staff received one email of
support and one email of opposition since the Commission hearing, these are included with
this report.
Commission Recommendation: On 6/11/15, the Commission voted 5-0-1 (Commissioner
Muller abstained), recommended denial as filed, and approval of only the following
requests for Z2014012:
1. Increase and reconfiguration of the parking to have a total of 151 parking spaces (137

apply to outdoor light fixtures at the residential entrance to the building. There shall be no
lighting on perimeter walls except at driveways.

material that meets Air Quality standards with marked spaces. All guests, customers,
customers, staff, residents, visitors and any other persons shall park in the designated
parking area and not on the adjacent streets, proximate neighborhood streets, or offsite
residential parcels; except that offsite event parking at nonresidential properties is
permitted with a valet or shuttle service.
n. Maricopa County Department of Transportation extends their recommendation with the
following conditions:
1. The plans show expansion of the SUP area for a distance of ±85 feet along Brown Road
(a minor arterial roadway). Dedication of 25’ (to provide a 65’ total half-width) along Brown

Quality rules and regulations.
p. The following Drainage Review conditions shall apply:
1. At the time of the application for building permits, the applicant shall provide a design for

flows are directed to the new retention basin(s).
5. Drainage review of planning and/or zoning cases is for conceptual design only and does

not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the
Maricopa County Drainage Policies and Standards.
6. All development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance and current engineering policies, standards and

Formal Meeting Minutes

s. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
t. Noncompliance with the conditions of approval will be treated as a violation in
accordance with the Maricopa County Zoning Ordinance. Further, noncompliance of the
conditions of approval may be grounds for the Planning and Zoning Commission to take
action in accordance with Chapter 3 (Conditional Zoning).
u. Non-compliance with the regulations administered by the Maricopa County
Environmental Services Department, Maricopa County Department of Transportation,
Drainage Review Division, Planning and Development Department, or the Flood Control
District of Maricopa County may be grounds for initiating a revocation of this Special Use
Permit as set forth in the Maricopa County Zoning Ordinance.
v. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval is temporary
and allows the property to enjoy uses in excess of those permitted by the zoning existing
on the date of application, subject to conditions and stipulations. In the event of the failure
to comply with any condition or stipulation, and at the time of expiration of the Special Use
Permit, the property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to comply with any
conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation or expiration of the Special Use Permit. The Special
Use Permit enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted.
w. Event traffic exiting onto Signal Butte Road shall only be permitted turning right /
southbound. Applicant shall address by signage, striping or physical barrier. There shall be
no event traffic ingress/egress from Brown Rd. There shall be no event traffic
ingress/egress onto 107th St other than for the purpose of secondary emergency access.
x. The following MCESD conditions will apply:
1. Contact the Onsite Program (602-506-0372) for possible septic permitting requirements
associated with the expansion (new building up to 6,000 sq. ft. and 5,000 sq. ft. storage
building).
2. Development and engineering design shall be in conformance with the Maricopa County
Stormwater Quality Management and Discharge Control Regulation. If required, the
owner/developer shall prepare a SWPPP and obtain approval by MCESD prior to
construction. (A separate submittal to MCESD would be required.) If required, upon
completion of construction, the owner shall fulfill MCESD requirements and obtain a post
construction stormwater permit.
3. If applicable, the site plan shall contain a note designating the entity responsible for
operation and maintenance of the on-lot stormwater management facilities consistent with
an approved operation and maintenance plan. (C-44-15-107-M-00)
Chairman Chucri thanked Planning and Zoning, staff, and everyone involved for their
work on this item.
John Burns, applicant, requested to have one of the residents, Allen Baker, speak

Formal Meeting Minutes
Wednesday, July 22, 2015
before the Board prior to him, due to Mr. Baker’s prior work engagements.
Mr. Baker spoke in favor of Superstition Manor stating that he is a contiguous property
owner, and believes that Superstition Manor has raised the value of his property and is
an improvement to the neighborhood. He added that noise from Superstition Manor is
not an issue, and the problem is with the vacant land, which attracts motorcycles, quads
and other off-road activities by trespassers.
Mr. Burns presented PowerPoint slides to accompany him while he spoke to the Board.
He discussed the business of Superstition Manor, noting that it is a non-denominational
wedding business that provides a much needed service to the community. In addition,
Superstition Manor has provided other services to the community, including seven
funerals to date and charitable events. Mr. Burns discussed the issues that Superstition
Manor is experiencing and the amendments to the Special Use Permit (SUP) he is
requesting. He stated that parking is an issue and in his original request he asked for
fewer parking spaces than were needed. He added that next to his property is Tonto
National Forest, and when additional or oversize parking is needed he is unable to
prevent people from parking there since it is federal land. He stated that all of the
residents who live within 300 feet of Superstition Manor are in support of his requests,
with the exception of three properties that are vacant and two properties that did not
give a response in favor or opposed. He stated that there have never been any traffic
issues. He showed pictures of the property and noted that he has made significant
improvements to the property, which was in very poor condition when he originally
purchased it. He added that all of the changes he is requesting are requests made to
him by clients and neighboring residents. He gave two options for adding additional
parking and the various amendments to the SUP he is requesting, and presented those
options to the Board with pictures of the proposed changes. Additionally, he requested
an extension of the SUP to 15 years, allowing background music for guests on the
patios during business hours, allowing tree replacement at the appropriate time
according to its planting schedule, increasing business hours Sunday through Thursday
from 9:00 p.m. to 10:00 p.m., fixing the set-back issues, and allowing the entire property
to be used for weddings and other events.
Chairman Chucri stated that some of the requests made by the applicant were not
presented to the Planning and Zoning Committee, and is outside the scope of some of
the considerations the Board will be deciding on.
Debra Stark, Director of Planning and Development, confirmed that the applicant’s
request to the Planning and Zoning Commission was for additional time for the SUP,
expanding the parking boundaries, additional building area, which included an additional
5,000 square foot storage area, 8,100 square foot building for grooms and other
activities, one patio shade cover, allowing additional amplified music, adding the off-site
rental, and altered development set-backs. She explained that the Commission
approved the following:
 Additional parking with a requirement of asphalt and parking space markings;
 Off-site rental within the SUP;
 Additional hour of business operation Sunday through Thursday; and
 Additional patio-covering.
The Commission denied the following:
 Additional square footage of the buildings;
 Amplified music; and

Formal Meeting Minutes
Wednesday, July 22, 2015
 Extension of years for the SUP.
Chairman Chucri asked about the eight foot wall requirement, and Ms. Stark advised
that the Commission was in concurrence with that requirement.
David Lawhead, resident, spoke in favor of Superstition Manor, noting the increase in
property value to neighboring homes and improvements to the community and
neighborhood. He added that he did not have any issue or concerns with Mr. Burns’
requests.
Larry Kratzer spoke in favor of Superstition Manor, noting that he does not live in the
area, but works in local law enforcement and has worked as a Security Coordinator for
Superstition Manor for one and a half years. He stated that the property owners are
very involved in the operation of the business. The owners provide a log for the security
officers to fill out hourly regarding noise, traffic, patrol, etc. He stated that parking is an
issue and additional parking would be helpful. He added that he has not had any issues
with the level of noise and music. He noted that it is difficult to get people off the
property right at 9:00 p.m. In addition, there have not been any issues with traffic
congestion and noted one incident where someone was asked to leave the property.
Supervisor Kunasek asked who generally parks across the road on the federal land. Mr.
Kratzer stated that he believes many people parking on the federal land are there for
off-roading activities and not wedding or event guests.
Chairman Chucri registered the support of Boyd Lee, resident, and Brittany Burns,
resident.
Chairman Chucri noted the possible recommendations prior to hearing the opposition.
The recommendations included the following:
 Business hours would not be extended Sunday through Thursday.
 There will not be any additional parking.
 Off-site rental may not include outside delivery or pick-up from the property and
all off-site rental services must be done by Superstition Manor.
 One additional patio cover will be allowed.
 Additional music will not be allowed.
 An additional building with a patio would be allowed.
 Allow a boundary shift of 85 foot to accommodate the relocation of the
dumpster.
 A driveway behind the property for delivery purposes would be allowed.
 Amplified music may only be played during ceremonies.
Donald Dahler, resident; Rachel Rubarow, resident; Ann Farence, resident; and Scott
Schmier, resident; made comments in opposition to the requests made by Superstition
Manor, noting several concerns and issues with the property, including concerns about
the requested set-backs, noise, traffic and public safety, and enforcing the conditions of
the SUP. They also discussed the impact of the business to the rural-residential
landscape of the community.
NOTE: The discussion and motion for item PZ-3 was paused to consider items 6
“a” through “f”. Items 6 “a” through “f” remain in their original placement on the
agenda.

Formal Meeting Minutes

Chairman Chucri registered the opposition of Joe Rubanow, resident; Mark Rubanow,
resident; and John Farence, resident.
Mr. Burns addressed concerns that were raised by residents who spoke in opposition
and asked the Board to grant the conditions he is requesting. Supervisor Kunasek and
Chairman Chucri responded to Mr. Burns and commented on the position the Board
took when it approved the original SUP. They also noted their consideration of the
comments and concerns expressed by neighboring residents.
Chairman Chucri stated his recommendation for a motion. Ms. Stark clarified the
specific amendments that the Chairman and Board Members recommended, which
include the following modifications to conditions ‘a’, ‘b’, ‘d’, ‘e’, ‘h’ and ‘k':
(New language to be added is underscored and deleted language is struck through)
a. Development of the site shall be in substantial conformance with the Site Plan entitled
“Superstition Manor”, consisting of one (1) full-size sheet, dated April 24, 2015, and
stamped received April 27, 2015, except as modified by the following conditions. Within
30 days of Board of Supervisors’ approval, the site plan shall be revised to delete the
5,000 sf new storage building and 8,116 sf new building (addition) with grooms room,
and 1,157 sf new patio cover – and replace with a maximum building square footage of
3,007 sf new patio covers aggregate additional building space, and 3,400 sf aggregate
additional enclosed building space for storage and kitchen only (as approved
previously). The revised site plan shall also include deletion of the western expansion
area that includes parking, retention and outdoor storage area, but will allow for an 85’
expansion to the west of the special use permit area only to accommodate a service
driveway to the new storage building and dumpster.
b. Development of the site shall be in conformance with the Narrative Report entitled
“SUP for Superstition Manor”, consisting of eight (8) pages, dated revised May 22,

Director explained to her that the County saved money with this contract. She
commented on the difficulty of getting a recount and the importance of having the best
systems to count ballots. She suggested that Board make a bid after the five-year
contract ends so the contract does not continue indefinitely.
14. REVENUE AND EXPENDITURE FOR MAINTENANCE OF VOTING EQUIPMENT
Approve an amendment which requests receipt of grant funding pertaining to the approved
Memorandum of Understanding (MOU) and Addendum Number 1, between the Board of
Supervisors (BOS), the State of Arizona, and the Secretary of State (Agenda Number C-

responsible for the County's compliance with the agreement and reporting requirements in
return for Helping America Vote Act (HAVA) funds for its purchase of qualifying voting
systems, equipment, external labor or other HAVA qualifying items. The funds will be used
for maintenance on Insight Optical voting machines and 400C vote counting equipment
and software license fees for BPS and WinEDS software.
The amendment awards $223,650 for FY 2012, $167,737 in FY 2013, and $111,825 for FY
2014. The Department requests an increase to Election Grant Fund revenue (248) HAV9
grant for FY 2016 for the full amount of $503,215.50, and increase the expenditure in the
Elections Department (210) Elections Department Grant (248) by same amount. The grant
funds, $503,215.50, may not be expended for any indirect costs which may be incurred.
The department's indirect cost rate for FY12, FY13, and FY14 are 56.2%, 48.7%, and
55.8% respectively. The recoverable indirect cost of administering this grant is $0; the non-
recoverable indirect cost is $269,777.81. Grant revenues are not "local revenues" for the

86. RESCIND AND APPROVE IGA WITH TOWN OF QUEEN CREEK AND TOWN OF
GILBERT FOR IMPROVEMENTS TO OCOTILLO ROAD AND POWER ROAD

Formal Meeting Minutes
Wednesday, July 22, 2015
Rescind the action taken by the Board of Supervisors (Board) on June 10, 2015 (C-64-15-
122-M-00) whereby the Board approved an Intergovernmental Agreement between
Maricopa County, the Town of Queen Creek and the Town of Gilbert for the intersection
improvements of Ocotillo Road and Power Road; and approve a new version of the
Intergovernmental Agreement between Maricopa County, the Town of Queen Creek and
the Town of Gilbert for the intersection improvements of Ocotillo Road and Power Road.
Also, approve the addition of the sub project T519 Ocotillo Road at Power Road to the
Partnership Support (PSUP) project for FY 2016.
The action requested above is proposed because, after the Board took its June 10, 2015
action to approve the Intergovernmental Agreement for the intersection improvements of
Ocotillo Road and Power Road, the partner municipalities requested that new language be
added to the Agreement. The proposed new language would provide that Maricopa
County’s contribution would not include any project enhancements by the partner
municipalities. (Agreement Paragraph 4.3) “Enhancements” means any project features
over and above the design requirements set forth in the Maricopa Association of
Governments (MAG) standard specifications. The new language also clarifies the limits of
current Queen Creek right-of-way (Paragraph C) and deletes an unnecessary reference
(Paragraph 10). The proposed new version of the Agreement is now provided with this
current proposed action.
Under the Intergovernmental Agreement, the County will submit a payment of $42,000 to
the Town of Queen Creek towards the installation of a traffic signal and striping at the
intersection. Funds are available in the FY 2016 Partnership Support (PSUP) project
reserve for this project. The Town of Queen Creek intends to construct the north half-street
improvements of Ocotillo Road from Recker to Power Road, which includes a box culvert
across the Sonoqui Wash, traffic signals at Power Road, utility relocations, and drainage
improvements.
The estimated project cost is $3,580,000, and based on the jurisdictional location of the
intersection, the County will be responsible for one-quarter of the cost of the intersection
improvements or $42,000. The Town will be responsible for the remaining balance of the
costs. The Town of Queen Creek will lead the project and annex the intersection 30 days
after the final acceptance of the project. The Town of Queen Creek will be responsible for
the maintenance and operations of the intersection and traffic signal when the project is
complete.
The terms of the agreement are in effect as of Board of Supervisors approval and shall
remain in full force and effect until all stipulations have been satisfied, except that it may be
amended upon written agreement by both parties. Supervisory District No. 1 (C-64-15-142-

County will also install a new traffic signal at the intersection of Riggs Road and Sossaman
Road.
The County will be responsible for the estimated project cost of $14,970,000, having
expended $655,000 in prior years, with the remaining $14,315,000 to be expended in fiscal
years 2016 through 2018. The Town of Queen Creek will annex all the unincorporated
areas within six (6) months upon substantial completion of construction. The Town of
Queen Creek will be responsible for the maintenance and operations of the structure and
improvements when the project is complete. The terms of the agreement are in effect as of
Board of Supervisors approval and shall remain in full force and effect until all stipulations
have been satisfied, except that it may be amended upon written agreement by both
parties. Supervisory District No. 1 (C-64-15-136-M-00)

the expense of the service for which the fee is assessed and the fee does not exceed the

One of the Court’s mandated duties is capturing the official record of court proceedings.
Arizona Supreme Court Rule 30 directs when a court proceeding requires the presence of
an official court reporter for this purpose. Beyond Rule 30, the Court determines whether
the official record may be created by electronic recording. Maricopa County local rules 2.22
and 10.5 require a separate request for each proceeding, if a court reporter is requested
and not mandated by Rule 30. These local rules provide parties with adequate time to
make a request that the matter be handled by a certified and authorized court reporter. If
approved and resources are available, the Court shall make arrangements for a certified
and authorized court reporter to be present for the purpose of taking the record of the
proceedings. The costs for the authorized court reporter will be borne by the requesting
party, or as directed by the Court to secure that actual estimated costs are reimbursed to
defray expenses of the services.
Authorizing the Civil Case Court Reporter Fee of $140 half day and $280 full day will
improve resource usage of court employed court reporters and reimburse expenses that
are now expended in the support of non-County directed purpose.
The new Civil Case Court Reporter Fee will be assessed to private parties in court
proceedings which a court reporter is not required by law who prefer to have a certified and
authorized court reporter rather than access to the electronically captured record. The
Court anticipates that this will primarily occur in civil cases. In the event that a particular
courtroom is not outfitted with functioning electronic recording technology, a certified and
authorized court reporter will be made available without application of these fees.
The approval of and availability of this fee will not restrict or inhibit any party’s ability to
obtain a record of court proceedings based solely on that party’s inability to pay for these
services. Parties may request a waiver or deferral of fees using the established process.
This fee does not require approval from the Arizona Supreme Court Administrative Office
of the Courts. The assessment of the fee would commence following BOS approval of the
fee. The proposed fee will be attributable to and defray or cover the expense of providing
the service for which the fee is assessed and the fee does not exceed the actual cost of
that service. (C-80-16-001-2-00)
