Commission
Recommendation: On 8/6/15, the Commission voted 5-1 (Muller dissenting) to
recommend approval of Z2015019 subject to conditions ‘a’
– ‘h’.
a. Development of the site shall comply with the Site Plan entitled “PH30547F,
Lindsay Palm)”, consisting of five (5) full-size sheets, dated May 12, 2015, and
stamped received July 16, 2015, except as modified by the following conditions.
b. Development of the site shall be in conformance with the Narrative Report
entitled “T-Mobile Site – PH30547F – Lindsay Palm Property”, consisting of four (4)

d. A Minor Amendment shall be required to co-locate future carriers on the
Wireless Communication Facility.
e. The wireless communication tower shall retain the stealth properties as originally
designed. Any damaged or missing fronds or branches shall be replaced within
60 days of such damage occurring.
f. This Special Use Permit shall expire 30 years from the date of approval by the
Board of Supervisors, or upon termination of the use for a period of 90 days or
more. All of the site improvements shall be removed within 60 days of such
termination or expiration.
g. Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Special Use Permit as set forth in the Maricopa
County Zoning Ordinance.
h. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval
allows the property to enjoy uses in excess of those permitted by the zoning
existing on the date of application, subject to conditions. In the event of the
failure to comply with any condition, and at the time of expiration of the Special
Use Permit, the property shall revert to the zoning that existed on the date of
application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, or the expiration of the Special Use
Permit, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in
value of the property from the value it held on the date of application due to
such revocation or expiration of the Special Use Permit. The Special Use Permit
enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of
the property as if the Special Use Permit had never been granted.

Project Summary:
1. The request is for a 30-year SUP for a new 70’ (h) monopalm Wireless Communication
Facility (WCF) with related equipment shelter. The original request was heard at the
May 7, 2015 Planning and Zoning Commission hearing. At that time, the applicant
proposed an 80’ (h) monopalm. The case was continued to the August 6, 2015 Planning
and Zoning Commission hearing due to opposition at the meeting. The proposed facility
is located on 500 sq. ft. of a 1.05 ac. undeveloped property located in RU-43 zoning
district. The subject property is located south of Appleby Road and approx. 400 ft. west
of Lindsay Road in the Chandler area.
2. The SUP area will be located 65’ from the east property line, 20’ from the south property
line, 65’ from the west property line, and approximately 260’ from the north property line
of the site. The 16’ x 16’ lease area for the SUP will be screened by an 8’ (h) CMU block
wall. This walled compound will enclose the monopalm tower, equipment boxes, and
other related equipment. A dedicated 12’ wide access easement will access the site
from E. Appleby Road along the east and south sides of the parcel. A 12’ x 18’ parking
space for the service technician will be located adjacent to the facility on the east
side.
Subject Area
Public Participation Summary:
3. Prior to the May 7, 2015 Planning and Zoning Commission hearing, the applicant mailed
notices to property owners within a 300’ radius of the site, requesting residents to call or
contact David Ullrich of Reliant Land Services (applicant). At the time of the original
report, one (1) resident had contacted the applicant requesting information regarding
health issues with WCF towers. At that time, the applicant informed the resident that the
proposed tower would meet all Federal Communication Commission guidelines for
health/safety. Staff mailed Commission and Board hearing notification postcards to

property owners within 300’. Staff received eight (8) letters of opposition prior to the
hearing, which were included in a supplemental packet distributed to the Commissioners
at the hearing.
4. Since the May 7, 2015 hearing, the applicant contacted the organizer of the
neighborhood opposition to resolve opposition to the case. The applicant revised the
proposal and reduced the proposed tower height by 10’. The applicant has reported to
staff that any change other than withdrawal of the proposal is unacceptable to the
neighborhood opposition. Staff has received an additional four (4) letters of opposition, for
a total of twelve (12) letters.
Background:
5. February 23, 2015: David Ullrich, on behalf of Phalavann EA, applied for a SUP to construct
an 80’ (h) stealth monopalm WFC on subject site.
6. April 17, 2015: In response to technical comments, applicant submitted revised plans and
narrative for submittal to Planning and Zoning Commission.
7. May 7, 2015: Planning and Zoning Commission hearing. By a vote of 6-0, Commission
recommended continuance to the August 6, 2015 hearing to allow the applicant time
to hold a neighborhood meeting regarding the WCF and to address issues and
concerns.
8. July 16, 2015: Applicant submitted revised Site Plan and Citizen Participation Plan. Revised
plans include 10’ reduction in proposed maximum height of WCF to 70’ and updated
applicant’s community outreach.

Adopted Plans:
10. Queen Creek Area Plan: Urban Residential/ Very Low Density (0-4 d.u./ac.).
11. Chandler General Plan: The Chandler General Plan designates the site as Traditional
Urban Character (2.5 – 3.5 d.u./ac.). Proposed uses include low-density single-family
residential development.

Police Protection: Maricopa County Sheriff’s Office (MCSO)
Outstanding Concerns from Reviewing Agencies:
12. N/A
Staff Analysis:
13. This proposal meets the underlying Rural-43 zoning district standards. However, due to
monopole height, the Wireless Communication Facility regulations require an 2:1
setback from all property lines, which the proposed facility does not meet with regards
to the rear (south), and side (east/west) property lines. The existing use of this parcel is
pasture and the subject property is surrounded by rural zoning developed with single-
family homes, pastures, and public service facilities. The applicant did not justify the
placement of the WCF within the required setbacks in the provided narrative, but has
indicated in conversations that the proposed location near the rear property line results
from the wishes of the property owner who does not want the proposed tower more
Agenda Item: 4 - Z2015019

centrally located within the site, should they wish to develop it residentially. It should be
noted; the existing lot width of 147’ does not provide sufficient lot width to provide the
required 140’ setbacks from side property lines.
14. This WCF is stealth designed as a monopalm. The pole is structurally engineered for
single-location of one (1) wireless carrier without compromising the stealth quality of this
facility. There are no plans for expansion or additional appurtenances for the proposed
WCF as presented herein. There are a number of natural palms in the area which will
help blend the monopalm into the horizon. The 8’ (h) CMU wall will provide screening,
noise abatement, and security.
15. There are no outstanding issues from reviewing County Agencies and staff is supportive
of this request for the WCF. Should the Commission recommend approval of this
application, staff recommends granting the reduction setback requirements.
Recommendation:
16. Staff recommends the Commission motion for approval of Z2015019 with conditions ‘a’ –
‘h’ for the following reasons:
 The proposal is a stealth design.
 The use appears to be compatible with the surroundings.
 Reviewing County agencies have no concerns.
Provided the following conditions are met:
a. Development of the site shall comply with the Site Plan entitled “PH30547F,
Lindsay Palm)”, consisting of five (5) full-size sheets, dated May 12, 2015, and
stamped received July 16, 2015, except as modified by the following conditions.
b. Development of the site shall be in conformance with the Narrative Report
entitled “T-Mobile Site – PH30547F – Lindsay Palm Property”, consisting of four (4)
pages, dated Revised May 14, 2015, and stamped received July 16, 2015.
c. The height of the wireless communication facility shall be limited to 70’ including
all antennas and attachments.
Agenda Item: 4 - Z2015019

SPECIAL USE PERMIT - PROJECT NARRATIVE
T-Mobile Site — PH30547F — Lindsay Palm Property
SW of Applebee Road and Lindsay Road, Chandler AZ 85286
February 12, 2015 — Revised May 14, 2015 - 22015019
E QUEEN CREEK RD
RECEIVED JUL Ib 2105
Applicant:
Reliant Land Services, Inc., representing T-Mobile
7201 E. Camelback Rd. #310,
Scottsdale, AZ 85251

PUROSE OF REQUEST
T-Mobile Wireless Communications is proposing to construct a 70' tall (reduced from 80') Wireless
Communications Facility monopalm within the property. The property is just west of the SWC of Lindsay
and Applebee Road, in Chandler, AZ. The purpose of this application is to request a Special Use Permit
for the approval of the new communications tower for a time period of 30 years. Assessor's Parcel
Number 304-73-003S has an address of 14407 E. Appleby Road and is approximately 45, 474 sf in size.
DESCRIPTION OF PROPOSAL
T-Mobile respectfully requests approval to install the 70' tall Wireless Communications Facility. As
depicted on the Site Plan and Elevations, the tower will be on the southern portion of the property. The
vacant site is currently used for horse grazing, with wire fencing surrounding the site. An 8' CMU wall is
proposed to screen the ground compound from view and provide security. The property is owned by
Mr. Paul Ea. The placement in on the southern portion of the site will not preclude future development
of a residence.
RELATIONSHIP TO SURROUNDING PROPERTIES
The land use and zoning Classifications surrounding the parcel are as follows:
North: Vacant PAD, Chandler South: RU-43, Maricopa County, single family home
East: Maricopa County RU-43 West: RU-43 Maricopa County, single family home
The subject site is a vacant 1.05 acre vacant future residential property. Applebee Road is a country lane
servicing three additional properties to the west, with a City of Chandler development called Layton
Lakes to the north with S. Layton Lakes Blvd W. also intersecting with Lindsay Rd, immediately north of
Applebee Road. Based on land ownership, it is not anticipated that homes will exist immediately to the
north of the subject site, as the LDS Church owns a 4.8 acre site, along with a .55 acre water well site
owned by City of Chandler. The existing Haley Elementary School is just to the northwest. To the west, a
residence exists on another one acre lot. The tower location provides about 235' from the nearest
residence to the west, approximately 220' to the east, and 485' to the south. There is existing verticality
along Lindsay Road with a significant power line corridor, along with an SRP switching yard on the
northeast corner of the intersection located in Gilbert. Those locations are further from the center of
the Radio Frequency Engineer's desired location. There is also local electric and telephone lines running
east-west approximately 140' south of the north property line.
This site was chosen after attempting to locate closer to the intersection of Ocotillo Road and Lindsay
Road, about a half mile to the south. Four vacant properties were considered at that intersection, but
none of the property owners was willing to place a tower on their respective properties, as they all have
future development plans for the property. Several other sites were reviewed before choosing this site.

LOCATION AND ACCESSIBILITY
The 1.05 acre site is located to the north of Ocotillo Rd. in the south Chandler area. The proposed WCF is
located to the southern portion of the property, with dustproofed access proposed directly from the
gravel road surface of Applebee Road. The subject site has an existing wire fence on all boundaries
typical of ranch properties, with a pair of swing gates for access.
CIRCULATION SYSTEM
The existing use has vehicular access throughout the site. No changes are requested or required for the
bounding street, for this addition to an existing vacant property. A graveled entry road will be
completed to the WCF site from Applebee Road, and a dustproofed technician parking will be marked
on the plans. The WCF is an unmanned facility and will generate only the occasional technician trips,
typically, once per month.
DEVELOPMENT SCHEDULE
The WCF Tower will be scheduled for completion as soon as all necessary approvals are obtained, and
construction is expected to take approximately 60 days.
COMMUNITY FACILITIES AND SERVICES
This site is located in the Chandler Unified School District, but as this is an uninhabited facility, no school
impact is created. Installation of this tower will fill a current gap in service in this area and will help
provide better customer call completion, emergency communications, and 911 First Responders service
calls.
PUBLIC UTILITIES AND SERVICES
Water — N/A, Sewer — N/A
Fire Protection — Rural Metro, Police Protection — Maricopa County Sherriffs office
Electric— SRP, Natural Gas — N/A
Refuse Collection — N/A, Technician to remove any generated trash.
Telephone —Qwest, Cable Television — Cox Communications

SUMMARY
The construction of this facility will help all types of wireless communication in the region, filling a gap in
service. We respectfully request approval of the Special Use Permit and site plan for T-Mobile.

Drainage Engineering Review has reviewed the plans and report submittal date
stamped 02/23/2015 for the subject application and has no objections.
Any approval of this case should include the following standard stipulations:
1. Drainage review of planning and/or zoning cases is for conceptual design only
and does not represent final design approval nor shall it entitle applicants to
future designs that are not in conformance with Section 1205 of the Maricopa
County Zoning Ordinance and the Maricopa County Drainage Policies and
Standards.
2. All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance and current engineering
policies, standards and best practices at the time of application for
construction.
Following are comments from the Flood Control District:
The applicant should be aware that the Flood Control District of Maricopa
County has conducted a major stormwater management study/plan in this
area. The Higley Area Drainage Master Plan (ADMP) is available for use by
developers. New development in the watershed is expected to acknowledge
and assess their project for compatibility with the ADMP. Deviations from
the ADMP must be documented, and an engineering analysis provided that

shows the deviations do not increase downstream flood peaks, volumes or
other flood hazards. A copy of the Higley ADMP is available at Flood
Control District of Maricopa County office for review. Should the applicant
have a question regarding this ADMP, they should contact Felicia Terry of the
Disrict at (602) 506-8111.

Re: Parcel No.:
Dear Mr. Scheerer:
I reside RIGHT NEXT DOOR to the proposed site for the above reference cell tower
installation.
I STRONGLY OPPOSE THIS INSTALLATION! Please find attached a report addressing
many of my concerns. However; of greatest concern is that my husband received a liver
transplant and already has a compromised immune system.
When the owner, Helen Remington, one parcel east of the proposed location, was approached by
T-Mobile and she refused; she was informed that there were several other sites available.
The proposed site DIRECTLY ADJACENT next to my house is an unoccupied acreage property
and not a residence. Also, this site is across the street from a grade school.
This is not only a possible health risk, but a drastic devaluation of my property and there is
already a cell tower within about /2 mile from the proposed site.
Thank you for your consideration.
Sincerely,
/3

La Mesa Council holds hearing Nov. 5 on proposal to erect cell phone tower in Lake

By Miriam Raftery
When Mom asked me to look into possible health hazards posed
'41 by cell phone panel antennas that a church in her neighborhood
wants to put up, I expected to find reassuring facts to allay Mom's
concerns. Instead, I found deeply disturbing data that makes me
wonder why the public is not being informed about health
" risks—and why our government seems intent on covering up
troubling truths.
Cell phone companies and the U.S. Food and Drug Administration
assert that cell phone towers don't pose health risks to the public.
Some studies support this assertion, but other studies suggest just the opposite.
Harvard-trained Dr. Andrew Well at -the University of Arizona's medical center recently
observed, "In January 2008, the National Research Council (NRC), an arm of the National
Academy of Sciences and the National Academy of Engineering, issued a report saying that
we simply don't know enough about the potential health risks of long-term exposure to RF
energy from cell phones themselves, cell towers, television towers, and other components of
our communications system. The scientists who prepared the report emphasized, in
particular, the unknown risks to the health of children, pregnant women, and fetuses as well
as of workers whose jobs entail high exposure to RF (radiofrequency) energy....Because so
much of cell phone technology is new and evolving, we don't have data on the consequences
of 10, 20 or 30 years worth of exposure to the RF energy they emit," Weil concluded. The
report called for long-term safety studies on all wireless devices including cell phones,
computers, and cell phone towers.

-DANGERS OF LIVING NFAR CELL PHONE TOWERS RAISED Page 2 of 3
A 2006 report issued by the World Health Organization (WHO) offered some reassurance
and found no scientific evidence that radiofrequency signals from cell towers cause adverse
health effects. The report noted that up to five times more of the RF signals from FM radio
and television (than from cell towers) are absorbed by the body with no known adverse
effects on health in the more than 50 years that radio and TV broadcast stations have been
operating.
But an Australian study found that children living near TV and FM broadcast towers, which
emit similar radiation to cell towers, developed leukemia at three times the rate of children
living over seven miles away.
If you live within a quarter mile of a cell phone antenna or tower, you may be at risk of serious
harm to your health, according to a German study cited at www.EMF-Health.com , a site
devoted to exposing hazards associated with electromagnetic frequencies from cell phone
towers and other sources.
Cancer rates more than tripled among people living within 400 meters of cell phone towers or
antennas, a German study found. Those within 100 meters were exposed to radiation at 100
times normal levels. An Israeli study found risk of cancer quadrupled among people living
within 350 meters (1,148 feet) of a cell phone transmitter—and seven out of eight cancer
victims were women. Both studies focused only on people who had lived at the same
address for many years.
Other studies have found that levels of radiation emitted from cell phone towers can damage
cell tissues and DNA, causing miscarriage, suppressing immune function, and causing other
health problems.
Astoundingly, the federal government does not allow rejection of a cell phone tower based on
health risks, according to a 2005 article. A Goog1e search found no evidence that this
situation has changed.
Yet over 1.9 million cell phone towers and antennae have been approved nationwide without
federal studies to assure safety of those living nearby.
How many cell phone towers and antennas are in your neighborhood? Find out at
vvww.antennasearch.com . I plugged in my address on Mt. Helix, hardly an urban stronghold,
and was astounded to discover that there are 96 cell phone towers, 286 antennas and 2
proposals for new towers within four miles of my home!
So how about Mom's neighborhood, where an Evangelical church insists a new tower is
needed? Mom gets perfectly fine cell phone reception, and so do the neighbors she's spoken

- DANGERS OF LIVINGI\T' AR CELL PHONE TOWERS RA-TSED Page 3 of 3
with—not surprising since there are already 113 towers and 335 antennas within a four-mile
radius.
Churches, schools, fire stations, and other buildings are increasingly erecting cell phone
towers or antennas because cell phone companies are willing to pay rental fees of hundreds
or even thousands of dollars a month—welcome infusions for cash-strapped budgets. But at
what cost to the public's health? There are young children in Mom's neighborhood, less than
one block from the proposed cell phone antenna site.
in Sweden, the government requires interventions to protect the public from electromagnetic
frequencies. Why isn't the U.S. government paying attention to this potential risk to public
safety?
If you wish to share your views on the T-Mobile proposed cell phone tower at 5777 Lake
Murray Blvd. (near Marengo Avenue), the La Mesa City Council will hold a public meeting on
Wednesday, November 5th at 7 p.m. in Council Chambers at the La Mesa City Hall, 8130
Allison Ave., La Mesa.

Case: Z2015019
Attn: Derek Scheerer
Dear Mr. Scheerer:
Please be advised that I am against the installation of any cell tower in my area.
I was approached several years ago for installation of a cell tower on my then dairy property
and I refused. I do believe that the installation has a negative impact on the neighborhood and
I do not support it's installation at any time.
Thank you for your consideration.
Sincerely,

Mr. Scheerer,
Please add our parcel to any lists you may have regarding the proposed addition of 80' palm tree cell
phone towers by T-Mobile proposed to be located on Appleby Road near Lindsay in Chandler; Case
#Z2015019. We found it distressing that no previous mailings had made it to our home regarding this
case. We became aware of it by stopping to read the posted sign on the property and then going to the
home next to the parcel for your information. As a resident of this county island just two parcels from
the proposed towers, I would have thought that we should be included in mailings for any proposed
changes within our county island, not to mention one so close which would affect our view and property
values.
It is our opinion that if such towers were placed on the proposed parcel, that our property values would
not just drop but sink. We have lived in this county island for 15 years and love it. It is uncomfortable
enough that developments are encroaching upon our island and stirring up dust and traffic and nuisance
behaviors. Add to that the image as the county island as a place to "dump" our unwanted but necessary
parts of infrastructure and we feel like 2n d class citizens. We cannot imagine such a proposal being
approved within any HOA structured development, and feel that we have as much right to the same
privileges enjoyed by those homeowners and should be protected by the county from such.
The owner of that parcel does not and never will reside on that parcel, so any agreements should be
carefully considered by the Board and Planning and Zoning Commission. This landowner purchased this
parcel for an investment with no intention to ever build on it or reside there. It is merely a profit he is
seeking so he has no concern as to how his decisions and actions might affect the neighbors around him.
There must be more commercial areas where such towers can be placed. If these towers were to go in
they would never come down making that property unsellable and reducing the value and more
importantly, salability of all the properties in our part of that county island encompassing Appleby Rd
and 142nd St. When we built our home in 2001, we were told that NOTHING could be above 30'. We do
not understand why that rule would be different for a commercial entity wanting to build something on
a RESIDENTIAL lot. We do not believe that this would ever be approved on a residential lot within city
boundaries and are very bothered that as county island residents we could be taken advantage of in this
manner.
Please hold public hearings and inform us in writing of the time and place. Or better yet, just reject the
proposal without further ado.
Thank you for your understanding and assistance.

Subject: Cellular Tower Opposition

Hello Carol, this is regarding Case# PA2014150 / Case# Z2015019. As a property owner/ liaison for
my community, I am sending you our petition of opposition regarding the listed case. I have been in
contact with Reliant Land Services, David Ullrich, and could not come to an agreement of his offer of
lowering the height of the proposed cellular tower. The community is not interested in group
meetings from Reliant Land Services / Team Mobile, to attempt to convince us the cellular tower has
any benefits within our community. Within the 300' radius from the proposed wireless communication
facility, there are 10 property parcels which are within the radius of that distance. 8 of the 10 are in
opposition and the remaining two are vacant land which meets the 20% that requires a 3/4 minimum
vote of the Board Of Supervisors. Currently I have attached an opposition petition which documents
24 residents, surrounding the proposed wireless communication facility, in opposition.
David Ulirich also advised me Team Mobile could not use the existing wireless communication
facility, located approximately 1,750 feet, east, from the proposed wireless communication facility
site, as an alternative, as it would not meet their needs (unknown need reasons). To my
understanding, per the Maricopa County text amendment, 1A2014001, there is a better way to
reduce the amount of wireless communication facilities in such close proximity by collocating on
existing towers. I have spoke to the property owner at 21501 S. 146th St, (parcel# 304-72-043), John
Felty, who has an existing wireless communication facility on his property. John states the tower
is between 95' - 100' in height and believes there are 2-3 available areas for collocation. John states
the wireless communication facility is an AT&T tower, managed/ owned by Crown Castle. In the past
John states Sprint and Nextel had collocated, but since terminated their contract which allows for
available collocation.
We are aware there are 6-7 additional locations sites available to Team Mobile, but despite the
community opposition Team Mobile continues to target this specific site within our community.
A special use permit is being requested, by Reliant Land Services, as it does not meet the property
line requirements; wireless communication facilities shall be setback 2 feet from all property lines for
each one foot in height. The proposed wireless tower height is 70', which needs to be setback 140'
from any property line. The east and west side of this property overlaps the 140' setback.
The next upcoming meeting is scheduled on 816115 at 9:30am at the BOS Auditorium, located at 205
W. Jefferson St., as a continuance of the special permit hearing Reliant Land Services/ Team Mobile
is attempting to obtain.
Please add this petition attachment to the case file for our opposition.
Thank you,
Philip Canchola
