LICENSE No. P50109 AMENDMENT No. 01 C-50-10-109-M-01 AMENDMENT No. 1 TO LICENSE AGREEMENT FOR USE OF REAL PROPERTY RECITALS A. Lake Pleasant Marina Partners, LLC,(“Licensor”) and Maricopa County, a political subdivision of the state of Arizona (“Licensee”) are parties to that certain License Agreement No. P50109 (the “Agreement”) dated and approved by the Maricopa County Board of Supervisors on April 28, 2010. The Agreement is for use of certain facilities and property and receipt of services as further described in the Agreement, at Scorpion Bay Marina, Lake Pleasant, Arizona. B. Under the Agreement the Licensor granted a license commencing on May 15, 2010 and continuing through May 15, 2015. C. Licensor and Licensee now mutually desire to amend the Agreement to renew and extend the term and update Licensee notice address. AGREEMENT NOW, THEREFORE, in consideration of the foregoing and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Licensor and Licensee agree to amend the Agreement as follows: 1. Licensor and Licensee have continued to operate under the terms and conditions of the Agreement since May 15, 2015, and currently continue to do so, and Licensor and Licensee hereby agree to renew and extend the term of the Agreement. 2. The term of the Agreement is hereby renewed and extended retroactively from May 16, 2015 through May 15, 2020. This Agreement is subject to termination pursuant to the provisions of A.R.S. §38-511. 3. Upon signature by the Maricopa County Board of Supervisors, the effective date of this Amendment No. 1 shall be retroactive to May 16, 2015. 4. Licensor and Licensee hereby acknowledge that Licensor was previously inadvertently referred to as Lake Pleasant Marina Partners, LLP, in the Agreement and, further, Licensor and Licensee hereby agree that any such reference should have been, and is now considered to be, a reference to Lake Pleasant Marina Partners, LLC, as Licensor. 5.
