CONTRACT NO. C-19-15-037-3-01 AMENDMENT 1 AMENDMENT TO THE AGREEMENT BETWEEN MARICOPA COUNTY THROUGH THE MARICOPA COUNTY ATTORNEY’S OFFICE AND SAGE COUNSELING, INCORPORATED I. The Parties entered into Behavior Specific Adult Diversion Program Contract (C-19-15- 037-3-00)(“Contract”) on or about May 20, 2015. II. The Parties mutually desire to amend the Contract to clarify that Level III rates apply to Indigent participants, clearly identify assessment fees and to set Level III (“Indigent”) fees. III. The parties agree to: A. Amend paragraph 2, Fees to clarify that Level III rates apply to Indigent participants, as follows: The Contractor shall collect a participation fee from each participant in accordance with fees schedule set forth in Attachment A. The Contractor may charge the reduced Level II rates to any client/family that meets the income qualifications and receives the benefits of the Federal School Lunch Program, AHCCCS, or SSDI. The fee shall include the cost of any required facilities. Contractor understands and agrees that under no circumstances is the County liable for any fees or costs related to this Contract. At his option, the County Attorney may utilize monies accumulated in the Drug Diversion Fund to satisfy the costs associated with this agreement if the participant is indigent and unable to pay the costs associated with the behavior specific adult diversion program. Indigent for the purpose of this agreement means a person who is without sufficient means or ability to provide themselves with adequate food, shelter or social necessaries and whose income does not exceed 50% of the federal poverty guidelines updated periodically in the Federal Register by the U.S. Department of Health and Human Services under the authority of 42 U.S.C. 9902(2). The rates for Indigent participants are Level III rates on the attached fee schedule. B. Amend Attachment A, the fee schedule, to clarify assessment fees and set Level III (“Indigent”) fees, as follows: Individual Group Education Class: Assessment Counseling Counseling One Day Session Session Level I $140 $65 $40 $110 Level II $100 $45 $28 $75 Level III (Indigent) $35 $15 $10 $25 CONTRACT NO. C-19-15-037-3-01 AMENDMENT 1 IV. The foregoing paragraphs contain all the changes to the Contract. All other terms of the original Contract not amended hereby, remain in full force and effect.
