May 6,2015 Mr. Steve Chucri, Chairman Maricopa County Board of Supervisors 301 West Jefferson Street, 10 th Floor Phoenix, AZ 85003 RE: REQUEST FOR BOARD OF SUPERVISORS APPROVAL Dear Mr. Chucri: The purpose of this letter is to notify and request approval from Maricopa County for an annexation by the City of Phoenix of unincorporated public right-of-way pursuant to Arizona Revised Statutes (A.R.S.) §9-471(N). This request is to annex only unincorporated right-of-way of 51st Avenue, south of La Mirada Drive. The City of Phoenix will annex that portion of right-of- way along 51st Avenue, south of La Mirada Drive, approximately 0.841 acres, 0.0013 square miles, and assume responsibility for road maintenance. Under A.R.S. 9-471 (N), a County right- of-way with no taxable real property may be annexed by an adjacent city or town upon mutual approval of the Board of Supervisors and the City Council. The annexation ordinance was adopted by the Phoenix City Council on April 22, 2015. A copy of the City of Phoenix Ordinance is enclosed for your information. We would hope that the Board of Supervisors, too, will schedule this for formal action at its earliest convenience. Please advise us when formal action is scheduled by the Board of Supervisors. WHEREAS, the City of Phoenix desires to annex certain property, consisting of public right of way outside the City, NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PHOENIX AS FOLLOWS: SECTION 1. That the corporate limits of the City of Phoenix be, and they are hereby, increased so as to include within the corporate limits of the City of Phoenix the unincorporated right of way of 51 st Avenue, south of La Mirada Drive, more particularly described in Section 2 hereof, and that said territory is hereby annexed and declared to be a part of the City of Phoenix contingent upon the fulfillment of the conditions of A.R.S. Section 9-471(N). SECTION 2. That the City Council hereby determines that the territory to be annexed is described as follows: That part of the Northeast quarter of Section 8 and Northwest quarter of Section 9, Township 1 South, Range 2 East, G&SRB&M, described as follows: BEGINNING at the intersection of the South line of the North 643 feet of said Northwest quarter of Section 9 and the West line of said Northwest quarter of Section 9, being also a point in the East line of said Northeast quarter of Section 8 and being also a point in the boundary of the area annexed to the City of Phoenix by its Ordinance No. G-5189, recorded in Document No. 2008-0597694, records of Maricopa County, Arizona; thence Easterly along said South line of the North 643 feet of the Northwest quarter of said Section 9 to a point in the boundary line of said area annexed to the City of Phoenix, being also the East line of the West 55 feet of said Northwest quarter of Section 9; thence Southerly along said East line of the West 55 feet to a point in the South line of the North 976 feet of said Northwest quarter of Section 9; thence Westerly along last said South line of the North 976 feet to a point in the West line of said Northwest quarter of Section 9, being also the East line of said Northeast quarter of Section 8; thence continuing Westerly along the South line of the North 976 feet of said Northeast quarter of Section 8 to a point in the West line of the East 55 feet of said Northeast quarter of Section 8; thence Northerly along said West line of the East 55 feet to a point in the South line of the North 643 feet of said Northeast quarter of Section 8, being also the boundary line of said area annexed to the City of Phoenix; thence Easterly along said South line of the North 643 feet, being also the boundary line of said area annexed to the City of Phoenix, to the East line of said Section 8 and the POINT OF BEGINNING. SECTION 3. That the map or plat attached to this ordinance is an accurate map of the territory annexed, and the same is hereby adopted as the official map of the territory hereby annexed, which said map and plat show the legal boundaries thereof, together with the avenues, streets, alleys and lanes and the locations thereof. SECTION 4. That the Mayor of the City of Phoenix be, and he hereby is, authorized and directed to certify that said map is an accurate map of the territory annexed under the provisions of this ordinance. 2 Ordinance S-41617 SECTION 5. That a copy of this ordinance, together with the attached official map, shall be filed with the Board of Supervisors of Maricopa County, State of Arizona, for their consideration pursuant to A.R.S. Section 9-471(N). SECTION 6. That the annexation of the above-described territory is contingent upon the approval of the annexation by the Board of Supervisors, Maricopa County, State of Arizona. SECTION 7. That, approval of the County Board of Supervisors pursuant to A.R.S. Section 9-471(N), a copy of this Ordinance, together with an accurate map of the territory hereby annexed to the City of Phoenix, certified by the Mayor of said City, shall be filed and recorded in the office of the County Recorder of Maricopa County, Arizona. SECTION 8. If any provisions of this ordinance shall be held invalid, its invalidity shall not affect any other provision, and for this purpose the provisions of this ordinance are hereby declared to be severable.
