Commission
Recommendation: On 1/22/15, the Commission voted 9-0 to recommend approval of
MCP2014002 subject to conditions ‘a’ – ‘f’:
Provided the following conditions are met:
a. Development and use of the site shall comply with the narrative report entitled, “Plains
Cavern Facility Expansion”, consisting of seven (7) pages, dated revised November 10,
2014 and date stamped received November 12, 2014 except as modified by the following
conditions.
b. Uses on the subject property shall be limited to the following:
1. Brine pond(s) and associated infrastructure and equipment to facilitate LPG storage and
distribution.
2. Underground “salt dome” storage caverns and associated infrastructure and equipment.
3. Truck loading/unloading facilities, associated infrastructure and equipment to facilitate
LPG storage and distribution.
4. LPG processing equipment (storage tanks, pipelines, etc.)
5. Office, warehouse and maintenance facilities related to the LPG storage and distribution

f. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property owner to enjoy uses in excess of those permitted by the underlying zoning existing
on the date of application, subject to conditions. It is, therefore, stipulated and agreed that
revocation of this Military Compatibility Permit due to the failure to comply with any
condition does not reduce any rights that existed on the date of application to use, divide,
sell, or possess the property and that there would be no diminution in value of the property
from the value it held on the date of application due to such revocation. The Military
Compatibility Permit enhances the value of the property above its value as of the date the
Military Compatibility Permit is granted and revocation results in the same value of the
property as if the Military Compatibility Permit had never been granted. (C-44-15-054-M-

County Island Status: N/A
Additional Comments: N/A
Commission Recommendation: On 1/22/15, the Commission voted 9-0 to recommend
approval of Z2014083 subject to conditions ‘a’ – ‘o’:
Provided the following conditions and stipulations are met:
a. This special use permit (SUP) amends and supersedes all previous zoning entitlement
approvals for the Palo Verde Nuclear Generating Station (PVNGS) including the power
generation facility and the evaporation ponds. This list of conditions amends and
supersedes all previous stipulations and conditions.
b. This SUP is a permanent zoning entitlement without expiration.
c. PVNGS operations are subject to oversight and regulation by the Nuclear Regulatory
Commission (NRC). In exercise of its jurisdiction, the NRC requires that a nuclear facility,
its environs, design, operation and maintenance comply with operational criteria and
regulations intended to protect the public health and safety. PVNGS shall operate within
the limits of these parameters.
d. PVNGS shall be operated and developed on the property identified within and in general
conformance with the Concept Plan of Development consisting of one page entitled “Palo
Verde Nuclear Generating Station Special Use Permit Bubble Plan”, dated initial submittal
to Maricopa County October 31, 2014 (concept plan).
e. Development of PVNGS shall also be consistent with the exhibit entitled “Palo Verde
Nuclear Generating Station Special Use Permit Floodplain Exhibit”, dated initial submittal to

development that are not in conformance with Section 1205 of the Maricopa County Zoning
Ordinance, and Drainage Policies and Standards.
k. Additional nuclear power reactor units, beyond the three existing units, shall not be
added to PVNGS without an amendment to allow such additional nuclear power reactor
units. Said major amendment to the SUP shall be presented to the Maricopa County Board
of Supervisors after recommendation of the Maricopa County Planning & Zoning
Commission. An expansion of the SUP land area shall be a major amendment presented
to the Maricopa County Board of Supervisors after recommendation of the Maricopa
County Planning & Zoning Commission. Uses consistent with the SUP as approved herein
or expansion of current operations shall not be considered a major or minor amendment to
the SUP but rather shall be considered in general conformance with the concept plan and
substantial conformance with the narrative.
l. PVNGS shall abide by all state and federal laws regarding jurisdictional dams.
m. Development and use of the PVNGS property shall comply with requirements for fire
hydrant placement and other fire protection measures as deemed necessary by the Palo
Verde Nuclear Generating Station Fire Department.
n. As stated above PVNGS is required by federal regulations to comply with the
requirements, regulations and oversight of the NRC in relation to the public health and
safety in its nuclear operations. In most cases, the requirements of the NRC exceed the
requirements of the Maricopa County Zoning Ordinance, and violations of the NRC’s
requirements are subject to corrective actions by federal authorities. When federal laws
and regulations overlap with the requirements of Maricopa County and the State of
Arizona, the laws and regulations of the United States shall preempt such local
governance. This includes these conditions of SUP approval.
o. Construction permitting at PVNGS may be governed by a Memorandum of
Understanding (MOU) between the Maricopa County Planning & Development Department
and Arizona Public Service Company (APS). (C-44-15-056-M-00)

Commission
Recommendation CPA2012012
1. On 1/22/15, the Commission voted 7-1 to recommend approval of CPA2012012 subject
to conditions ‘a’ – ‘g’:
Provided the following conditions are met:
a. Development and use of the site shall comply with the narrative report entitled, “Russell
Ranch South”, including all exhibits dated revised June 12, 2014, and stamped received
June 13, 2014, except as modified by the following conditions.
b. If the Board takes action to amend or revert/rescind subsequent zoning, this land use
plan shall be considered for amendment.
c. The total number of residential units shall not exceed 333 dwelling units.
d. Not less than 27 acres shall be developed as open space to include neighborhood park,
pocket parks and an internal trail system. At the time of each preliminary plat submission,
the developer shall include a description of the status, cumulative acreage and proposed
amenities.
e. The following Maricopa County Flood Control District (FCD) conditions shall apply:
1. A Floodplain Use Permit must be obtained from the Floodplain Management and
Services Division of the Flood Control District.
2. Approval of the Conditional Letter of Map Revision by the Federal Emergency
Management Agency (FEMA) will be required prior to Flood Control District recommending
approval of the Final Plat.
f. The following State Historic Preservation Office (SHPO) condition shall apply:
1. An archeological survey shall be submitted to and approved by the Arizona State
Historic Preservation Office prior to issuance of a grading permit or approval of a Final Plat.
The applicant must contact the state office prior to initiating disturbance of the site. The
applicant shall provide the Planning and Development Department with written proof of
compliance with this stipulation.
g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property owner to enjoy uses in excess of those permitted by the land use existing on the
date of application, subject to conditions. In the event of the failure to comply with any
condition of approval, the property shall change to the land use designation that existed on
the date of application. It is, therefore, stipulated and agreed that revocation due to the
failure to comply with any conditions does not reduce any rights that existed on the date of
application to use, divide, sell or possess the property and that there would be no
diminution in value of the property from the value it held on the date of application due to
such revocation. The Comprehensive Plan Amendment enhances the value of the property
above its value as of the date the Comprehensive Plan Amendment is granted and
changing to the prior land use designation results in the same value of the property as if

the Comprehensive Plan Amendment had never been granted. (C-44-15-057-M-00)
Deborah Stark, Director of Planning and Development Department, reviewed item PZ-4
and PZ-5 noting that a separate vote was necessary for each item. She said staff
received two letters in support, 56 letters in opposition, and a petition containing 876
signatures in opposition. Ms. Stark noted there were residents in opposition that also
attended the Planning and Zoning Commission meeting. She stated more information
regarding both items is included in the handouts, and the Planning and Zoning
Commission voted 7-1 on both items.
Chairman Chucri asked the applicant to approach and thanked those present who came
to speak.
Bill Lally, presenting on behalf of the applicant HilgartWilson / J and A Camelback
Property, LLC, thanked County staff and gave a presentation noting several points of
interest regarding the project such as: location, timeline from the beginning to the
current state, information on surrounding properties and developments, drainage issues,
meetings held with the community, original developer issues, and zoning information
concerning lot size.
Howard Thorpe, resident, spoke in opposition to agenda items PZ-4 and PZ-5 and gave
a presentation regarding several concerns such as overcapacity of school district, traffic,
change to parcel lot size and water retention.
Edward Artz, resident, spoke in opposition to these items and presented information
regarding water retention and drainage concerns.
Supervisor Kunasek asked about water retention requirements that exist today. Ms.
Stark responded that a basin currently exists but it does not drain properly. Robert
Fidorca, Drainage Representative, responded that the new developer has stated in a
report that the deficiencies would be deferred to Phase four and five. Discussion
ensued regarding water retention basin issues including fixing retention concerns in
subsequent development phases and increases to the number of lots in this phase.
The following individuals were registered in opposition of agenda items PZ-4 and PZ-5:
Charles Reading
Timothy Foster
Kate Szafranski
Lynne Corbett
Aaron Spirek
Cathy Seros
Julie Hesla

The following residents spoke in opposition to agenda items PZ-4 and PZ-5 commenting
on specific points as noted:

James Palmer
 insisted that rezone retentions should be adhered to.
Stephen Brook
 developer knew the land uses when the development area was purchased.
Carol Holley
 current property owner rights are not being protected.
Joseph Corbett
 attended all meetings and stated that if the zoning is changed he believes it will
continue to change.
Robert Hesla
 change in lot size is a large concern of his.
Todd Fritz
 decrease of quality of life due to the zoning change.
Alisa Wattie
 zoning issues that may lead to other problems within the development.
Tammy Synowiecki
 overpopulated school district.
Mitchel Dukatt
 traffic and smaller parcel size.
Supervisor Hickman noted that the development drainage problems are a continuum
from the previous developer and asked for a brief history of the area. Ms. Stark
responded that the original developer was issued a violation in 2009 because
construction was done outside of the scope of the permit that was issued. The original
developer had accrued fines of $430,000.00 then left the development. The Home
Owners Association (HOA) was then cited but has been working with the Planning and
Development Department. A permit has been issued for Phase 3 however the issue still
remains about lot capacity in the new development.
Supervisor Hickman about the moratorium in Phase 3. Ms. Stark responded that the
moratorium is a part of Phase 3 and it will not be lifted because the work was done
outside of the scope of the permit. As soon as the problems are resolved then the
moratorium would be lifted.
Mr. Lally addressed the following issues that the citizens questioned:
Drainage: The two basins were to be temporary. Now they need Vector Control and
there is an engineer’s estimate of $800,000 to recalibrate the slopes and add dry wells.
The HOA is working on this.
Traffic: They have designed the area so that most people will use the Camelback
entrance and have cut off some other entrance points.
School District: Discussions with the local schools confirm that they are fine with the
projected number of new students, and there is a plan for a new high school.

Formal Meeting Minutes

Supervisor Kunasek asked what the lot widths are for the north boundary. Mr. Lally
referred to a map and responded that Parcel 4 would contain lots at a minimum of
13,500 square feet. Discussion ensued regarding the different lot sizes within each
parcel.
Supervisor Kunasek asked for more details on traffic for the area. Mr. Lally referred to a
map and responded that a potential traffic calming area is set to the far east, however,
the developer will continue to work with the Department of Transportation to resolve any
issues.
Mr. Lally informed the Board that the developer intends to change the name of the
development at some point in response to citizens that have voiced support to change
in the development.
Supervisor Hickman thanked the residents for attending the meeting and gave a review
of the conerns of these residents. He explained he met with the developer and
residents and noted discrepancies in the reports that school districts and Luke Air Force
Base were in opposition of this development. He stated that he will be working with the
HOA in resolving the drainage issues. In addition, he noted that the applicant had
worked diligently for the past two years in resolving the residents’ concerns and that the
Board must be consistent in promoting economic development especially in the west
valley.
The following persons also registered in opposition to these items:

7. ROAD DE-ANNEXATION FROM THE CITY OF PEORIA TO MARICOPA COUNTY
Pursuant to A.R.S. § 9-471.03 to determine if the public interest is served by de-annexing
road right-of-way from City of Peoria jurisdiction to Maricopa County in accordance with
Peoria Ordinance No. 2014-32, and the analysis of the impact of the requested de-
annexation.
Right-of-way location: 99th Avenue from North of Olive Avenue to Peoria Avenue.
After reviewing the analysis and hearing those that may appear for or against the request,
if the Board determines that the public interest is served by this de-annex/annexation
action, a vote of approval shall direct the following:
1. File an ordinance setting forth the legal description of the public right-of-way and
declaring the return of the right-of-way contingent on the fulfillment of the additional
conditions of the statute in the Office of the Clerk of the Board.
2. Pursuant to ARS § 9-471.03(F), set a public hearing for March 25, 2015 to de-annex
road subject right-of-way from City of Peoria jurisdiction to Maricopa County, in accordance
with Peoria Ordinance No. 2014-32, and the Ordinance approved by the Board of
Supervisors on this date.
3. Send notice of the date, time and place of the hearing on the requested action to each
owner of real property subject to taxation adjacent to the subject public right-of-way at least
twenty (20) days prior to the hearing.
Legal description of the roadway to be de-annexed, identified as Exhibit "A", is attached.
Analysis of this requested action: The City of Peoria annexed land area east of a line 40’
east of the 99th Avenue section line on May 23, 1963. On November 21, 1966, The Board
of Supervisors, adopted a resolution declaring 99th Avenue to 65 feet east of the 99th
Avenue section line for a road improvement project, project 56-372. A 25 foot strip of the
roadway declared was in Peoria jurisdiction. By declaration of 99th Avenue, the operation
and maintenance of the 25’ strip in Peoria jurisdiction was assumed by Maricopa County.
The Department of Transportation has maintained the entire width of 99th Avenue to 65’

east of the 99th Avenue section line since the construction of the MCDOT road
improvement project. Since a 25 foot portion of 99th Avenue lies within City of Peoria
jurisdiction, Peoria and MCDOT have agreed that it is in the best interest of both parties to
de-annex from the City of Peoria that portion lying within the 99th Avenue corridor that is
maintained by MCDOT to avoid confusion between the two entities as to which is
responsible for the road maintenance, regulation and policing as well as a benefit to the
public by making it easier to determine which entity to contact regarding issues related to
the road. Also, since MCDOT is currently maintaining the road in question, there would not
be additional financial burden due to this action beyond what it already has. MCDOT would
assume full liability in the de-annexed strip as the City of Peoria would no longer be the
jurisdiction of record. Supervisory District No. 4 (C-64-15-072-M-01)

12. COUNTY ATTORNEY REQUEST FOR REVIEW OVER BASELINE
Per the Board approved FY 2016 Budget Guidelines and Priorities, approve allowing the
Office of Management & Budget to review the following requests over baseline:
1. $1,458,992 for salaries and benefits of 18 new positions in the Recurring (0000) County
Attorney (190) General Fund (100) so that personnel currently in one-time special project
positions in Non-recurring (0001) various special revenue funds can continue the efforts
begun as pilot or special circumstances. These positions include prosecutors, detectives,
paralegals and support staff and were originally created for a Cold Case Unit, mitigation
research, warrant backlog, the Temple Murder case, and domestic violence and sex crimes
backlog
2. $1,225,019 to create 26 new positions in the Recurring (0000) County Attorney (190)
General Fund (100) including: four (4) prosecutors, four (4) additional restitution clerks, two
(2) victim advocates, four (4) civilian positions for the Investigations Division, one (1)
management analyst, five (5) paralegals, and six (6) support staff. These positions will
assist us to maintaining an appropriate prosecuting attorney staff level, handling increased
restitution requests, responding to increased victim requests for service, utilizing civilians to
locate victims and witnesses and freeing sworn law enforcement detective to perform other
police duties, utilize a civilian to oversee the agency's CALEA accreditation program, and
add proportionate numbers of paralegals and support staff to assist increased prosecutor
numbers.
3. $258,181 to increase the MCAO budget to accommodate an additional day of salaries
and incremental benefits during FY 2016 for employees in the Recurring (0000) County
Attorney (190) General Fund (100).
4. 221,972 to increase the salaries and benefits budgets to move one (1) attorney, one (1)
paralegal, and one (1) victim advocate from the Recurring (0000) County Attorney (191)
Grant Fund (219) to the Recurring (0000) County Attorney (190) General Fund (100).
Anticipated grant revenues in FY 2016 will not be sufficient to support these critical
positions. Also move one (1) support position from Recurring (0000) County Attorney (190)
General Fund (100) to Recurring (0000) County Attorney (198) Diversion Fund (220). This
will help reduce the net impact on the County Attorney (190) General Fund (100).
5. (51,556) to reduce the personnel budget in the Recurring (0000) County Attorney (190)
General Fund (100) that can reallocated for some of the increases noted in other baseline
increase items.
6. (927,284) to reduce the supplies and services budgets in the Recurring (0000) County
Attorney (190) General Fund (100) that can reallocated for some of the increases noted in
other baseline increase items.
The net amount of budget increase above baseline the County Attorney is requesting in FY
2016 totals $2,185,324. (C-19-15-028-2-00)

13. RECORDER AND ELECTIONS REQUEST FOR REVIEW OVER BASELINE
Per the Board approved FY 2016 Budget Guidelines and Priorities, approve allowing the
Office of Management & Budget to review the following requests over baseline:
Recorder- $1,698,269 Recorder Surcharge Fund 236 for use of non-recurring fund
balance.
Elections-$4,329,156 (Fund 100-non-recurring expense and revenue for Presidential
Preference Election-State mandate)
The $1,698,269 use of Recorder Surcharge fund balance includes upgrades to technology
systems and equipment.
The cost of the Presidential Preference election is reimbursed by the State of Arizona. (C-
36-15-001-2-00)
Motion to approve by Supervisor Kunasek, seconded by Supervisor Hickman
Supervisor Kunasek concurred with Supervisor Hickman regarding the potential cost
shifts from the State. He noted that the Presidential Preference election has not been
put into the State budget and by statute the County must be reimbursed the costs. He
said he is interested whether the County will be reimbursed by the State.
Supervisor Gallardo stated that there has been discussion between the State and
County, on whether the Presidential Preference election is needed. He noted that the
cost to the State is $6 million with $4.3 million being the most for Maricopa County. He
noted that it should be taken to the County Supervisors Association (CSA) because
other counties will feel the State budget cuts as well. He stated that there needs to be
discussion regarding the issue with State Legislature. Supervisor Gallardo agrees that
the County should be reimbursed the costs for the Presidential Preference election but
there should be discussion in whether the election is truly needed.
Helen Purcell, County Recorder, noted that the costs for the Presidential Preference
election are not in the State Legislature or Governor Doug Ducey’s budgets. She said
there are a couple of ways it could be handled—1) through session law for the
upcoming Presidential Preference election in 2016, or 2) by an across-the-board change
in statute to eliminate the election. She stated that a meeting was held with the

TRANSPORTATION SERVICES
Approve a one-time addition to fleet of a 2006 Ford Crown Victoria to Medical
Transportation Services. The vehicle, equipment #11654, has 135,231 miles and is valued
at $4,029. The annual operating expenses are anticipated to be $3,500 and will be paid
from the Detention Fund. This vehicle will be retired at the end of its useful life with no
funding from the General or Detention Fund for its replacement.
A need for MCSO access to a vehicle on site at the hospital (MIHS MMC) by detention
personnel for all three shifts was recently made known. This vehicle will remain at
Maricopa Medical Center for assigned personnel to be used in the event of an emergency
and to conduct random checks of outside facilities. (C-50-15-062-M-00)
Blue Crowley, resident, questioned the vehicles use and the monetary value of each
stating “at the end of its useful life”. He questioned why item 16 states the County
already had the aircraft but now is adding it. He asked why the item was retired from
the fleet and why is it now being added back to the fleet. He then asked how many
aircrafts the County has.
Supervisor Kunasek stated that item 16 is to formally make the 1990 Harlan Aircraft Tug
a part of the fleet.
Mr. Crowley stated he does not understand why it took 8 years to add it to the fleet.
Motion to approve by Supervisor Kunasek, seconded by Supervisor Hickman
Ayes: Chucri, Hickman, Barney, Kunasek, Gallardo

be $1,500. This vehicle will be permanently removed from the fleet at the end of its useful

Adult Probation is a low cost alternative to jail and prison. At the current caseload ratios,
which are based on evidence based practices, this department has been showing
remarkable MfR results in areas such as successful completions from probation/pretrial
supervision and sentencings for new felony offenses. These successes have a positive
influence on community safety, as well as reduced present and future court and jail costs.
There has been steady growth in probationer and defendant numbers in several high risk
programs over the last several years. There has also been steady growth in programs
having direct impact on jail costs. None of these growth areas show signs of subsiding. (C-

81. RE-ISSUE TWO STALE DATED WARRANTS
Approve the reissuance of two stale dated warrants to Mr. Joel Cohen. The two warrants
are: #675028 in the amount of $837.06, and #660807 in the amount of $224.14. Sufficient
evidence has been presented to explain the delay in presenting these checks for payment.
In accordance with ARS § 11-644, the original check was not presented for payment within
one year and therefore the monies were transferred to the county general fund.
Specifically, the entry was a credit to Balance Sheet Account (BSA) 0201 (which is a
County liability account) as the claim may be presented to the Board within one year of
stale dating for authorization to reissue the original check. On year two, the stale dated
check that was put into BSA 0201 was posted as General Fund revenue as there was no
claim against the Board after the first year to re-issue the check. Therefore, in order to
properly account for the above events, the reissuance of the check will be processed from
Fund 100, Type 01, BSA 0201. In addition, the Department of Finance will need to prepare
a journal entry to reverse the revenue that was moved to the General Fund. (C-06-15-313-
